FY 23/24 spending is consistent with FY 22/23 spending.

Capital project spending in June 2024 is primarily for Priority Basin Project, Darrell Tank Improvement, Storm Drain repairs, and Sewer Vactor Truck purchase.

In June 2023, the Revenue Refunding Bond Series 2023 was issued to refinance the Town's FY 23/24 contribution is based on budget/contract.

There was an SFPUC wholesale water rate increase on July 1, 2023 to $5.21 (from $4.75, a 9.6 % increase). The increase in FY 23/24 as compared to FY 22/23 is attributed to the SFPUC rate increase, as well as higher units purchased.

CITY COUNCIL MEETING
JULY 8, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPOINTING ONE MEMBER TO THE FINANCIAL ADVISORY COMMITTEE FOR A PARTIAL TERM JULY 9, 2024 THROUGH DECEMBER 31, 2024 AND TO A FULL THREE-YEAR TERM JANUARY 1, 2025 THROUGH DECEMBER 31, 2027 PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Town has four Council-appointed boards and committees that serve in an advisory capacity to the City Council on a volunteer basis: the Administrative Hearing Panel, Architecture and Design Review Board (ADRB), Citizens Communications Advisory Committee and Financial Advisory Committee. The term length is three years, with staggered terms expiring December 31st of each year. The City Council makes appointments annually to fill expiring terms and may also appoint applicants to fill unexpected vacancies for partial terms as necessary throughout the year.

A vacancy exists on the ADRB in the Alternate seat due to the resignation of Zach Hulsey in January 2024 for a term ending December 31, 2026, and a vacancy exists on the Financial Advisory Committee due to the resignation of Catherine Lee in April 2024 for a term ending December 31, 2024.

The Town conducted a recruitment beginning April 22, 2024 with a deadline of 12 p.m. on Friday, May 24, 2024. Recruitment efforts included posting of the notice on Town bulletin boards, at Hillsborough schools, on the Town website, on San Mateo and Burlingame Library bulletin boards and inclusion in weekly e-announcements. Following the application deadline, no applications were received for the ADRB. Three applications were received for the Financial Advisory Committee.

The Finance Commissioner and staff liaison conducted applicant interviews and discussed recommendations for appointments. Michael Quackenbush is recommended for appointment to the partial term through December 31, 2024 and to the full term of January 1, 2025 through December 31, 2027. Appointing Mr. Quackenbush to the full term in addition to the approximately five month partial term will provided administrative efficiencies for the candidate in the recruitment process that will begin in approximately September for the full term.

If the City Council prefers to appoint only to the partial term at this time, the resolution can be modified and read into the record for approval at the meeting.

The continuing vacancy in the Alternate seat on the ADRB will be included in an upcoming recruitment.

FISCAL IMPACT: There is no fiscal impact associated with this agenda item. -23-

I am writing to express my interest in joining the Financial Advisory Committee (FAC).

I have been a Town resident now for over 5 years. During that time, I have thought about trying to volunteer within my community to help the Town in any way I can. When I saw the FAC opening recently, I thought my almost 40 years of experience as a CPA in the audit and assurance industry might be put to good use. As my career begins to wind down volunteer work is becoming a higher priority for me. I believe I would be an excellent fit for the FAC as I have served on other non-profit boards during my career and I would hope to bring some of the knowledge I have accumulated to the FAC.

Your consideration would be greatly appreciated.

CITY COUNCIL MEETING
JULY 8, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION AWARDING TO AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH GALLAGHER BENEFIT SERVICES, INC. FOR A CLASSIFICATION AND COMPENSATION STUDY IN THE AMOUNT OF $98,000.00, PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Town of Hillsborough developed a Request for Proposal (RFP), as required by the Town’s Purchasing Policy, inviting consultants to submit proposals to conduct a comprehensive classification and compensation study of the Town’s full-time positions. The RFP was advertised on the Town’s website, and staff also contacted nine consultants that have provided similar services to many of the area’s municipal agencies.

The proposed comprehensive classification and compensation study will review current job classifications and recommend updates that will ensure compliance with modern practices, incorporate technological advances and update language. The study will also identify potential career growth paths, review minimum requirements and evaluate hierarchical consistency. The study will also review and recommend a benchmarking procedure for the Town’s positions so that the positions are competitively aligned with the external labor market.

The Town received seven (7) proposals in response to the RFP. After a detailed review of the proposals and interviews with three firms, the Town has selected Gallagher Benefit Services, Inc., formerly known as Koff & Associates, as the preferred consultant to carry out the study based on their project experience and methodology. The selection of this consultant is based on qualitative factors and is not subject to low bid.

FISCAL IMPACT: Staff has carefully reviewed Gallagher’s fee proposal and has determined that the cost of $98,000.00 is reasonable. The fiscal year 2024-25 Adopted Budget included an estimated cost of $80,000.00 for the classification portion of the study. After thorough review, staff would also like to include the compensation analysis that was recommended in Gallagher’s proposal. This additional compensation analysis will exceed the $80,000.00 included in the FY 2024-25 Adopted Budget. At this time, there are sufficient funds in the General Fund budget to accommodate this remaining $18,000.00. Staff will track the budget throughout the year, and if needed, will bring forward a budget amendment for consideration at a later date.

ENVIRONMENTAL ISSUES: The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.

The policy must “pay on behalf of” the insured and must include a provision establishing the insurer's duty to defend. e. Minimum Policy Limits Required
(i) The following insurance limits are required for the Agreement:

Combined Single Limit
Commercial General Liability $2,000,000 per occurrence/ $2,000,000 aggregate for bodily injury, personal injury, and property
damage
Automobile Liability $2,000,000 per occurrence for bodily injury and property damage
Employer’s Liability $2,000,000 per occurrence
Professional Liability $2,000,000 per claim and aggregate (errors and omissions)
(ii) Defense costs shall be payable in addition to the limits. (iii) Requirements of specific coverage or limits contained in this section are not intended as a limitation on coverage, limits, or other requirement, or a waiver of any coverage normally provided by any insurance. Any available coverage shall be provided to the parties required to be named as Additional Insured pursuant to this Agreement. f. Evidence Required
Prior to execution of the Agreement, the Consultant shall file with the Town evidence of insurance from an insurer or insurers certifying to the coverage of all insurance required herein. Such evidence shall include original copies of the ISO CG 00 01 (or insurer’s -38-
6 equivalent) signed by the insurer’s representative and Certificate of Insurance (Acord Form 25- S or equivalent), together with required endorsements. All evidence of insurance shall be signed by a properly authorized officer, agent, or qualified representative of the insurer and shall certify the names of the insured, any additional insureds, where appropriate, the type and amount of the insurance, the location and operations to which the insurance applies, and the expiration date of such insurance.
g. Policy Provisions Required
(i) Consultant shall provide the Town at least thirty (30) days prior written notice of cancellation of any policy required by this Agreement, except that the Consultant shall provide at least ten (10) days prior written notice of cancellation of any such policy due to non-payment of premium. If any of the required coverage is cancelled or expires during the term of this Agreement, the Consultant shall deliver renewal certificate(s) including the General Liability Additional Insured Endorsement to the Town at least ten (10) days prior to the effective date of cancellation or expiration.
(ii) The Commercial General Liability Policy and Automobile Policy shall each contain a provision stating that Consultant’s policy is primary insurance and that any insurance, self-insurance or other coverage maintained by the Town or any named insureds shall not be called upon to contribute to any loss.
(iii) The retroactive date (if any) of each policy is to be no later than the effective date of this Agreement. Consultant shall maintain such coverage continuously for a period of at least three years after the completion of the work under this Agreement. Consultant shall purchase a one (1) year extended reporting period A) if the retroactive date is advanced past the effective date of this Agreement; B) if the policy is cancelled or not renewed; or C) if the policy is replaced by another claims-made policy with a retroactive date subsequent to the effective date of this Agreement.
(iv) All required insurance coverages, except for the professional liability coverage, shall contain or be endorsed to provide a waiver of subrogation in favor of the Town, its officials, officers, employees, agents, and volunteers or shall specifically allow Consultant or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. Consultant hereby waives its own right of recovery against Town, and shall require similar written express waivers and insurance clauses from each of its subconsultants.
(v) The limits set forth herein shall apply separately to each insured against whom claims are made or suits are brought, except with respect to the limits of liability.

Further the limits set forth herein shall not be construed to relieve the Consultant from liability in excess of such coverage, nor shall it limit the Consultant’s indemnification obligations to the Town and shall not preclude the Town from taking such other actions available to the Town under other provisions of the Agreement or law.
h. Qualifying Insurers
(i) All policies required shall be issued by acceptable insurance companies, as determined by the Town, which satisfy the following minimum requirements:
-39-
7 (1) Each such policy shall be from a company or companies with a current A.M. Best's rating of no less than A:VII and admitted to transact in the business of insurance in the State of California, or otherwise allowed to place insurance through surplus line brokers under applicable provisions of the California Insurance Code or any federal law.
i. Additional Insurance Provisions
(i) The foregoing requirements as to the types and limits of insurance coverage to be maintained by Consultant, and any approval of said insurance by the Town, is not intended to and shall not in any manner limit or qualify the liabilities and obligations otherwise assumed by the Consultant pursuant to this Agreement, including but not limited to, the provisions concerning indemnification.
(ii) If at any time during the life of the Agreement, any policy of insurance required under this Agreement does not comply with these specifications or is canceled and not replaced, Town has the right but not the duty to obtain the insurance it deems necessary and any premium paid by Town will be promptly reimbursed by Consultant or Town will withhold amounts sufficient to pay premium from Consultant payments. In the alternative, Town may cancel this Agreement.
(iii) The Town may require the Consultant to provide complete copies of all insurance policies in effect for the duration of the Project. (iv) Neither the Town nor any of its officials, officers, employees, agents or volunteers shall be personally responsible for any liability arising under or by virtue of this Agreement.
j. Subconsultant Insurance Requirements. Consultant shall not allow any subcontractors or subconsultants to commence work on any subcontract until they have provided evidence satisfactory to the Town that they have secured all insurance required under this section. Policies of commercial general liability insurance provided by such subcontractors or subconsultants shall be endorsed to name the Town as an additional insured using ISO form CG 20 38 04 13 or an endorsement providing the exact same coverage. If requested by Consultant, Town may approve different scopes or minimum limits of insurance for particular subcontractors or subconsultants.

12. Indemnification.
a. To the fullest extent permitted by law, Consultant shall defend (with counsel of Town’s choosing), indemnify and hold the Town, its officials, officers, employees, volunteers, and agents free and harmless from any and all claims, demands, causes of action, costs, expenses, liability, loss, damage or injury of any kind, in law or equity, to property or persons, including wrongful death, in any manner arising out of, pertaining to, or incident to any acts, errors or omissions, or willful misconduct of Consultant, its officials, officers, employees, subcontractors, consultants or agents in connection with the performance of the Consultant’s services, the Project or this Agreement, including without limitation the payment of all damages, expert witness fees and attorney’s fees and other related costs and expenses except such loss or damage caused by the sole negligence or willful misconduct of the Town. Consultant's obligation to indemnify shall survive expiration or termination of this Agreement and shall not be restricted to insurance -40-
8 proceeds, if any, received by Consultant, the Town, its officials, officers, employees, agents, or volunteers.
b. If Consultant’s obligation to defend, indemnify, and/or hold harmless arises out of Consultant’s performance as a “design professional” (as that term is defined under Civil Code section 2782.8), then, and only to the extent required by Civil Code section 2782.8, which is fully incorporated herein, Consultant’s indemnification obligation shall be limited to claims that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the Consultant, and, upon Consultant obtaining a final adjudication by a court of competent jurisdiction, Consultant’s liability for such claim, including the cost to defend, shall not exceed the Consultant’s proportionate percentage of fault.

13. California Labor Code Requirements.
a. Consultant is aware of the requirements of California Labor Code Sections 1720 et seq. and 1770 et seq., as well as California Code of Regulations, Title 8, Section 16000, et seq., which require the payment of prevailing wage rates and the performance of other requirements on certain “public works” and “maintenance” projects (“Prevailing Wage Laws”). If the services are being performed as part of an applicable “public works” or “maintenance” project, as defined by the Prevailing Wage Laws, and if the total compensation is $1,000 or more, Consultant agrees to fully comply with such Prevailing Wage Laws. Consultant shall defend, indemnify and hold the Town, its officials, officers, employees and agents free and harmless from any claims, liabilities, costs, penalties or interest arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. It shall be mandatory upon the Consultant and all subconsultants to comply with all California Labor Code provisions, which include but are not limited to prevailing wages (Labor Code Sections 1771, 1774 and 1775), employment of apprentices (Labor Code Section 1777.5), certified payroll records (Labor Code Sections 1771.4 and 1776), hours of labor (Labor Code Sections 1813 and 1815) and debarment of contractors and subcontractors (Labor Code Section 1777.1). The requirement to submit certified payroll records directly to the Labor Commissioner under Labor Code section 1771.4 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Section 1771.4.
b. If the services are being performed as part of an applicable “public works” or “maintenance” project, then pursuant to Labor Code Sections 1725.5 and 1771.1, the Consultant and all subconsultants performing such services must be registered with the Department of Industrial Relations. Consultant shall maintain registration for the duration of the Project and require the same of any subconsultants, as applicable. Notwithstanding the foregoing, the contractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Sections 1725.5 and 1771.1. c. This Agreement may also be subject to compliance monitoring and enforcement by the Department of Industrial Relations. It shall be Consultant’s sole responsibility to comply with all applicable registration and labor compliance requirements. Any stop orders issued by the Department of Industrial Relations against Consultant or any subcontractor that affect Consultant’s performance of services, including any delay, shall be Consultant’s sole responsibility. Any delay arising out of or resulting from such stop orders shall be considered Consultant caused delay and shall not be compensable by the Town. Consultant shall defend, indemnify and hold the Town, its officials, officers, employees and agents free and harmless from -41-
9 any claim or liability arising out of stop orders issued by the Department of Industrial Relations against Consultant or any subcontractor.

14. Verification of Employment Eligibility.

By executing this Agreement, Consultant verifies that it fully complies with all requirements and restrictions of state and federal law respecting the employment of undocumented aliens, including, but not limited to, the Immigration Reform and Control Act of 1986, as may be amended from time to time, and shall require all subconsultants and sub-subconsultants to comply with the same.

15. Reserved.

16. Laws and Venue.

This Agreement shall be interpreted in accordance with the laws of the State of California.

If any action is brought to interpret or enforce any term of this Agreement, the action shall be brought in a state or federal court situated in the County of San Mateo, State of California. 17 Termination or Abandonment.
a. Town has the right to terminate or abandon any portion or all of the work under this Agreement by giving ten (10) calendar days written notice to Consultant. In such event, Town shall be immediately given title and possession to all original field notes, drawings and specifications, written reports and other documents produced or developed for that portion of the work completed and/or being abandoned. Town shall pay Consultant the reasonable value of services rendered for any portion of the work completed prior to termination. If said termination occurs prior to completion of any task for the Project for which a payment request has not been received, the charge for services performed during such task shall be the reasonable value of such services, based on an amount mutually agreed to by Town and Consultant of the portion of such task completed but not paid prior to said termination. Town shall not be liable for any costs other than the charges or portions thereof which are specified herein. Consultant shall not be entitled to payment for unperformed services, and shall not be entitled to damages or compensation for termination of work.
b. Consultant may terminate its obligation to provide further services under this Agreement upon thirty (30) calendar days’ written notice to Town only in the event of substantial failure by Town to perform in accordance with the terms of this Agreement through no fault of Consultant.
18 Documents.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE AN AGREEMENT FOR PROFESSIONAL SERVICES WITH OSMOSE UTILITY SERVICES, INC. FOR THE GIS ASSET VERIFICATION AND LOCATING PROJECT IN THE AMOUNT OF $298,494.00 PURSUANT TO CEQA GUIDELINE 15301
SUMMARY: The Town has existing Geographic Information System (“GIS”) data that contains location and attribute information about assets in Town, including water assets, storm assets, and sanitary sewer assets. The existing GIS data, while comprehensive, often has inaccurate location information. The Town desires to hire a firm to survey and collect location and descriptive information for Town assets, covering approximately 4,300 water meters, 2,700 water valves, 1,000 hydrants, 3,000 sewer manholes and cleanouts, 1,170 storm catch basins, 325 storm outlet structures, 200 storm manholes, 130 storm inlet structures, and 50 storm trash racks as part of the survey. The objectives of this project are to improve the precision of existing Town assets, discover and catalog any Town assets that are not currently in the Town GIS data, and collect photos and attribute information about the surveyed Town assets. When completed, this project will provide staff with more consistently accurate data and support management of Town assets.

The need to modernize, and improve the precision of the GIS system was identified as a priority to properly identify assets which can reduce staff time in maintenance, emergencies, and future designs. Staff issued a Request for Proposal (“RFP”) for professional consulting services to undertake the work of surveying Town assets. The RFP was advertised through the Town website, and staff also directly contacted firms that perform this type of work. Staff received two proposals, one from Forester’s Co-Op and one from Osmose Utility Services, Inc. After a detailed review, both firms were invited to interview. After careful evaluation by the staff panel, staff identified Osmose Utility Services, Inc. as the preferred consultant based on their experience, technical methodology and approach, and understanding of the scope of work.

FISCAL IMPACT: After careful review of the cost proposal, staff and Osmose Utility Services, Inc. negotiated the total not-to-exceed project amount to $298,494.00. It is recommended funding in the amount of $298,494.00 be allocated from and split equally between the approved Fiscal Year 2024-25 Streets and Stormwater, Sewer, and Water Division Operations budgets. Sufficient funding remains in the budgets for this project.

ENVIRONMENTAL ISSUES: This project is exempt from the California Environmental Quality Act (CEQA) per Section 15301 of the California Code of Regulations.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE AN AMENDMENT TO THE EXISTING AGREEMENT WITH HAZEN AND SAWYER, INC. FOR WATER SERVICE LINE INVENTORY SERVICES IN THE AMOUNT OF $81,640.00, FOR A TOTAL AGREEMENT AMOUNT OF $181,120.00, PURSUANT TO CEQA GUIDELINE 15301
SUMMARY: On November 11, 2023, City Council authorized the City Manager to execute an agreement with Hazen and Sawyer, Inc. (Hazen) in the amount of $99,480.00 to conduct a water service line material inventory (Inventory), as required by the United States Environmental Protection Agency published revisions to the Lead and Copper Rule. Hazen worked with Hillsborough staff to collect and review all available Town records, including San Mateo County Tax Assessor databases and codes, Hillsborough policy records and codes, building and planning permit records and codes, capital improvement project records, engineering specifications and records, water operation work orders, water staff interviews, etc. They used this thorough review of records to create a database to identify water service line material type for every water service line in the Town of Hillsborough (8,400 public and private water service lines).

Unfortunately, there were significant gaps in Hillsborough’s available record set that resulted in a large number of Hillsborough water service lines being designated as “unknown material”. In order to improve the findings of the records analysis, it is recommended that a California Department of Drinking Water (DDW) approved water service line statistical analysis be performed. The statistical analysis will use field verification techniques to physically identify water service line materials for a statistically valid number of service lines (approximately 400) with “unknown” material designation.

Should the initial number of service lines be inconclusive, an additional 150 “unknown” water service lines would be field investigated (This is an optional task).

Hazen has provided a quote for service in the amount of $81,640.00 to conduct the field service line verifications and the statistical analysis ($59,220.00 for 400 service lines and $22,420.00 for an additional 150 service lines, if needed). The results of the field service verifications and analysis will be incorporated into the Town’s Inventory and the Inventory will be submitted to DDW by the October 16, 2024 regulatory deadline.

FISCAL IMPACT: The cost of the proposed additional services is $81,640.00, which is in addition to the previously authorized contract sum of $99,480.00, for a total cost of $181,120.00. It is recommended that funding be allocated from the FY 2024-25 water operations budget in the amount of $81,640.00. Sufficient funding remains in the budget for this project. -55-

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH DEBORAH YACOBELLIS, PERMIT SOFTWARE UPGRADE CONSULTANT, IN A NOT-TOEXCEED AMOUNT OF $100,000.00, PURSUANT TO CEQA GUIDELINE 15378 SUMMARY: The Building & Planning Department, which manages the Town-wide permit services platform and is overseeing the upgrade migration to a new cloud-based version of the software, is requesting an amendment to its professional service agreement with Deborah Yacobellis (“consultant”) for increased scope of services and assistance on the upgrade migration of TRAKiT.net to Community Development.

The Town has launched a new permitting and business licensing platform and is undergoing system configuration to optimize the system’s use. CentralSquare owns and supports the permit service platform Community Development, the newer cloud-based version of the Town’s most recent platform TRAKiT.net. Their service contract included data migration and some guidance on improvements.

While the Community Development contract included some workflow analysis and process optimization, staff desired more personalized evaluation of their system and process needs, and assistance in managing the relationship with Central Square and the technical aspects of a software upgrade. In consultation with other jurisdictions migrating to the Community Development platform, it became evident of the benefit to obtain an independent consultant to configure the system and define workflow and processes, all with the goal to improve internal staff efficiencies and the external customer experience.

After a review of proposals, the Town procured consulting services from the consultant, as approved by the City Manager for the estimated consulting cost of $20,000.00.

The consultant has 20 years of experience in software design, engineering, and implementation, with additional expertise in system optimization and project management, and over 17 years of experience providing consulting services to municipalities in the system and process evaluation and improvement. Current contracts include the jurisdictions of Burlingame, Mill Valley, Tiburon, and San Anselmo. She offers a hands-on and accessible approach, and has intimate knowledge of the construction review and permitting process from both the jurisdiction side and customer-facing user experience.

The initial contract was intended to allow for an analysis by the consultant of the current status of the project and make what were thought to be minor improvements to the progress. Upon review -63-

of the configuration, training, and implementation needs for the system's permitting and business licensing modules, the scope was significantly more involved. The previous system is over 20 years old, and converting to an online, self-service, customer-facing platform, with an online payment system, requires more extensive changes than previously estimated.

Hence, staff seeks the City Council’s approval and authorization for the City Manager to execute an amendment to the original agreement in a total not to exceed amount of $100,000.00, to meet these expanded goals.

Under the Town’s Purchasing Policy, services in an amount over $75,000 are required to be procured through a Request for Proposals (RFP) process. In lieu of the RFP process, staff is instead recommending that this work, which is estimated to be in excess of $75,000.00, be procured directly with the consultant that is currently up to speed on the assignment and nearing completion of the project. This is because it would be futile for the Town to go out to RFP as the Town will benefit from lower costs by continuing with the consultant due to her deep knowledge of the Town’s new system and processes and any other vendor will need to get up to speed on and/or create at costs to the Town. It has been held that where competitive proposals work an incongruity and are unavailing as affecting the final result, or where competitive proposals do not produce any advantage, competitive bidding is not applicable. See, Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631. On this basis, staff is recommending that the City Council concur with staff’s findings above and adopt the resolution approving and authorizing the City Manager to execute an amendment to the original agreement with the consultant. Staff has included findings consistent with the above in the draft resolution for the City Council’s consideration.

FISCAL IMPACT: The contract is paid hourly, and the amendment would add $80,000.00 to the existing $20,000.00 agreement. A California Department of Housing and Community Development grant partially offsets the overall project. Adequate reserves are available to fund this increased contract in 60111204-6047 Building/Planning Software Upgrade.

ENVIRONMENTAL ISSUES: The City Council’s adoption of the resolution is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15378 as the approval of any amendment would constitute a continuing administrative activity of the Town to upgrade migration to a new cloud-based version of software and the action will not result in any potentially significant physical impact on the environment.

CITY COUNCIL MEETING
JULY 8, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION AUTHORIZING PLACEMENT OF SEWER SERVICE AND

STORM DRAINAGE CHARGES, SPECIAL TAX FOR POLICE PROTECTION AND FIRE

PROTECTION AND PREVENTION, AND THE FLAT CHARGE COMPONENT OF THE GARBAGE COLLECTION FEE ON THE FISCAL YEAR 2024-25 COUNTY TAX ROLL AND

AUTHORIZING THE COUNTY TAX COLLECTOR TO COLLECT SUCH CHARGES PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: The Town's sewer service charges, storm drainage charges, public safety special tax and the flat garbage collection fee are collected by the County Tax Collector in the same manner in which the County collects the property taxes. The Hillsborough Municipal Code requires the Town to annually adopt a resolution authorizing the County Tax Collector to collect the above charges.

The procedures to place the charges on the tax roll and the publication of the notice on the hearing are those prescribed in the California Health and Safety Code 5473 through 5473.8. The public safety tax that gets put on the tax roll is pursuant to Government Code section 50077(b) and the provisions in the Municipal Code.

There are an estimated 3,903 households that will be assessed an annual residential sewer charge of $4,145.00 for an estimated total of $16,177,935.00 to support the sewer operations. This represents a 4% increase from the $3,985.00 annual charge last year. Commercial accounts will be manually assessed and billed with the water charges based on their winter water usage and relationship to the charge of an "equivalent dwelling unit" of $4,145.00. The sewer charge was approved by City Council on May 13, 2024 in a noticed public hearing.

The annual storm drainage charge was first authorized in fiscal year (FY) 1994-95 upon the implementation of the National Pollutant Discharge Elimination System (NPDES) Stormwater Pollution Prevention Program. The authorizing ordinance, however, does not provide for adjustments to the annual charge to cover changes to program costs; hence, it has remained the same since the initial implementation. An annual charge of $7.34 per parcel will be assessed to 4,013 parcels for an estimated total of $29,445.42.00 to partially pay for storm drain costs.

The public safety tax of $218.00 for 61 unimproved and $570.00 for 3,920 improved parcels will bring in an estimated $2,247,480.00 towards partial funding of public safety operations. The special tax initially set at $190 for unimproved parcels and $496 for improved parcels in FY 1998- 99 was increased by 2% each year, but the authorizing ordinance set a maximum of 115% of the initial amounts. The maximum amounts have been assessed since FY 2005-06.

The flat garbage collection fee reflects a 5% increase from the previous year in the amount of $363.84 per year to be assessed on an estimated 3,904 parcels. Projected receipts of -89-

$1,420,431.00 net of the incidental charges (collection fee charged by the County and the cost to prepare the data in the required format) will be remitted to Recology per the franchise agreement.

FISCAL IMPACT: Collection charges will be assessed by the County in exchange for the service.

The cost is part of the operating budget. All revenues are reflected in the approved budget.

The County Controller is hereby authorized to place the Town of Hillsborough residential sewer charges, storm drainage charges, special tax for police protection and fire protection and prevention, and the flat garbage collection fee on the FY 2024-25 County tax roll, and that the County Tax Collector is hereby authorized to collect such charges in the same manner, by the same person, and at the same time as, together with and not separately from, the general taxes applicable to real property in the Town of Hillsborough.

3. The County is hereby authorized to retain the necessary amount from such collections to cover the cost of the County’s services hereunder (pursuant to the County’s formula allocating among all the agencies for which the County provides tax collection services, the cost of the County offices involved in collecting the taxes, prorated according to the amount of taxes collected from each agency), and the balance of such collections shall be remitted to the Town.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE A THIRD AMENDMENT TO THE EXISTING AGREEMENT WITH FREYER & LAURETA, INC. FOR ENGINEERING SERVICES FOR THE PRELIMINARY DESIGN OF THE HIGHLINE WATER PIPELINE PROJECT IN THE AMOUNT OF $1,327,000.00, FOR A TOTAL AGREEMENT AMOUNT OF $2,079,800.00
SUMMARY: The Town of Hillsborough operates a complex water distribution system to supply portable water for domestic use, landscape irrigation and fire suppression. The normal source of water is the San Francisco Public Utilities Commission’s (SFPUC), Sunset Pipeline No.1 and Crystal Springs Pipeline No. 2. These historical points of connection are at lower elevations, which requires the Town to pump millions of gallons uphill, at significant costs. Also, the process of lifting water and using this historical route is vulnerable to seismic events. The Town stores this water in 17 active storage tanks and one reservoir located at 10 sites throughout the Town.

The Town desires to install a new direct water transmission pipeline that would link the Town's water system to the improved Harry Tracy Water Treatment Plant located in Millbrae. The new pipeline would serve several functions:

1. Provide an alternate source of water to the Town should the water supply from the SFPUC's "lower" zone become unavailable for any reason (pipe damage due to earthquake, water quality event, etc.).

2. Provide an almost limitless supply of water at the Town's western boundary, which could be critical in fighting a large wildland fire. Water available at the top of the Town's pressure zone also provides emergency water to all areas in Town for firefighting purposes. Distributing water from the top down is not impeded by existing tank sizes and pump limitations.

3. Avoid day-to-day operation of various existing pump stations that currently work to deliver water from the SFPUC lower zone to the Town's higher elevations and pressure zones. This will result in a significant energy savings to the Town.

4. Provide increased seismic reliability to the Town's higher elevation pressure zones.

5. Water made available via the highline would not be impacted by planned PSPS (Public Safety Power Shutoff) events.

6. Deliver water to the Town and partner agencies Burlingame and Millbrae. -93-

On September 14, 2020, City Council awarded an Agreement for professional conceptual design services to Freyer & Laureta, Inc. (“F&L”) for the Highline Water Pipeline Design from the Harry Tracy Water Treatment Plant to the Town of Hillsborough Water System (“Project”) in the amount of $421,600.00.

On October 10, 2022, City Council approved an amendment to the Agreement for additional design coordination efforts with the Town’s partner agencies, Burlingame, Millbrae and the SFPUC, in the amount of $150,000.00.

On April 11, 2023, City Council approved a second amendment for the preparation of the Project’s California Environmental Quality Act (CEQA) documents, in the amount of $181,200.00.

The Town desires to approve a third amendment to the Agreement now that the preliminary study/analysis and CEQA is accounted for. This amendment would be to complete the preliminary design package in the amount of $1,327,000.00. F&L provided a proposal for these additional services which are summarized as follows:
• Project management and coordination
• Topographic surveying, geotechnical investigation, geohazard engineering • Preliminary pipeline design, including basis of design report, fault crossing analysis, and hydraulic modeling
The comprehensive design for this size of project is complex and challenging. A multiphase design process allows the Town to methodically determine the best design approach and authorize funding in phases. F&L successfully completed the tasks associated with the original agreement and subsequently approved amendments. The conceptual design and preliminary analysis allowed the Town and partner agencies to determine the most favorable pipeline alignment. The CEQA review period is complete, no further environmental reviews or revisions are anticipated, and the final IS/MND will be presented to Council for adoption at the August 2024 City Council. The next step is to complete the preliminary design package as presented in this agenda item. As preliminary design significantly progresses, it is anticipated an amendment for the final pipeline design and development of construction drawings will be presented to Council for approval prior to the end of the calendar year, so the project can be ready for bidding in 2025.

Staff carefully reviewed the proposed scope and cost and after some negotiations with F&L, staff finds the proposal reasonable for the level of effort necessary to complete this preliminary design task. This would be the largest capital project in the Town's history, and the percentage cost of the needed design work is proportionate based on the needed effort. The estimated overall project cost is $32.5 million, of which the Town is anticipating receiving Federal BRIC Funding in the amount of $22.75 million, with the approximate remaining $9.75 million paid by each of the partner cities, the Town, Millbrae and Burlingame. This design cost is part of the overall project cost and part of the initial estimate, and part of the Town's Capital Improvement Plan budget specific to water.

FISCAL IMPACT: Staff recommends amending the existing agreement with F&L a third time in the amount of $1,327,000.00, for a total agreement amount of $2,079,800.00. It is recommended funding be allocated from the adopted Fiscal Year 2024-25 High Line Water Connection (CIP -94-

#510) budget. Sufficient funding remains in the budget. Staff anticipates receiving Federal funds to cover the reimbursement of 70% of project costs.

ENVIRONMENTAL ISSUES: Pursuant to California Environmental Quality Act (CEQA), the Town of Hillsborough prepared a draft Initial Study/Mitigated Negative Declaration (IS/MND) to evaluate the potential environmental effects of the Project. The Initial Study concludes that potential significant environmental effects could occur from project implementation in the following issue areas: air quality, biological resources, cultural resources, geology/soils, transportation, tribal cultural resources, and utilities / service systems. However, mitigation measures were identified that would reduce these potential impacts to less-than-significant levels. The public comment period is complete and no comments were received that would result in delays or the need for other studies prior to the start of project design. It is anticipated the draft IS/MND will be presented at the August 2024 City Council for Final IS/MND adoption.

AGENDA STAFF REPORT
ITEM SUBJECT: REVISIONS TO THE WILDLAND URBAN INTERFACE (WUI) INSPECTION

PROGRAM
SUMMARY: In 2018, a risk assessment was conducted to evaluate the wildfire risk to the Town of Hillsborough ("Town"). In 2019, the Central County Fire Department (CCFD) and the Town initiated the Wildland Urban Interface (WUI) inspection program to address the findings of the risk assessment and mitigate the risk of wildfire to the community.

CCFD annually evaluates the WUI program to meet the needs of the Town, residents, and CCFD.

The evaluation of inspections conducted in 2023 found that 80% of properties inspected passed on the initial site visit, demonstrating the successful mitigation efforts made by property owners.

Planned revisions to the program would recognize the efforts of those who continue to maintain their property and allow CCFD staff to focus on areas where improvement of vegetation management is still needed. The planned revisions to the program are listed below:
• Provide an education-based program versus the current enforcement program. • Divide the Town into three sections with a rotating three-year inspection cycle. • Provide free evaluations to homeowners and request an inspection when the property owner has not completed the required maintenance.
• An inspection fee will only be charged for enforcement cases. • Continue to provide free property consultations.
• Investigate reported vegetation management concerns and inspect as necessary.

FISCAL IMPACT: The fiscal impact will be to the Central County Fire Department (CCFD) general fund.
