SUBJECT:
2024 Edward Byrne Justice Assistance Grant (JAG)

RECOMMENDED ACTION
It is recommended that the City Council adopt Resolution No. 2024-64, accepting the allocation of $36,200 from the U.S. Department of Justice, for the purpose of partially funding operational overtime.

BACKGROUND
The Edward Byrne Justice Assistance Grant Program (JAG) is the leading source of federal justice funding to state and local jurisdictions. The JAG Program provides states, tribes, and local governments with critical funding necessary to support a range of program areas including law enforcement and crime prevention.

Historically, JAG allocations for all entities in the San Bernardino County area have been joined in what Department of Justice/Office of Justice Programs (DOJ/OJP) calls a “disparate” grouping. DOJ/OJP determines the allocation amounts and groupings of local recipients by formulas, which are primarily based on population and violent crime. When a joint allocation determination was made, the localities in the disparate group would agree on which locality would serve as the fiscal agent and a Memorandum of Understanding that identifies which jurisdiction serves as the applicant or fiscal agent for the disparate group must be completed and signed by the authorized representative for each participating jurisdiction. The fiscal agent is considered the pass-through entity and the relationship with the other disparate members is considered a subaward/subrecipient for grant administrative purposes. The fiscal agent is the legal applicant responsible for submitting the application, reporting, and monitoring subawards, and retaining all paperwork and applicable certifications.

There was a significant organizational change affecting the County and participating jurisdictions with the JAG 2024 grant. DOJ/OJP has determined that only San Bernardino County and the City of San Bernardino will be joined as a disparate group, and the other 17 local municipalities will be independent, making the City of Hesperia its own fiscal agent for the JAG 2024 grant.
