may grant the Minor Accommodation if the Council finds that it will not have a material adverse impact on the public welfare or adjacent property; staff has determined the findings can be made because the proposed improvements will not encroach any further into the required setback than the existing home and the proposed improvements within the setback will not be out of character with other homes on Wingfield Road. There are similar side Council Member Weber commented that there's only two small areas that will be encroaching into the setback and it's actually less than the existing encroachment, for which City Engineer Lovett confirmed in the affirmative.

At this point, Council Member Gold opened the public hearing. As there were no comments or objections, Council Member Gold then closed the hearing.

NEW BUSINESS
A. Consideration of an Agreement with Studio-MA to Provide an Alternate Design and Renderings for the Round Meadow/Mureau Roads Intersection Landscape City Manager Kallman presented the following report:
in the summer of 2020, the City initiated a project to renovate the long overdue landscaping area at the Round Meadow/Mureau Road intersection; a series of proposals and conceptual designs from two primary landscaping firms for the project were reviewed by the City Council and a majority of the City Council selected the design concept submitted by L. Newman Design group; in May 2022, the City Council discussed design concepts of both the Long Valley and Round Meadow projects and the City Council directed staff to solicit an alternative design for both the Long Valley and Round Meadow projects and enter into an agreement with Studio MA to assist with the alternatives; once the new design for the Long Valley project was approved, staff requested a proposal from Studio-MA to develop an alternative design for the landscape renovations at the Round Mcadow and Mureau Road intersection; staff believes that as Studio-MA provided the major conceptual changes to the new Long Valley design, working directly with the team at Studio-MA would be the most time and cost-efficient direction to complete this long overdue project; the total cost for the design and renderings is $11,600, provided by restricted funds.

Upon MOTION of Council Member Siegel, seconded by Council Weber and unanimously carried on roll call vote, it was resolved to approve the alternate design and renderings for the Round Meadow/Mureau Roads Intersection Landscape Improvement Project in the amount of $11,600.

in the amount of $21,750 for changes to the scope of work; in addition, the City Council authorized statt an additional contract contingency of $11,962 for discretionary use on future unforeseen design costs; since the September 2020 City Council meeting, the scope of work has again changed and Willdan Engineering is requesting additional extras, which include the deletion of the traffic turn around and gate relocation, and deletion of the parking relocation on the Meyerstein/Compass Realty property, and others; the requested extras ($66,850) exceed the contract and contingency budget that the Council has authorized staff, and as such, staff requests a project budget adjustment from the City Council; staff also requests a $10,000 contingency for unforeseen costs.

Council Member Weber suggested a $20,000 contingency should be added for the unforeseen costs.

The rest of the Council agreed.

Upon MOTION of Council Member Weber, seconded by Council Member Siegel and unanimously carried on roll call vote, it was resolved to approve an amendment to an agreement with Willdan Engineering for extra tasks for the civil engineering design services for the Long Valley Road/Valley Circle Boulevard/US-101 On-Ramp Improvements Project (Measure R) in the amount of $66,850 with a $20,000 contingency for unforeseen costs.
