CITY COUNCIL MEETING

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH HF&H CONSULTANTS, LLC. FOR A WATER RATE UPDATE PURSUANT TO CEQA GUIDELINES 15378 AND 15273 AND PUBLIC RESOURCES CODE SECTION 21080(B)(8)
SUMMARY: The Town of Hillsborough is conducting a water rate update. The study will provide financial projections and revenue requirements needed to meet operating and capital needs and cover debt service and reserve requirements.

The Town adopted a five-year water rate series in November 2022, and the first two years of the rate series have been implemented. The water rate update is needed due to additional forthcoming capital needs and rising costs of wholesale water. The Town is reviewing the Highline Pipeline project to determine the funding and financing plan for the $32 million (70% grant-funded) water system project. This project will provide a highly reliable source of water to all three cities within the project area (Hillsborough, Burlingame, and Millbrae) in the event of a wildfire as well as immediately after large earthquakes that can occur on the nearby highly active faults. In addition, the Town will need to review the revenue requirement impact for the recently released San Francisco Public Utilities Commission (SFPUC) wholesale water rate increases.

Under the Town’s Purchasing Policy, all services in an amount over $30,000 are required to be procured through a Request for Proposals or RFP process. In lieu of the RFP process, staff is instead recommending that this work, which is anticipated to be in excess of $30,000, be procured directly through HF&H. This is because it would be futile for the Town to go out to RFP as the Town will benefit from lower costs by hiring HF&H directly primarily because HF&H has historically worked on the Town’s water rates and has knowledge and databases that any other vendor will need to get up to speed on and/or create at costs to the Town. It has been held that where competitive proposals do not produce any advantage, competitive bidding is not applicable. See, Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631.

On the above basis, staff is recommending hiring HF&H directly for this work. The Town gains efficiency and cost savings by working with HF&H as the firm can leverage its existing models created for the 2022 study, and HF&H possesses knowledge of the Town’s system and processes from the recent 2022 study.

FISCAL IMPACT: The contract is paid on an hourly basis, and the estimate for the work is $39,365.00. Any change in the scope of work will be brought forward by the consultants for approval. The FY 2023-24 budget has a budget for rate studies.

ENVIRONMENTAL ISSUES: In accordance with the California Environmental Quality Act (CEQA) -17-
Agenda Staff Report - Hillsborough City Council
April 8, 2024

Page 2 ends

and the CEQA Guidelines, the action to hire a consultant to analyze any potential increases in the water service charges is exempt from CEQA pursuant to Section 15378 and Section 15273 of the CEQA Guidelines and Public Resources Code Section 21080(b)(8) because (i) any rate analysis that could lead to increased charges would be for the purpose of meeting operational and maintenance expenses of the aforementioned services and (ii) the charges constitute the creation of a funding mechanism/other governmental fiscal activity which does not involve any commitment to any specific project that may result in potential significant physical impact on the environment.

APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH HF&H CONSULTANTS, LLC. FOR A WATER RATE UPDATE PURSUANT TO CEQA GUIDELINE 15378,15273 AND PUBLIC RESOURCES CODE SECTION 21080(B)(8)
WHEREAS, the Town of Hillsborough (“Town”) sets customer rates for water services; and
WHEREAS, the Town will be conducting a rate study to determine the rate requirements to cover the cost of the system and operations; and WHEREAS, under the Town’s Purchasing Policy, all services in an amount over $30,000 are required to be procured through a Request for Proposals or RFP process; and

APRIL 8, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING THE PURCHASE OF TWO REPLACEMENT PUBLIC WORKS VEHICLES IN THE AMOUNT OF $747,450.34 PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Public Works Department is scheduled to replace two vehicles in FY 2023-24 using funds allocated from the FY 2023-24 Public Works Vehicle Capital Replacement Fund.

The first vehicle is a Vactor Jet Truck assigned to the Sewer Division (#527) and will be replaced with an updated Vactor Jet Truck. The existing truck is a 2009 International truck. The vehicle is beyond its planned service life, repair costs have been very high just to keep it in use, and the engine no longer meets current California emission standards.

The replacement Vactor Jet Truck for the Sewer division is equipped with updated technology that will facilitate ease of operation for a more efficient cleaning of the sanitary sewer system. It will be outfitted with 800 feet of ¾ inch jet hose which allows us to maintain easement areas where some of the Town’s sewer main infrastructure is located.

The Vactor Jet Truck is supplied by Owen Equipment, and is part of the Sourcewell cooperative pricing agreement which the Town participates in.

MANUFACTURER PRICE PER JET TRUCK
OWEN EQUIPMENT $691,568.28
OWEN Equipment included the registration fee and the 9.375% sales tax.

The second vehicle for replacement is a FORD F-150 Pick-up Truck assigned to the Streets Division (#230). The existing truck is a 2007 pickup truck, which is beyond its planned service life and was originally planned for replacement in 2020/2021. The replacement truck will be an Electric F-150 Lightning Pick-up Truck.

The State of California has a goal of electrifying government fleets by 2025 to help reduce greenhouse gases and transportation emissions by 40% by 2030. Furthermore, California would like 100% Electric Vehicle sales by 2035. This purchase continues our plan with the Town to go green, and further reduce our carbon footprint. Electric vehicles are an essential part of a clean energy future, and studies have shown that they may play a key role in arresting climate change.

The Town last reviewed electric vehicles in 2018 during a County of San Mateo Grand Jury report, when electric vehicles were initially being adopted into local government fleets within the County.

Vehicle technology and incentives have improved since then, and the most common purchase of vehicle for municipal maintenance, the F150 will be all electric. Based on the dollar value of this -55-

purchase, the Town’s Purchasing Policy does require an RFP or other competitive procurement process. A legal exception to this requirement exists for contracts where a public agency determines, based on the facts and circumstances of the contract in question, that public bidding would produce no competitive advantage for the public agency or would be futile because the nature of the procurement. See Graydon v. Pasadena Redevelopment Agency, et al. (1980) 104 Cal. App 3d 631, 635. Based on ongoing supply issues and shortages that auto dealers around the nation have faced, including Ford, the Town does not believe it will gain any competitive advantage by using a formal solicitation process primarily because any solicitation process is unlikely to yield any results based on the supply issues. Local Ford dealerships were contacted to provide competitive quotes per the Town’s Purchasing Policies and Procedures. Towne Ford, James Ford, and Fremont Ford provided quotes and status of availability for this vehicle. Towne Ford was able to meet the current Ford factory direct cost without delay in delivery.

DEALER PRICE PER TRUCK
TOWNE FORD $55,882.06
JAMES FORD No Truck Available
FREMONT FORD No Truck Available
Towne Ford included the registration fee and the 9.375% sales tax.

Staff recommends purchasing one Vactor Jet Truck from OWEN Equipment in the amount of $691,568.28 and one FORD Lightning Electric F-150 from Towne Ford in the amount of $55,882.06, for a total cost of $747,450.34 from the Public Works Vehicle Capital Replacement Fund.

FISCAL IMPACT: There are existing funds in the Public Works Vehicle Capital Replacement Fund for the replacement vehicles.

ENVIRONMENTAL ISSUES: The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.

• Town of Hillsborough Integrated Pest Management Policy The above laws, regulations and policies require the services of a biological consultant to ensure regulatory compliance and to monitor sensitive and endangered species in known habitat areas within the project work areas.

On July 13, 2018, the Town entered into an agreement with Woods Biological, Inc. for two years, with the option to renew for a third year, for a total agreement amount of $70,800.00.

On May 10, 2021, City Council approved an amendment to the existing agreement for an additional two years, with the option to renew for a third, in the amount of $45,325.00, for total agreement amount of $116,125.00. The agreement is currently in the third year and ends on May 26, 2024.

Biological work for open space vegetation management typically occurs April through October each year. The current agreement would end during the 2024 active work season. Staff recommends the current agreement be extended to October 31, 2024, and that an additional $13,000.00 be approved in order to complete the biological work for the 2024 open space vegetation management cycle. This second amendment is necessary for continuity of reporting by -59-

ITEM SUBJECT: RESOLUTION AUTHORIZING ADDITIONAL FUNDING FOR THE 2023 SANITARY SEWER REHABILITATION & REPLACEMENT PROJECT 23A IN THE AMOUNT OF $107,618.00 FOR TOTAL COST OF $2,359,164.00 PURSUANT TO CEQA GUIDELINE SECTION 15301
SUMMARY: his project includes the replacement and upsize of approximately 5,400 linear feet of damaged and undersized sanitary sewer mains in the Tartan Trail Road area. The sewer segments are located both within street public right-of-way and easement areas within the Town’s wastewater basin discharging to the San Mateo Wastewater Treatment Plant. The project additionally includes the rehabilitation of manhole structures and the replacement of lower service laterals and cleanouts. On September 11, 2023, the City Council awarded the project to D’arcy & Harty Construction, Inc. (Darcy) in the amount of $2,046,860, with a 10% contingency in the amount of $204,686.00 for a total allocation of $2,251,546.00.

During construction, it was determined that an additional segment of pipe in the vicinity is failing and has led to ongoing maintenance issues this winter. This segment was not included in the original bid documents, but is a direct continuation of the sewer system the contractor is currently working on. Even with this additional segment, it is anticipated the contractor will complete the work within the original contract time. Should the additional funding be authorized, staff would issue a change order to authorize the contractor to proceed with the extra work.

FISCAL IMPACT: It is recommended that additional funding in the amount of $107,618.00 be allocated from the approved budget for the Priority Basins Inflow & Infiltration Program (CIP #701), for a total allocation of $2,359,164.00. Sufficient funding remains in the budget for this project.

ENVIRONMENTAL ISSUES: This project is exempt from the California Environmental Quality Act (CEQA) per Section 15301 of the California Code of Regulations.

ITEM SUBJECT: RESOLUTION AWARDING TO AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH CASEY CONSTRUCTION INC. FOR THE 1450 SOUTHDOWN ROAD STORM DRAIN REPLACEMENT PROJECT IN THE AMOUNT OF $161,200.00, WITH 20% CONTINGENCY IN THE AMOUNT OF $32,240.00 FOR A TOTAL COST OF $193,440.00 PURSUANT TO CEQA GUIDELINE 15301
SUMMARY: An existing 12” storm drain pipe at 1450 Southdown Road has been found to be disjointed, offset, and filled with tree roots, causing localized flooding and ineffective conveyance of water. The pipe conveys stormwater from Southdown Road, through the backyard of 1450 Southdown Road property, to a catch basin on Black Mountain Road. The property is significantly sloped with several existing landscape improvements and mature trees over and near the pipe.

The Town desires to abandon a portion of the existing pipe in place and install new pipe by directional drilling/trenchless method and replace a portion of the existing pipe by open trench method. Approximately 290 linear feet of 12” HDPE pipe will be installed using directional drilling/trenchless method and 20 linear feet of 12” HDPE and 30 linear feet of 24” HDPE pipe will be installed by open trench method.

This project was advertised in accordance with the Uniform Public Construction Cost Accounting Act and staff additionally contacted eight contractors who perform this specialized type of work.

Bids were opened on Thursday, March 28, 2024, and bid results were announced in the Town Hall Council Chamber in accordance with the Town’s policy and procedures. A bid summary is as follows:
1) Casey Construction, Inc. $ 161,200.00
2) DeVaney Engineering, Inc. $ 180,500.00
3) NORGO Engineering Corporation $ 195,300.00
4) W.R. Forde Associates, Inc. $ 195,380.00
5) Pacific Underground Construction, Inc. $ 342,700.00
Of the five bids received for this project, Casey Construction Inc. was confirmed by staff to be the lowest responsible bidder submitting a responsive bid. Staff conducted an analysis of the bid submittal and determined that the bidder’s qualifications and experience levels are satisfactory to perform all work associated with this project. Casey Construction Inc. is a local construction firm and has previously completed similar projects in Town with positive results.

FISCAL IMPACT: Due to the unknown soil conditions and limited survey data, staff recommends a 20% contingency. Therefore, it is recommended that funding be allocated from the approved -66-

CITY COUNCIL MEETING
APRIL 8, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: CONCEPTUAL REVIEW OF THE SUBDIVISION OF 2260 REDINGTON ROAD (APN 028-040-120) INTO THIRTY-FOUR PARCELS AND TWO COMMON PARCELS, AND

DEDICATION OF PUBLIC UTILITY AND EMERGENCY VEHICLE ACCESS EASEMENTS SUMMARY: On October 12, 2023, the Town received a Conceptual Plan application to subdivide 2260 Redington Road, commonly known as Strawberry Hill, into thirty-four lots suitable for single family homes. The proposed subdivision also includes dedications of new public utility and emergency vehicle access easements.

The existing 48.3-acre property is bordered by Macadamia Drive to the west and south, single family homes on Skyfarm Drive to the east, and Forest View Drive to the north. The property contains the primary mansion built in 1912, formal gardens, pool house and pool, carriage house, other accessory structures, a creek, and other landscape features. Primary access to the property is via Redington Road. The existing property consists of six lots, four of which are not included as part of this subdivision.

The other two lots would be subdivided into thirty-four lots:
-One 14.9-acre lot for the existing estate
-Thirty-three lots, ranging from 0.5 acre to 1.5 acre lots, for future individual single family residences
Additionally, two parcels would be created, one lot for a private road and cul-de-sac to provide access to most of the new lots, and one for a common storm water detention basin. The applicant is proposing gated entrances at both access points from Macadamia Road to the private roads.

See Attachment 1 for the conceptual map.

Hillsborough Municipal Code (HMC) section 16.16.020 requires Conceptual Review of all proposed subdivision projects. This preliminary review of the proposed subdivision is intended to facilitate optimum subdivision design, reduce unproductive efforts by all parties, and bring about a better result for applicants, Town residents and the City Council. The process provides a forum for citizens and the City Council to provide preliminary feedback on issues relating to the subdivision’s design and potential environmental issues. This conceptual review is step one in a multi-step subdivision map approval process and does not constitute final approval of the proposed subdivision. Per the California Subdivision Map Act and HMC Sections 16.16.010.B and

16.16.060, a Tentative and Final Parcel map must be submitted to the City Engineer and reviewed by the City Council in advance of any final subdivision approval.

The proposed subdivision meets all requirements of the State of California Subdivision Map Act and the Town’s Subdivision Ordinance for lot design, access, topography and future building site, -70-

with the exception of minimum lot frontage. Per HMC 16.02.020.A, B and C, the minimum lot frontage shall be one hundred fifty feet on a public street, seventy-five feet on the turnaround area of a cul-de-sac, and for lots at an intersection, one hundred feet on each street. The applicant is proposing some lots that do not meet the minimum frontage requirements. Pursuant to

16.02.020.D, the Council may approve these lots if the goals of the Housing Element of the General Plan are met. Based on the 2023 General Plan update, staff has determined twenty of the lots do comply with the Housing Element certified by the state Housing and Community Development department and recommends conditional approval of thirteen lots (Lots 3,4,9-11,23- 26, 29-32) that do not the meet the minimum frontage. Details on lot frontage are outlined in the table on Attachment 1. Details on lot size are outlined in the table in Attachment 2. Note the minor deficits in lot size will be addressed prior to submittal of the tentative map application.

While not required, the applicant has also prepared a conceptual home and driveway plan for all lots, which is included as Attachment 3 to the staff report. Note that the houses and driveways are shown in concept only, intended to illustrate that a future new home on the site could meet the minimum development standards required by the Municipal Code. The actual design of any future new home would be subject to review and approval by the Town’s Architecture and Design Review Board (ADRB).

The City Engineer notes that the proposed lot would comply with all other subdivision standard requirements, as outlined in HMC Chapter 16.28. As a condition of future tentative map approval and prior to construction of any new home, the developer would be required to construct new sewer, domestic and fire suppression water, storm drainage, and roadway infrastructure, private sewer and water service connections for each lot, and any other improvements necessary for the public safety. The new roadway would be privately owned and maintained, but the subdivider would dedicate public utility and emergency access vehicle easements. Upon acceptance of the public improvements by the City Engineer, the Town would own, operate, and maintain the utility mains. Additionally, the subdivider will provide an access road for a through connection and access from the new cul-de-sac to Redington Road for utility and fire apparatus access only. The developer would be responsible for paying all development charges, including sewer and water capital development fees.

Pursuant to HMC Chapter 16.18, prior to final map approval, developers of new subdivisions will be required to pay park in-lieu fees, or provide other means of community benefit as determined by the Town, to mitigate the impacts of property development.

Public Comment letters for this conceptual review item received before 5:00 p.m. on Wednesday, April 3, 2024 are included as Attachment 4 to the staff report. The public comment letter received primarily expressed concerns over ensuring the essential character of Hillsborough is maintained, considering impacts to the entire Town, low income housing and accessory dwelling units, details on individual lot development, tree removal, and park dedication. Any public comment received after 5:00 p.m. on Wednesday, April 3, 2024 and prior to 4:00 p.m. on Monday, April 8, 2024 will be emailed to the City Council and posted on the Town website.

FISCAL IMPACT: There is no fiscal impact associated with this agenda item. -71-

ENVIRONMENTAL ISSUES: Pursuant to HMC 16.16.020 and 16.16.040, preliminary environmental analysis is performed during the conceptual review of a subdivision. This includes the Town's preliminary review of the conceptual plan and the environmental information form submitted by the applicant, and other environmental issues identified during the conceptual review process.

Upon preliminary review and initial study, staff has determined that the applicant shall likely prepare an environmental impact report (EIR) prior to tentative map approval to comply with the California Environmental Quality Act (CEQA).

Fr: Isabella Lanza – 2360 Skyfarm Drive, Hillsborough CA 94010 RE: Review of Subdivision of 2260 Redington Road Notification “… Welcome to the Town of Hillsborough – a unique residential community … Hillsborough strives to maintain the rustic character and rural charm that are the hallmarks of our town. We are dedicated to preserving our history, natural beauty, architectural heritage and small-town atmosphere that contribute to the essential character of our community and make it a wonderful place in which to live and raise a family.” -Hillsborough

How do some cities lose their core identity over time while others retain their character and remain immune to outside pressure to evolve? 2260 Redington Road – AKA Strawberry Hill, is one of two remaining legacy estates in Hillsborough. The owner of this land has the right subdivide and sell their land and hopefully the Hillsborough Planning Department will have the good judgement to assess the impact of the proposal on the entire community.

Given the size of this parcel and its prominent imprint on the topography and landscape of Hillsborough; Was this notification letter delivered to just the surrounding neighbors or the entire resident base in Hillsborough? If NOT, it should, as the current proposal will negatively affect all of Hillsborough.

What does two “private roadway and gated community entrances” to Macadamia mean? Will they be a secure ‘key-pad’ entrance? If so, this would be a first in our town.

How many of the 33 parcel lots will be 0.5 acre and what are the lot frontage dimensions of each lot? Will ADU units be an automatic part of each lot? What will be implemented to regulate the development on slopes to minimize risk of harm from landslides, erosion and water runoff and well as to preserve the natural setting and scenic character of Strawberry Hill?
Will these be custom built homes or developer spec houses? If it is one developer, Who is submitting the plan? Will these homes be regulated individually by the Hillsborough Architectural Review Board for size, style, character and landscape? ATTACHMENT 4

Given the mature landscape of this prominent piece of land and the fact that the greenbelt is primarily made up of Eucalyptus trees – What precautions will be in place to ensure that the entire area is not de-forested? What plans are in place to ensure that this development fits into the current style of Hillsborough and not a carbon copy of an East Bay gated development?
With the history and legacy of this land -- Why wouldn’t consideration be given to inserting a park or open space so that the entire community would benefit? Name it Strawberry Hill – Vista Park is a treasured and much utilized space. Anchoring a beautiful space within any proposal would help mitigate the density of the current plan. It also would enhance and balance the existing 15-acre parcel that will encompass the existing estate.

Thoughtful consideration should be given to how to move forward with ANY proposal particularly if it is being pushed through to meet state mandated low-income housing unit requirements.

My home on Skyfarm Drive is directly across from the back of this proposed monstrosity – and while I have no right to object to developing this land – I do object to this specific proposal as it will never contribute to the essential character of our community and enhance what makes Hillsborough a wonderful place to live.

Thank you for the opportunity to express my concerns–
Isabella Lanza

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AMENDMENT NO. 1 TO THE EMPLOYMENT

AGREEMENT FOR CITY MANAGER DOUG DAVIS RELATING TO A COMPENSATION ADJUSTMENT, PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: Doug Davis was appointed to the position of City Manager by the City Council on July 8, 2023. As specified in Mr. Davis's employment agreement, the City Council conducted a 6-month performance evaluation. The performance evaluation was the culmination of a process that began in January and included individual interviews with all members of the City Council as well as four department heads. A written memorandum summarizing the feedback was prepared and the results of this information-gathering process were presented to the City Council during a closed session held on March 11, 2024. After concluding the performance evaluation, the City Council agreed to a compensation adjustment adjusting the City Manager’s salary from $273,182.00 to $319,358.00.

FISCAL IMPACT: The annual cost of the salary increase is estimated to be $46,176.00.

ENVIRONMENTAL ISSUES: The City Council’s action in approving the amendment is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guideline 15378 as something that does not constitute a “Project” as defined by CEQA as it is more akin to an administrative action of the City Council related to personnel matters.
