TITLE OF ITEM: ELECTION CONSULTING PROJECTS - HOLLISTER

INDEPENDENCE DAY RALLY BALLOT MEASURE

BRIEF DESCRIPTION: The City of Hollister has several requests for Election Consulting projects. Each project has a cost and staff is seeking direction to move forward. This item is asking for Council direction on election consulting for a ballot measure in 2022 concerning holding the Annual Independence Day Rally beginning in 2023.

RECOMMENDATION: Provide staff direction for election consulting for a ballot measure in 2022 concerning holding the Annual Independence Day Rally beginning in 2023.

DEPARTMENT SUMMARY: The City Clerk is seeking direction to move forward with securing Best Best and Krieger (BBK) to provide election consulting services concerning a ballot measure for the 2022 Election, asking the voters to decide if the City of Hollister should hold an Annual Independence Day Rally each year. Staff is also seeking clarification that this would be an advisory measure:

An advisory question is a type of ballot measure
https://ballotpedia.org/Ballot_measure > in which citizens vote on a non-binding question. The difference between an advisory vote and any other type of ballot measure is that the outcome of the advisory question will not result in a new, changed, repealed, or rejected law or constitutional amendment. Rather, advisory questions allow voters to voice their preference and allow the state legislature or local government to gauge public opinion on the issue being presented.

At the April 18, 2022, City Council meeting, Council provided direction to staff to hold a Special City Council meeting on a Saturday, to receive public input and discussion.

FINANCIAL IMPACT: Unknown. In addition to consulting fees, each city wide measure costs between $16,000.00 -$26,000.00 for the November 8, 2022 Election.

CEQA: This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines §§ 15378 and 15061(b)(3) as it is an organizational structure change that will not result in any direct or indirect physical change in the environment.

TITLE OF ITEM: FIRE DISTRICT

BRIEF DESCRIPTION: The City of Hollister has several requests for Legal Consulting projects. Each project has a cost and staff is seeking direction to move forward. This item is asking for Council direction regarding securing legal consulting services for a Fire District.

RECOMMENDATION: Provide staff direction regarding securing legal consulting services for a Fire District.

DEPARTMENT SUMMARY: At the April 18, 2022 City Council Meeting, the City Clerk was seeking direction to move forward with securing Best Best and Krieger (BBK) to provide legal consulting services concerning a Fire District, which would serve the City of Hollister, City of San Juan Bautista, and the County of San Benito. Staff was seeking clarification from Council if the desire is to create a Fire District with a JPA Agreement, or, forming an entirely new agency, which would involve County LAFCO.

Staff has learned that the new agency process would take likely around a year to complete to provide time for the application process, LAFCo analysis and hearings, and a possible election. The LAFCo process would likely be initiated by either the City Council or San Benito County Board of Supervisors. The conclusion of the process would be 2023 or 2024.

At the April 18, 2022, City Council Meeting, Council directed staff to add this to the Special City Council Meeting in May 2022 for public input and further discussion.

FINANCIAL IMPACT: Unknown. Pricing depends on complexity.

CEQA: This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines §§ 15378 and 15061(b)(3) as it is an organizational structure change that will not result in any direct or indirect physical change in the environment.
