ITEM SUBJECT: RESOLUTION AWARDING TO AND AUTHORIZING THE CITY MANAGER TO EXECUTE THREE (3) THREE-YEAR CONTRACTS WITH THE DAVEY GROUP, CALTLC, AND
THE OAKLEY GROUP FOR ARBORICULTURAL SERVICES FOR A THREE YEAR NOT TO EXCEED TOTAL AMOUNT OF $150,000.00 PURSUANT TO CEQA GUIDELINES 15061(B)(3), 15307, 15308, AND 15378
SUMMARY: On February 13, 2023, the City Council adopted changes to the Town's Municipal Code related to tree protection pursuant to its adoption of Ordinance No. 789. The updates reflect a balance between the community's desire to strengthen tree protection in Town as well as improve clarity of the requirements.
To support the new elements of the ordinance, the Town requires on-call arboricultural services to support the implementation of the requirements such as a review of arborist reports and tree removal permit applications.
In June 2023, Town staff issued a Request for Proposals (RFP) for on-call arboricultural services.
Six companies submitted proposals. The proposals were evaluated based on the companies' qualifications and experience, technical approach, proven ability, and willingness to adhere to the Town's requirements. Based on these criteria, the Town has selected The Davey Group, CalTLC, and The Oakley Group and recommends these three firms be awarded the on-call arboricultural services contract.
FISCAL IMPACT: The on-call arboricultural services will be funded by tree removal fees charged to result in no net impacts to the adopted Town budget.
ENVIRONMENTAL ISSUES: The proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment pursuant to CEQA Guideline section 15061(b)(3),and, alternatively, is exempt from further CEQA review under CEQA Guideline sections 15307 and 15308 as an action authorized by local ordinance to maintain, restore, or enhance a natural resource. Finally, the proposed action is also exempt from CEQA under Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION AWARDING TO AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH NORGO ENGINEERING CO. FOR THE 150 WOODRIDGE ROAD PIPE EXTENSION PROJECT IN THE AMOUNT OF $179,785.00, WITH A 10% CONTINGENCY IN THE AMOUNT OF $17,978.50, IF NEEDED, FOR A TOTAL PROJECT BUDGET OF $197,763.50 PURSUANT TO CEQA GUIDELINE 15301
SUMMARY: The Public Works Department has been working on improvements nearest to 150 Woodridge Road to extend a portion of the Town’s storm drainage infrastructure to alleviate storm drain runoff to the nearby property. The existing storm drain system includes 24-inch and 15-inch reinforced concrete pipes that both daylight onto riprap and overland flow through private property to eventually drain into San Mateo Creek. During recent heavy rains, the storm water flowing out of the pipes eroded away a portion of the existing channel, and caused scouring of the slope near the private structure. The extension of the Town’s infrastructure has been prioritized and is necessary to prevent further erosion of private property and potential property damage. This project should be completed before the next rainy season.
The project includes installing a junction structure,150 linear feet of 24-inch High-Density Polyethylene (HDPE) pipe, Town standard outfall to reduce the energy of the storm water and divert water away from the resident’s home per the recommendation of the resident’s and Town’s geotechnical engineers, and backfilling the eroded soil.
The Town conducted competitive bidding as required by the Town’s Municipal Code and the State Public Contract Code. Two bids were received. The bid results are presented below:
NORGO Engineering Co. $ 179,785.00
Farallon Company $ 406,620.00
The apparent low bid in the amount of $ 179,785.00 was submitted by NORGO Engineering Co.
Staff conducted an analysis of the bid submittal and determined that the bidder’s qualifications and experience levels are satisfactory to perform all work associated with this project. NORGO Engineering Co. is a local construction firm and previously worked on similar projects for the Town.
Contractors who perform this type of work are currently booked through the summer and fall, and the bid submittals are consistent with the current bidding climate. The bid from Farallon included additional (optional) items not called out for in the bid solicitation. However, comparing the necesary bid items required, NORGO's bid is complete.
FISCAL IMPACT: It is recommended that funding in the amount of $177,000 be allocated from the Miscellaneous Storm Drain Repairs Program (Capital Improvement Plan #804), and the remaining -29-

funding in the amount of $17,978.50, which includes a 10% contingency if needed, be allocated from the Storm Water Master Plan Improvement Program (Capital Improvement Plan #801).

CITY COUNCIL MEETING
JULY 10, 2023
AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION AUTHORIZING PLACEMENT OF SEWER SERVICE AND
STORM DRAINAGE CHARGES, SPECIAL TAX FOR POLICE PROTECTION AND FIRE
PROTECTION AND PREVENTION, AND THE FLAT CHARGE COMPONENT OF THE GARBAGE COLLECTION FEE ON THE FISCAL YEAR 2023-2024 COUNTY TAX ROLL AND
AUTHORIZING THE COUNTY TAX COLLECTOR TO COLLECT SUCH CHARGES PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Town's sewer service charges, storm drainage charges, public safety special tax and the flat garbage collection fee are collected by the County Tax Collector in the same manner in which the County collects the property taxes. The Hillsborough Municipal Code requires the Town to annually adopt a resolution authorizing the County Tax Collector to collect the above charges.
The procedures to place the charges on the tax roll and the publication of the notice on the hearing are those prescribed in the California Health and Safety Code 5473 through 5473.8. The public safety tax that gets put on the tax roll is pursuant to Government Code section 50077(b) and the provisions in the Municipal Code.
There are an estimated 3,900 households that will be assessed an annual residential sewer charge of $3,985 for an estimated total of $15,541,500 to support the sewer operations. This represents a 4% increase from the $3,832 annual charge last year. Commercial accounts will be manually assessed and billed with the water charges based on their winter water usage and relationship to the charge of an "equivalent dwelling unit" of $3,985. The sewer charge was approved by City Council on May 8, 2023, in a noticed public hearing.
The annual storm drainage charge was first authorized in fiscal year 1994-1995 upon the implementation of the National Pollutant Discharge Elimination System (NPDES) Stormwater Pollution Prevention Program. The authorizing ordinance, however, does not provide for adjustments to the annual charge to cover changes to program costs; hence, it has remained the same since the initial implementation. An annual charge of $7.34 per parcel will be assessed to 4,012 parcels for an estimated total of $29,448.08 to partially pay for storm drain costs.
The public safety tax of $218 for 59 unimproved and $570 for 3,920 improved parcels will bring in an estimated $2,247,262 towards partial funding of public safety operations. The special tax initially set at $190 for unimproved parcels and $496 for improved parcels in 1998-1999 was increased by 2% each year, but the authorizing ordinance set a maximum of 115% of the initial amounts. The maximum amounts have been assessed since 2005-2006.
The flat garbage collection fee reflects a 5% increase from the previous year in the amount of $346.56 per year to be assessed on an estimated 3,903 parcels. Projected receipts of $1,352,623 -33-

net of the incidental charges (collection fee charged by the County and the cost to prepare the data in the required format) will be remitted to Recology per the franchise agreement.
FISCAL IMPACT: Collection charges will be assessed by the County in exchange for the service.
The cost is part of the operating budget. All revenues are reflected in the approved budget.
ENVIRONMENTAL ISSUES: The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.
