Subject: Cooperative Fire Protection Agreement Extension

Recommendation:

Authorize the City Manager to execute an extension to the Cooperative Fire Protection Agreement between the City of Highland and U.S. Forest Service.

Fiscal Impact:

None at this time.

Public Notice:

The agenda for this item was posted at the three locations per Resolution No. 2011-047 and on the City’s website.

Background:

On June 13, 2023, the City Council approved a cooperative agreement to provide mutual aid between the City of Highland (City) and the U.S. Forest Service, see attachment 1. Under the agreement, each agency agrees to provide a designated fire or rescue response to any area in the jurisdiction of either agency based upon an operating plan as outlined in the agreement.

The response would be dependent upon the existing emergency conditions within each jurisdiction and the status of resources. This agreement was important during the Line Fire incident of September 5, 2024, because it provided a mechanism for the U.S. Forest Service to cover all costs associated with the incident to protect Highland residents.

The original agreement had an expiration date of December 31, 2024, unless extended by an executed modification, signed and dated by all properly authorized, signatory officials. The principal contacts listed on the agreement for the City included Fire Chief Ron Janssen and City Manager Joseph Hughes. On December 12, 2024, Fire Chief Ron Janssen executed a modification of the agreement to extend the period of performance to November 30, 2025, see attachment 2.

Page 3 of 55 ends

To preserve the cooperative agreement, it is necessary to once again extend the performance period. Staff is recommending approval of the following per attachment 3:

1. Extend the expiration date to July 2, 2028.

2. Replace the City principal contacts for Fire Chief from Ron Janssen to Liz Brown and City Manager from Joseph Hughes to Carlos Zamano.
