Nathan R. Freeman, Director of Development Services
SUBJECT:

Award Professional Services Agreement with LDM & Associates, Inc.

RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager, or designee, to execute a three (3) year Professional Service Agreement with LDM & Associates, Inc., in an amount not-to-exceed $350,000, to provide Community Development Block Grant (CDBG), Housing, and Labor Compliance professional services and for the preparation of the City’s 2025-2029 Consolidated Plan, yearly Action Plan, and Analysis of Impediments to Fair Housing to meet the regulatory requirements of the U.S. Department of Housing and Urban Development (HUD).

BACKGROUND
On June 20, 2024, staff issued Request for Proposals (RFP) No. 2023-24-004 for CDBG, Housing, and Labor Compliance Monitoring Professional Services. On the due date of August 20, 2024, three (3) proposals were received from LDM and Associates (Rancho Cucamonga, CA), Wildan Engineering (San Bernardino, CA), and MNS Engineers, Inc. (Riverside, CA).

Shortly thereafter, staff from the Economic Development and Engineering divisions carefully reviewed the proposals received and concluded that the proposal from LDM and Associates (LDM) was the most responsive. More specifically, for the last several years, the City has contracted with LDM to assist in the implementation of CDBG-funded programs and to ensure compliance with Federal regulations and guidelines.

ISSUES/ANALYSIS
The current Professional Services Agreement (PSA) for professional CDBG administration and housing services is about to expire. The Economic Development division is responsible for the preparation of the City’s five-year 2025-2029 Consolidated Plan, yearly Action Plan, and an update Analysis of Impediments to Fair Housing. The City has historically used professional services in administering its CDBG-funded programs to ensure compliance with federal regulations and timeliness. The award of the PSA is necessary to continue professional CDBG administration/implementation, housing, and labor compliance monitoring.

With this in mind, staff is requesting that the City Council authorize the City Manager, or designee, to execute a PSA with LDM because: 1) they have a long-term relationship with HUD which has and will continue to benefit the City’s stance with HUD to maintain its annual CDBG allocation; 2) LDM has successfully performed the above tasks and at this point in time, contracting with a new firm would cost the City additional time and money to bring them up to speed; and 3) HUD operates on a 5-year program cycle.

CITY GOAL SUPPORTED BY THIS ITEM
Future Development: Facilitate balanced growth to ensure cohesive community development and pursue economic development.

FISCAL IMPACT
Funding for this contract was approved in the 2024-25 budget under contract services in the CDBG and Housing accounts.
