STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: August 17, 2026
REPORT # Planning-2026-01

AGENDA ITEM: RESOLUTIONS APPROVING THE INITIATION OF GENERAL

PLAN AMENDMENT AND PREZONE FOR THREE PROJECT SITES

DEPARTMENT: Planning
DEPARTMENT HEAD: Jeff Crechriou, Airport Director

COUNCIL NEXT STEPS: Hold A public hearing and:

1. Adopt a resolution approving the initiation of General Plan Amendment 2026-1 and Prezone 2026-1 for a 1.9-acre parcel located at the northwest corner of Fairview Road and HWY 25 (APN 020-330-003); and

2. Adopt a resolution approving the initiation of Prezone 2026-2 for the 12.9-acre parcel located in the unincorporated area of the County of San Benito, Northwest of Wright Road and San Felipe Road and the initiation of Gene ral Plan Amendment 2026-2 to amend the Land Use Plan Map of the City of Hollister General Plan to include to annex the parcel into the City (APN 019-090-025; and

3. Adopt a resolution approving the initiation of General Plan Amendment 2026 -3 and Prezone 2026-3 for a 40.03-acre parcel located between Highway 25 and the City of Hollister Municipal Airport (APN 014-090-053, 014-090-016, and 014-090-058).

DISCUSSION: The City has received three application submittals for an Initiation of a General Plan Amendment and Prezone. These Applications are:

1. GPA 2026-1 and Prezone 2026-1 - Vakili

2. GPA 2026-2 and Prezone 2026-2 – Brigantino

3. GPA 2026-3 and Prezone 2026-3 - Wynn/Clearist Park

Sections 17.80.030 17.86.040 of the Hollister Municipal Code require any applicant who wishes to apply for a General Plan Amendment and/or Prezone to first apply for an Initiation application. This allows the City Council to review the proposal and d etermine if the Council is supportive of the annexation prior to a formal application which requires the expenditure of monies by the applicant (related to application fees , plans and environmental review).

A General Plan Amendment for all annexation requests is required to amend the Land Use Map to show that the project area within the City Limit Line. The City must also establish the zoning designation of the property that takes effect once the annexation is approved- Prezoning.

The proposed annexations are described in detail below.

GPA 2026-1 and Prezone 2026-1 (Vakili)

On May 22, 2026, the Applicant applied for an Initiation of a General Plan Amendment and Prezone for an approximately 1.9 Acre site located at the northwest corner of

Page 27 of 77 ends

Fairview Road and HWY 25 an unincorporated parcel further identified as San Benito County Assessor Parcel Number (APN) 020-330-003. This parcel is located within the City’s Sphere of Influence (SOI).The location of this parcel is shown on the map below:

Figure 1: Vakili Annexation Area

The parcel is currently designated as Low Density Residential in the General Plan.

However, this parcel is located along HWY 25 with access to the parcel located on HWY 25 and single family uses are not the best for this parcel. The Applicant’s project includes an amendment to the General Plan to designate this parcel for commercial use which would provide additional commercial opportunities in the area. This parcel was designated for commercial in the prior 2040 General Plan Update that was rescinded by the City Council.

The Applicant (Vakili) will be responsible for the inclusion of Cielo Vista parcels in the formal annexation application and any work associated with the annexation of this development to ensure the annexation is contiguous to the City.

The Applicant’s written statement is included as Attachment 1.

GPA 2026-2 and Prezone 2026-2 (Brigantino)

On April 22, 2026, the City of Hollister Planning Division received an application requesting the Initiation of Prezone and General Plan Amendment for the approximately

12.9-acre unincorporated parcel further identified as San Benito County Assessor Annexation Site

Page 28 of 77 ends

Parcel Number (APN) 019-090-025. The parcel, currently used for agricultural purposes, is located between Highway 25 and the City of Hollister Airport and is contiguous with the west City limit along San Felipe Road. The parcel is within the General Plan planning area and Sphere of Influence (SOI). The location of the parcel is shown on the map below:

Figure 2: APN 019-090-025

.

The parcel is designated as Industrial in the 2040 General Plan. The Applicant proposes to prezone the site to M1 (Industrial) which is consistent with the existing general plan land use designation.

While the request to Initiate a Prezone would designate the parcel as M1, the applicant intends to continue the parcels use for crop production which is an allowed use in the M1 Zoning District. Because the request for a Prezone will allow for an expansion of use in the future (the eventual development of the site) review under CEQA is required.

Additionally, because annexation will lead to the eventual discontinuation of agriculture on the site, impacts related to the discontinuation of agricultural uses will need to be studied.

This parcel is located within the City’s Sphere of Influence and is adjacent to the City Limit Line.

GPA 2026-3 and Prezone 2026-3 (Wynn/Clearist Park)
Project Site

Page 29 of 77 ends

On July 15, 2026, the City of Hollister Planning Division received an Initiation of a General Plan Amendment and Prezone application for an approximately 40.03 acre project site (APN 014-090-053, 014-090-016 and 014-090-058). This parcel is currently developed with one residential dwelling and is located between Highway 25 and the City of Hollister Airport and is contiguous with the west City limit along San Felipe Road. The parcel is within the General Plan planning area and Sphere of Influence (SOI). The location of the parcel is shown on the map below.

Figure 3: Clearist Park Annexation Area

The parcel is currently designated as Industrial in the 2040 General Plan and the Applicant proposes to Prezone the parcel to Industrial Business Park (IBP ). A request for Initiation was previously approved by the City Council in 2019, however that Initiation did not move forward and a new Initiation application was required because the 2040 General Plan has since been adopted.

This parcel is located within the City’s Sphere of Influence and is adjacent to the City Limit Line and represents the orderly growth of the City’s boundary near the airport.

Should the City Council approve this annexation request, environmental review (CEQA) will be conducted as a part of the project to determine any environmental impacts related to annexation and the ultimate development of this project site.

The Applicant has provided a Plan for Services which is included as Attachment 6.

CONCLUSION: Three Applicants are requesting initiation of a General Plan Amendment and Prezone for annexation into the City of Hollister. The City Council will

Page 30 of 77 ends

weigh and determine if each project should move forward for the study and review of the eventual annexation into the City. The City Council is not required to approve these initiation requests.

At tonight’s meeting the City Council will weigh the benefits of each annexation and make a determination to:

1. Approve or deny Initiation of GPA 2026-1 and Prezone 2026-1 – Vakili (APN 020-330-003).

2. Approve or deny Initiation of GPA 2026-2 and Prezone 2026-2 – Brigantino (APN 019-090-025).

3. Approve or deny Initiation of GPA 2026-3 and Prezone 2026-3 - Wynn/Clearist Park (APNs 014-090-053, 014-090-016 and 014-090-058).

FISCAL IMPACT: $0

PREVIOUS COUNCIL OR COMMISSION ACTION: None

CEQA: As the proposed Initiation of Prezone and General Plan Amendment are exempt from review under the California Environmental Quality Act (CEQA) as the approval to initiate a project is not a project under CEQA. Should the City Council approve the initiation of one or all of these requests, each project will be reviewed under CEQA to determine and apply the appropriate level of CEQA analysis.

PLAN FOR SERVICES

Property Owner Name: John Wynn/Clearist Park LLC (APN 014-090-058) John Wynn/Moonflower Company LLC (APNs 014-090-
016 & 053)
Applicant Name: Anne Hall/San Benito Engineering & Surveying Inc Assessor Parcel Numbers: 014-090-053, 014-090-016, 014-090-058

This Plan for Services accompanies the application of pre-zoning for property by the City of Hollister for purposes of annexation. The property to be annexed comprises 40.0 acres. The annexation site is located west of San Felipe Rd, north of APN 050-010-008 – see attached map. The property is currently under agricultural use, with approximately 4 acres in the south east portion used for residential purposes. These structures, when possible, will be converted to industrial uses. The owner is requesting a pre-zoning of Industrial Business Park (IBP), which is consistent with the contiguous City of Hollister properties.

Pursuant to Section 56653 of the Cortese/Knox Act, the City of Hollister must file a plan for providing services for the affected area of the annexation as part of the submission of the Resolution of Application. Section 56653 requires that the plan for providing services include the following information:

1. An enumeration and description of the services to be extended to the affected (annexed) property.

2. The level and range of those services.

3. An indication of when those services can feasibly be extended to the affected property.

4. An indication of any improvements or upgrading of structures, roads, sewer or water facilities, or other conditions the local agency would impose or require within the affected territory if the change or organization (annexation) is completed.

5. Information with respect to how those services will be financed.

In addition, San Benito County LAFCO policy also requires a clear quantifiable mechanism to provide adequate services.

Below is an analysis of the services that will be required for the annexation of the affective property pursuant to the requirements set forth by Section 56653 of the Act.

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 2 of 5 ends

***
The Clearist Park Annexation consists of 40.0 acres located west of San Felipe Rd, north of APN 050-010- 008. The applicant is requesting pre-zoning and annexation under the City’s Planning and Development Policies contained in their General Plan.

The following is a list of services that would be provided to the Clearist Park Annexation. They will be provided by the City of Hollister unless otherwise noted:
 General Government
 Police Service
 Fire Service
 Water Service
 Sewer Service
 Storm Drainage
 Road Construction
 Street and Utility Maintenance
 Parks and Recreation
General Government
General Government Services include the City Council, City Administration (City Manager, City Attorney), City Finance (Payment of Utility Bills), Building, Planning, Engineering and Animal Control. These services are currently being provided to the City populous at large. Annexation of the affected area in its current condition will not cause any increase in City General Government services. Development of the site, if annexed, will cause a minor increase in General Government Service for the City Council, City Administration, City Finance and Animal Control. These will be financed through an incremental increase in General Fund Revenues, such as property and sales taxes. The City is also requiring that all projects requesting annexation enter into an agreement to be fiscally neutral (project will provide all revenues necessary to provide public service). The incremental increase in services for Building, Planning and Engineering will be financed through permit fees.

Police Service
Police service to the affected area will be provided by the Hollister Police Department upon annexation.

The Police Department provides this service throughout the city based on staffing levels set by the City Council. The proposed annexation is contiguous to the current City limits (current service area). The annexation will extend the boundary of police service currently in effect.

Upon annexation and development, the project will include roadways that would affect traffic enforcement/collision investigation responsibilities, and an incremental increase in staffing levels and capital equipment due to the increase in population. The increase in police service will be financed by

Page 41 of 77 ends

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 3 of 5 ends

the imposition of a Mello-Roos Community Facilities public safety tax. The increase in capital equipment will be financed through the imposition of police impact fees collected at the time of building permit issuance or prior to occupancy of the site. The annexation of the area will not create the need for any police related structures or improvements.

Fire Service
Fire service to the affected area will be provided by the Hollister Fire Department upon annexation. The Fire Department provides this service throughout the city and adjoining County areas, via a mutual aide agreement, based on staffing levels set by the City Council. The Fire Department houses its personnel at its stations located at the northwest corner of Fifth Street & Sally Street and Union Road & Valley View Road. The proposed annexation is contiguous to the current City limits (current service area), and will extend the boundary of fire service currently in effect. The area is within the five-minute first response of the city Fire Station 1 (Fifth St & Sally St). Upon annexation and development, the project will require an incremental increase in staffing levels and capital equipment due to the increase in population. The increase in fire service will be financed by the imposition of a Mello-Roos Community Facilities public safety tax. The increase in capital equipment will be financed through the imposition of fire impact fees collected at the time of building permit issuance or prior to occupancy of the site. The annexation of the area will not create the need for any fire related structures or improvements.

Water Service
Once annexed the property will be within the City of Hollister’s service area. The annexation would have no effect on the provision of the service by the City of Hollister. All plans for water service will need to be approved by Hollister’s Engineering Department. The current houses are served by an existing well.

Upon annexation, the well will be used for landscape (non-domestic) use only. The proposed project has not yet determined the number of industrial units that will be built, but it is estimated it will contain 15 each 2 acre lots. The city does not have a standard for water estimated water usage in Industrial Zones, but it does have a wastewater standard that would be a direct result of water use. It is estimated at 1,8000 gpd/ac for light industrial and 12,000 for heavy industrial. The proposed uses are unknown at this time, but it is anticipated to be light industrial. Assuming an average use of 6,900 gpd/ac, for an estimated 30 usable acres, the business park could use 207,000 gallons per day. Existing water mains are located in San Felipe Rd near the project site, and Minh Dr, part of the annexation. Water will be supplied to the annexing area from the water mains located in the Clearist Park subdivision and Minh Dr.

A developer will be required to fund the installation of the water lines to all City of Hollister standards.

Sewer Service
Four residential structures currently occupy the site, and are served by existing septic tanks.

Development of the site after annexation will require City of Hollister sewer service. The City of Hollister currently provides sewer service as far north as the airport and Technology Drive subdivision, and with

Page 42 of 77 ends

Page 4 of 5 ends

the Hollister Domestic Wastewater Treatment Plant (DWTP), which serves within the city limits and portions of unincorporated San Benito County. The project proposed would generate an anticipated flow of 207,000 gallons per day of wastewater.

Sewage or wastewater flows are transported to the treatment plant via a series of transmission lines.

The proposed property would flow to a proposed sanitary sewer transmission lift station that will be located in Clearist Park subdivision.

The sanitary sewer lift in Clearist Park subdivision runs a force main to the airport lift station. Per the City of Hollister Sanitary Sewer Collection System Master Plan adopted in August, 2010, this entire property is included in the study area. To offset the use of the capacity for the transmission lines, any development will be assessed an impact fee at the time of building permit issuance. A sewer treatment impact fee will also be assessed to provide funding for additional capacity at the sewer plant.

Storm Drainage
The property generally surfaces flows to the north, through adjoining areas of unincorporated San Benito County to the Tequisquita Slough. In accordance with the Low Impact Development requirements of the City of Hollister Grading and Best Management Practices Control Ordinance (Ord. #1053) more water will be retained on site than in traditional development methods, but a small portion and overflow will still be sent to the surface drainage system. The developer will be required to fund the installation of all storm drainage improvements needed for the affected area to the City Standards.

Road Construction
The City of Hollister requires that there be adequate roadways to serve the transportation needs of the city residents. The City, private developers or a combination of both, funds roadways. The project site front is on San Felipe Rd and Minh Dr. Upon development, it may require improvement of the property frontage to City of Hollister standards. The development may require, on an incremental basis, the need for expanded roadway facilities in the city. To offset these incremental costs, any development will be assessed a traffic impact fee at the time of final occupancy for a building permit.

Street and Utility Maintenance
Annexation of the property in its current state will not require an increase in the funding for the street or utility maintenance. Development of the site will require maintenance of city streets, landscaping and utility facilities that will serve the site, as well as streets and utility systems within the development.

The area street maintenance is funded by the City of Hollister state-collected taxes and Community Facility Districts. City utility systems are currently funded by City user fees, however as a part of any development agreement, the property will be required to annex to a new lighting and landscaping district for the maintenance of lighting, landscaping and utility services that will serve the site.

Page 43 of 77 ends

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 5 of 5 ends

Parks and Recreation
No parks or recreation units currently occupy the affected area. Development of industrial projects generally do not require a park contribution. At the time of review of the development application, the projects financial contribution for park lands or facilities will be determined.

The City of Hollister generally funds a number of recreation programs to serve the needs of city residents. These programs are funded at a level of 75 percent by user’s fees. The remaining costs are funded by the City of Hollister General Fund. The City will enter into an annexation agreement with the owner of the property to ensure that development of the site is fiscally neutral, which would include the City portion of the funding required for recreational programs.

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: August 3, 2026
REPORT # Public Works-2026-01

AGENDA ITEM: A RESOLUTION RESCINDING RESOLUTION 2023-164 AND

APPROVING THE NEW TRAFFIC CALMING MEASURES REQUEST POLICY AND

PROCEDURES

DEPARTMENT: Public Works
DEPARTMENT HEAD: Tony White, Public Works Director

COUNCIL NEXT STEPS: Adopt a resolution rescinding resolution 2023-164 and approving the new Traffic Calming Measures request policy.

DISCUSSION:

The City Manager recommends adoption of a new Traffic Calming policy based on the 2023 Speed Cushion Policy and Procedure Policy to include all traffic calming measures and to align administrative responsibilities with the City's Council-Manager form of government. In addition to expanding the type of calming measure beyond speed cushions, the proposed amendments assign responsibility for evaluating traffic engineering impacts and determining the appropriateness of traffic calming measures to the City Engineer, the City's designated subject matter expert.

The revisions also remove operational decision-making from the City Council's role, consistent with Hollister Municipal Code Section 2.08.020, which provides that the City Manager is responsible for the efficient administration of a ll City affairs under the Manager's authority. Accordingly, traffic engineering policies and their implementation are administrative functions carried out by the City Manager through the Public Works Department.

The suggested policy expands the definition of applicant to include HOA and city council members if they wish to do so on behalf of a constituent.

Purpose

The purpose of the Traffic Calming Policy and Procedures is to establish consistency and transparency for installation of traffic calming elements in City residential streets.

Advantages and Disadvantages of Traffic Calming Measures

Traffic calming on residential streets consists of engineering measures intended to reduce vehicle speeds, discourage cut-through traffic, and improve safety for pedestrians, bicyclists, and motorists. Common treatments include speed cushions, speed humps, raised crosswalks, curb extensions, traffic circles, and enhanced pavement markings. When properly designed and installed, these measures ca n reduce speeding and collisions, improve neighborhood livability, encourage walking and bicycling, and enhance safety near schools, parks, and other community destinations.

Traffic calming can also reduce reliance on ongoing traffic enforcement by creating self- enforcing road conditions.

Despite these benefits, traffic calming measures also present challenges that should be carefully considered. Certain devices may increase emergency response times, generate additional vehicle noise from braking and acceleration, or divert traffic onto adjacent residential streets. Installation and maintenance require public funding, and some measures may affect parking, drainage, street sweeping, or access for larger vehicles. Because the effectiveness and impacts of traffic calming vary by location, most transportation professionals recommend that requests be evaluated through an engineering study that considers traffic speeds, volumes, collision history, roadway characteristics, emergency access, and community input before selecting the most appropriate treatment. Overall, traffic calming is most successful when implemented as part of a balanced, data-driven approach that improves public safety while minimizing unintended consequences.

This policy outlines criteria and steps that will be taken by staff when evaluating a traffic calming request.

Eligible Applicants
A request may be submitted by:

 A property owner;
 A resident living within the affected neighborhood;

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: August 17, 2026
REPORT # City Manager-2026-38

AGENDA ITEM: DISCUSSION REGARDING POTENTIAL REGULATIONS FOR

SPAYING AND NEUTERING OF ANIMALS AND ANIMAL BREEDING

DEPARTMENT: City Manager
DEPARTMENT HEAD: Ana Cortez, City Manager

COUNCIL NEXT STEPS: Discuss potential regulations related to the spaying and neutering of dogs and cats, unaltered animals, and animal breeding within the City of Hollister, and provide direction to staff, if desired

DISCUSSION:

The Animal Ad Hoc Committee is seeking City Council input regarding whether the City should consider regulations addressing the breeding of dogs and cats and requiring certain animals to be spayed or neutered.

As an example, the City of Seaside adopted Ordinance No. 2030 establishing regulations intended to address animal overpopulation and the number of unwanted or surrendered animals. The ordinance generally requires dogs and cats above specified ages to be spayed or neutered unless the owner obtains certification allowing the animal to remain unaltered. Certain exemptions are also provided, including for law enforcement animals, animals that cannot safely be altered for medical reasons, and animals temporarily within the City.

The Seaside ordinance also establishes a breeder permit program for individuals who intentionally breed dogs or cats for the purpose of selling or transferring offspring. The program includes requirements related to permitting, animal ca re, advertising, recordkeeping, identification of animals, and enforcement.

The purpose of this discussion is not to introduce or adopt an ordinance at this time, but rather to provide the City Council with an opportunity to discuss whether similar regulations may be appropriate for the City of Hollister and, if so, what provisions Council would like staff to further evaluate.

Based on Council feedback, staff could return at a future meeting with additional information and potential ordinance options for Council consideration.

FISCAL IMPACT:

There is no direct fiscal impact associated with holding this discussion. Should Council direct staff to develop an ordinance or regulatory program, potential costs associated with administration, permitting, enforcement, and public outreach would be evaluated and presented as part of a future agenda item.
