City Council Meeting of
May 14, 2024
Century Communities DIF Parkland Credit Request
According to information provided by Century Communities and the City' s Landscape Architect ( Community Works Design Group), the construction of ` private' ( but open to the public) active and passive park areas within the project will cost an estimated 866, 000. 00, or $ 654,370.00 more than the City's DIFs collected for the City's Parkland Acquisition & Park Facilities.
The Highland Municipal Code Section 16. 40.200 ( D)( 2) stipulates that only the park fee is required for residential development containing 50 parcels or less. The Highland Municipal Code Section 16. 40. 200 ( D)( 6)( h( iv)( b) further permits DIF credit up to 50% for proposed privately owned and maintained park and recreational facilities if the City determines it is in the public interest to allow such credit — and after certain standards have been met. That Section of the Municipal Code also includes a park fee credit for the reasonable value of the park and recreational improvements provided by the developer for land dedicated to the City for use as a public park as approved by the City. In the case of the Century Communities, all parks will be owned and maintained by the Homeowner' s Association but open to the public.
The City' s parkland needs will be met and exceeded by Century Communities as required within the Highland Park Planned Development entitlement documents ( City Council Resolution No. 2016- 034), and the Homeowner' s Association will be maintaining all park facilities. The estimated construction cost noted above is considered a reasonable value, and excludes the fees for utility connections, off -site street improvements, and the land value. Since there will be no dedication of land to the City for park development, no appraisal was requested to justify the estimated land value.
There will be no direct impacts to the City's existing DIF Fund because the proposed planned park facilities as identified in the Highland Park Planned Development Document and Tract Map exceeds the City' s Active Parkland Ratio, and the facilities will be constructed by Century Communities ( with extensive amenities as approved by the City' s Landscape Architect and the Highland Planning Commission). In addition, there will be no on -going impact to the City's General Fund since the Homeowner's Association will maintain all the subject park facilities in perpetuity.
PUBLIC NOTICE: No Public Notice is required prior to the City Council taking action on this item. However, the Agenda has been posted in the three ( 3) locations and on- line in accordance with City Council policy.
2 -2-
City Council Meeting of
May 14, 2024
Century Communities DIF Parkland Credit Request
BACKGROUND/ PROPOSAL: The Highland Park Planned Development project was initially approved in June 2016 ( ENV- 15- 003, GPA- 15- 003, CUP- 15- 001, and TTM- 14- 004), with a subsequent Design Review approval for the housing product in March 2022 DRA- 22- 002).
On April 10, 2024, Century Communities requested the City estimate the City' s Parkland Acquisition & Park Facilities Development Impact Fee credit for the Highland Park Planned Development.
The City' s Development Impact Fees in effective on April 28, 2021, was used to estimate the amount of DIF credits ( as adopted by City Council Resolution No. 2021- 007) ( see Attachment A — DIF Schedule, City Council Resolution No. 2021- 007).
Parkland Acquisition & Park Facilities Development Impact Fee credit request The applicable Parkland Acquisition & Park Facilities Development Impact Fee is 4, 702.87 per attached unit (City Council Resolution No. 2021- 007). The Highland Park Planned Development will include 45 applicable detached housing units; therefore, the total Parkland Acquisition & Park Facilities Development Impact Fee is $ 211, 629. 15.
In accordance with the Highland Municipal Code Section 16.40.200( D)( h)( iv)(A), a subdivider or developer may receive a DIF credit against the requirements for the payment or the dedication of land for the reasonable value of park and recreation improvements provided by the subdivider or developer. As noted in the Fiscal Impact Section above, the proposed Highland Park Planned Development park facilities will be owned and maintained by the Homeowner' s Association - but remain open to the public.
Parkland Ratio (Quimby Act):
The City' s General Plan ( Conservation and Open Space Element — Chapter 5) and the Highland Municipal Code Section 16. 40. 200 ( Park and Recreation Facilities) establishes the City' s Park Ratio at 2. 5 acres per 1, 000 residents. This ratio consists of 2. 0 acres of active park acreage and 0. 5 acre of undeveloped natural parkland. In California, park standards are provided by the Quimby Act of 1975, which gave cities the authority to pass parkland impact fees or dedication ordinances, recognizing the tremendous strain that local cities where under to provide enough parkland and open space for their residents. The City' s current Quimby fees and the City' s Development Impact Fee Resolutions are both updated periodically. As noted above, should the City deny the DIF park credit request, Century Communities would be required to pay the full amount of Park DIF fees listed in City Council Resolution 2021- 007 totaling $ 211, 692. 15 ( 45 units @ $ 4, 702. 87 each).
3 -3-
City Council Meeting of
May 14, 2024
Century Communities DIF Parkland Credit Request
The parkland requirement for the Highland Park Planned Development 45 units ( or 155 new residents), as established by the City' s General Plan and Municipal Code, and implemented by the DIF Resolution, is . 31 acres of active park facilities. The proposed 44 acres of active park facilities in the Highland Park Planned Development exceeds the City' s park facilities requirement while incorporating unique park standards and reserving public parkland within the related Tract Map.
As required, the park facilities within Highland Park Planned Development will be owned and maintained by the Homeowner' s Association.
In accordance with the Highland Municipal Code Section 16. 40. 200( D)( h)( iv)( A), it is estimated the construction of the required active and passive park areas within the Highland Park Planned Development project will cost an estimated $ 866, 000. 00, or 654, 370. 00 more than the City DIFs required for the Parkland Acquisition & Park Facilities ( excluding fees for utility connections, off -site improvements, and land acquisition).
Standards required for fee credit:
Approval for Parkland DIF credit(s) shall be based on a determination by the City that it is in the public interest to allow such credit( s), and that all the following standards have been met (or will be met prior to approval of the final map or development permit):
1. That yards, court area, setbacks, and other open space areas, which are required to be established and maintained by other provision of this title ( i.e., Highland Municipal Code), are satisfactorily incorporated into the project design.
Response: The Highland Park Planned Development project was approved via a Conditional Use Permit ( CUP- 15- 001) which adopted a Planned Development Document ( Highland Park Planned Development Document) which set forth unique and detailed development standards that help achieve a 46- unit master planned residential community with extensive recreational amenities consistent with the City's Development Code that serve residents and visitors. The Highland Park Planned Development Document requires that each residential lot within the project incorporate a small private yard/ courtyard for each individual housing unit in addition to the shared open space/park amenities.
2. Evidence is provided that the private ownership and maintenance of the area will be adequately provided for by recorded written agreement, covenants or restrictions.
Response: The Highland Park Planned Development will include extensive amenities with a Homeowner' s Association ( HOA) function 4 -4-
City Council Meeting of
May 14, 2024
Century Communities DIF Parkland Credit Request
responsible for maintenance of all parkland landscaping, and recreational facilities in perpetuity.
3. That the use of the private area is restricted to park and recreational purposes by an open space easement or other instrument in favor of, or enforceable by, the City.
Response: The Highland Park Planned Development project was approved with a Tract Map ( TM 19915) which reserved portions of the property for open space and park & recreational purposes, as well as water quality management ( Lot 47).
4. That the proposed private area is reasonably adaptable for use for park or recreational purposes, taking into consideration such factors as size, shape, topography, geology, access, and location.
Response: The Highland Park Planned Development park and recreational facilities locations were reviewed and approved by the City' s Landscape Architect, Planning Commission and City Council. The Highland Park Development Document includes unique design standards for the park facilities to serve residents and visitors. Final park facility designs were reviewed and approved by the City' s Planning Commission and will also be reviewed and approved by the City' s Landscape Architect before park construction permits are issued.
5. That the private recreational areas can be utilized by project residents in a manner which would reduce the need for public recreational facilities in proportion to the requested park land credit.
Response: The Highland Park Planned Development recreational areas are within short walking distance from each of the 46 residential units connected by sidewalks and short trail along the northerly park boundary), and the project Developer will construct . 44 acres of active parkland to serve the estimated 155 new residents. The Developer' s cost to construct the park facilities is estimated at $ 866, 000. 00. The proposed acreage exceeds the . 31 acres envisioned by the City' s General Plan and the City' s Land Use and Development Code Section 16. 40. 200 ( Park and Recreational Facilities). The current Park DIF is $ 211, 692. 15, or 654, 793. 00 less than the reasonable construction costs of the park and recreational facilities proposed for the Highland Park Planned Development project. The Highland Park Planned Development is also contiguous to extensive multi -use trails within the East Highland' s Ranch Planned Unit Development and is within a half mile of the city' s local and regional trail networks leading into the San Bernardino National Forest and the City Natural Parkland near the easterly terminus of Base Line.
Constructing additional park facilities beyond the City' s minimum Quimby Ratio and being connected to regional trails and public improvements 5 -5-
City Council Meeting of
May 14, 2024
Century Communities DIF Parkland Credit Request
helps reduce the need for the City to construct additional public recreational facilities in proportion to the requested parkland credit.
Based on the required standards listed above, staff recommends the City Council consider Century Communities request for a fifty percent ( 50%) " Parkland Acquisition and Park Facilities" DIF credit for the Highland Park Planned Development in the amount of $105, 814. 80 ($ 4, 702. 87 Park DIFs x 45 units x 50% = $ 105,814.80).
