SUBJECT:

Acceptance of Irrevocable Offer of Dedication of Drainage Easement on Recorded Tract Map No.13751

RECOMMENDED ACTION
It is recommended that the City Council and Board of Directors of the Hesperia Water District adopt Resolution No. 2026-41 accepting the Irrevocable Offer of Dedication for the Drainage Easement delineated on Tract Map No. 13751 as City of Hesperia Drainage Easement or (C.H.D.E.), recorded with the San Bernardino County Recorder on March 7, 1989, in Book 219, pages 1-3, as Document No. 89-081811. (Applicant: City of Hesperia)

BACKGROUND
In February 1989, the City Council approved Final Tract Map No. 13751, creating 63 single-family residential lots on approximately 46 gross acres zoned Single-Family Residential (R-1). The project is located east of Eleventh Avenue, west of Ninth Avenue, and north of Smoke Tree Street. The final tract map was recorded on March 7, 1989.

The Owner's Statement on the recorded final tract map includes an Irrevocable Offer of Dedication for a 120-foot-wide Drainage Easement to the City of Hesperia. However, the city did not formally accept dedication at the time the map was recorded.

ISSUES/ANALYSIS
While the dedicated easement has been used by the City as a flood control measure since 1989, it was found that the dedication was never formally accepted due to an error in the Acceptance Certificate on the map. The intended easement will continue to be used by the city for both above ground and underground flow mitigation as two 10-foot diameter pipes are within this easement that help to convey flows within the H-01 watershed.

Adoption of Resolution No. 2026-41 will formally accept the Irrevocable Offer of Dedication for the Drainage Easement.
