City of Hesperia

STAFF REPORT

DATE: March 18, 2025
TO: Mayor and Council Members
Chair and Board Members, Hesperia Water District

FROM: Rachel Molina, City Manager
BY: Cassandra Sanchez, Director of Public Works/City Engineer Deanna Lestina, Project Manager

SUBJECT: Award Professional Service Agreements for On-Call Traffic Engineering and Land Surveying Services

RECOMMENDED ACTION

It is recommended that the City Council and Board of Directors of the Hesperia Water District approve the award of a Professional Services Agreement (PSA) to eight professional consultants to provide On-Call Traffic Engineering and Land Surveying Services for an initial term of three (3) years and each contract in an amount not to exceed $ 250,000 for Traffic Engineer ing Services and $100,000 for Land Surveying Services for each consultant as follows:

Traffic Engineer
Fehr & Peers $250,000
Linscott, Law & Greenspan, Engineers (LLG) $250,000
Transtech Engineers, Inc. $250,000
Michael Baker International $250,000

Land Surveyor
CASC Engineering and Consulting, Inc. $100,000
IMEG $100,000
Onward Engineering $100,000
WestLAND Group, Inc. $100,000

BACKGROUND

The Public Works Engineering Division (Engineering) provides various engineering and project services in support of development projects, capital improvement projects , and Public Works maintenance activities citywide. Often, these services require the expertise and a specialty license of a Traffic Engineer and/or licensed Land Surveyor. As services are required, Consultants on the pre-approved on-call list may be utilized by the City. In using the pre-approved consultants, the City will reduce contract administration time and costs to procure professional services for traffic engineering and land surveying services allowing Engineering to continue to provide in-house and public services as the need arises.

Soliciting for professional contract services for each task or project is a lengthy process of roughly three to four months. In certain circumstances, services are needed promptly, and cannot wait for the solicitation of these professional services to be completed. In using pre-approved consultants from the on -call list, staff will be able to procure services timelier , thereby providing continued service to developers, Public Works, other City Departments, and/or capital projects.

ISSUES/ANALYSIS

On January 22, 2025, Engineering released a Request for Proposal (RFP) ENG-2025-01 to solicit proposals for on-call traffic engineering and land surveying services. A total of twelve proposals for traffic engineering services and fifteen proposals for land surveying services were received in response to the RFP. Each proposal was reviewed by a selection committee and evaluated based on the understanding of the RF P, approach to the scope of work, and experience and qualifications. Proposals were received from the following consultants:

require the City or District to utilize the entire contract amount; actual expenditures will be based on services provided as they occur.

Consultants were informed that approval of the recommended action does not guarantee the issuance of contracts and/or task orders. On -call contracts allow Staff the flexibility to mobilize professional services quickly and efficiently under pre-negotiated terms and conditions. On-call professional service contracts are standard practice in areas like engineering, construction, and consulting and can be found in local, regional, and state government agencies such as San Bernardino County and the California Department of Transportation.

CITY GOAL SUPPORTED BY THIS ITEM

Public Safety - Ensure public safety resources adequately protect our community.

Future Development - Facilitate balanced growth to ensure cohesive community development and pursue economic development.

Capital Improvement - Continually evaluate capital improvement priorities.

FISCAL IMPACT

Costs associated with the recomme nded contracts, which shall not exceed $ 250,000 for traffic engineering services and $100,000 for land surveying services per contract over the three -year contract term, will be funded through available revenue sources, operating budgets, and/or capital budgets. As these are on -call traffic engi neering and land surveying professional service contracts, the speci fic tasks or projects have not yet been determined or assigned. Adequate appropriation for the costs of the services is included in the City’s Adopted Budget and will be included in future recommended budgets through the end of each contract term.

ALTERNATIVE(S)

1. Do not award the PSAs and direct staff to utilize the RFP process to solicit survey and traffic professional services for each individual activity or project. Individual solicitations will require additional cost and time for solicitation and contract administration as well as a delay of services to internal City departments and the public.

2. Provide alternative direction.

SUBJECT: Acceptance of FY 2021-22 CDBG Street Improvements

RECOMMENDED ACTION

It is recommended that the City Council accept the completed FY 20 21-22 CDBG Street Improvements project (C.O. No. 7166) and authorize staff to record a “Notice of Completion” and release all withheld retention amounts after 30 calendar days from the date of recordation.

BACKGROUND

The Fiscal Year (FY) 2021 -22 CDBG Street Improvements (Construction Order No. 7166) (the “Project”) was identified in the City’s Capital Improvement Program (CIP). On May 16, 2023, the City Council awarded the construction contract to VSS International, I NC. in the amount of $2,966,340; and approved an additional 10% contingency in the amount of $296,634, for a total construction budget of $3,262,974.

Community Development Block Grant (CDBG) funding from the U.S. Department of Housing and Urban Development (HUD) was utilized to fund the Project. In recent years, more CDBG funding has been directed to street improvement projects to meet the City Council’s goal of street preservation and improvement. CDBG funds have strict limitations of its use. Streets are selected based on meeting specific criteria in accordance with HUD and CDBG guidelines.

ISSUES/ANALYSIS

All construction work was complete in February 2025 with total expenditures of $ 3,153,211. Upon acceptance of the Project, a Notice of Completion will be recorded, and the 5% retention held by the City will be released after 30 days from the date of recordation. Upon City Council acceptance, the project will be under a one-year warranty.

CITY GOAL SUPPORTED BY THIS ITEM

FROM: Rachel Molina, City Manager

BY: Pam Lee, City Attorney
SUBJECT: Rescinding Approval of City Council Resolution No. 2020-69, Which Established A Special A-04 Storm Drainage Impact Fee in the A-04 Drainage Corridor

RECOMMENDED ACTION

It is recommended that the City Council review the report and adopt Resolution No. 2025-06 to rescind Resolution No. 2020-69, which established a Special A-04 Storm Drainage Impact Fee in the A-04 Drainage Corridor.

BACKGROUND

The A-04 drainage course is natural regional drainage channel on the Master Plan of Drainage along the western portion of the City, just east of Interstate 15, mostly between Main Street and Eucalyptus Street. This channel conveys large quantities of stormwater through the City. Because of its significance, Main Street near Pyrite is often inundated with flood waters during storm events. On December 1, 2020, in its desire to protect life and property in the A-04 drainage corridor from future storm events and encourage responsible development in that area , the City Council passed Resolution No. 2020-69, adopting a special A-04 Storm Drainage Impact Fee (“A-04 Fee”) to fund storm drainage infrastructure in the area. Developers with residential and commercial projects being developed on properties located within the A-04 drainage corridor and benefitting from the City’s construction of the A-04 storm drainage infrastructure were intended to be responsible to pay for said benefits.

On April 28, 2022, Apex HM, LLC, Desert-Candle, LP, LCTH Investment, LP, and California Arroyo Fund, Inc. (the “Developers”) filed a Petition for Peremptory Writ of Mandate and Complaint in San Bernardino County Superior Court against the City (Case No. CIVSB2208845), challenging the validity and implementation of the A-04 Fee under Resolution No. 2020-69. On December 17, 2024, following a bench trial, the Court issued a peremptory writ of mandate declaring that the A-04 Fee was not adequately supported by the nexus study (which was prepared by a third-party consultant), enjoining the City from collecting any further A-04 Fees, and requiring the City to rescind Resolution No. 2020-69.

ISSUES/ANALYSIS

In light of the Court’s December 17, 2024 Peremptory Writ, the City will no longer collect any future A-04 Fees established by Resolution No. 2020-69. All previous A-04 Fees that were paid to the City, and which were not paid under protest, do not need to be returned. The City can keep such funds for any other A-04 draining infrastructure use.

Furthermore, any developer that constructs any residential or commercial project within the A-04 drainage corridor will now have to construct their own storm drain improvements at their cost and

expense to ensure that any adverse impacts from flooding or storm flows are minimized for their own project and properties downstream. Accordingly, s taff recommends the rescission of Resolution No. 2020-69 in compliance with the Court’s ruling.

CITY GOAL SUPPORTED

Financial Health – Maintain a balanced budget and adequate reserves.

FISCAL IMPACT

No impact to the General Fund, as the A-04 Fee is a development impact fee to be collected and used for a specific purpose. No additional revenues from the A-04 Fee also means that there will be little to no specific expenditures on future A-04 storm drainage infrastructure for the time being.

Such infrastructure will be borne by the developers constructing in the A-04 drainage corridor.

Dayco Funding Corporation, et al. Settlement Agreement

RECOMMENDED ACTION
It is recommended that the City Council approve the attached settlement agreement in the pending litigation matter Dayco Funding Corporation, et al. v. City of Hesperia (SBSC Case No.

CIVSB2307020) regarding the development of approximately 40 acres of vacant land along the south side of Mojave Street between Topaz Avenue and Datura Road in the City of Hesperia, CA 92345, identified as Assessor's Parcel Numbers 0 405-261-15,16,17,18, 27, 28, 29 & 30 - 0000 (the "Property").

BACKGROUND
Subdividers Dayco Funding Corporation and NV Hesperia Investors, LLC own the land for which Tentative Map 17916 (TM-17916) was proposed. TM-17916 is a 177 lot subdivision of 40 acres located at the southwestern corner of Mojave Street and Topaz Avenue. On July 9, 2009 the City’s Planning Commission conditionally approved TM-17916. Various legislatively adopted automatic extensions extended the life of TM-17916 to August 21, 2022.

Prior to the final expiration date of the TM-17916, August 21, 2022, the Subdividers had submitted various documents comprising the Final Map package that Subdividers contend demonstrated the Final Map was in substantial conformance with TM -17916. However, City staff disagreed and contended the Final Map package was incomplete in several material respects.

On August 19, 2022, two days before the expiration of the map on August 21, 2022, Petitioners filed an application for an extension of TM-17916. This had the effect of granting an extension of TM- 17916 for 60 days of the date the application for the extension or until the date the extension application is approved, conditionally approved, or denied. (Gov. Code § 66452.6(e)). On September 6, 2022 the Petitioners provided the City with a fully executed Subdivision Improvement Agreement and some of the necessary cash deposits required. However, they failed to provide the City with the required improvement security, stating it would be provided on September 20, 2022. On September 7, 2022 the City’s Development Review Committee considered and denied the application to extend the life of TM-17916. Pursuant to Hesperia Municipal Code section 17.08.050(e), if the Final Map is not officially filed within the life of a tentative map, all proceedings regarding the map are terminated and the applicant must file a new tentative map.

After the DRC denied the extension of TM -17916 the Petitioners appealed the decision to the Planning Commission that considered and denied the appeal on November 10, 2022. The Planning Commission’s denial was appealed to the City Council, which denied the appeal on December 20, 2022.

Staff Report to the City Council
March 18, 2025

Thereafter, on March 17, 2023 the Subdividers initiated litigation regarding the City’s denial of TM- 17916. After several months of settlement discussions, the City and the Subdividers have come to an agreement regarding TM -17916 and a settlement of the p ending litigation. The proposed Settlement Agreement, attached hereto as Attachment 1, provides that the developer will be permitted to submit all required documents pertaining to the Phase 1 Final Map for TM-17916 as soon as reasonably possible for review, approval, and recordation, which is anticipated to occur within the next six (6) months.

Upon the recordation of the Phase 1 final map, TM -17916 will be extended for a period not to exceed 48 months from the date of recordation, pursuant to Government Code section 664552.6(a). The Subdivider will also be afforded the opportunity to complete and submit an application for Phase 2 Final Map for TM -17916, in accordance with the conditions set forth in TM-17916, the City’s Municipal Code, the subdivision Map Act, and any other applicable law in effect as of. Furthermore, any construction of infrastructure improvements for the Project, including but not limited to the A -04 drainage improvements, will be credited against any development impact fees owed by the developer to the City.

Within thirty (30) days after the City provides written confirmation that the Phase 1 Final map of TM-17916 has been recorded, and TM -157916 has been extended in accordance with the settlement agreement, the developer will file a Re quest for/Notice of Dismissal of the pending litigation. Each party shall bear its own costs and fees incurred in this litigation.

ENVIRONMENTAL REVIEW

The Project already completed an environmental review and a Mitigated Negative Declaration was prepared and adopted as part of the original Project. No proposed changes to the original Project are contemplated, so the approved Mitigated Negative Declaration is still applicable.

In consideration for Developer's obligation under this Agreement to construct the Public Improvements (if not constructed by others), a credit shall be applied by the City to offset some of all of the Fee Obligations (the "Fee Credits"). At the time of this Agreement, the estimated cost to construct the Public Improvements is __________ Dollars ($ ) for the Public Improvements, as set forth in Exhibit D. (the "Estimated Credit Amounts"). The actual amount of such credit and, if applicable, reimbursement amount for each impact fee shall be calculated as provided in Sections 5.2 and 5.3.

ess the Estimated Credit Amounts, leaving a balance in the amount of _______ Dollars ($ __ ) that may be reimbursed to Developer as provided in Sections 5.2 and 5.3 ("Estimated Reimbursement Amounts").

5.2 Reconciliation; Final Offset against the Fee Obligations. Upon completion of the Public Improvements by Developer, Developer shall submit to the Public Works Director such information as the Public Works Director may require to calculate and verify the total eligible and actual costs incurred by Developer to construct the Public Improvements (the "Verified Construction Costs").

The Actual Fee Credits and, if applicable, Actual Reimbursement Amounts owed to Developer for construction of the Public Improvements shall be equal to the Verified Construction Costs, subject to the limits contained in Section 5.3, and shall be used for the purposes of the final reconciliation.

If the Verified Construction Costs are less than the Fee Credits, then Developer shall pay the remaining balance to the City to fully satisfy Developer's Fee Obligations within thirty (30) days. If the Verified Construction Costs exceed the Fee Credits, then the City shall reimburse the Developer in accordance with the provisions of Section 5.3.

5.3 Fee Credit Limits. Notwithstanding anything to the contrary in this Section 5, the following limits apply with respect to credit and reimbursement ofDIF:

Such amounts may include the reasonable soft costs of the City related to the improvements, such as indirect costs of construction, professional engineering and design services, construction management, soils testing, administrative costs, permits, plan check fees, and inspections. For soft costs to be reimbursable to Developer pursuant to this Agreement, City must be able to verify that such soft costs are specifically attributable to the specified Public Improvements for which reimbursement is being made, by reference to separate subcontract~ or by another means approved by the City. The total amount of the soft costs shall not exceed fifteen ercent (15%) of the amount eligible for reimbursement. The Public Works Director may, in his/her reasonable discretion, reduce or disallow reimbursement for any costs he/she finds excessive or unreasonable.

5.3.4 Availability of Unencumbered Impact Fees. In the event that the City has a reimbursement obligation under this Section 5 and at the time such reimbursement is due, there is insufficient funds in the City's account for the relevant Impact Fees, then the City may elect, exercisable by written notice delivered to Developer (a "Deferral Notice"), to defer the payment of such amounts until the time the funds become available in the City'S account for the relevant Impact Fees, which Deferral Notice shall set forth the amount of such Deferral (the "Deferral Amount"), the applicable Section of this Agreement to which such reimbursement obligation relates, and shall set forth the City's 4

to reimburse Developer for the Deferral Amount. Such Deferral Amount shall not accrue interest. Upon written request from Developer from time to time, the City shall execute a statement prepared by Developer acknowledging the then outstanding Deferral Amount as of the date of such request (a "Deferral Amount Statement"). Developer shall have no right to receive the Deferral Amount unless and until all of the following are met: (i) the Public Improvements are completed and accepted in accordance with the requirements of Section 5.4 of this Agreement, (ii) the City has sufficient funds in the City's relevant Impact Fee account to pay the Deferral Amount, and (iii) the City Council appropriates said funds to pay the Deferral Amount in accordance with the priority schedule for City Council approved projects. 8. Acceptance of Improvements; As-Built or Record Drawings. If the Public Improvements are completed by Developer in accordance with the Plans and Specifications, the City shall be authorized to accept the Public Improvements. Notwithstanding the foregoing, City may not accept any Public Improvements (or the applicable portion thereof) unless and until Developer provides two (2) sets of "as-built" or record drawings or plans to the City for all such Public Improvements (or the applicable portion thereof). The drawings shall be certified and shall reflect the condition of the Public Improvements as constructed, with all changes incorporated therein.

9. Warranty and Guaranty. Developer hereby wan-ants and guarantees all the Public Improvements against any defective work or labor done, or defective materials furnished in the performance of this Agreement, including the maintenance of the Public Improvements, for a period of one (1) year following completion of the work and acceptance by City ("Warranty"). During the Warranty, Developer shall repair/, replace, or reconstruct any defective or otherwise materially " unsatisfactory portion of the Improvements, in accordance with the Plans and Specifications. All repairs, replacements, or reconstruction during the Warranty shall be at the sole cost and expense of Developer.

Nothing herein shall relieve Developer from anY other liability it may have under federal, state, or local law to repair, replace, or reconstruct any Public Improvement following expiration of the Warranty or any extension thereof.

Developer's warranty obligation under this section shall survive the expiration or termination of this Agreement.

If Developer fails to construct and install all or any part of the Public Improvements, or if Developer fails to comply with any other obligation contained herein, Developer and its surety shall be jointly and severally liable to City for all administrative expenses, fees, and costs, including reasonable attorneys' fees and costs, incurred in obtaining compliance with this Agreement or in processing any legal action or for any other remedies permitted by law.

If the default or violation constitutes an immediate threat to the public health, safety, or welfare, City may provide the Notice of Default verbally, and Developer shall substantially commence the required work within twenty-four (24) hours thereof. Immediately upon City's issuance of the Notice of Default, Developer and its surety shall be liable to City for all costs of construction and installation of the Public Improvements and all other administrative costs or expenses, as provided for in Section 10 of this Agreement.
