HHA RESOLUTION NO. 2025-01
A JOINT RESOLUTION OF THE HESPERIA HOUSING AUTHORITY AND CITY COUNCIL OF THE CITY OF HESPERIA, CALIFORNIA, DECLARING ASSESSOR PARCEL NO. 0407-232-07 AS EXEMPT SURPLUS LAND OF THE HESPERIA HOUSING AUTHORITY AND AUTHORIZING THE TRANSFER, AT NO COST, TO THE CITY OF HESPERIA FOR FUTURE GOVERNMENT USE AND PURPOSE, PURSUANT TO THE SURPLUS LAND ACT, AND THE CITY’S ACCEPTANCE OF SUCH EXEMPT SURPLUS LAND WHEREAS, the Hesperia Housing Authority (“Authority”) and the City of Hesperia (“City”) both own, administer and manage various properties throughout the City for public agency purposes, in accordance with state law and local policies; and WHEREAS, Assessor Parcel No. 0407-232-07 (“Property”) is located on the easterly side of 9th Avenue between Smoketree and Live Oak Streets and is owned by the Authority; and WHEREAS, the Property is no longer necessary for the Authority’s uses or purposes and is better suited to serve as a future government-use asset by the City; and WHEREAS, the Surplus Land Act (California Government Code Section 54220 et seq.) governs the disposition of surplus land by local authorities, including the Authority and the City; and WHEREAS, pursuant to California Government Code Section 54221(f)(1)(C), the Property qualifies as “exempt surplus land”, as it is being transferred between government agencies for government uses and purposes and will not be sold for private development; and WHEREAS, the transfer of the Property from the Authority to the City will allow the City to repurpose the land for future government uses (to be determined through separate review and approval by the City Council) and ensures compliance with state law and aligns with the City’s goals of efficient property management; and WHEREAS, the Authority Board and the City Council have determined that transferring the Property to the City, at no cost and for the City’s future government uses and purposes, is consistent with the Surplus Land Act; and WHEREAS, the City Council desires to accept the Property for its own governmental use and purposes, and not for commercial or industrial uses or activities, including nongovernmental retail, entertainment, or office development.
WHEREAS, the declaration and transfer of the Property is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines §15061(b)(3), as it can be seen with certainty that there is no possibility the activity will have a significant impact on the environment.
