TOWN OF HILLSBOROUGH

CITY COUNCIL MEETING
OCTOBER 13, 2025
AGENDA STAFF REPORT
ITEM SUBJECT: Resolution Approving and Authorizing the City Manager to Execute a Loan Agreement with Pooled Liability Assurance Network Joint Powers Authority (PLAN JPA) and Accepting $750,000.00 in Temporary Funds for the Macadamia Access Road Repair Project (Phase 1 – East) Under CEQA Guideline 15301
SUMMARY: The 2022–2023 winter storms caused several slip-outs along the Macadamia access roads located in the Macadamia and Crocker open space areas. A total of nine slip-outs were observed over approximately 4,000 feet of the dirt access road. Repairs to these access roads are necessary to maintain access to the Town’s public sewer main within the easement and ensure reliable sanitary sewer services to Town residents.
On August 11, 2025, the City Council authorized a construction contract to repair six of the nine sites as part of Phase 1 (East) (“Project”). The scope of the Project includes installation of new soldier pile retaining walls, repairing an existing retaining wall, excavation, and associated drainage. The award amount was $982,425.00, with a 10% contingency of $98,242.50, for a total construction budget of $1,080,667.50.
The Town is currently seeking disaster relief reimbursement funding from the Federal Emergency Management Agency (FEMA) and the California Office of Emergency Services (CalOES) for the storm-related damage. The Town has been formally obligated under the FEMA disaster recovery process, which positions the Project for future reimbursement once eligible costs are validated.
The Town has also arranged a $750,000.00 loan agreement with Pooled Liability Assurance Network Joint Powers Authority (PLAN JPA). The loan carries no interest and is repayable only in the event, and to the extent, that funding reimbursement is provided to the Town by FEMA or CalOES. Acceptance of this loan provides the Town a source of funding reimbursement while awaiting potential disaster reimbursement, which could be delayed by many months.
The subject loan agreement has been reviewed for accuracy and is ready for execution. Upon authorization, the City Manager will sign the agreement on behalf of the Town and complete the acceptance of funds.
FISCAL IMPACT: The PLAN JPA loan provides $750,000.00 in temporary funding to be applied to the Macadamia Access Road Repair Project. This loan is interest-free and repayable only if reimbursement funds are received from FEMA or CalOES.
ENVIRONMENTAL ISSUES: The project qualifies for a California Environmental Quality Act (CEQA) statutory exemption under California Public Resources Code (PRC) Section -399-

21080.25(b)(3). Statutory exemptions are projects specifically excluded from CEQA consideration as defined by the State Legislature as delineated in PRC section 21080 et seq. Senate Bill (SB) 922, approved by the State on September 30, 2022, includes several amendments to PRC Section 21080.20 and Section 21080.25 relating to environmental quality.
Discretionary projects undertaken, carried out, or approved by a public agency to maintain, repair, restore, demolish, or replace property or facilities damaged or destroyed as a result of a disaster in a disaster-stricken area in which a state of emergency has been proclaimed by the Governor are not subject to any other provisions of the California Environmental Quality Act. This project will repair storm damage along two existing sewer maintenance access roads with the purpose of restoring use of the roads by replacing damaged road segments through a combination of retaining walls and embankment repairs. The Macadamia Drive access roads were damaged as a result of storm events for which the Governor of California proclaimed a State of Emergency in March 2023 for areas impacted by storm events, including San Mateo County. The Town of Hillsborough is located in San Mateo County and is carrying out the project in direct response to damage caused by the 2023 storm events.
