AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ADOPTING THE CLASSIFICATION SPECIFICATION FOR THE

EXPANDED POSITION OF PUBLIC WORKS INSPECTOR III AND THE POSITION OF DEPUTY CITY CLERK PURSUANT TO CEQA GUIDELINE 15378
SUMMARY: This item presents for City Council approval the classification specifications for the following two positions:

Public Works Inspector III:

The Public Works Department desires to expand the existing classification specification of Public Works Inspector to include a Public Works Inspector III, in addition to Public Works Inspector I and II. The Public Works Department’s need for in-house inspection for both private development and capital improvement projects has significantly increased over the last ten years. The Public Works Inspector III position will have the skillset to inspect highly complex capital improvement projects, providing the Town a reliable in-house resource as needed, in-lieu of additional consulting inspectors. Adoption of this expanded classification specification will not increase the Town's budgeted headcount.

Deputy City Clerk:

The addition of a Deputy City Clerk position was included in the FY 2024-25 adopted budget. The Deputy City Clerk will assist with agenda preparation and record keeping, support the implementation of updated programs, policies, and technology, and provide backup support for facilitation of City Council meetings. This position ensures continuity of operations in the absence of the City Clerk, safeguarding against any potential disruptions.

FISCAL IMPACT: The salary increase for the expansion of the Public Works Inspector III position and the Deputy City Clerk position are included in the Fiscal Year 2024-25 adopted budget.

ENVIRONMENTAL ISSUES: The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines sections 15378(b)(2) and 15378(b)(5) as ongoing administrative or organizational activities that will not result in direct or indirect physical changes in the environment.

PUBLIC WORKS INSPECTOR

I/II/III

DEFINITION
Under direction (I) or general (II & III) supervision, performs a variety of routine to complex technical work involved in inspecting the workmanship and materials used in public works construction projects; ensures conformance with applicable federal, state, and local laws, codes, and ordinances, technical plans and specifications, and departmental regulations; assists in preliminary design, cost estimation, review of new and future public works projects, and some project management; and performs related duties as assigned.

SUPERVISION RECEIVED AND EXERCISED
Receives direction (Public Works Inspector I) or general supervision (Public Works Inspector II & III) from assigned supervisory or management staff. Exercises no direct supervision over staff (.Public Works Inspector I & II) or exercises technical and functional direction over and provides training to lower‐level staff (Public Works Inspector III).

CLASS CHARACTERISTICS
Public Works Inspector I: This is the entry‐level classification in the Public Works Inspector series. Initially under direction, incumbents learn and perform routine inspection activities required to ensure compliance with applicable federal, state, and local laws, codes, and ordinances, technical plans and specifications, and departmental regulations. As experience is gained, assignments become more varied, complex, and difficult; direction and frequent review of work lessen as an incumbent demonstrates skill to perform the work independently.

Positions at this level usually perform most of the dutiesrequired of the positions at the Public Works Inspector II level but are not expected to function at the same skill level and usually exercise less independent discretion and judgment in matters related to work procedures and methods. Work is usually supervised while in progress and fits an established structure or pattern. Exceptions or changes in procedures are explained in detail as they arise.

Public Works Inspector II: This is the fully qualified journey‐level classification in the Public WorksInspectorseries. Positions atthislevel are distinguished fromthe Public WorksInspector I by the performance of the full range of duties as assigned, working independently, and exercising judgment and initiative. Positions at this level receive only occasional instruction or

assistance as new or unusual situations arise and are fully aware of the operating procedures and policies of the work unit.

Public WorksInspectorIII: Thisisthe advanced level classification in the Public Works Inspector series responsible for performing the most complex public works inspections. This position is distinguished from the Public WorksInspector I/IIseries by involvement in additional phases of capital improvement projects, including but not limited to, assisting with preliminary design and layout of proposed projects, project coordination, plan and specification review, change order negotiation, cost estimating, field compliance monitoring, materials testing and inspection, use of various field equipment such as GPS and surveying equipment, and public outreach. Incumbents regularly work on tasks which are varied and complex, requiring independent judgement and initiative. Positions in the classification rely on experience and judgement to perform assigned duties.  Positions at this level receive only occasional instruction or assistance as new or unusual situations arise and are fully aware of the operating procedures and policies of the work unit. Assignments are given with general guidelines and incumbents are responsible for establishing objectives, timelines, and methods to complete assignments.

Positions in the Public Works Inspector class series are flexibly staffed; positions at the II‐level are normally filled by advancement from the I‐level, and III‐level filled by advancement from the II‐level; progression to the II‐level and III‐level is dependent on (i) management affirmation that the position is performing the full range of duties assigned to the classification; (ii) satisfactory work performance; (iii) the incumbent meeting the minimum qualifications for the classification including any licenses and certifications; and (iv) management approval for progression to the Public Works Inspector II‐level or III‐level.

DATE: July 15, 2024
TO: Lisa Natusch, City Clerk
FROM: Julie Parenti, Fire Inspector
(650) 558-7648
SUBJECT: CASA Under the Stars event 2024
The following list is a typical set of conditions the fire department utilizes to ensure a minimum standard of fire and life safety. We recommend that arrangements be made by the applicant for a tour of the event site to receive more detailed comments. This tour should be conducted at least 14 days prior to the event.

Final conditions of approval are subject to review of floor plans, proposed routes of travel for public viewing, and a field inspection prior to opening. Temporary conversion of this space for public attendance will be acceptable, provided the applicant addresses the following concerns.

1. Provide a floor plan with site dimensions, exits, and proposed foot traffic pattern for the public. Floor plan shall be emailed to Inspector Julie Parenti at [email protected]. A review of the floor plan and arrangement of contents will be used by the Fire Department to determine a maximum occupancy load. Maximum occupancy load shall not exceed this limit. In addition to the overall limit, secondary floor areas served by a single stairway will be further restricted based on a review of floor plans. Event volunteers are to be provided in sufficient numbers to ensure enforcement of the limits. The standby fire watch has the authority to restrict additional visitors and/or order the number of people in the venue to be reduced if overcrowding exists at any time. Foot traffic flow pattern shall be designed to minimize overcrowding in any area. Traffic flow shall be continually monitored and regulated by the volunteers.

2. If applicable, a standby fire watch shall be on duty during the time the fair is open to the public. The primary responsibility is enforcement of fire and life safety provisions of the California Fire Code. Duties are limited to those activities, except for medical emergencies, or other unusual, or hazardous conditions that may arise. Standby costs are paid by the applicant and are negotiated with the awarded security company.

3. Exterior exit pathways shall be a hard surface walkway free from tripping hazards.

Exterior exit pathways shall be illuminated at night at any time the event is open to the public. Exterior gates shall be kept unlocked at all times.

4. Portable fire extinguishers with a minimum UL rating of 2A10BC shall be provided so that travel distance to an extinguisher does not exceed 75’. A fire extinguisher shall be provided for each 3000 square feet of floor area and at least one fire extinguisher shall be provided for each level. Extinguishers shall be accessible and visible. Or their location clearly marked.

5. Building Department approval and permits shall be obtained, if necessary, for remodeling and electrical work. The applicant is responsible for ensuring compliance with all Town of Hillsborough requirements.

6. Light duty extension cords are prohibited. UL approved multi-outlet power taps may be acceptable provided they are connected directly to a permanent outlet. Power tap cords shall be protected from physical damage and must be located so as not to present a tripping hazard.

7. No smoking signs shall be posted throughout the event space.

8. Candles, open flame, and other sources of ignition are prohibited.

9. Flammable liquids, propane, or other highly flammable materials or decorations are prohibited.

10. The driveway shall be maintained clear for emergency vehicle access during the hours the event is open to the public. Parking related to the event shall not restrict emergency vehicle access.

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ACCEPTING AS COMPLETE THE CONTRACT WITH G.

BORTOLOTTO & CO, INC. FOR THE 2023 STREET RESURFACING PROJECT IN THE AMOUNT OF $3,692,192.63 PURSUANT TO CEQA GUIDELINE 15301 SUMMARY: This project consisted of street resurfacing and rehabilitation work for over 28 miles of the Town’s roadways of conventional asphalt, rubberized asphalt, micro-surfacing, rubberized cape seal, and crack sealing preventative maintenance.

The primary factor for choosing streets for rehabilitation was the Pavement Condition Index (PCI) of each roadway. PCI is a measure of a street’s condition derived through field inspections that utilize scoring criteria developed by the Metropolitan Transportation Commission (MTC) pavement management program. Field inspections were conducted in October 2022, and the roads with the lowest PCI rating were used to determine the 2023 year’s roadway design. The original project scope was completed in January 2024 and increased the Town’s average PCI condition rating to

83. Due to value engineering during construction, additional streets were added to the project scope.

The project paused during the rainy months, and the contractor resumed in early summer to complete these additional streets.

FISCAL IMPACT: On April 10, 2023, the project was awarded to G. Bortolloto & Co. in the amount of $3,842,864.40, with 10% contingency in the amount of $384,286.44, if needed, for a total project budget of $4,227,150.84. The project was successfully completed in the amount of $3,692,192.63, which is below the authorized budget.

Due to favorable pricing and desired timing of construction and completion, on April 10, 2023, the City Council approved a FY 2022-23 budget amendment to Capital Improvement Fund CIP #401 in the amount of $4,061,791.80 and authorized the Finance Director to make an inter-fund borrowing in FY 2023-24 for cash flow purposes of up to $1.25 million from the General Fund to the Capital Fund for CIP #401 to be paid back no later than June 30, 2024 (Resolution No. 23-26). Funding was allocated from FY 2022-23 Capital Improvement Fund CIP #401.

ENVIRONMENTAL ISSUES: This project is categorically exempt from the California Environmental Quality Act (CEQA) according to Section 15301 of the California Code of Regulations.

ITEM SUBJECT: RESOLUTION ACCEPTING AS COMPLETE THE CONTRACT WITH NORGO ENGINEERING FOR THE 2530 SKYFARM DRIVE STORM PIPE REPLACEMENT PROJECT IN THE AMOUNT OF $208,625.00 PURSUANT TO CEQA GUIDELINE 15301 SUMMARY: This project included replacing 3 segments of damaged stormwater pipe with 170 feet of 24” High-Density polyethylene (HDPE) in a public utility easement. Due to excessive rain in the winter of 2023 and the corrosion of galvanized storm pipes, three segments of the pipes needed to be redesigned and replaced. In addition to the replacement of the pipes, three catch basins were also repaired and reinforced.

Investigatory and evaluation work for this project was completed in 2023. However, the rainy season, slippery conditions, and heavy groundwater runoff at the site delayed the start of the construction of the project until early June 2024. This project was developed and designed by the Public Works engineering staff.

FISCAL IMPACT: On November 13, 2023, the project was awarded to NORGO Engineering in the amount of $198,500.00 with a 10% contingency, for a total construction budget of $218,350.00.

Project funding was allocated from the approved budget for the Storm Water Master Plan Improvement Program (Capital Improvement Plan #801). The project was completed in the amount of $208,625.00 which is below the authorized budget with contingency.

ENVIRONMENTAL ISSUES: This action is categorically exempt from CEQA according to Section 15301 of the California Code of Regulations.

CITY COUNCIL MEETING
AUGUST 12, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: RESOLUTION ADOPTING THE MITIGATED NEGATIVE DECLARATION AND

THE MITIGATION MONITORING AND REPORTING PROGRAM (MMRP) FOR THE WATER

PIPELINE DESIGN FROM HARRY TRACY WATER TREATMENT PLANT TO THE TOWN OF HILLSBOROUGH WATER SYSTEM (“HIGHLINE WATER PIPELINE”) PROJECT SUMMARY: The Town of Hillsborough ("Town") operates a complex water distribution system to supply portable water for domestic use, landscape irrigation and fire suppression. The normal source of water is the San Francisco Public Utilities Commission’s (SFPUC), Sunset Pipeline No.1 and Crystal Springs Pipeline No. 2. These historical points of connection are at lower elevations, which requires the Town to pump millions of gallons uphill, at significant costs. Also, the process of lifting water and using this historical route is vulnerable to seismic events. The Town stores this water in 17 active storage tanks and one reservoir located at 10 sites throughout the Town.

The Town desires to install a new direct water transmission pipeline that would link the Town's water system to the improved Harry Tracy Water Treatment Plant located in the City of Millbrae.

The project will install a new, seismically resilient water pipeline that begins in Millbrae at the existing SFPUC Helen Turnout on Helen Drive and ends at the Town of Hillsborough's Darrell Tanks located slightly southwest of Darrell Road. The purpose of the project is to provide an additional connection to the Town's water supply from the SFPUC's system in the higher-pressure zones in the event water cannot be delivered from SFPUC to the Town's lower pressure zones.

The proposed pipeline will provide a reliable water source within and adjacent to the Wildfire Urban Interface to increase fire suppression resources and protect critical water storage and distribution infrastructure, as well as the residents of all three municipalities. When the project is fully implemented, the new pipeline will provide an approximate flow target of six million gallons per day.

INITIAL STUDY / MITIGATED NEGATIVE DECLARATION (IS/MND) AND MITIGATION

MONITORING AND REPORTING PROGRAM (MMRP) SUMMARY
Pursuant to California Environmental Quality Act (CEQA) Guideline §15063, the Town of Hillsborough prepared an Initial Study to evaluate the potential adverse environmental effects of the project. The Initial Study concluded that potential significant environmental effects could occur from project implementation in the following issue areas: air quality, biological resources, cultural resources, geology and soils, transportation, tribal cultural resources, and utilities and service systems. However, mitigation measures were identified that would reduce these potential impacts to less-than-significant levels.

A Notice of Intent (NOI) to adopt the Draft IS/MND was issued on May 17, 2024. The Draft IS/MND was circulated for public review from May 15, 2024, through June 14, 2024, pursuant to CEQA guidelines §15105. During the public review period, one comment letter was received from Caltrans. The comment letter clarified Caltrans requirements for traffic on State roadways and states that the project must comply with all requirements for impacted Caltrans facilities, including facilities within the roadway. The project would comply with all Caltrans requirements; therefore, comments received during this time did not introduce any new or significant environmental impacts beyond those already addressed in the Draft IS/MND. The comment letter and staff responses are included in the City Council agenda packet.

FISCAL IMPACT: This action will not create any new financial responsibility for the Town.

ENVIRONMENTAL ISSUES: Pursuant to the CEQA Guidelines, the Town of Hillsborough prepared an IS/MND to analyze the impacts of the project scope. The Final IS/MND contains mitigation measures to avoid or substantially lessen the environmental effects of the project.

3 WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred.

NOW, THEREFORE, BE IT RESOLVED by the City Council of The Town of Hillsborough:

SECTION 1: The above recitals are true and correct and incorporated herein by reference.

SECTION 2: The City Council hereby certifies that it has reviewed and considered the information in the Final IS/MND prepared for the Project in compliance with CEQA (including its implementing regulations) prior to taking action. The City Council hereby finds, based on its independent review and analysis: (i) that the Final IS/MND was prepared in compliance with CEQA; and (ii) that based on the imposition of mitigation measures, there is no substantial evidence in the administrative record supporting a fair argument that the Project may have a significant effect on the environment. No new significant environmental impacts have been identified in the Final IS/MND and any changes to the IS/MND in response to comments or otherwise do not constitute substantial revisions requiring recirculation under State CEQA Guidelines section 15073.5. Pursuant to Public Resources Code section 21080, subdivision (c)(2), the City Council hereby approves and adopts the Final IS/MND based on the entirety of the record of proceedings.

SECTION 3: Pursuant to Public Resources Code section 21081.6, the City Council has also reviewed and considered the MMRP for the Project and finds that such MMRP is designed to ensure compliance with the mitigation measures during Project implementation. The City Council hereby approves and adopts the MMRP.

Implementation of the mitigation measures contained in the MMRP is hereby made a condition of approval of the Project. In the event of any inconsistencies between the mitigation measures set forth herein and the MMRP, the MMRP shall control.

SECTION 4: The documents and materials that constitute the record of proceedings on which this Resolution has been based are located at Hillsborough Town Hall, 1600 Floribunda Avenue, Hillsborough, CA 94010. The custodian for these records is Lisa Natusch, City Clerk. This information is provided pursuant to Public Resources Code section 21081.6.

SECTION 5: Town staff shall cause a Notice of Determination to be filed and posted with the San Mateo County Clerk and the State Clearinghouse within five working days of approval of the Project.

Re: Water Pipeline Design from Harry Tracy Water Treatment Plant to the Town of Hillsborough Water System ─ Mitigated Negative Declaration (MND) Dear Natalie Gribben:

Thank you for including the California Department of Transportation (Caltrans) in the environmental review process for the Water Pipeline Design from Harry Tracy Water Treatment Plant to the Town of Hillsborough Water System Project. The Local Development Review (LDR) Program reviews land use projects and plans to ensure consistency with our mission and state planning priorities. The following comments are based on our review of the May 2024 MND.

Please note this correspondence does not indicate an official position by Caltrans on this project and is for informational purposes only.

Project Understanding
The proposed project will install a seismically-resilient water pipeline that begins in the City of Millbrae at the existing San Francisco Public Utilities Commission (SFPUC) Helen Turnout and ends at the Town of Hillsborough's Darrell Tanks. The purpose of the project is to provide an additional connection to the Town's water supply from SFPUC's system in the higher-pressure zones in the event water cannot be delivered from SFPUC to the Town's lower pressure zones. The proposed pipeline will provide a reliable water source within and adjacent to the Wildland Urban Interface to increase fire suppression resources and protect critical water storage and distribution infrastructure, as well as the residents of all three municipalities. Some of the project locations are close to Caltrans’ Right-of-Way (ROW).

“Provide a safe and reliable transportation network that serves all people and respects the environment.” Construction-Related Impacts
Project work that requires movement of oversized or excessive load vehicles on State roadways requires a transportation permit that is issued by Caltrans. To apply, please visit Caltrans Transportation Permits (link). Prior to construction, coordination may be required with Caltrans to develop a Transportation Management Plan (TMP) to reduce construction traffic impacts to the State Transportation Network (STN).

In Appendix A, there are numerous utilities that may conflict with the installation of the water pipeline, which includes stormwater drainage systems. Any effected drainage systems within Caltrans’ ROW or maintained, under maintenance agreements with State easements, will need to be identified and the proposed work at these locations reviewed by Caltrans.

Equitable Access
If any Caltrans facilities are impacted by the project, those facilities must meet American Disabilities Act (ADA) Standards after project completion. As well, the project must maintain bicycle and pedestrian access during construction. These access considerations support Caltrans’ equity mission to provide a safe, sustainable, and equitable transportation network for all users.

Thank you again for including Caltrans in the environmental review process. Should you have any questions regarding this letter, please contact Melissa Hernandez, Associate Transportation Planner via [email protected]. For future early coordination opportunities or project referrals, please contact [email protected].

CITY COUNCIL MEETING
AUGUST 12, 2024

AGENDA STAFF REPORT
ITEM SUBJECT: ORDINANCE AMENDING CHAPTER 15.10 (ENERGY CODE) OF TITLE 15 (BUILDINGS AND CONSTRUCTION) OF THE HILLSBOROUGH MUNICIPAL CODE BY AMENDING SECTION 15.10.030 AND REPEALING SECTION 15.10.050 (ENERGY REACH CODE) IN ITS ENTIRETY PURSUANT TO CEQA GUIDELINE 15378 - INTRODUCTION SUMMARY: On April 11, 2022, the City Council adopted Ordinance No. 783 adding a new Section

15.10.050 (Energy Reach Code) to Chapter 15 of Title 15 of the Hillsborough Municipal Code related to new low-rise residential construction to require, among other things that:
• space heating and water heating appliances only be electric, or in other words, that all gas piping for space heating and water hearing be prohibited, and; • cooking and clothes drying appliances using natural gas or propane be required to be prewired for a future electric appliance installation.

Around the same time that the City Council adopted Ordinance No. 783, many other cities in California were also contemplating the adoption of Energy Reach Codes that required new building construction and/or remodels to only include electric wiring for appliances, or where gas or propane piping is installed, that the new or remodeled building also include prewiring for future electric appliances. Some cities even went so far as to prohibit all gas piping in new building construction. One city that opted to take this approach was the City of Berkeley.

The California Restaurant Association brought a suit challenging Berkeley's ban on gas piping in new buildings. The suit sought to invalidate Berkeley's gas ban and block its enforcement, arguing that the federal Energy Policy & Conservation Act (EPCA) preempted the local ban. In a precedent-setting decision, the Ninth Circuit ruled in favor of the Association, concluding that Berkeley's ban on gas piping concerned the energy use of appliances covered by the EPCA, thus rendering Berkeley’s gas ban unenforceable.

Subsequently, on January 2, 2024, the Ninth Circuit denied the City of Berkeley’s petition to rehear the case en banc, and, following this decision, the City did not exercise its right to appeal to the Supreme Court and the decision is now final and binding on all cities in the State of California.

Based on the Berkeley decision, the Town’s is now preempted from enforcing its gas piping prohibition for space heating and water heating purposes. As such, on June 10, 2024, the City Council by motion directed staff not to enforce the two provisions regarding water heating and space heating to comply with the Berkeley decision.

Staff is now bringing forward this formal Municipal Code amendment to repeal the Town’s gas prohibition, and the Town’s Energy Reach Code as a whole, in order to ensure the Town is in compliance with the Berkeley case.

As the 2022 State Energy Code already imposes an "electric ready" requirement for all types of appliances in new residential construction, staff is recommending that the City Council simply repeal the Town’s Energy Reach Code and staff will continue to enforce the 2022 State Energy Code. This will still require that all new residential construction install electric prewiring for all appliances even where gas or propane piping is provided, ensuring that all future homeowners have the option of using either gas or electric appliances in a new home. The Town previously adopted the 2022 State Energy Code via its 2022 Building Code update, under Ordinance No. 788 in January 2023.

FISCAL IMPACT: There is no fiscal impact associated with this item.

ENVIRONMENTAL ISSUES: The City Council’s action to introduce and adopt this ordinance is not a project subject to the requirements of the California Environmental Quality Act, pursuant to 14 C.C.R. section 15378(b)(5), because it is an administrative governmental activity which will not cause a direct or indirect physical change in the environment.

ORDINANCE NO.

ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF HILLSBOROUGH AMENDING CHAPTER 15.10 (ENERGY CODE) OF TITLE 15 (BUILDINGS AND

CONSTRUCTION) OF THE HILLSBOROUGH MUNICIPAL CODE BY AMENDING SECTION 15.10.030 AND REPEALING SECTION 15.10.050 (ENERGY REACH CODE) IN ITS ENTIRETY PURSUANT TO CEQA GUIDELINE 15378
The City Council of The Town of Hillsborough hereby finds and ordains as follows:

WHEREAS, the Town of Hillsborough, California (“Town”) is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, on April 11, 2022, the City Council adopted Ordinance No. 783 amending Title 15 (Buildings and Construction) of the Hillsborough Municipal Code, Chapter 15.10 (Energy Code), and amending by reference the 2019 California Energy Code; and WHEREAS, Ordinance No. 783 added a new Section 15.10.050 (Energy Reach Code) to Chapter 15 of Title 15 of the Hillsborough Municipal Code related to new low-rise residential construction to require, among other things, that space heating and water heating appliances be required to be electric and cooking and clothes drying appliances using natural gas or propane be required to be prewired for a future electric replacement appliance; and WHEREAS, in California Restaurant Association v. City of Berkeley, a panel of the U.S.

Court of Appeals for the Ninth Circuit held that an all-electric new construction ordinance adopted in the City of Berkeley was preempted by the federal Energy Policy and Conservation Act; and WHEREAS, on January 2, 2024, the Ninth Circuit denied the City of Berkeley’s petition to rehear the case en banc, and, following this decision, the City did not exercise its right to appeal to the Supreme Court; and
WHEREAS, given that this ruling is now final and binding on all jurisdictions within the Ninth Circuit, the Town could be vulnerable to a legal challenge were it to enforce certain provisions of Section 15.10.050, and it is therefore in the Town’s best interest to repeal this section.

NOW, THEREFORE, the City Council of the Town of Hillsborough does ordain as follows:

Section 1. The recitals above are each incorporated by reference and adopted as findings by the City Council.

Section 2. Adoption of this Ordinance is not a project subject to the requirements of the California Environmental Quality Act, pursuant to 14 C.C.R. section 15378(b)(5), because it is an administrative governmental activity which will not cause a direct or indirect physical change in the environment.
-81-
2 Section 3. Chapter 15.10 (Energy Code) of Title 15 (Buildings and Construction) of the Hillsborough Municipal Code is hereby amended by repealing Section 15.10.050 (Energy Reach Code) in its entirety.

“15.10.030 - Reserved.”
Section 5. This ordinance shall take effect 30 days following its adoption.

Section 6. No less than five days prior to the adoption of this Ordinance, the City Clerk published a summary of this Ordinance in accordance with Government Code section 36933.
