MEMORANDUM
To: Honorable Mayor and Members of the City Council
From: Roxanne Diaz, City Attorney
Date: August 22, 2022
Subject: Determination of the City Council that as a result of the COVID-19 State of Emergency that Meeting in Person would Present Imminent Risks to the Health or Safety of Attendees Pursuant to Government Code Section 54953(e) Background
This item is being presented in order to allow the City Council the flexibility to meet virtually pursuant to Assembly Bill (“AB”) 361’s special Brown Act requirements for teleconference meetings. These special requirements give local public agencies greater flexibility to conduct teleconference meetings when there is a declared state of emergency and the legislative body determines an in-person meeting would present imminent risks to the health and safety of attendees.
By way of background, on March 4, 2020, Governor Newsom proclaimed a state of emergency to exist in California due to the spread of COVID-19. The Governor subsequently issued numerous executive orders suspending or modifying state laws to facilitate the response to the emergency.
Among other things, these executive orders superseded certain Brown Act requirements and established special rules to give local public agencies greater flexibility to conduct teleconference meetings, including authorizing council members and board members to participate in meetings from remote locations without compliance with certain noticing requirements. (Executive Order N-29-20.) Suspended teleconferencing rules included the Brown Act’s requirements that: (1) the notice of the meeting and agenda identify the location of the remote location; (2) the remote location is accessible to the public; and (3) the agenda provides an opportunity for the public to directly address the council at each teleconference location. The special rules suspending these Brown Act requirements expired on September 30, 2021. (Executive Order N-08-21, ¶ 42.) On September 16, 2021, in anticipation of the then-imminent expiration of his special rules for teleconference meetings, the Governor signed AB 361. In key part, this bill amends the Brown Act to establish special requirements for teleconference meetings. AB 361 continues to permit remote meetings during a proclaimed local emergency, if state or local officials have imposed or

Determination that Meeting in Person Presents Imminent Risks to Health and Safety of Attendees August 22, 2022
recommended measures to promote social distancing or whether as a result of the emergency, meeting in person would present imminent risks to the health and safety of attendees.
In order to meet under these special teleconferencing requirements, pursuant to Government Code Section 54953(e)(1)(B), the City Council must hold a meeting for the purpose of determining whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
Discussion
The City Council has met remotely throughout the pandemic to protect the health and safety of the public and staff and has complied with the requirements of AB 361. However, at the Special City Council meeting of August 9, 2022, the City Council was unable to make the required findings to continue to meet remotely pursuant to AB 361 as the vote was tied 2-2 which resulted in no action.
Accordingly, the purpose of this report is to institute the process under AB 361 to once again hold public meetings in a remote format and be subject to the AB 361 special Brown Act requirements for teleconference meetings. In doing so, the City is not precluded from holding a City Council meeting both in person and virtually on zoom or in a hybrid format. Making the determination that as a result of the COVID-19 emergency, meeting in person would present imminent risks to the health or safety of attendees, does not prevent one or all members of the Council from holding a meeting in-person in City Hall. Making this determination will allow flexibility to each member of the legislative body to determine for themselves based on their own health matters whether attending a meeting will be risk to their health and safety or that of the other attendees, including staff.
The declared COVID-19 emergency is still in effect. Furthermore, given the recent surges in Los Angeles County over the summer and possibly another surge with students back in school, Los Angeles County official continue to recommend measures to promote social distancing. The Los Angeles County Department of Public Health Order Responding Together at Work and in the Community recommends physical distancing. The County Health Department encourages people at risk for severe illness or death from COVID-19 to take protective measures such as social distancing and, for those not yet fully vaccinated, to physically distance from others whose vaccination status is unknown. The County Health Department also continue to recommend that employers take steps to support physical distancing and that people maintain physical distancing to prevent COVID transmission in public settings. Last, the California Division of Occupational Safety and Health still requires that employers provide training on the effectiveness of physical distancing in the workplace.
Fiscal Impact
There is no direct impact to the General Fund as a result of the City Council’s action.
City Council
Determination that Meeting in Person Presents Imminent Risks to Health and Safety of Attendees August 22, 2022
Recommendation
That the City Council adopt a motion making a determination that as a result of the California COVID-19 State of Emergency, that holding City Council meetings and any other City legislative body meetings in person would present imminent risks to the health and safety of the attendees.

Monthly Report
August 2022
Project/Program Current Status
1. Long Valley Entrance
Improvement Project –
Measure R
At its meeting of May 24, 2021, the City Council directed the landscape designer to work with Camille MugrdechianArmen on the parking lot layout and landscaping. The final design components for the Long Valley project are about completed. There are a few aesthetic items that we are still working on in phase 1 (parking lot). Phase 2 is still in plan review with Caltrans and City of LA.
2. Overhead Power Lines
Undergrounding
No Change - Survey has been completed for the utility
undergrounding of Little Hollow Road. SCE has commenced its design work. Survey for Jed Smith Road between
Fitzpatrick and Kit Carson was completed but SCE has
requested additional field data from the surveyor before design work can commence.
3. 24314 Long Valley Road A demolition permit for the old single-family residential buildings was issued on 11/21/18. A grading permit was
issued and grading commenced on 4/8/19. Piles have been installed. A surplus of soil has been temporarily stockpiled on the lower pad near Long Valley Road during grading, pile work, and geotechnical remediation. The lot has
subsequently been sold. Revised grading and building plans were submitted to the City. A new grading permit was issued on 1/7/22 and the new building permit was issued on
2/11/22. Construction commenced in April. Drill rigs are currently on the site drilling for caissons/piles and soil nails to provide additional support to the upper slope.
4. Las Virgenes Municipal
Water District Pump
Station Generator
LVMWD will be installing a generator for the water pump station located next to the Little Bus Stop at the Round Meadow Road/Jed Smith Road Intersection. This generator is to ensure that power is maintained to the pump station currently providing water to City residents and fire hydrants, in case of power outages. This project has received approval from the Hidden Hills Community Association, as this
property is currently being leased to them from the City. At its meeting of July 26, 2021, the City Council agreed to grant an easement to LVMWD for the generator. The easement
document has been signed by the Mayor and recorded. A
construction schedule for the generator has not been

provided however, LVMWD has submitted electrical plans
to the City for review.
5. Mureau Road
Landscaping
The City Council approved a conceptual plan and selected L.
Newman Design Group to design landscaping improvements
at the northeast and northwest corners of the Round
Meadow Road/Mureau Road intersection. Design work is
roughly 50% complete. The HHCA Landscape Committee
requested revisions to the concept. At its meeting of May 24, 2021, the City Council directed the landscape designer to work with the HHCA Landscape Committee and Camille
Mugrdechian-Armen in preparing alternative concepts and profile renderings. Ms. Mugrdechian-Armen is currently
working on the renderings. As portions of this landscaping are not on City property, staff will also be working with the School District and the County of Los Angeles to obtain permits and easements.
6. Reclaimed Water In response to the current drought situation, City staff has been working with Las Virgenes Municipal Water District and the Hidden Hills Community Association (HHCA) in the use of reclaimed water for irrigation within the City. In June the Water District installed a 10,000 gallon reclaimed water tank in the upper City Hall parking lot. This tank and the reclaimed water were provided at no cost to the City from the Water District. Seedland Care has been using this to water HHCA and City arenas, trees and shrubs. LVMWD has subsequently made reclaimed water available to Seedland Care directly from the Hidden Ridge purple pipe system. As such, the tank will no longer be needed and will be removed this week. However, LVMWD will now be charging the City and HHCA for the reclaimed water. The Water District will additionally pursue extending reclaimed water supplies into the City, however this may take several years.
7. Housing Element State Law requires that the City update and certify its Housing Element by February 11, 2022. The first draft of the Housing Element was approved by the City Council at its meeting of November 22, 2021, and subsequently
submitted to the State Department of Housing and
Community Development (HCD) for review. Comments on
the Housing element were received from HCD and
considered by the Council at its meeting of 2/14/22. The City’s Housing Element consultant was directed to address City Engineering Monthly Report
August 19, 2022
the comments and resubmit the draft Housing Element to
the City Council for approval at a future meeting, prior to resubmittal to HCD. The final draft was submitted to the City Council for its consideration at a public hearing on 6/11/22.
The City Council approved the final draft and it was
submitted to HCD for certification on 6/12/22.
8. Accessory Dwelling
Units
City staff has been working with a consultant on a new
Accessory Dwelling Unit Ordinance that will comply with new State of California Laws. This ordinance will be
considered by the City Council during a public hearing at its meeting of 8/22/22.
Note: Any changes to projects that were listed in last month’s report are highlighted.
AGENDA REPORT
CITY OF HIDDEN HILLS
TO: Honorable Mayor and Members of the City Council
FROM: Dirk Lovett, City Engineer
DATE: August 22, 2022
SUBJECT: Public Hearing to Consider Ordinance No. 381 of the City Council of the City of Hidden Hills Updating the City of Hidden Hills Accessory Dwelling Unit Standards and Requirements
BACKGROUND
State law requires all cities to allow Accessory Dwelling Units (ADUs) in residential zones subject to local regulations. The purpose of this law is to encourage the production of additional housing opportunities for persons of low and moderate income, including seniors, persons with disabilities, and household employees. New laws enacted by the State of California in 2020 and 2021 removed several restrictions around the development of ADUs, and contained measures designed to actively promote construction.
City staff has prepared Ordinance No. 381 to update the City of Hidden Hills’ current “Second Unit” standards by establishing regulations governing ADUs and Junior Accessory Dwelling Units (JADUs), in compliance with California Government Code Sections 65852.2 and 65852.22, as well as to provide local standards for the development of ADUs and JADUs as determined by the City of Hidden Hills.
A Public hearing Notice was posted, as required by the Hidden Hills Municipal Code, on August 12, 2022. No comments have been received as of the writing of this report.
ANALYSIS
The City of Hidden Hills currently has standards for “Second Units”. Under the recent State of California Laws, these Second Units are now referred to as ADUs and JADUs. The proposed ordinance therefore intends to replace the current Second Unit standards with ADU and JADU standards consistent with Government Code Sections 65852.2 and 65852.22.

Accessory Dwelling Unit Ordinance No. 381
August 22, 2022
Second Unit Per the City of Hidden Hills Municipal Code; Use to be Replaced by ADU Standards
“Second Unit” shall mean an attached or detached residential dwelling unit which provides complete, independent living facilities for one or more persons including permanent provisions for living, sleeping, eating, cooking and sanitation, and is located on the same site area as the primary dwelling.
Currently, Second Units are allowed in all residential zones subject to the following standards:
The lot has a single family residence.
Only one Second Unit is permitted per property.
Second Units may be attached or detached to the main residence. The maximum size of Second Units shall be 1,200 sf, except those in RAS-2 zones which may be 1,500 sf.
A minimum of one off street parking space shall be provided for each bedroom of the Second Unit. This additional parking space shall be restricted to parking within a garage on the property or in the rear yard setback on a paved surface so as not to be visible from the public on which the primary dwelling fronts.
The property shall be served by a sanitary sewer and the Second Unit shall not have separate utility meters.
The property owner shall occupy either the main residence or the Second Unit, and the Second Unit may not be sold separate from the main residence. The Second Unit shall incorporate similar colors, materials, architectural features as the main residence.
The Second Unit shall comply with building code and development standards applicable to the main residence including but not limited lot coverage, setbacks, floor area ratios, heights, landscaping, etc.
If a separate entrance to the Second Unit is required it shall not be located on the front of the primary residence.
The Second Unit shall have a permanent foundation.
All landscaping shall be installed per Chapter 10 (water efficient landscaping) of the Hidden Hills Municipal Code.
Accessory Dwelling Unit (ADU) and Junior Accessory Unit (JADU) Standards as Proposed in Ordinance No. 381
“ADU” means an attached or detached residential dwelling unit which provides complete independent living facilities for one or more persons and is located on a lot with a proposed or existing primary dwelling. It shall include permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as the primary dwelling is situated. An ADU may take City Council
Accessory Dwelling Unit Ordinance No. 381

the following forms:
"Attached" means the ADU is attached to the primary dwelling. "Detached" means the ADU is separated from the primary dwelling. “JADU” means a unit that is no more than 500 square feet in size and contained entirely within an existing or proposed single-family dwelling.
Proposed Ordinance No. 381 will comply with the State of California’s new laws while protecting as many of the City’s previous Second Unit standards as possible. Currently, any ADU applications received by the City default to the current State standards. Adoption of tonight’s proposed ordinance will allow the City to preserve some of the previous standards, as allowable by State law. Major changes from the current Second Units to ADU’s include:
A maximum of 2 ADU’s shall be allowed on a property, including one junior ADU and one detached ADU.
A JADU of no more than 500 sf shall be allowed withing the walls of a primary residence. Statewide Exemption ADUs of 800 square feet, with a height limitation of 16 feet, and 4 feet side and rear yard setbacks [this generally equates 14’ due to required HHCA equestrian easements] cannot be precluded by development standards like lot coverage requirements.
Detached ADU’s shall be located to the rear of the primary dwelling. Attached ADU’s shall maintain front yard setbacks in compliance with City zoning (50’), except in the case of a Statewide Exemptions ADU, which may be allowed in front yard setbacks.
Two detached ADU’s are allowed on properties containing multiple dwelling structures.* ADU applications shall be approved ministerially, without discretionary review. No setback shall be required for an existing nonconforming living area that is converted to an ADU in the same location and dimensions as the existing nonconforming habitable structure.
Except when Statewide Exemptions limit the height of ADUs to 16 feet, ADU’s shall not exceed a height of 18 feet.
An attached ADU shall not be permitted as a second story of a single-family dwelling or above a detached accessory building such as a guest house or garage. A minimum of one off-street parking space must be provided for the ADU, in addition to the parking required for the primary dwelling. This additional parking space may be provided in a garage or carport, through tandem parking on an existing driveway, or in the rear yard setback on a paved surface so as not to be visible from the public on which the primary residential dwelling fronts.
No additional parking is required for an Accessory Dwelling Unit that satisfies any of the following:
i. The Accessory Dwelling Unit is located within one-half mile walking distance of public transit.
City Council
Accessory Dwelling Unit Ordinance No. 381
August 22, 2022
ii. The Accessory Dwelling Unit is located within an architecturally and historically significant historic district.
iii. The Accessory Dwelling Unit is part of the proposed or existing primary residence dwelling or an accessory structure.
iv. When on-street parking permits are required but not offered to the occupant of the Accessory Dwelling Unit.
v. When there is a car share vehicle located within one block of the Accessory Dwelling Unit.*
No additional parking is required for a JADU.
The ADU shall be located on a lot that is served by a public sanitary sewer system, and separate utility meters shall be required to serve the ADU if the ADU is constructed at the same time as a new primary residential dwelling.
If the ADU is demolished or destroyed, or if the ADU is modified such that it no longer complies with this section, the property owner shall return the lot and all improvements into a condition that complies fully with applicable land use and building standards set forth in this code. The property owner shall apply for any and all permits necessary to complete the scope of work, as required under the City’s building and fire codes. If fire sprinklers are required for the primary residence, they shall be required for the ADU.
If the property contains a JADU, one of the residential dwellings on the lot shall be occupied as the primary dwelling of the owner of the lot and shall not be rented or leased as long as the Junior ADU exists.
The rental of an ADU or JADU shall be for a term of not less than 30 days. *These items have been included to make the City’s ADU ordinance compliant with State law and in anticipation of potential future development outside the gates.
All other building and zonings codes and standards that currently apply to Second Units, and those that apply to the underlying zone (except as specified in the new Article O, provided those requirements do not preclude the construction of Statewide Exemption ADU) shall apply to ADU’s under proposed Ordinance No. 381.
The City’s recently adopted Housing Elements anticipates a total of 22 ADU’s to be built over the next 8 years. It should also be noted that staff asks all potential developers of ADUs to first work with the Homeowners Association on compliance with their current standards.
If the City Council adopts Ordinance No. 381 it must then be forwarded to California Department of housing and Community Development (HCD) within 60 days. If HCD finds the ordinance is not compliant with state law, it will provide the city with 30 days to respond before taking any further action. In that scenario, the city must consider the findings, and either amend its ordinance City Council
Accessory Dwelling Unit Ordinance No. 381
August 22, 2022
to bring it into compliance, or adopt a resolution with findings as to why the ordinance does comply with state law. [Gov. Code § 65852.2(h)(1), (2).]
Servant’s Quarters Per the City of Hidden Hills Municipal Code; Accessory Use to be Removed
The current code allows as an accessory use “Servants' quarters with kitchen facilities within the servant quarters; provided, such kitchen shall either be in the main residence or in an adjacent service quarters building of not in excess of 1,500 square feet and used solely for not in excess of two "domestic servants"….and in no instance for rental purposes, including, as a rental purpose, occupancy granted solely in exchange for nondomestic services to the owners of the main house….” The proposed ordinance would remove this accessory use, as such a use can be filled with ADUs and JADUs that could be permitted under state law and the code amendments addressed above.
COMPLIANCE WITH CEQA
This ordinance is exempt from environmental review under the California Environmental Quality Act, (California Public Resources Code §§ 21000, et seq., (“CEQA”) and the CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) because this zoning ordinance implements the provisions of Government Code Section 65852.2 and is therefore exempt from CEQA pursuant to Public Resources Code Section 21080.17 and California Code of Regulations Section 15282(h).
To the extent that any provisions of this ordinance are not exempt pursuant to Section 15282(h), the amendments are not subject to CEQA pursuant to CEQA Guidelines Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

PUBLIC HEARINGS
A. Consideration of Approval of the 2021-2029 Housing Element, and Adoption of Resolution No. 999 Adopting the 2021-2029 Housing Element of the City of Hidden Hills General Plan and Finding that the Housing Element is Exempt from the California Environmental Quality Act
City Engineer Lovett presented the following report:
cities in the Southern California Association of Governments (“SCAG”) region are required by State law to prepare updates to the Housing Elements of their General Plans for the 2021-2029 planning period; in 2021, City staff and our consultant prepared a draft Housing Element update and on November 15, 2021 the City Council conducted a public meeting to review the draft Housing Element and solicit public comments; a second public hearing was conducted on November 22, 2021 and the City authorized staff to submit the draft Housing Element to the California Department of Housing and Community Development (“HCD”) for review; on January 21, 2022 HCD issued a letter finding that the draft Housing Element addresses many statutory requirements; however, revisions will be necessary to comply with State law; as such the City Council on February 14, 2022, reviewed HCD comments and received public testimony, which at the conclusion of that meeting the City Council directed staff to prepare a revised Housing Element addressing HCD’s comments.
Housing Consultant John Douglas presented a detailed PowerPoint to the City Council, staff and the audience outlining the changes that were made to the housing element.
A member of the audience inquired if the consultant considered any sites that are located within the City’s sphere of influence, but are not located presently within the city.
City Attorney Diaz responded that the City’s Housing Element with respect to Mr. Douglas’ work on the element, is believed to be in compliance with State law in terms of all of the provisions and the requirements in the Housing Element for us to adopt new policies and zoning code amendments, that the City will do so in the future.
Upon MOTION of Council Member Weber, seconded by Council Member Siegel, and carried unanimously on roll call vote, it was resolved to approve Resolution No. 999 entitled: A City Council Minutes
July 11, 2022
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HIDDEN HILLS ADOPTING THE 2013-2021 HOUSING ELEMENT OF THE GENERAL PLAN AND FINDING THAT THE
HOUSING ELEMENT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
B. Consideration of Revising the City of Hidden Hills Speed Hump Policies, Guidelines and Procedures and Approval of the Installation of City Speed Humps on Long Valley Road Between Round Meadow Road and Little Hollow Road (in Front of the Hidden Hills Community Center)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HIDDEN HILLS
APPROVING THE REVISED CITY OF HIDDEN HILLS SPEED HUMP
POLICIES, GUIDELINES AND PROCEDURES
City Engineer Lovett presented the following report:
the City Council adopted a speed hump policy back in 2004, and per that policy, the City Council can install speed humps when it receives petitions from residents, and it meets several requirements; there are currently nine speed bumps in the City, and on June 23, 2021, the City Council did receive two petitions requesting speed humps, and also that the City lower the speed limit to 25 miles per hour; no specific location for those speed bumps was provided but at its meeting on October 25, 2021 and November 8, 2021, the Council discussed these two petitions and other traffic calming concepts around the City and directed staff to contract with a traffic consultant, Jaime Rodriguez of Traffic Patterns; he provided a report to the City covering the speed humps and speed signs along with various other traffic calming measures that was considered by the City Council on April 11; Mr.
Rodriguez included a recommendation to install four (4) new speed humps on Long Valley Road between Round Meadow Road and Hilltop Road, as well he recommended the City Council accept several of his, including the speed bumps, which they did and directed staff to implement them; because the old policy authorized the Council to take action when a petition is submitted and all of the conditions of the policy are met, not all of the policy requirements are complied with, and staff felt it necessary to modify the speed hump policy; with revisions such as, language has been added to the “Procedures” section to provide authority to the City Council to initiate the process for the installation of speed humps. With respect to the “Guidelines,” which governs the criteria under which speed humps may be approved, language has been added to allow the City Council to approve the installation of speed humps if such installation is recommended by the City’s consultant traffic engineer; the speed humps have been approved by the HHCA and will cost approximately $5,000 each.
City Council Minutes
July 11, 2022
Upon MOTION of Council Member Siegel, seconded by Council Member Gold, and carried unanimously on roll call vote, it was resolved to approve Resolution No. 1000 adopting the revised City of Hidden Hills Speed Hump Policy, direct staff to obtain bids to install four speed humps, signs, and striping on Long Valley Road between Round Meadow Road and Hilltop Road, and authorize the City Manager to select and enter into an agreement with a contractor, in an amount not to exceed $45,000, to install the four speed humps, signs, and striping.
CONSENT CALENDAR

C. Reconsideration of the Circumstances of the COVID-19 State of Emergency and Determine that the City will Continue to Hold Meetings Via Teleconferencing Pursuant to the Finding Set Forth in Government Code Section 54953(e)(3) Upon MOTION of Council Member Siegel, seconded by Council Member Gold, and carried unanimously on roll call vote, it was resolved to approve items A, B, and C of the consent calendar as submitted.
NEW BUSINESS
A. Consideration of Approval of an Agreement with Lanspeed for the Server to Cloud Migration Project and Purchase of Three New Workstations for City Staff Administrative Analyst Limón presented the following report:
Lanspeed, has been the City's IT services provider for the last few years, and they have made recommendations to bring us more current and up to date with our hardware and software; the first item is the server to cloud migration; our City-owned data is stored on a server and this data is backed up daily and regularly, but there is concern about the aging hardware and the possibility of the server to fail at any time, and if it were to fail, we would not lose our data, but we would probably be down for a minimum of a few days at City Hall and unable to access data until it was restored by Lanspeed; rather than replacing the existing server, Lanspeed is recommending that the City move to a server less model and migrate its data to the cloud; this option is a more cost effective, more efficient solution; City staff is in need of three new workstations as well.
City Council Minutes
July 11, 2022
Upon MOTION of Council Member Gold, seconded by Council Member Siegel, and carried unanimously on roll call vote, it was resolved to approve the attached proposals from Lanspeed to (1) perform the Server to Cloud Migration Project; (2) to purchase and install two desktop workstations at City Hall; and (3) to purchase a laptop workstation for the Accounting Specialist; and (4) authorize staff to prepare an Agreement with the vendor in an amount not to exceed $12,998.74 and authorize the Mayor and City Clerk to execute the agreement on behalf of the City.
B. Consideration of Approval of an Agreement with StudioMA to Provide a Design and Concept Renderings for the City Hall Landscape Per Capita Project Administrative Analyst Limón presented the following report:
The City of Hidden Hills was awarded a grant to rehabilitate our space in front of City Hall earlier this year from the State’s Per Capita program, and based on the grant guidelines and project criteria, staff submitted a project to enhance the outdoor space surrounding City Hall to increase its recreational and Community benefit for all residents to enjoy; staff reached out to Camille Mugrdechian-Armen with StudioMA who, as you know, is currently working on landscape design projects at Long Valley Road and Round Meadow Road; Ms. Mugrdechian-Armen is familiar with the City standards and the fresh consistent design throughout the Community; staff has asked for a proposal for design services, which would renovation of the existing landscape, new irrigation systems, improve walking paths, handrails, seating areas, picnic tables, shade structures, lighting and signage outside of City Hall; design services are considered a pre-construction cost, which are reimbursed by the grant and the proposal from StudioMA is broken down into two components, for design and concept renderings for a total cost of $19,700; the Per Capita Grant requires a 25% match from the City.
Mayor Pro Tem Freedland and Council Member Siegel seemed concerned that staff only received one bid and thought another bid should have been received. They suggested that staff research the possibility of creating a policy for the future.
City Manager Kallman responded that the Municipal Code allows for an exception on soliciting bids when the purchase best serves the interests of the City due to the history of the materials, supplies, equipment and/or labor to be purchased. In the case of this project, it is recommended City Council Minutes
July 11, 2022
to use StudioMA as they are currently working on both the Long Valley and Round Meadow projects.
Mayor McCorkindale agreed that in most other instances, she too would like to see numerous bids, but in this particular case, for this design portion, she doesn’t believe that the City would use anyone else, nor does she believe it would be in the best interest of the residents. Based on the goal that the Council had with correcting some inconsistencies in design in the neighborhood, she would stand with staff and their decision to just have gotten the bid from this particular company.
Council Member Weber stated that if the City doesn't have a policy, then it should have a policy but he thinks that any policy the City ends up having, should be for projects with a higher cost than these two projects being discussed today as it can be a waste of resources for a miniscule amount, as the City only has to pay for 25% of the project, which the City Manager has the ability to approve such an amount without coming to Council.
After some continued discussion between the City Council and staff, Council Member Weber made the motion, which was seconded by Council Member Gold, and approved on a 3-2 vote to approve a proposal for design services and a concept rendering from StudioMA in the amount of $19,700 and authorize staff to prepare an agreement with the vendor and authorize the Mayor and City Clerk to execute the agreement on behalf of the City.

Subject: Re: Financials - June 2022
Good morning
I have reviewed everything. The journal entries are approved. The financials are fine as a preliminary report. It appears that you have not yet accrued the property tax revenue for the fiscal year yet.
When is the audit?
Stay cool

Hi Mike,
Sorry for the delay. Attached please find our Financials and Journal Entries for the month of June, 2022.
I have entered most of the year-end adjusting entries but I’m still waiting for some more receivables and payables to fully close FY21-22.
I’ll also start working on the fixed assets and send it over to you.
Thanks,

Accrued Interest represents the interest that would be received if the fixed income investment was sold prior to the coupon payment.
Yield to Maturity is the actual average annual return on a note if held to maturity.
Estimated Annual Income ("EAI") and Estimated Yield ("EY") calculations are for informational purposes only and are derived from information provided by outside parties. Schwab cannot guarantee the accuracy of such information. Since the interest and dividends are subject to change at any time, they should not be relied upon exclusively for making investment decisions. The actual income and yield might be lower or higher than the estimated amounts. EY is based upon EAI and the current price of the security and will fluctuate. For certain types of securities, the calculations could include a return of principal or capital gains in which case EAI and EY would be overstated. EY and EAI are not promptly updated to reflect when an issuer has missed a regular payment or announced changes to future payments, in which case EAI and EY will continue to display at a prior rate.

FROM: Chantelle Limón, Administrative Analyst
DATE: August 22, 2022
SUBJECT: Consideration of a Cap on Saturday Night Ticket Sales, Online Ticket Sales, and Ticket Prices for the 2022 Fiesta
Background
This year, the City is celebrating its 61
st anniversary with the annual two-day Hidden Hills Fiesta Celebration, scheduled for October 8
th and 9th, 2022. Following last year’s event, City staff received feedback from attendees and the City Council related to 1) limiting Saturday night dinner and carnival attendance and 2) offering an online ticket sales option. Additionally, this report will also recommend 3) an increase in ticket prices, given a rise in food and labor costs.
Discussion
Saturday Night Attendance
The Saturday night dinner and carnival is a Fiesta weekend favorite and attendance hit a record high in 2021. Over the course of six-hours, it is estimated that, based on ticket sales, at least 2,471 people attended the event at the Spring Valley Arena. Residents and their guests are welcome to attend the event without purchasing a ticket so actual attendance could have been even higher. 2021 Dinner & Carnival Ticket Sales
Ticket Type Units Sold
Adult Dinner & Wristband 1557
Child Dinner & Wristband 409
Wristband Only* 505
TOTAL 2,471
*Wristband allows access to rides and games
In comparison, the total number of tickets sold in 2019 was 1,263. It is possible that attendance doubled in 2021 because Fiesta was canceled in 2020 due to the pandemic. Moreover, social events were fewer in October 2021 as the County was still easing out of over a year of COVID restrictions City Council

and “Safer at Home” orders. Regardless of the motivation to attend, 88% of attendees said they plan to return next year, in a post-2021 Fiesta survey administered by staff.
Over 50% of Fiesta attendees said that the dinner and carnival was their favorite Fiesta event, based on survey results. However, several comments (of 90 total respondents) in the survey were related to the evening being “too crowded” with “too many people” and “too many non-residents.” At the November 8, 2021 City Council meeting, the City Council expressed concern that Fiesta may be getting too large and suggested that the Fiesta Committee discuss the capacity issue.
City staff did discuss capacity with the 2022 Fiesta Committee. The committee agreed that a limit on ticket sales would be appropriate, to keep the event from becoming too large. The committee suggested a cap on ticket sales per household, limiting residents to purchasing 10 tickets per event, through a particular date, and then opening ticket sales until sold out. Beyond establishing an “early bird” limit on tickets per household, staff is recommending a cap at 1,500 total dinner tickets sold and a maximum of 250 additional wristbands sold, for a total count of 1,750.
Online Ticket Sales
At the November 8, 2021 City Council meeting, the City Council expressed an interest in implementing an online ticket sales option for Fiesta tickets. The post-2021 Fiesta survey asked “would you be interested in an online ticket sale option for meal tickets and carnival wristbands” with 75% of respondents selecting “Yes.”
Staff researched two popular event management and ticketing websites, Eventbrite and Ticketleap.
Both platforms offer a similar service in which an organizer can create an event and guests can purchase tickets online via credit card. The service charges ticketing and credit card processing fees which can either be absorbed by the organizer or passed on to the buyer. After considering both services, staff is recommending Eventbrite for this event. The platform is easy to navigate on the back end, user friendly for buyers, and the ticketing and credit card processing fees are comparable to Ticketleap. Additionally, the Hidden Hills Community Association (HHCA) uses Eventbrite to sell tickets for several of their events so the service may already be familiar to Hidden Hills residents.
Regarding the ticketing and credit card processing fees, staff is recommending that these fees be passed along to the buyer as they were not anticipated in the Fiscal Year 2022-23 budget. The fees are based on percentages and amount to an additional two to four dollars per ticket. For example, a $25 adult dinner ticket would amount to approximately $28.16 if purchased via Eventbrite.
However, residents will still have the option to purchase their Fiesta tickets in person at City Hall, with cash or check, to avoid any service fees. If, however, tickets are purchased online, they will still need to be picked up in person at City Hall. Proof of purchase on an electronic device will not gain entry to ticketed events and “print at home” tickets will not be available.

Ticket Prices
Food and labor costs are up, nationwide, and Fiesta is no exception. In 2021, the total cost for Saturday night dinner catering was $32,360.97. The 2022 anticipated catering cost, with a similar menu to last year, is $39,392.90 based on 1500 guests. Additionally, the 2021 and 2022 rides and games vendor, Southland Shows, offers a better selection of attractions, and at a higher cost, than the 2019 vendor. Finally, the preferred Sunday night Wine Exchange/Dinner vendor, Chef Marcus Roberto, expressed that his food costs have increased 25% since last year, raising costs for this dinner ticket, as well.
Based on the information above, staff is recommending the following ticket prices for 2022. A final column indicates the last time the ticket price was adjusted. Ticket prices for the Pancake Breakfast are not included in the chart below as they are determined by the Equestrian Services Committee with the HHCA. Sales from the Pancake Breakfast are passed through to the HHCA.

Fiscal Impact
The Fiscal Year 2022/23 City budget anticipates $48,714 in revenue for Fiesta. Of that, $35,593 is expected to be from Saturday night dinner and carnival sales. If tonight’s recommended ticket prices and cap on ticket sales are approved, the new revenue is expected to be $39,150.
Recommendation
It is recommended that the City Council approve (1) limiting Saturday night dinner and carnival attendance by capping dinner ticket sales at 1,500 and additional wristbands at 250; (2) utilizing the Eventbrite service to offer an online ticket sales option for guests; and (3) increasing ticket prices as outlined in the report.

SUBJECT: Update on City Drought Response and a Consideration of Approval of a General Fund Budget Adjustment in the Amount of $27,000 for FY 2022-23 Related to Additional Recycled Watering Costs
Background
Following the third consecutive year of a severe drought and water shortage in California, the Las Virgenes Municipal Water District (LVMWD) activated Stage 3 of a Water Shortage Emergency and announced additional limitations on water usage for all customers. Effective May 1, 2022, all outdoor potable water budgets were reduced by 50% and a one-day-per-week watering restriction went into effect thirty days later. The Los Angeles Department of Water and Power (LADWP) also imposed watering restrictions on its customers, though less strict than those imposed by LVMWD. The City has water accounts with both LVMWD and LADWP.
Discussion
Following the announcement of impending watering restrictions, City staff took immediate steps to curtail the use of potable water on City property. First, staff located all eight City water meters, six with LVMWD and two with LADWP. All meters were adjusted to irrigate one day per week.
Next, the City inquired about the availability of recycled (or reclaimed) water as an alternative to potable water for City maintained landscape. Recycled water or “purple pipe” is plumbed throughout neighboring cities including Calabasas, Agoura Hills, and Westlake Village, to irrigate public areas. As Hidden Hills is not plumbed with purple pipe, with the exception of a small area on Hidden Ridge Road, LVMWD provided the City with a temporary recycled water storage tank and a worker to fill the tank daily from the existing source on Hidden Ridge Road. Seed Landcare, the City’s contracted landscape maintenance provider, has been hand watering all City maintained landscape, including the Spring Valley Arena, with recycled water since June 1, 2022. A map attached to this report identifies these areas in blue.
City Council
Drought Response
August 22, 2022
On August 18, 2022, the water district removed the storage tank from City Hall and provided Seed Landcare with direct access to the recycled water source on Hidden Ridge Road. This is a more efficient process, now that Seed Landcare is equipped with their own water hauling trucks; the storage tank is no longer needed.
The storage tank and labor to fill the tank had been provided at no cost. However, the City was recently told by the water district that they will start charging for the actual recycled water usage.
Potable Water vs Recycled Water Savings
The transition from potable water use through irrigation systems to hand watering with recycled water made an immediate impact on the amount of water being used. Although recycled water is nearly double the cost of potable water ($8 per unit versus $4 per unit; 748 gallons makes up one unit of water), the City is using approximately 90% less water now. See the chart below of anticipated cost savings by using hand applied recycled water.
Units* Cost*
Potable Water Before June 1, 2022 240.00 $2,275.00
Recycled Water After June 1, 2022 22.40 $430.50
Savings 217.60 $1,844.50
*Approximate
With hand applied recycled watering in place, all City irrigation systems have been turned off.
This has resulted in a total cost savings of $1,844.50 per month.
Comparison in Labor and Water Costs
Seed Landcare recently informed the City that hand watering has resulted in a significant increase in labor costs. City staff had budgeted an additional $300 per month for hand watering and included this in the approved FY 2022-23 City budget. However, the actual labor cost increase is $3,850.00 per month; two workers spend 16-18 hours a week hand watering City property.
The chart below illustrates a comparison in labor and water costs, before and after hand watering with recycled water began on June 1, 2022.
Before June 1, 2022 After June 1, 2022 Budgeted
FY 2022/23 Change Monthly Annual Monthly Annual
Labor $664.00 $7,968.00 $4,514.00 $54,168.00 $11,568.00 $42,600.00 Water $2,275.00 $27,300.00 $430.50 $5,166.00 $21,600.00 -$16,434.00 $2,939.00 $35,268.00 $4,944.50 $59,334.00 $33,168.00 $26,166.00 City Council
Drought Response
August 22, 2022
Frequency of Watering
The three equestrian arenas in the City were previously watered six days per week for dust control.
In August, the Hidden Hills Community Association reduced the watering to three days per week.
As historically the City has paid for the watering of the Spring Valley Arena, this resulted in an additional cost savings.
It should also be noted that water usage is highest in the warm summer months and is expected to be lower in cooler months. Labor costs are estimated to decrease in the winter months when frequency of watering decreases, as determined by the weather and Seed Landcare.
Fiscal Impact
The approved FY 2022/23 City budget anticipated $11,568.00 in landscape labor costs and $21,600.00 in water costs. As outlined above, despite an anticipated savings in water costs, labor costs are anticipated to be $54,168.00. Therefore, a budget adjustment in the amount of $27,000.00 is requested. Staff is researching whether various restricted funds can offset this additional General Fund usage.
Recommendation
It is recommended that the City Council authorize a General Fund budget adjustment of $27,000.00 for City landscape costs, in order to continue to limit the use of potable water during the drought.

MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Kerry Kallman, City Manager
DATE: August 22, 2022
SUBJECT: Discussion and Direction Regarding In-Person and Hybrid (Zoom and In-Person) City Council Meetings
Background
With the onset of the COVID-19 Pandemic in early 2020, the last “in-person” City Council meeting held in Hidden Hills was on March 9, 2020. On March 16, 2020, the City Council held its first virtual meeting via the Zoom platform. All City Council meetings have been held solely in a virtual setting ever since. City Hall was closed to visitors in early 2020 and re-opened in April 2021 and has remained opened to the public.
On September 16, 2021, Governor Newsom signed AB 361. The Bill amended the Brown Act and established special requirements for teleconference meetings of a legislative body of a local public agency when there is a declared state of emergency. Among the changes was the ability for the entire legislative body to meet virtually without providing a publicly accessible location and having to identify teleconference locations on the agenda. These changes were made to provide for the health and safety of local government officials, staff and the public.
As the City Council was already meeting remotely, the City was required to make certain findings pursuant to AB 361. The City Council made the required findings until a special meeting on August 9. 2022. At that meeting, the vote on the AB 361 was deadlocked at 2-2 which resulted in the necessary findings not being adopted. By default, meetings of the City Council reverted to pre-AB 361 Brown Act rules. These include a requirement that the meeting is held in a publicly accessible facility (i.e. City Hall), a majority of the legislative body must be physically in the jurisdictional boundaries of the agency, and those members who desire to teleconference must adhere to the Brown Act teleconference provisions and post the agenda at the teleconference location, list their address of their teleconference location on the agenda and make the teleconference accessible to the public.
City Council
Return to In-person Meetings
August 22, 2022
Discussion
The City Council had discussed a return to in-person meetings two previous times. The first was on June 28, 2021. At that time the City Council gave direction to return to in-person meetings in a virtual format after September 30, 2021. Staff began making the necessary modifications to the City Council Chambers broadcast system to allow for an in-person/hybrid virtual format that would allow City Council Members, staff and/or the public to participate seamlessly in person or via a teleconference platform. In the lead up to September 30, two significant things occurred.
The first was the passage of AB 361 which was discussed above. The second was an increase or surge in Covid cases throughout Los Angeles County. Consequently, the City Council continued meeting in a virtual only format.
Following the 2021/22 winter surge, the City Council again discussed a return to in-person City Council meetings on April 25, 2022. Although another new surge of Covid cases was in its infancy, the City Council provided direction to provide an in-person/hybrid format for City Council meetings at the first meeting in June of 2022. The City Council went on to say that the item could be revisited if there is a significant increase in cases between that time period.
Come June, it appeared that the County was in the midst of another surge. At that time, staff made the determination that a return to in-person meetings was not advisable. Additionally, LA County Public Health strongly recommended the wearing of a mask in most indoor public settings including local government offices. With the coming City Council summer recess, staff found it best to revisit a return to in-person meetings once Covid cases started to decrease and after the summer break
Based on the City Council action of August 9, staff has prepared the City Council Chambers for a return to in-person City Council meetings. In addition, the virtual hybrid option is being used to allow Council Members, staff, consultants, and the public the option of participating in-person or in a virtual format. The virtual format has proven to be extremely efficient for interested residents and has significantly increased public participation in City Council meetings. Out of the area consultants are no longer required to travel to City Hall to participate as well. Finally, it should be noted that both the cities of Agoura Hills and Westlake Village offer an in-person hybrid City Council meeting format. The City of Calabasas, while not currently offering in-person meetings, have agreed to offer a hybrid version when they return to the City Council Chambers Fiscal Impact
Costs associated with upgrades to Audio/Visual services to allow for In-Person/Hybrid meetings were included in the adopted FY 2021/22 City budget. The necessary equipment has been acquired and installed.
City Council
Return to In-person Meetings
August 22, 2022
Recommendation
It was staff’s interpretation of direction from the City Council on August 9 to agendize a discussion on a return to in-person meetings with a hybrid participation format. As that system is currently in use for tonight’s meeting, staff is recommending continued use of the hybrid format for future in-person City Council meetings.
