Consideration of Approval of the Revised Second Amendment to the Agreement for Solid Waste Services with Waste Management to Extend the Term for an Additional Two Years
Acting City Manager Marlowe presented the following report:
on December 11, the City Council approved the Second Amendment to the Agreement for Solid Waste Services with Waste Management to extend the term of the Agreement for an additional two years, as it expires on December 31, 2023; the Second Amendment approved by the City Council included language stating that Waste Management agreed to waive their ability to request a rate adjustment due to unforeseen changes; however, when the City requested a two-year extension, it was with Waste Management’s understanding that they would still have the ability to request a rate adjustment due to unforeseen changes as permitted under their current Agreement, accordingly, the Revised Second Amendment deletes that language. All the other terms of the Agreement remain unchanged from the previous version.
