SUBJECT:
Declaration of Assessor Parcel No. 0407-232-07 as Exempt Surplus Property and Approval of Transfer from the Hesperia Housing Authority to the City and placement in the General Fund for Governmental Purposes
RECOMMENDED ACTION
It is recommended that the Housing Authority Board and the City Council jointly: (1) adopt a resolution declaring property with Assessor Parcel No. (APN) 0407-232-07 as exempt surplus land for future agency use and governmental purposes pursuant to the Surplus Land Act (California Government Code §54206 et seq); (2) approve the transfer of the property with APN 0407-232-07 from the Housing Authority to the City; (3) accept the property with APN 0407-232-07 and place the property in the City’s General Fund at no cost to the General Fund; and (4) authorize the Executive Director and City Manager and/or designee(s) to execute all necessary documents to effectuate the transfer.
BACKGROUND
Assessor Parcel No. 0407-232-07 (the “Property”) is located on the easterly side of 9th Avenue between Smoketree and Live Oak Streets. The Property is approximately 3.3 acres and is zoned High Density Residential (HDR) and was originally acquired by the Housing Authority to support housing development and related purposes. However, the Property is no longer needed for housing purposes, as other properties located elsewhere in the city will be served as additional sites for housing purposes, including high density residential development. The Property is not listed on the Long Range Property Management Plan and is not listed on the site inventory for housing purposes. Rather, the Property, being adjacent to or within the vicinity of other City facilities, is better suited to serve as a future governmental-use asset to further the City’s current and future operational needs.
The Surplus Land Act requires public agencies, such as the Hesperia Housing Authority, to declare property as surplus or exempt surplus before disposing of it. Government Code Section 54221(f)(1)(C) defines properties used or planned to be used for public agency use or governmental purposes as exempt surplus land. This designation ensures compliance with state law and aligns with the City’s goals of efficient property management.
After careful review, staff has determined the Property is more suitable for government use (to be determined through separate review/approval of the City Council) than for housing development, and declaring the Property as exempt surplus will streamline its transfer and ensure compliance with the Surplus Land Act.
Lastly, the declaration and transfer of the Property is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines §15061(b)(3), as it can be seen with certainty that there is no possibility the activity will have a significant impact on the environment.
CITY GOAL SUPPORTED BY THIS ITEM
Future Development- Facilitate balanced growth to ensure cohesive community development and pursue economic development.
FISCAL IMPACT
The transfer of the Property will have no direct fiscal impact on the General Fund, as the Property will be transferred at no cost. Future costs associated with the use or development of the Property will be evaluated and included in the applicable departmental budgets.
