ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE AN AMENDMENT TO THE IT MANAGED SERVICES AGREEMENT WITH EATON &

ASSOCIATES FOR COMPREHENSIVE INFORMATION TECHNOLOGY (IT) MANAGED SERVICES IN THE AMOUNT OF $333,660.00 FOR ONE YEAR FOR A TOTAL FOUR-YEAR CONTRACT AMOUNT OF $1,233,660.00 PURSUANT TO CEQA GUIDELINE 15378 SUMMARY: The Town of Hillsborough (“Town”) maintains a comprehensive Information Technology (IT) environment that aims to ensure continuity of essential services for the community. These services include maintaining a robust technological infrastructure, implementing business enterprise and software applications, and establishing a reliable and secure network mainframe in accordance with the Town’s IT Strategic Plan.

From 2003 to 2021, the City of South San Francisco’s IT Department (SSF IT) provided the Town with IT Managed Services through a Memorandum of Understanding. In late 2020, SSF IT indicated to the Town that they would no longer be able to continue providing comprehensive IT services, resulting in the Town issuing a Request for Proposals (RFP) in June 2020. After an extensive selection process, the Town selected Eaton & Associates (Eaton) as the most qualified firm and entered into an IT Managed Services Agreement in June 2021, after approval by the City Council. The Agreement utilized the Town’s Professional Services Agreement (PSA) template with additional language that covers IT-specific services such as security management, digital policies and procedures, and confidentiality, similar to other agency IT Agreements such as the City of Sunnyvale and the City of Irvine.

In addition to day-to-day IT management, Eaton and the Town have worked collaboratively to bolster the Town’s network security and to keep up with the ever-changing technological landscape. Some notable projects included:
• Decommissioning 19 virtual machines and upgrading the 20 remaining; • Ensuring proper data backups through NAS, Veeam and Amazon Web Services; • Implementing network monitoring and asset management tracking tools; and • Supporting new software implementations such as TylerMunis, Workforce ERP, Cartegraph, and CentralSquare (in progress).

During the next year, the Town is aiming to conduct a full assessment of its IT service needs to examine if changes to the Scope of Services are needed to continue providing proper IT coverage for all departments. The proposed Amendment with Eaton is for one year in order to maintain proper continuity of IT Managed Services while the reassessment takes place. -47-

FISCAL IMPACT: The cost of the proposed Amendment is $333,660.00, which would be added to the previously approved sum of $900,000.00 for a total Agreement amount of $1,233,660.00.

Funding for IT services and improvements is included as part of the FY 2024-25 proposed budget.

ENVIRONMENTAL ISSUES: The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.

ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A TWO-YEAR AGREEMENT WITH TETRA TECH, INC. FOR AS-NEEDED

PROFESSIONAL SUPERVISORY CONTROL AND DATA ACQUISITION (SCADA) SYSTEM SUPPORT SERVICES IN THE AMOUNT OF $120,000.00 PURSUANT TO CEQA GUIDELINE 15301
SUMMARY: The Town’s potable water system is a complex system with varying components and topography. The system has 19 separate but interconnected pressure zones with 10 water storage sites, 18 water tanks, and 14 water pump stations. The potable water system is managed and controlled by a Supervisory Control and Data Acquisition (SCADA) System. The SCADA system also allows the Town to monitor and control its three sanitary sewer pump stations.

On March 26, 2024, the Town issued a request for proposals (RFP) for a SCADA System Maintenance and Support Services.
• Tesco Controls, Inc., Tetra Tech, Inc. and TelStar Instruments, Inc. requested to be added to the proposers’ list;
• Tesco Controls, Inc. and Tetra Tech, Inc. attended the optional pre-proposal meeting; • Tetra Tech, Inc. and Telstar Instruments, Inc. submitted proposals by the proposal deadline; and • Tesco Controls, Inc. submitted a letter of non-proposal.

The Town’s evaluation committee reviewed the two proposals and found the Tetra Tech, Inc. proposal, qualifications and costs to be the most qualified and cost-effective. The evaluation committee conducted an interview with Tetra Tech, Inc. and checked references. Based on the proposals, interview, and references, the evaluation team found Tetra Tech, Inc. to be the most qualified company to provide SCADA system maintenance and control services for the Town of Hillsborough Public Works Department. The services provided under the agreement will be limited to an annual not-to-exceed amount of $60,000.00.

The term of the proposed agreement is two years with the ability to extend the agreement for one additional year upon written mutual consent of both parties. The proposed agreement may be terminated by the Town at any time.

FISCAL IMPACT: These as needed SCADA support services would support the SCADA Improvements (Capital Improvement Plan #514) and Public Works Operations Divisions. It is recommended that funding be allocated from the approved FY 2023-24 SCADA Improvements (CIP# 514) and anticipated Water and Sewer Divisions Operations budget for the next two years, or three if the agreement is extended. Staff will track the budgets and if needed, will bring back a budget resolution for City Council to review and adopt. -51-

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION SUBMITTING A REQUEST TO THE METROPOLITAN TRANSPORTATION COMMISSION FOR THE ALLOCATION OF FISCAL YEAR 2024-25 TRANSPORTATION DEVELOPMENT ACT ARTICLE 3 PEDESTRIAN/BICYCLE PROJECT FUNDING PURSUANT TO CEQA GUIDELINES 15378 AND 15306
SUMMARY: The Metropolitan Transportation Commission (MTC) directly administers the Transportation Development Act TDA Article 3 funds and has delineated the procedures and criteria for the submission of claims to TDA Article 3 funds. Per the aforementioned procedures, the City/County Association of Governments (C/CAG) is responsible for the development and implementation of the TDA Article 3 Program as the designated Congestion Management Agency in San Mateo County.

C/CAG invited agencies to submit project proposals to participate in the TDA Article 3 Program.

The goal of this program is to fund pedestrian and bicycle projects using TDA Article 3 funds derived from Local Transportation funds and the State Transit Assistance fund. C/CAG recently adopted a resolution (24-23) in support of the Town’s application for $100,000.00 of funding to be put towards the development of a comprehensive Bicycle and Pedestrian Master Plan.

MTC requires that requests for the allocation of TDA Article 3 funding be submitted as part of a single, countywide coordinated claim from each county in the San Francisco Bay region. C/CAG will submit the recommendation of funding allocations to MTC on behalf of the Town of Hillsborough.

FISCAL IMPACT: The Adopted Fiscal Year 2023-24 Budget allocated $100,000 of funding for the Bicycle and Pedestrian Master Plan, allowing the Town to match the grant allocation of $100,000.00.

It is also exempt pursuant to CEQA Guideline 15306 as the funding will be used to design and study a potential bike and pedestrian project, including any environmental analysis required, and will involve information collection as authorized per Guideline 15306.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2024- 25 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017, AND AUTHORIZING THE SUBMITTAL OF APPLICATIONS FOR SB 1 TRANSPORTATION FUNDING PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: On April 28, 2017, the Governor signed Senate Bill 1 (SB 1), which is known as the Road Repair and Accountability Act of 2017. SB 1 establishes the Road Maintenance and Rehabilitation Program (RMRP) to address deferred maintenance on the state highway and local street and road systems. The bill provides that funds shall be used for projects that include, but are not limited to, the following:
• Road maintenance and rehabilitation
• Safety projects
• Railroad grade separations
• Complete streets components, including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and stormwater capture projects in conjunction with any other allowable project
• Traffic control devices
On November 1, 2017, the State Controller (Controller) began to deposit various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA).

Although the exact amount has not been determined by the Controller for fiscal year 2024-2025, the projected revenue for fiscal year 2024-2025 will include an estimated $275,973 of RMRA funds that will be expensed per SB 1 Accountability and Transparency Guidelines, adopted on August 15, 2018.

SB 1 eligibility procedures require, among other things, the applicant's governing body to submit to the California Transportation Commission a list of projects that are proposed with RMRA funds, including roadways with limits identified. The list of the projects is considered flexible, which allows for substitutions, additions, or removal of roadways in the future. The approval of this resolution will identify the list of the roadways to be included in future projects and make these projects eligible for RMRA funding.

This is the eighth year requesting authorization for the submittal of applications for SB-1 funding, which will enable the Town to continue essential maintenance and rehabilitation of roadways for the segments selected for the 2025 Street Resurfacing Project. -69-

1. The foregoing recitals are true and correct.

2. The following newly proposed project will be funded in-part or solely with Fiscal Year 2024-25 Road Maintenance and Rehabilitation Account revenues:

Project Title: 2025 Street Resurfacing Project
Project Description: This project consists of street resurfacing, maintenance, and rehabilitation work for approximately 30 miles of the Town’s roadways, including hot mix asphalt overlay, microsurfacing, and crack sealing. The primary factor for choosing the roadway segments included for rehabilitation is the Pavement Condition Index (PCI) of each roadway. PCI is a measurement of a street’s condition derived through field inspections that utilize scoring criteria developed by the Metropolitan Transportation Commission’s (MTC) pavement management program. Field inspections were conducted in the fall of 2022, and the roads with the lowest PCI rating were included in this project.

Project Location: Exhibit A – Project Streets List
Estimated Project Schedule: The project is anticipated to begin in May 2025, and is expected to be completed by October 2025.

Estimated Project Useful Life: Resurfacing and rehabilitation work will extend life expectancy of these streets as shown below:
• 2-2.5” HMA Overlay – 10-15 years
• Microsurfacing – 5 to 7 years
• Crack Sealing – 3 to 5 years

CITY COUNCIL MEETING
JUNE 10, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: BY MOTION, DIRECT STAFF TO NOT ENFORCE PROVISIONS OF THE TOWN’S ENERGY REACH CODE ORDINANCE NO. 783 THAT PROHIBIT NATURAL GAS

AND PROPANE PIPING IN NEW CONSTRUCTION FOR HEATING AND WATER HEATING PURPOSES PURSUANT TO CEQA GUIDELINE 15061
SUMMARY: On April 11, 2022, the Hillsborough City Council adopted an ordinance adding Section 15.10.050 (Energy Reach Code) to Chapter 15 of the Hillsborough Municipal Code (HMC) related to new low-rise residential construction to require that space heating and water heating appliances be required to be electric and cooking and clothes drying appliances using natural gas or propane be required to be prewired for a future electric replacement appliance. Among other things, this all-electric preferred mixed fuel option requires the following:

1.Systems using gas or propane space heating equipment to serve new residences, new detached accessory dwelling units, and new detached habitable structures are not permitted. (HMC §

15.10.050.D.)

2. Systems using gas or propane water heaters to serve new residences, new detached accessory dwelling units, and new detached habitable structures are not permitted. (HMC § 15.10.050.E.)

3. Buildings plumbed for natural gas or propane clothes drying or cooking equipment shall include certain electric-ready components for each gas terminal or stub out. (HMC § 15.10.050.F.) BACKGROUND: At the time the City Council adopted the Energy Reach Code, other cities had adopted similar ordinances, with some cities completely prohibiting all natural gas piping in new construction. One city that adopted an all-electric requirement (i.e. a natural gas ban) was the City of Berkeley. After Berkeley adopted its ordinance, it was challenged by the Restaurant Association in federal court raising preemption issues under the federal Energy Policy and Conservation Act (EPCA). The lower court held that the Restaurant Association’s claim under federal law was insufficient and the court dismissed the claim. The Restaurant Association then appealed that decision to the Ninth Circuit Court of Appeals (Cal. Rest. Ass’n v. City of Berkeley, 89 F.4th 1094 (9th Cir. 2024)). The Ninth Circuit Court of Appeals ruled that the Restaurant Association’s federal law claim was sufficient and held that Berkeley’s Ordinance was preempted by the EPCA. The EPCA expressly preempts state and local regulations concerning the energy use of appliances. (89 F.4th at 1102.) The Ninth Circuit held that the EPCA’s preemption clause supersedes state and local regulations, including building code requirements, that “relate” to the quantity of energy directly consumed by certain appliances at the place where those products are used. (89 F.4th at 1101.) A preemption clause that covers regulations on “energy use” “fairly encompasses an ordinance that effectively eliminates the ‘use’ of an energy source.” (89 F.4th at 1102.) -77-
Agenda Staff Report - Hillsborough City Council

Page 2 ends

The Ninth Circuit concluded that the EPCA preempted Berkeley’s ban because the Ordinance prohibited the onsite installation of natural gas infrastructure necessary to support covered natural gas appliances. (89 F.4th at 1101.) In other words, the EPCA preempts building codes like Berkeley's Ordinance that ban natural gas piping within new buildings because it prohibits the installation of necessary natural gas infrastructure on premises where covered appliances are used. (89 F.4th at 1102.)

The Ninth Circuit reasoned that the EPCA’s purpose was to ensure that states and localities “could not prevent consumers from using covered products in their homes, kitchens, and businesses.” (89 F.4th at 1103.) “Covered product” is defined as certain “consumer products,” such as refrigerators, dishwashers, and kitchen ovens, and includes direct heating equipment, water heaters, and clothes dryers. (42 U.S.C. §§ 6291(2), 6292.) The EPCA’s preemption clause therefore extends to regulations that both (i) directly address the covered products and (ii) affect the on-site infrastructure related to the use of those products. (Id.) ANALYSIS: In light of the above, components of the Town’s Ordinance are problematic and subject to preemption since the EPCA preemption broadly encompasses regulations that address covered products themselves and building codes that concern their use of natural gas. (See 89 F.4th at 1103.) While HMC section 15.10.050.F of the Town’s Ordinance only requires buildings plumbed for natural gas or propane clothes drying or cooking equipment to be electric-ready, as opposed to being completely prohibited from having natural gas infrastructure, both sections

15.10.050.D and 15.10.050.E expressly ban 1) systems using gas or propane space heating equipment, and 2) systems using gas or propane water heaters to serve new residences and structures. Those regulations arguably prohibit consumers from using certain natural gas and propane powered appliances (space heating equipment and water heaters) in newly constructed buildings, and would therefore be preempted due to the Ordinance’s manipulation of the building code for new construction to regulate the natural gas or propane consumption of those products when gas or propane service is otherwise available to premises where such products are used. (See 89 F.4th at 1101.)
As such, based on this recent case law and the preemption ruling, it is recommended that the City Council, by motion, direct staff to not enforce 15.10.050.D and 15.10.050.E and any other provision in the ordinance that would be considered a ban on natural gas or propane for covered appliances.

Town staff will work to bring back a revised ordinance to impose an electric ready option that would allow for both natural gas piping along with electrical outlets for all relevant appliances.

FISCAL IMPACT: There is no fiscal impact associated with this agenda item other than staff time associated with preparing the item and working in the near future to revise the Energy Reach Code Ordinance.

ENVIRONMENTAL ISSUES: The City Council’s direction to staff on this issue is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15061(b)(3) because it has no potential for resulting in a physical change to -78-

the environment. In the event that this item is found to be a project under CEQA, it is exempt from further environmental review pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility that the action approved may have a significant effect on the environment. In this circumstance, the proposed action would have no or only a de minimis effect on the environment by returning to the status quo of allowing for all new singlefamily residential construction to include gas or electrical components for various appliances on site.

ATTACHMENTS: Energy Reach Code Ordinance No. 783
PREPARED BY: Christopher J. Diaz, City Attorney
RECOMMENDATION: By motion, direct staff to not enforce provisions of the Town’s Energy Reach Code, Ordinance No. 783, that prohibit natural gas and propane piping in new construction for heating and water heating purposes, including 15.10.050.D and 15.10.050.E, and any other provision in the ordinance that would be considered a ban on natural gas or propane for covered appliances.

ORDINANCE NO. 783

ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF HILLSBOROUGH AMENDING TITLE 15 (BUILDINGS AND CONSTRUCTION) OF THE
HILLSBOROUGH MUNICIPAL CODE, CHAPTER 15.10 (ENERGY CODE), BY ADDING SECTION 15.10.050 (ENERGY REACH CODE) AND AMENDING BY REFERENCE THE 2019 CALIFORNIA ENERGY CODE (CALIFORNIA CODE OF REGULATIONS, TITLE 24, PART 6) AND FINDING THE ACTION TO BE EXEMPT

FROMCEQA
THE CITY COUNCIL OF THE TOWN OF HILLSBOROUGH DOES ORDAIN as follows:

WHEREAS, the Town of Hillsborough, California ("Town") is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, in 2019 the Town of Hillsborough Received a grant in the amount of $10,000 from Peninsula Clean Energy (PCE) to study the adoption of reach codes within the Town; and WHEREAS, at the April 12, 2020, City Council meeting staff presented an informative report to the City Council on the PCE grant and received direction from Council to research the feasibility of developing Town reach codes; and
WHEREAS, at the April 12, 2021, City Council meeting staff presented the findings of their research and requested guidance from the Council regarding which of three reach code models to pursue; and
WHEREAS, at the February 14, 2022 City Council meeting staff provided an informative update on the status of reach code development and requested further guidance on two additional code options; and
WHEREAS, the at the February 14, 2022 City Council meeting the Council indicated their desire to amend the Town's local regulatory scheme to adopt an All-Electric Preferred with Mixed Fuel Option Reach Code; and
WHEREAS, the Town of Hillsborough published notice of a public hearing for the adoption of the ordinance pursuant to California Government Code Section 6066 on March 25, 2022, and April 1, 2022; and
WHEREAS, at least one copy of the 2019 California Energy Code amended by this ordinance was available for public inspection at the office of the City Clerk fifteen (15) days preceding the public hearing pursuant to Government Code Section 50022.6; WHEREAS, the City Council held a duly noticed public hearing on April 11, 2022 to adopt an All Electric Preferred with Mixed Fuel Option Reach Code Ordinance; and WHEREAS, the California Building Standards Code, Title 24 of the California Code of Regulations, is updated every three years by the California Energy Commission (CEC) and the California Building Standards Commission (CBSC), and the most recent edition was published on -80-
July 1, 2019 and became effective throughout California on January 1, 2020; and WHEREAS, Part 6 of Title 24, called the California Energy Code, establishes energy standards for all new buildings constructed in California; and WHEREAS, California Health and Safety Code Section 17958.7 and 18941.5 authorize cities to adopt local modifications to the California Building Standards Code determined to be reasonably necessary because oflocal climatic, geological or topographical conditions; and WHEREAS, the City Council of the Town of Hillsborough finds and declares that there are distinct and unique characteristics of the Town of Hillsborough with regard to local climatic, geological, or topographical conditions which make it desirable for reasons of public health, safety, and welfare to adopt the provisions of this ordinance, which provide more stringent standards than those which would otherwise apply under the 2019 California Energy Code, Sections 100.0, 100.1, and 150.0. Specifically, the Town of Hillsborough finds as follows:

I. CLIMATIC CONDITIONS.

In the Town, normally the months of May through September have no rain and abundant sun, drying out the great quantities of vegetation present everywhere in Town and providing an extensive fuel source for fires. Seasonal climatic conditions in and around the Town create severe fire hazards to the public health and welfare. Reducing greenhouse gas (GHG) emissions associated with natural gas is necessary to reduce the Hillsborough's contribution to climate change, which is contributing to severe local climatic conditions.

II. GEOLOGICAL CONDITIONS.

The Town's western boundary is within a few miles of the San Andreas Fault, one of the major seismic faults running through California. An earthquake along the San Andreas Fault, or along any of the other numerous seismic faults elsewhere in the Bay Area, could break gas, electrical, and water lines, increasing the chance of fires and impairing the ability to fight them.

Reducing the reliance on natural gas in new construction will decrease the risk of fires caused when gas lines rupture or break in seismic-related events. Experts have cautioned that one or more major earthquakes in the Bay Area, affecting the whole region, are inevitable and will probably happen sometime within the next several decades.

III. TOPOGRAPHICAL CONDITIONS.

The Town's hilly topography, numerous cul-de-sacs, winding narrow roads, numerous canyons, high proportion of landscaped areas to hardscape areas within the developed portions of the Town, and substantial areas of open space with dense, natural vegetation all mean that there are substantial areas throughout Town where urban and wildland areas abut and which have the potential for fires that could spread quickly over a wide area and threaten many homes and inhabitants. Reducing the reliance on natural gas in new construction is necessary to reduce the Hillsborough's contribution to climate change and increased risks of fires. -81-
WHEREAS, the City Council has reviewed and considered the public testimony and agenda reports prepared in connection with this ordinance, including the policy considerations discussed therein; and
NOW, THEREFORE, the City Council of the Town of Hillsborough does ordain as follows:

Section 1. The recitals above are each incorporated by reference and adopted as findings by the City Council.

Section 2. The adoption of the ordinance is not a project under the requirements of the California Environmental Quality Act, together with related State CEQA Guidelines ( collectively, "CEQA") because it has no potential for resulting in a physical change to the environment. In the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility that the action approved may have a significant effect on the environment. In this circumstance, the proposed action would have no or only a de minimis effect on the environment by requiring all new single-family residential construction to implement electric space heating and electric water heating appliances, unless the project meets the performance-based requirements in the Energy Code. The Ordinance is also exempt from CEQA under CEQA Guidelines section 15308, because it is a regulatory action for the protection of the environment to reduce greenhouse gas emissions.

Section 3. Chapter 15.10 (Energy Code) of Title 15 (Buildings and Construction) of the Hillsborough Municipal Code, is hereby amended to add Section 15.10.050 ("Energy Reach Code") as set forth in Exhibit A, attached hereto and incorporated herein by reference.

Section 4. This ordinance shall take effect 30 days following its adoption.

Section 5. No less than five days prior to the adoption of this Ordinance, the City Clerk published a summary of this Ordinance in accordance with Government Code section 36933. The City Clerk will certify to the passage of this Ordinance by the City Council of the Town of Hillsborough, California, and cause a summary to be published once within fifteen (15) days after its adoption in accordance with Government Code section 36933.

Section 6. The City Council hereby directs staff to prepare, execute and file with the San Mateo County Clerk a Notice of Exemption within five working days of first reading of this ordinance.

Section 7. If any provision of this ordinance or its application to any person or circumstance is held to be invalid, such invalidity has no effect on the other provisions or applications of the ordinance that can be given effect without the invalid provision or application, and to this extent, the provisions of this ordinance are severable. The City Council declares that it would have adopted this ordinance irrespective of the invalidity of any portion thereof. -82-
Section 9. The documents and materials that constitute the record of proceedings on which this Ordinance and the above findings have been based are located at 1600 Floribunda A venue, Hillsborough, California, in the City Clerk Department.

Section 10. The Building Official is directed to file a copy of this ordinance with the California Building Standards Commission and the State Department of Housing and Community Development or other state agencies required by law.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ACCEPTING TWO (2) FIVE-FOOT-WIDE PUBLIC UTILITY EASEMENTS PURSUANT TO HILLSBOROUGH MUNICIPAL CODE CHAPTER 16.36 RELATING TO LOT LINE ADJUSTMENTS FOR 260 ROBIN ROAD, 280 ROBIN ROAD, 1430 SAN RAYMUNDO ROAD AND 1440 SAN RAYMUNDO ROAD PURSUANT TO CEQA GUIDELINE 15061(b)(3), 15304 AND 15305
SUMMARY: The owners of 260 Robin Road, 280 Robin Road, 1430 San Raymundo Road, and 1440 San Raymundo Road submitted a lot line adjustment application under Hillsborough Municipal Code Chapter 16.36 related to lot line adjustments. The lot line adjustment application is to correct a discrepancy which affects each property’s boundary lines. The discrepancy is in the recorded documentation associated with nearby survey monuments located on Robin Road and San Raymundo Road. Depending on which monument is referenced, the location of the property line could be off by as much as five and a half feet. To correct the discrepancies, the owners are proposing minor adjustments to the property lines of all four properties, and a parcel map to memorialize the correction. The changes to the lot lines are minor and no significant physical improvements can be made due to the minor changes in property lines.

During review, it was determined the existing public utility easement between 1430 and 1440 San Raymundo Road conflicts with existing private property structures, such as a garage and house.

This easement may contain existing public utilities, but it would not be suitable for new future utilities. The two San Raymundo Road property owners have offered to dedicate a new five-footwide public utility easement along each side of the property line, consistent with the Town’s current subdivision standards. The new easements would allow the Town to install new public utilities, if needed, without impacting an existing garage or house structure. No other easements are proposed to be dedicated or abandoned at this time, and no construction is proposed as part of this agenda item.

Consistent with the Hillsborough Municipal Code (HMC) section 16.36.050 the City Engineer cannot approve the lot line adjustment until the City Council accepts the proposed two five-footwide public utility easements at a public hearing. Staff has noticed this public hearing consistent with the requirements of Hillsborough Municipal Code Sections 16.36.050 and 16.20.040 that generally requires a Type A notice providing notice to all residents within 500 feet. Should the City Council choose to accept the dedication of easements, they will be included in the parcel map for the lot line adjustment that is within the authority of the City Engineer to approve.

The City Engineer has reviewed the lot line adjustment that is being processed via a parcel map and tentatively plans to approve the lot line adjustment contingent on City Council’s acceptance of the easement dedication. The City Engineer believes the lot line adjustment can be approved as -87-

the findings required for a lot line adjustment under Hillsborough Municipal Code 16.36.050(C) can be met that require the following:
• The lots that will result from the proposed lot line adjustment conform to the general plan and all the applicable zoning and building ordinances in effect and comply with the provisions of this title pertaining to or affected by the size, shape, dimensions, or location of lots in subdivisions for which tentative and final maps are required;
• The proposed lot line adjustment will not be detrimental to the health, safety, or general welfare of the town or its inhabitants.

The lot line adjustment conforms with the following General Plan policies:
• Policy LU-2.2: Continue to review new development proposals to ensure that they do not overwhelm their sites or their neighborhood. The proposed lot line adjustments would not overwhelm their sites of their neighborhoods should new development be proposed. • Policy LU-2.3: Continue to minimize land use conflicts within the Town where possible. There are no land use conflicts associated with the lot line adjustment. • Policy LU-5.1: Review any proposed dedication to the Town of new recreational or other facilities to ensure that the dedication will provide benefits to the community and not create substantial burdens for Hillsborough. The public utility easements offered for dedication would benefit the community by providing a means to enhance future public utility service, without creating substantial burdens for Hillsborough.

The lot line adjustment conforms to the following Hillsborough Municipal Code sections, which include applicable zoning and building ordinances:
• HMC 17.24 – Required Setback Areas, HMC 17.32 – Residential structure size and lot coverage.

With the adjusted lot lines, the existing homes on al properties comply with the setback requirements and floor area ratios
• HMC 16.08 – Minimum Lot Size and Frontage, HMC 16.12 Hillside Lot Size. All four affected lots comply with the minimum lot shape and size requirements and recommendations of the city engineer.

No construction is proposed as part of this item so no building ordinances are applicable. The minor changes to the lot lines are considered insignificant and will not be detrimental to the health, safety, or general welfare of the town or its inhabitants.

No public comment letters for this item were received before 5:00 p.m. on Wednesday, June 5, 2024. Any written public comment received after 5:00 p.m. on Wednesday, June 5, 2024 and prior to 4:00 p.m. on Monday, June 10, 2024 will be emailed to the City Council and posted on the Town website.

FISCAL IMPACT: There is no fiscal impact associated with this agenda item. -88-

ENVIRONMENTAL ISSUES: The project has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15061(b)(3) as this action is more akin to a correction on paper to fix a minor property boundary issue. No actual physical changes are being proposed as all lots are built out and with this minor change in property boundaries, no new construction can occur. In the alternative, this action is also exempt pursuant to CEQA Guideline 15304 as this action will result in a minor change in the land at least with regard to property boundaries and CEQA exempts this type of action from environmental review. Finally, this action is also exempt pursuant to CEQA Guideline 15305 that acknowledges minor property line adjustments are authorized by this exemption.

Hillsborough, CA 94010

CITY COUNCIL MEETING
JUNE 10, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ADOPTING THE FY 2024-25 PROPOSED OPERATING AND CAPITAL BUDGET PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Town’s Proposed Operating and Capital Budget for Fiscal Year (FY) 2024-25 is $75.9 million for all funds, a decrease of 4% from the FY 2023-24 projection. The decrease is primarily due to the timing of capital project spending.

The Proposed Budget complies with the Town’s policies and guidelines. In addition, the General Fund, Water and Sewer Enterprise Funds, and the Asset Replacement Fund reserves comply with Town reserve policies and debt covenants.

A key factor in setting the FY 2024-25 budget is the stability of the property tax assessment roll.

Property tax, the Town’s largest General Fund revenue source, is projected to grow 4% based on the FY 2024-25 tax assessment roll. In-lieu Vehicle License Fees (VLF) revenue presents a risk to FY 2024-25 revenues and is budgeted using the latest estimates.

The City Council goal-setting session identified and prioritized the goals for the coming year. Many of the goals are long-term projects that will continue in future years. In FY 2024-25, the Town will continue focusing on implementing the policies and programs for the adopted Housing Element.

GENERAL FUND
The General Fund is the primary fund and accounts for the direct services that the Town provides to its citizens. The General Fund budget includes funding for key services such as public safety and recreation through the Hillsborough City School District (HRec), building and planning services, general government, and contributions to Burlingame and San Mateo libraries for Hillsborough residents to use.

The FY 2024-25 General Fund expenditures net of transfers is $35.3 million, an increase of $1.7 million (5%) over the FY 2023-24 projection. The increase is primarily due to salary and CalPERS cost increases, three new headcount additions, a Central County Fire Department JPA contribution, and one-time project funding. FY 2024-25 General Fund revenues are projected to be $36.0 million, a $0.4 million (1%) increase, primarily from property taxes, offset by non-recurring one-time revenues received in FY 2023-24.

The FY 2024-25 General Fund proposed budget reflects a net draw on General Fund reserves of $0.1 million.

GENERAL FUND RESERVE
-97-
Agenda Staff Report - Hillsborough City Council
June 10, 2024

Page 2 ends

The FY 2024-25 Proposed Budget reflects a $30.7 million General Fund reserve maintained for contingencies per policy and other programs. To balance the financial picture, the Town also has long-term pension liabilities of $36.1 million and other post-employment benefits liabilities of $9.9 million.

The Town’s General Fund Reserve Policy states that a minimum of 30% with a goal of 50% of expenditures should be reserved for contingencies such as a natural disaster, economic downturn, state revenue takeaways, pandemic, or other significant fiscal impact. The contingency reserve is projected to total $18 million in the FY 2024-25 budget. The General Fund reserve categories are proposed as follow for FY 2024-25:
• Contingency reserve at policy level – 30% minimum reserve – $10.8 million. • Contingency reserve – up to 50% – $7.2 million.
• Restricted reserve- Section 115 pension trust (General Fund portion) – held to mitigate the future budget impact for the cost of pension liabilities - $5.0 million. • Assigned for capital – storm drain and tree replacement - $2.7 million. • Assigned for the Highline Water Project – $5.0 million.

WATER AND SEWER ENTERPRISE FUNDS
The Water and Sewer Enterprise Funds are funded primarily from user rates and reserves.

Water Fund
The FY 2024-25 Water Fund revenue is projected at $17.2 million, a $1.0 million (6.2%) increase over the FY 2023-24 primarily attributable to an average 5% rate increase effective January 1, 2025. The Town monitors water revenue throughout the year.

The Water Fund expenses net of transfers is $17.9 million, a $0.8 million (-4%) decrease over the FY 2023-24 projection. The budget reflects water usage at a similar level as FY 2023-24 and a San Francisco Public Utilities Commission (SFPUC) wholesale water rate increase of 6.5% for FY 2024-25 ($5.55 v. $5.21 per ccf.). The expense increase is primarily attributable to increases in cost-of-living salary and benefits and SFPUC rate increase, somewhat offset by a decrease in capital improvements from the prior year due to planned project timing. The proposed Water Fund budget shows a draw on reserves of $0.8 million.

Sewer Fund
The FY 2024-25 Sewer Fund revenue is projected at $16.8 million, a $1.2 million (-6.6%) decrease over the FY 2023-24 projection primarily due to no General Fund transfer for storm drain capital in the proposed budget. (Sewer revenue, excluding transfer in the prior year, is increasing by $0.6 million, 3.8%). Prior year reserves fund the storm drain capital. A proposed 4% rate increase is effective July 1, 2024, as outlined in the adopted five-year sewer rate series.

The FY 2024-25 Sewer Fund expense net of transfers is $19.9 million, a $1.7 million (9%) increase over the FY 2023-24 projection, primarily due to higher capital improvement spending.

The proposed Sewer Fund budget reflects a net draw of $3.7 million in reserves, primarily attributable to capital improvements. This is consistent with the adopted sewer rate study findings, which show that the reserves will be drawn upon in the early years and hit the target level by year five of the rate series.

FY 2024-25 CAPITAL PLAN
The FY 2024-25 Proposed Budget funds $9.9 million in capital improvement projects (CIP) and $2.5 million in asset replacements and transfers to the Capital Fund that will be used to improve infrastructure and maintain the Town’s assets.
• Storm Drains - Storm drain replacements will improve system dependability in wet weather conditions.
• Water Main Replacement - Aging water pipes will be replaced to improve longevity, water quality, and water pressure to meet fire flow requirements and earthquake resistance. • Highline Water Project - Included in the Five-Year CIP Plan is the Town’s share of the Highline Water Project, totaling $6.5 million. The total project cost is $32 million, and the Town is the lead agency on the project. The project will provide a reliable, cost-effective water line at a higher elevation tied to the Harry Tracy plant, protect health and safety in a natural disaster, and result in operational savings in future years. The town is nearing final approval for federal grant funding, and the project funding will also include contributions from partner cities, debt, and other funding opportunities. In addition, $5 million of the General Fund reserve is recommended (and is included in the proposed budget reserve above) to be “Assigned” to this project for contingency and held until the project’s completion.
• Sewer Priority Basins - Sewer system improvements will reduce overflows and improve the longevity of the pipes. Priority Basin replacement is also essential for the sewer system to mitigate sewer system overflows.
• Parkside Culvert - The existing culvert has deteriorated and has several structural deficiencies, which could render the roadway unusable and unsafe if allowed to continue. This project will replace the culvert and improve the roadway on Parkside Avenue. Federal funds will likely fund 70% of the cost of the project.
• Shady Lane Storm Drain – The project involves installing new storm drain infrastructure on Shady Lane to reduce localized flooding and protect against roadway erosion. • Facilities - The budget funds an upgrade of the Town Hall Little House to increase office space for personnel.
• Vehicles/Equipment -Vehicles and equipment that are deteriorating, have exceeded their useful service life, and/or have high maintenance costs will be replaced. The proposed items in FY 2024- 25 are three police vehicles, the addition of one street sweeper, and one dump truck for street operations.

PROCESS
The budget process starts with the City Council's goal-setting public meeting each year. These goals and business plans set the priorities for the coming year and are incorporated into the budget proposal. Staff develop the line-item budgets for each department and fund, and the -99-

management team creates the proposed spending plan, which is then reviewed and approved in several public meetings before the public hearing and adoption.

The Proposed FY 2024-25 Budget was presented to the Financial Advisory Committee (FAC) for review and discussion at the April 29, 2024, meeting. The FAC recommended the Proposed Budget without further consideration.

The City Council reviewed the Proposed FY 2024-25 Budget in detail at the Budget Study Session public meeting on May 13, 2024.

FISCAL IMPACT: The Proposed FY 2024-25 budget provides for total spending of $75.9 million in all funds and is supported by general fund revenues, primarily property taxes, special safety tax, and other fees and charges, user rates for water and sewer, and reserves.

ENVIRONMENTAL ISSUES: The consideration of this item is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guideline 15378(b) as a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact, or as an administrative activity that will not result in direct or indirect physical changes in the environment. Any items or projects funded through the budget are not a commitment to any project, but instead, any such projects will undergo their own analysis and potential approval in the future.
