TITLE OF ITEM: RESOLUTION NO. 2022-9, A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF HOLLISTER ADOPTING A SPEED CUSHION POLICY

AND PROCEDURE FOR THE CITY OF HOLLISTER

BRIEF DESCRIPTION: The City has been receiving various complaints from our residents regarding excessive vehicular speeding through our City streets. As such, the Engineering Department would like to present, for City Council approval, a policy for installing speed cushions on public streets as a means of assisting with traffic calming measures. The intent of the speed cushions is to improve the safety of our local streets by reducing vehicular speed for passenger vehicles while allowing large emergency vehicles to pass unaffected.

RECOMMENDATION: The City Council ADOPT a Resolution approving the City of Hollister’s Speed Cushion Policy and Procedure.

DEPARTMENT SUMMARY: The City has received numerous complaints and concerns in regards to vehicle speeds throughout the City. As such, the City’s Engineering Department would like to establish a policy and procedures for the installation of Speed Cushions as a Traffic Calming Measure in an attempt to alleviate some of the concerns raised by our residents.

Adopting a Speed Cushion policy would provide the City and residents with a standard process that describes eligibility criteria and specifies the steps needed for residents to request the installation of speed cushions. The policy would also provide a standard process for the City to abide by during the review and/or approval of speed cushion installation. The policy would also delineate the appeal process which would give individuals the option to appeal a decision made by the Engineering Department or City Council regarding speed cushions. Additionally, the policy would provide the procedure for property owners to request removal of speed cushions when necessary.

Adopting a speed cushion policy would provide proper review and consistency throughout the City for such requests, as well as provide clarity to those residents who are interested in submitting or learning more about these types of requests.

The City of Hollister City Council reviewed the Speed Cushion policy at its regular City Council meeting of December 20, 2021 and determined to table this item to a special meeting of January 22, 2022.

FINANCIAL IMPACT: To be determined

SPEED CUSHION
Background: This policy provides Hollister Residents with an opportunity to submit a Petition Form for the installation of Speed Cushions on their streets. Speed cushions are one tool in the traffic calming toolbox that can be used to calm traffic on local streets.

Speed cushions are a series of raised “humps” that include wheel cutouts to allow emergency vehicles to pass unaffected, while reducing the speeds of passenger cars.

They are generally six feet in width, seven feet in length, three inches tall at their midpoint; placed across the traveled portion of the roadway a minimum of two feet apart.

Source: National Association of City Transportation Officials (NACTO) Rubbered cushions can be drilled into the existing roadway and Asphalt speed cushions may also be implemented.

Advantages
Speed cushions if placed strategically are designed to reduce passenger car speeds, while allowing large emergency vehicles (Fire Trucks) to pass unaffected and may divert traffic away from residential areas.

Disadvantages
Speed Cushions may slow response times of some emergency vehicles (Ambulances and Police Cars) and may divert traffic onto parallel residential streets. Diverting traffic onto other streets will be assessed in the analysis and evaluation of the project. They may also increase noise and air pollution for residents living immediately adjacent to the speed cushions. The curb and gutter area near the speed cushion may experience a reduction in effective street sweeping.

This document includes the speed cushion application and installation policy and procedures, speed cushion appeal process, speed cushion removal procedures, speed cushion petition form and frequently asked questions related to speed cushions.

SPEED CUSHION APPLICATION AND INSTALLATION

POLICY AND PROCEDURES
The City of Hollister establishes the following policy for the installation of Speed Cushions:

1.Steps to follow for Speed Cushion Installation:
a)The request for speed cushions will be initiated by a property owner in the City of Hollister. Upon request, the Engineering Department will send the requestor the City’s ‘Speed Cushion Policy and Procedures’ application packet. This application packet describes in brief, the salient aspects of speed cushions and the policy and procedures related to application and installation.
b)After a thorough review of the information, if the requestor desires to pursue the installation of speed cushions, she/he must complete the ‘Speed Cushion Petition Form’ and return it to the Engineering Department.
c)Note: Someone must be designated as the ‘Neighborhood Representative’ for this request. This person will be responsible for working with both the Engineering Department representative and the property owners (neighbors) of the affected neighborhood(s) to facilitate the application process.
d)The Neighborhood Representative will be responsible for collecting the signatures of ALL property owners (whether they approve or disapprove) on the street requesting the speed cushions; at least 67% (2/3rd) of the neighbors on a street have to approve the request for installation of speed cushions on their street. Once completed, the petition will be returned to the Engineering Department. e)The Engineering Department will review the completed Petition Form to determine whether the Petition meets the minimum criteria enumerated in item 2 below, of the ‘Speed Cushion Installation Policy and Procedure’ document. If the Engineering Department determines that the request does NOT meet the minimum criteria for installation, your application will be rejected, and your request will no longer be considered.
f)If the Petition meets the minimum criteria of the ‘Speed Cushion Installation Policy and Procedure,’ the Engineering Department representative will develop a speed cushion plan for the street, approximate the cost of installation and identify the exact location of the proposed speed cushions. Once this task is completed, the Engineering Department will draft a speed cushion placement diagram of the affected street, indicating the adjacent land owners.
g)Note: Once the exact location of the proposed speed cushion is determined, the Neighborhood Representative will be responsible for getting signatures from property owners immediately adjacent to the cushion (defined as the two to four closest property owners in both directions) to determine whether or not each property owner approves of speed cushion placement in front of their residence. h)The project will then be approved/denied by the City of Hollister City Council. i)If approved by the City Council, the Engineering Department will work to schedule the installation of the speed cushion.

1.a
Packet Pg. 11

2.Engineering Department Minimum Criteria for Eligibility:
a)The street or street segment shall be a two-lane local street as defined by the City of Hollister General Plan, where the primary function is to provide access to abutting residences. Engineering judgment will be used while making a decision as to the exact function the street performs. The installation of speed cushions on high-speed collectors and arterials is discouraged. Applications will be reviewed on a case-by- case basis.
b)The posted speed limit on the street should not be more than 25 mph. c)67 percent (2/3) of the property owners on the affected block/street must approve of the installation.
d)100 percent of the property owners immediately adjacent to the placement of the speed cushions must approve of the installation. Immediately adjacent is defined as two to four residences in either direction of the proposed speed cushion installation, depending upon the location of installation.
* If 100% of the property owners living immediately adjacent to the speed cushions do not agree to the placement, the Engineering Department will meet with the neighborhood facilitator to discuss alternate locations. In any case, unless 100% of the property owners living immediately adjacent to the speed cushions concur, the street will not be eligible for speed cushion installation.

Note: For ALL approval/vote counting purposes, each residence is defined by Assessor’s Parcel Number (APN). Each APN equals one vote. In the event a residence is occupied by someone other than the property owner, the property owner may be contacted; the property owner will act as the voting party. e)At least 15% of the vehicles travelling on the requesting street shall exceed the posted speed limit.
f)At least 10% of the vehicles travelling on the requesting street shall exceed speed limit by at least 10 mph.
g)The traffic volumes on the street should be between 500-7,000 vehicles/day. h)Note: If the speed and volume data identified in item 2 criteria “e” through “g” above is not available with the City, the Engineering Department will conduct surveys to collect the data needed.
i)The street or street segment should be at least 600 feet long. j)Speed cushions should be at least 300 feet from existing or proposed traffic control devices.
k)Speed cushions should not be located on curves less than 300 feet in radius. l)The installation of speed cushion(s) shall not adversely affect response times of emergency services. This shall be determined by the Engineering Department in conjunction with the affected emergency service(s) department input. If it is determined by the Engineering Department that emergency response time would be adversely affected by a request, the application may be rejected, and your request will no longer be considered.

1.a
Packet Pg. 12

m)If at any time during this process the Engineering Department finds that there would be a substantial traffic diversion to parallel local streets due to speed cushion installation, the neighborhood facilitator shall also be responsible for obtaining the approval/disapproval of property owners on the parallel, affected local street(s). n)It is recognized that special circumstances exist where placement of speed cushions are advantageous; therefore, areas such as school zones, safe routes to school/pedestrian routes, senior communities and other areas approved by the City Council may be considered for speed cushion placement, absent the above required elements for installation.
o)In the event of multiple requests from various neighborhoods, speed cushion requests will be prioritized based on the date and time a completed ‘Speed Cushion Petition Form’ is received by the Engineering Department. p)Once the review has been completed, the Engineering Department will inform the neighborhood facilitator of its findings.
q)Note: If the request does NOT meet any of the minimum criteria identified above for installation, your application will be rejected, and your request will no longer be considered.
r)If the Engineering Department determines the request meets the minimum criteria identified above in item 2, the request will continue to item 3.

3.Identify Exact Location and Draft Speed Cushion Placement Diagram:
a)The Engineering Department will work with the neighborhood representative to identify the exact location of the proposed speed cushions. Once this task is completed, the Engineering Department will draft a speed cushion placement diagram of the affected street. Costs of the installation will be determined at this time. b)Note: Once the exact location of the proposed speed cushion is determined, the neighborhood facilitator will be responsible for obtaining signatures from property owners immediately adjacent to the cushion (defined as the two to four closest property owners in both directions) to determine whether or not each property owner approves of speed cushion placement in front of their residence.

4.Request City Council Approval:
a)The request will then be placed on the next regularly scheduled City of Hollister, City Council agenda, for consideration.

5.Approval and Construction:
a)If approved by the City Council, the Engineering Department will work to schedule the installation of the speed cushions.
b)The construction of speed cushions shall be in accordance with the ‘Speed Cushion Detail’ page of this policy.
c)If the funding is not available, the installation request will be placed on a priority list based on the order of approval.

Speed Cushion Frequently Asked Questions (FAQ’s)
Are all streets not suitable for Speed Cushion installation? In order for a street to qualify for speed cushion installation, certain engineering criteria (e.g., traffic volumes, speeds, street function, etc.) have to be met. For instance, a street defined as an arterial or collector, or one that is a main emergency access street for the neighborhood may not be suitable for speed cushions.

What kind of neighborhood approval is needed for Speed Cushion? Speed cushions affect the entire neighborhood, therefore, at least 67% (2/3rd) of the property owners (defined by Assessor’s Parcel Number/APN’s) living on the street (and parallel streets if applicable) will be needed to approve the installation of speed cushions.

One hundred percent (100%) of property owners immediately adjacent to the cushion (defined as the two to four closest property owners in both directions) will be required to explicitly agree to the installation.

Who pays for the speed cushions?
Based on the availability of funding and as approved annually by the Hollister City Council, the City of Hollister will attempt to appropriate $20,000.00, per fiscal year towards speed cushion installation.
