PLAN FOR SERVICES

Property Owner Name: John Wynn/Clearist Park LLC (APN 014-090-058) John Wynn/Moonflower Company LLC (APNs 014-090-
016 & 053)
Applicant Name: Anne Hall/San Benito Engineering & Surveying Inc Assessor Parcel Numbers: 014-090-053, 014-090-016, 014-090-058

This Plan for Services accompanies the application of pre-zoning for property by the City of Hollister for purposes of annexation. The property to be annexed comprises 40.0 acres. The annexation site is located west of San Felipe Rd, north of APN 050-010-008 – see attached map. The property is currently under agricultural use, with approximately 4 acres in the south east portion used for residential purposes. These structures, when possible, will be converted to industrial uses. The owner is requesting a pre-zoning of Industrial Business Park (IBP), which is consistent with the contiguous City of Hollister properties.

Pursuant to Section 56653 of the Cortese/Knox Act, the City of Hollister must file a plan for providing services for the affected area of the annexation as part of the submission of the Resolution of Application. Section 56653 requires that the plan for providing services include the following information:

1. An enumeration and description of the services to be extended to the affected (annexed) property.

2. The level and range of those services.

3. An indication of when those services can feasibly be extended to the affected property.

4. An indication of any improvements or upgrading of structures, roads, sewer or water facilities, or other conditions the local agency would impose or require within the affected territory if the change or organization (annexation) is completed.

5. Information with respect to how those services will be financed.

In addition, San Benito County LAFCO policy also requires a clear quantifiable mechanism to provide adequate services.

Below is an analysis of the services that will be required for the annexation of the affective property pursuant to the requirements set forth by Section 56653 of the Act.

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 2 of 5 ends

***
The Clearist Park Annexation consists of 40.0 acres located west of San Felipe Rd, north of APN 050-010- 008. The applicant is requesting pre-zoning and annexation under the City’s Planning and Development Policies contained in their General Plan.

The following is a list of services that would be provided to the Clearist Park Annexation. They will be provided by the City of Hollister unless otherwise noted:
 General Government
 Police Service
 Fire Service
 Water Service
 Sewer Service
 Storm Drainage
 Road Construction
 Street and Utility Maintenance
 Parks and Recreation
General Government
General Government Services include the City Council, City Administration (City Manager, City Attorney), City Finance (Payment of Utility Bills), Building, Planning, Engineering and Animal Control. These services are currently being provided to the City populous at large. Annexation of the affected area in its current condition will not cause any increase in City General Government services. Development of the site, if annexed, will cause a minor increase in General Government Service for the City Council, City Administration, City Finance and Animal Control. These will be financed through an incremental increase in General Fund Revenues, such as property and sales taxes. The City is also requiring that all projects requesting annexation enter into an agreement to be fiscally neutral (project will provide all revenues necessary to provide public service). The incremental increase in services for Building, Planning and Engineering will be financed through permit fees.

Police Service
Police service to the affected area will be provided by the Hollister Police Department upon annexation.

The Police Department provides this service throughout the city based on staffing levels set by the City Council. The proposed annexation is contiguous to the current City limits (current service area). The annexation will extend the boundary of police service currently in effect.

Upon annexation and development, the project will include roadways that would affect traffic enforcement/collision investigation responsibilities, and an incremental increase in staffing levels and capital equipment due to the increase in population. The increase in police service will be financed by

Page 280 of 395 ends

Page 3 of 5 ends

the imposition of a Mello-Roos Community Facilities public safety tax. The increase in capital equipment will be financed through the imposition of police impact fees collected at the time of building permit issuance or prior to occupancy of the site. The annexation of the area will not create the need for any police related structures or improvements.

Fire Service
Fire service to the affected area will be provided by the Hollister Fire Department upon annexation. The Fire Department provides this service throughout the city and adjoining County areas, via a mutual aide agreement, based on staffing levels set by the City Council. The Fire Department houses its personnel at its stations located at the northwest corner of Fifth Street & Sally Street and Union Road & Valley View Road. The proposed annexation is contiguous to the current City limits (current service area), and will extend the boundary of fire service currently in effect. The area is within the five-minute first response of the city Fire Station 1 (Fifth St & Sally St). Upon annexation and development, the project will require an incremental increase in staffing levels and capital equipment due to the increase in population. The increase in fire service will be financed by the imposition of a Mello-Roos Community Facilities public safety tax. The increase in capital equipment will be financed through the imposition of fire impact fees collected at the time of building permit issuance or prior to occupancy of the site. The annexation of the area will not create the need for any fire related structures or improvements.

Water Service
Once annexed the property will be within the City of Hollister’s service area. The annexation would have no effect on the provision of the service by the City of Hollister. All plans for water service will need to be approved by Hollister’s Engineering Department. The current houses are served by an existing well.

Upon annexation, the well will be used for landscape (non-domestic) use only. The proposed project has not yet determined the number of industrial units that will be built, but it is estimated it will contain 15 each 2 acre lots. The city does not have a standard for water estimated water usage in Industrial Zones, but it does have a wastewater standard that would be a direct result of water use. It is estimated at 1,8000 gpd/ac for light industrial and 12,000 for heavy industrial. The proposed uses are unknown at this time, but it is anticipated to be light industrial. Assuming an average use of 6,900 gpd/ac, for an estimated 30 usable acres, the business park could use 207,000 gallons per day. Existing water mains are located in San Felipe Rd near the project site, and Minh Dr, part of the annexation. Water will be supplied to the annexing area from the water mains located in the Clearist Park subdivision and Minh Dr.

A developer will be required to fund the installation of the water lines to all City of Hollister standards.

Sewer Service
Four residential structures currently occupy the site, and are served by existing septic tanks.

Development of the site after annexation will require City of Hollister sewer service. The City of Hollister currently provides sewer service as far north as the airport and Technology Drive subdivision, and with

Page 281 of 395 ends

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 4 of 5 ends

the Hollister Domestic Wastewater Treatment Plant (DWTP), which serves within the city limits and portions of unincorporated San Benito County. The project proposed would generate an anticipated flow of 207,000 gallons per day of wastewater.

Sewage or wastewater flows are transported to the treatment plant via a series of transmission lines.

The proposed property would flow to a proposed sanitary sewer transmission lift station that will be located in Clearist Park subdivision.

The sanitary sewer lift in Clearist Park subdivision runs a force main to the airport lift station. Per the City of Hollister Sanitary Sewer Collection System Master Plan adopted in August, 2010, this entire property is included in the study area. To offset the use of the capacity for the transmission lines, any development will be assessed an impact fee at the time of building permit issuance. A sewer treatment impact fee will also be assessed to provide funding for additional capacity at the sewer plant.

Storm Drainage
The property generally surfaces flows to the north, through adjoining areas of unincorporated San Benito County to the Tequisquita Slough. In accordance with the Low Impact Development requirements of the City of Hollister Grading and Best Management Practices Control Ordinance (Ord. #1053) more water will be retained on site than in traditional development methods, but a small portion and overflow will still be sent to the surface drainage system. The developer will be required to fund the installation of all storm drainage improvements needed for the affected area to the City Standards.

Road Construction
The City of Hollister requires that there be adequate roadways to serve the transportation needs of the city residents. The City, private developers or a combination of both, funds roadways. The project site front is on San Felipe Rd and Minh Dr. Upon development, it may require improvement of the property frontage to City of Hollister standards. The development may require, on an incremental basis, the need for expanded roadway facilities in the city. To offset these incremental costs, any development will be assessed a traffic impact fee at the time of final occupancy for a building permit.

Street and Utility Maintenance
Annexation of the property in its current state will not require an increase in the funding for the street or utility maintenance. Development of the site will require maintenance of city streets, landscaping and utility facilities that will serve the site, as well as streets and utility systems within the development.

The area street maintenance is funded by the City of Hollister state-collected taxes and Community Facility Districts. City utility systems are currently funded by City user fees, however as a part of any development agreement, the property will be required to annex to a new lighting and landscaping district for the maintenance of lighting, landscaping and utility services that will serve the site.

Page 282 of 395 ends

Clearist Park/Moonflower Company Annexation – Plan for Services July 2026

Page 5 of 5 ends

Parks and Recreation
No parks or recreation units currently occupy the affected area. Development of industrial projects generally do not require a park contribution. At the time of review of the development application, the projects financial contribution for park lands or facilities will be determined.

The City of Hollister generally funds a number of recreation programs to serve the needs of city residents. These programs are funded at a level of 75 percent by user’s fees. The remaining costs are funded by the City of Hollister General Fund. The City will enter into an annexation agreement with the owner of the property to ensure that development of the site is fiscally neutral, which would include the City portion of the funding required for recreational programs.

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: September 8, 2026
REPORT # Planning-2026-02

AGENDA ITEM: A RESOLUTION VACATING THE RIGHT-OF-WAY OF A PORTION

OF NASH ROAD BETWEEN WEST STREET AND MONTEREY STREET

DEPARTMENT: Planning
DEPARTMENT HEAD: Jeff Crechriou, Airport Director

COUNCIL NEXT STEPS: Adopt a resolution vacating the right-of-way of a portion of Nash Road and approve the sale of the right-of-way to the San Benito High School District.

DISCUSSION: The Applicant, the San Benito High School District (District), has requested the City vacate its right-of-way over a portion of Nash Road, between West Street and Monterey Street. The District will compensate the City for the vacation.

On August 27, 2026, the Planning Commission adopted a Resolution determining that the proposed vacation of a portion of Nash Road is in conformity with the 2040 General Plan and that the vacation and disposal is not a project pursuant to CEQA Guidelines Section 15378.

A portion of Nash Road currently bisects the Hollister High School Campus. The City Council previously approved the temporary closure of Nash Road between West Street and Monterey Street for health and safety reasons (Resolution No. 2016 -176). The San Benito High School District has requested that this portion of the City’s right-of-way be vacated to the District to make this closure permanent and a part of the Campus.

The San Benito High School District has included a letter regarding the requested vacation which is included as Attachment 2.

Page 284 of 395 ends

Figure 1: Location of Right-of-Way to be Vacated

Streets and Highways Code section 8331 provides that a local agency may summarily vacate a street or highway so long as: (1) the street or highway has been impassable for vehicular travel for a period of five (5) consecutive years, and (2) no public money was used for the maintenance of the street or highway during such period. The subject right - of-way meets these conditions. Accordingly, a local agency may summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes. (Sts. & Hy. Code, § 8334, subd. (a).)

If ultimately approved, the right-of-way vacation would result in the City removing its surface rights to use this portion of Nash Road for vehicles . The northern portion of the road, which is located within the City, would then be zoned to Public Facility/ Institutional, same as the portion of the Campus which is in City Limits.

This portion of Nash Road, while shown in the 2040 General Plan, has been closed to vehicular traffic for several years. Permanent closure of this road to facilitate student crossings and to ensure a safe path of travel across Nash Road are consistent with the Goals, Policies and Actions of the General Plan. Policy C-1.10, Local Schools, encourages the City to improve pedestrian flow around school sites. Policy C -3.2, Pedestrian and Bicycle Connections, requires the City to ensure safe pedestrian pathways to schools. The vacation of the City’s rights over this portion of Nash Road will not impede the City’s ability to meet the Goals of the 2040 General Plan.

FISCAL IMPACT: Pursuant to the Final Offer to Negotiate Purchase of the Right of Way from San Benito High School District (District), the District will pay the City $10,000 for the Right of Way over the subject property.

PREVIOUS COUNCIL OR COMMISSION ACTION: The City Council adopted Resolution No. 2016-176 temporarily closing Nash Road between West Street and Monterey Street for the Hollister High School.

Pursuant to action taken by the City Council at its duly noticed meeting on May 18, 2026, the City of Hollister accepted the Final Offer to Negotiate Purchase of Right of Way from San Benito High School District (District). The parties, City and District, further agreed to coordinate in accordance with California Streets and Highway Code section 8335 to effectuate the formal vacation of the City’s right of way over the subject property.

The Planning Commission adopted a Resolution determining that the proposed vacation of a portion of Nash Road is in conformity with the 2040 General Plan and that the vacation and disposal is not a project pursuant to CEQA Guidelines Section 15378 during a public hearing on August 27, 2026.

CEQA: The vacation of right-of-way does not fall within the definition of a “project” pursuant to CEQA Guidelines section 15378 and no further environmental review is required. The existing road is currently closed off and is not used for vehicular traffic, and the right-of-way vacation would not change an existing condition. Furthermore, the vacation is consistent with the Hollister 2040 General Plan.

LETTER OF SUPPORT FOR NASH ROAD CLOSURE
On behalf of the San Benito High School District (“District”), we write in strong support of permanently closing the portion of Nash Road between Monterey Street and West Street adjacent to Hollister High School.

Hollister High School is the 2nd largest school in Northern California and 13th largest high school in California, serving over 3,400 students. Because the campus extends across this portion of Nash Road, students and staff must regularly cross the roadway while traveling between classrooms, programs, and facilities. Permanently closing this section would create a safer, unified campus which would significantly reduce the risk of vehicles coming into conflict with students, employees, and community members.

Although the roadway is currently closed on a temporary basis, the intention and overarching goal of the 2016 Interagency Cooperation Agreement (“Interagency Agreement”) between the City of Hollister (“City”), County of San Benito, and District when installing the Hollister High School gates was for the closure to ultimately become permanent. Under the Interagency Agreement, not only did the District fund all traffic calming measures and signage around the closure area, including the construction of the gates pursuant to the Interagency Agreement, but the District also financially supported the construction of the River Parkway to the south of the campus as an intended alternative means of thoroughfare in the area. The temporary closure has served as an important step toward that long-term safety objective, allowing the District and the City to address emergency access, traffic circulation, and other operational considerations before formalizing the permanent closure.

The need for a permanent closure is underscored by the vehicle-related incidents that have occurred since the gates were installed. To date, eight incidents have damaged portions of the gates since their installation. These incidents demonstrate the ongoing safety risks created when motorists attempt to travel through or navigate around this area. A permanent closure, accompanied by appropriate signage, would provide consistency and greater clarity to drivers and direct them toward well-established alternative routes, including River Parkway and the surrounding West and Monterey Street corridors.

Importantly, the closure would not prevent the Hollister Fire Department (“HFD”) and other first responders from reaching the campus or surrounding neighborhoods. It is the District’s understanding that all HFD trucks have the Opticom Access System to open and navigate the portion of the roadway when responding to an emergency. This ensures that fire and emergency services can continue to reach those in need without unnecessary delay.

In addition to serving students and staff members during the school day, Hollister High School welcomes families and community members for athletic competitions, performances, meetings, and events hosted by more than 50 active student clubs during evening hours and throughout the weekend. Permanently closing this section of Nash Road would provide a safer environment for everyone who visits the campus and must navigate between its facilities.

We deeply appreciate the City’s ongoing collaboration and partnership with the District throughout this process, including the City’s active participation in initial planning meetings, its thoughtful consideration of emergency- access needs, and its continued commitment to advancing a permanent solution. This close working relationship reflects a shared and unwavering dedication to protecting the safety of students, employees, first responders,

Page 292 of 395 ends

and the broader Hollister community, and it provides a strong foundation for the successful implementation of a permanent closure.

For these reasons, San Benito High School District respectfully urges the Hollister Planning Commission and City Council to approve the permanent closure of Nash Road between Monterey Street and West Street. We look forward to the continued partnership between the City and the District in making our schools and community safer.

STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: September 8, 2026
REPORT # Public Works-2026-44

AGENDA ITEM: A RESOLUTION AUTHORIZING THE CITY MANAGER, OR THEIR

DESIGNEE, TO APPLY FOR AND EXECUTE A FINANCIAL ASSISTANCE

AGREEMENT WITH THE STATE WATER RESOURCES CONTROL BOARD FOR

THE VALENZUELA WATER SERVICE UPGRADE PROJECT

DEPARTMENT: Public Works
DEPARTMENT HEAD: Tony White, Public Works Director

COUNCIL NEXT STEPS: Adopt a resolution designating the City Manager, or their designee, as the City’s Authorized Representative for the Valenzuela Water Service Upgrade Project, and authorize them to apply for and execute a financial assistance agreement with the State W ater Resources Control Board for the Project.

DISCUSSION: The Valenzuela Water System (VWS) is a small community water system located outside the City of Hollister that serves approximately 74 residents through 15 service connections. The system relies on a single groundwater well that has repeatedly exceeded the drinking water standard for nitrates.

In 2018, the California State Water Resources Control Board (SWRCB) issued a Compliance Order due to nitrates and inconsistent provision of drinking water availability and prompted the SWRCB to require the evaluation of long-term corrective actions to ensure a compliant source of drinking water. The Rural Community Assistance Corporation (RCAC) was identified as the lead technical assistance provider and coordinated efforts among the State, the Valenzuela Water System, San Benito County, and the City of Hollister. Through RCAC, Coleman Engineering was retained to prepare a Preliminary Engineering Report (PER) evaluating feasible alternatives .

The final revised engineering report, completed in August 2025, concluded that consolidation with the City of Hollister water system is the preferred long-term solution.

Specifically, the report recommends extending City water service to the Valenzuela community through construction of parallel dual 8” water mains connected to t he City's existing 12-inch distribution main on Nash Rd. The report determined that consolidation provides the most reliable solution. All the costs associated with this project will be reimbursed by the SWRCB.

The Valenzuela Water System Upgrade Project ("Project") has already advanced through several initial stages, including review by the San Benito County Development Review Committee, preparation of 90% complete improvement plans, and development of CEQA documentation.

The next step in the process is City Council approval of an authorizing resolution designating the City Manager as the City’s Authorized Representative for the Project.

This designation will authorize the City Manager, or designee, to provide the assurances, certifications, and commitments required for the financial assistance

Page 295 of 395 ends

application, including executing a financial assistance agreement from the SWRCB and any amendments or changes thereto.

Approval of the authorizing resolution represents an initial step in the DWSRF funding process and does not constitute authorization to proceed with construction. As the Project advances, staff will return to the City Council as necessary to provide Project updates and obtain additional approvals, including authorizations associated with the Local Agency Formation Commission (LAFCO) process and procurement of construction services.

The current estimated Project cost, as prepared by SanBell Engineering, is approximately $1,786,000. Project expenditures, which include staff time and resources, are to be funded through Fund 620 and subsequently fully reimbursed through DWSRF grant funding.

FISCAL IMPACT: Future approximate cost of $1,786,000 to Fund 620 which would be reimbursed from DWSRF grant.

PREVIOUS COUNCIL OR COMMISSION ACTION: N/A

CEQA: An Initial Study/Mitigated Negative Declaration (IS/MND) was prepared and circulated through the State Clearinghouse in accordance with CEQA. The required public review period has been completed.

Why Cities Work With Regulators
This is a normal public-utility process: identify a risk, coordinate the fix, protect residents, and keep the City in control of the next step. 1 Issue Identified
A water-quality, reliability, or
infrastructure issue needs a long-term
solution.
2 Regulator
Coordination
State and technical-assistance
partners help define a responsible
path forward.
3 City Due Diligence
The City reviews capacity, funding,
agreements, risk, and operational
impacts.
4 Council Action
Council authorizes the next controlled
step so funding and documents can
move forward.

Key Message
Working with regulators does not mean the City caused the issue or is taking on an unmanaged problem. It means the City is helping turn a compliance issue into a planned, fundable, long-term solution.

Benefits to the City
• Lower regulatory risk — early coordination reduces surprises • Better funding access — keeps grant options moving
• Defensible decision-making — clear record for Council action Council’s role is not to solve every technical detail tonight — it is to authorize the next controlled step so staff, regulators, and funding partners can keep the solution moving.21

Referred to: Housing, Community, and Economic Development Policy Committee WHEREAS, California cities have historically been responsible for adopting general plans and zoning regulations, reviewing housing development proposals, and providing or coordinating the streets, water, wastewater, public safety, parks, transportation, and other infrastructure and services necessary to support responsible, environmentally sound, and well-planned residential growth; and
WHEREAS, the League of California Cities is dedicated to protecting and expanding local control for municipalities across the state to ensure their orderly growth and development; and
WHEREAS, the League of California Cities recognizes that local zoning is a primary function of cities and an essential component of home rule, and that a city’s general plan should guide its land use planning and strategic decision-making free from pre-emption by the state; and
WHEREAS, increasingly prescriptive statewide housing mandates and development approval requirements can override locally adopted plans, zoning standards, and public review procedures without adequately accounting for differences that exist in each unique jurisdiction in infrastructure capacity, water availability, wildfire and evacuation risks, environmental constraints, fiscal impacts, public service needs, and community priorities; and
WHEREAS, California’s housing goals can be more effectively advanced through state funding, streamlined environmental requirements, and voluntary partnerships that support housing production while preserving the authority of locally elected officials to determine how and where housing is best planned and approved; NOW, THEREFORE, BE IT RESOLVED, by the General Assembly of the League of California Cities, assembled during the Annual Conference in Anaheim, California, on September 25, 2026, that the League of California Cities support the development and advancement of a state constitutional amendment or other legislative, policy, or ballot- based strategies that restore and strengthen local authority over housing and land use matters within municipal boundaries, including general plans, housing elements, zoning, density, design and development standards, project siting, and the approval or denial of housing development applications; and

BE IT FURTHER RESOLVED, that any constitutional amendment or alternative strategy should preserve the State’s authority to establish broad statewide housing goals and enforce constitutional and civil rights, fair housing requirements, building and life-safety standards, and generally applicable environmental protections, while protecting cities from state actions that compel, through funding conditions or state law, the approval of housing developments that are inconsistent with locally adopted requirements; override local zoning or density standards; or invalidate locally adopted housing or land use decisions when a city has planned in good faith to accommodate its regional housing needs allocation and maintains adequate capacity for housing at all income levels; and

BE IT FURTHER RESOLVED, that the League of California Cities consider establishing a statewide working group or other appropriate committee(s) to evaluate and develop a proposed constitutional amendment or other legislative, policy, or ballot-based strategies to restore and strengthen local authority over housing and land use matters including but limited to: conducting appropriate legal, fiscal, and policy analyses; engaging cities and other stakeholders; and building a statewide coalition of proponent supporters in preparation for; the November 2030 General Election, or within another reasonable time frame as determined by the working group.

2026 Resolution Packet

Background Information for Resolution

Source: City of Murrieta

Background:

California cities are responsible for planning residential growth, adopting general plans and zoning regulations, reviewing development proposals, and providing or coordinating the infrastructure and public services necessary to support new housing. Since 2010, the State has enacted more than 500 housing-related laws that have increasingly shifted housing and land use authority away from local governments. These laws have expanded by-right development, limited locally adopted standards and review processes, and established enforcement mechanisms, including the builder’s remedy, that may override local plans and zoning. Although these measures are frequently presented as solutions to housing affordability, many increase development capacity or restrict local review without delivering the meaningful production of housing needed to address the housing crisis.

At the same time, the State has continued to prioritize increased development capacity without adequately accounting for the infrastructure, public services, economic realities, and safety measures necessary to support housing growth.

State mandates often fail to reflect local conditions, including roadway and utility capacity, water availability, wildfire exposure, environmental limitations, fiscal impacts, and the availability of essential services. Cities are consequently required to accommodate additional housing while receiving no funding or assistance to address the resulting infrastructure and service demands.

Local elected officials are directly accountable to the residents who experience the effects of development decisions and are responsible for balancing housing production with infrastructure capacity, public safety, environmental protection, fiscal sustainability, and community needs. Cities of all types in California have been grappling with this dynamic, ranging from urban to rural, coastal to inland, small to large, northern to southern, voicing concerns to legislative representatives with minimal responsiveness. This is an issue of statewide concern that needs the strength and diversity of the League of California Cities to pursue a long-term solution.

The proposed resolution directs the League of California Cities to establish a statewide working group to evaluate a constitutional amendment or other legislative, policy, or ballot-based strategies to restore and strengthen local authority over housing and land use decisions. The working group would be tasked with developing a more balanced framework that preserves the State’s role in establishing broad housing goals and enforcing constitutional, civil rights, fair housing, building, life-safety, and environmental requirements, while restoring meaningful local authority to allow cities to determine how statewide housing 9 Page 351 of 395

2026 Resolution Packet
objectives should be implemented in a manner that reflects local conditions and community priorities while continuing to support responsible housing production.

As the primary statewide organization representing California cities, the League is uniquely positioned to lead this effort. Its established policy, legal, legislative, communications, and advocacy networks enable it to convene municipalities, evaluate potential strategies, conduct legal and fiscal analyses, build consensus, engage stakeholders, and coordinate with statewide decision-makers. League leadership would help ensure that any recommendation reflects the collective interests of California municipalities and would provide the credibility, organizational capacity, and statewide reach necessary to advance a viable strategy.

Subject: Support for the City of Murrieta's Resolution Establishing a Working Group to Evaluate a State Constitutional Amendment or Other Initiative to Restore Local Housing and Land Use Authority

Dear President Quinto:

I am writing in my individual capacity as Mayor of the City of Temecula to express my strong support for the City of Murrieta's proposed resolution for consideration by the General Assembly of the League of California Cities at the 2026 Annual Conference.

The proposed resolution presents an important opportunity to thoughtfully evaluate the appropriate balance between California's statewide housing objectives and the constitutional principle of local governance. Establishing a statewide working group to examine a potential constitutional amendment, legislative reforms, or other policy initiatives will provide a meaningful forum to assess how local authority over housing and land use decisions can be strengthened while continuing to address the State's housing challenges.

Cities are uniquely positioned to understand the needs, opportunities, and constraints of their communities. Local elected officials are accountable to the residents they serve and are best equipped to make land use decisions that reflect a community's character, infrastructure capacity, economic development goals, environmental stewardship, and long-term vision. Equally important, local governments bear the primary responsibility for protecting public safety. Decisions regarding housing density, transportation, emergency access, wildfire preparedness, evacuation routes, police and fire service capacity, water availability, and critical infrastructure are inherently local matters that require the knowledge and judgment of those who serve their communities every day.

While the State has an important role in addressing California's housing needs, a collaborative approach that respects local expertise and preserves meaningful local discretion will produce stronger, safer, and more sustainable communities. The proposed working group offers an opportunity to evaluate policies that achieve these shared objectives while restoring an appropriate balance between state direction and local authority.

Although this letter reflects my personal position and is not an official action or policy of the City of Temecula or the Temecula City Council, I respectfully endorse the City of Murrieta's submission of this resolution and encourage its favorable consideration by the League of California Cities General Assembly.

Thank you for your leadership and your thoughtful consideration of this important issue.

Respectfully,

Resolution No. 1: Staff Analysis

23 Page 365 of 395

League of California Cities Staff Analysis on Resolution No. 1

Staff: Brady Guertin, Legislative Advocate
Committee: Housing, Community, and Economic Development

Summary:

Resolution No.1 states that the League of California Cities (Cal Cities) will:

1. Support the development and advancement of a state constitutional amendment or legislative, policy, or ballot-based strategy that restores and strengthens local authority over housing and land use matters, including general plans, housing elements, zoning, density, design and development standards, project siting, and the approval or denial of housing development applications.

Pursuant to the resolution, the strategy should preserve the state’s authority to set broad, statewide housing goals and enforce civil rights, fair housing, building safety, and environmental standards while protecting local control by preventing the state from compelling the approval of developments that conflict with local requirements, override local zoning or density standards, or overturn local land use decisions where a city has planned for and maintained sufficient capacity to meet its housing obligations.

2. Consider establishing a statewide working group or other appropriate committee(s) to evaluate and develop a proposed constitutional amendment or other legislative, policy, or ballot-based strategies to restore and strengthen local authority over housing and land use matters.

The resolution states: “conducting legal, fiscal, and policy analyses; engaging cities and other stakeholders; and building a statewide coalition of proponent supporters in preparation for the November 2030 General Election, or within another reasonable time period.”

Background:

As provided in the background information, the city of Murrieta is sponsoring this resolution in response to concerns over state laws that have increasingly reduced city discretion over housing and land use decisions, including legislation that requires ministerial or by-right approvals for housing projects, limits the application of local development standards, and strengthens state enforcement mechanisms against local governments.

Additionally, the city of Murrieta, in its background information, maintains that these legislative efforts have not resulted in sufficient housing production to address California's housing shortage and have not adequately accounted for 24 Page 366 of 395

local infrastructure, public service needs, public safety, market, and fiscal considerations.

The resolution states that California’s housing goals are better advanced through state funding, streamlined environmental requirements, and voluntary partnerships, while preserving local authority over how and where housing is best planned and approved.

Consideration of the resolution may be informed by a brief examination of how the California Constitution allocates authority between the state and cities with respect to land use decisions.

The constitution grants cities the power to adopt local laws to protect the public’s health, safety, and welfare. This grant is called the “police power,” which is the basis for local land use regulation. The constitution grants charter cities the additional power to adopt local laws affecting “municipal affairs.” This power, commonly referred to as “home rule,” is based on the principle that a city, rather than the state, is in the best position to identify and satisfy the needs of the local community.

The constitution’s broad grant of police power contains a significant limitation.

Local law adopted under the police power is not valid if it “conflicts” with state law. A local law “conflicts” with state law when it regulates the same “field” in which the Legislature has stated its intent to occupy. In that case, state law is said to “preempt” the local law and it cannot be enforced.

An ordinance adopted by a charter city under the municipal affairs power cannot be enforced if it affects a “matter of statewide concern.” The subjects that have been identified as “matters of statewide concern” have changed over the years due to economic, social, and political circumstances.

Since the 1960s, the state has enacted numerous laws that limit or preempt aspects of local land use and zoning authority. These laws include the Fair Employment and Housing Act, Housing Element Law, Housing Accountability Act, Density Bonus Law, Permit Streamlining Act, accessory dwelling unit laws, California Environmental Quality Act, and others. In recent years, the state has enacted several laws that Cal Cities was the leading opposition force against, as many of the proposals pre-empted local land use authority, limited public review, and constrained local flexibility. In support of its housing and land use legislation, the Legislature has cited a statewide housing crisis and the need for increased housing production at all income levels while asserting that a uniform approach to local land use decision-making is required.

Discussion:

The resolution does not prescribe a specific policy mechanism. The eight letters in support recommend creating a working group or committee to evaluate potential approaches, including legislative proposals, constitutional amendments, or ballot initiatives to strengthen local authority over housing and land use matters.

A discussion of a strategy to restore and strengthen local authority over housing and land use matters will need to consider the California Constitution’s framework for both preemption of police power enactments and municipal affairs, discussed above. It will also need to determine whether changes to the California Constitution will be proposed, and whether they constitute an amendment or a revision, which require different processes.

A constitutional revision is a multistep process blending legislative consensus, voter support, and on occasion, a constitutional convention. It requires significant public engagement.

A constitutional amendment would require a ballot initiative, which includes gathering enough valid signatures to qualify for the ballot, building large coalitions to support election efforts, and campaigning to voters to support the initiative. This process can involve significant costs. In the last major election for ballot initiatives in 2024, proponents spent $8-$18 million to qualify for the ballot and spent nearly $700 million for the full election cycle, averaging out to about $100 million per ballot initiative.

Cal Cities has been engaged in ballot advocacy for over 20 years. In the early 2000s, Cal Cities developed a ballot advocacy infrastructure that included forming an issue political action committee, fundraising, establishing a network of regional managers, and building a coalition with other organizations to ultimately advocate on a ballot measure. Ballot advocacy requires the approval of the Board of Directors with a supermajority vote.

In the Legislature, Cal Cities plays an active and influential role to ensure that local flexibility and autonomy in the land use and housing space is maintained by engaging on dozens of bills every legislative session to ensure that cities' voices are heard at the state Capitol. Below, you will find Cal Cities “Existing Policy” on local control, housing, and land use policies.

Fiscal Impact
The resolution itself would not have a significant direct fiscal impact. However, depending on what actions follow, the fiscal costs could be significant.

Existing Cal Cities Policy
Vision
To be recognized and respected as the leading advocate for the common interests of California's cities.

Mission Statement
To expand and protect local control for cities through education and advocacy to enhance the quality of life for all Californians.

We Believe
• Local self-governance is the cornerstone of democracy. • Our strength lies in the unity of our diverse communities of interest. • In the involvement of all stakeholders in establishing goals and in solving problems.
• In conducting the business of government with transparency, openness, respect, and civility.
• The spirit of honest public service is what builds communities. • Open decision-making that is of the highest ethical standards honors the public trust.
• Cities are vital to the strength of the California economy. • The vitality of cities is dependent upon their fiscal stability and local autonomy.
• The active participation of all city officials increases the League's effectiveness.
• Partnerships and collaborations are essential elements of focused advocacy and lobbying.
• Ethical and well-informed city officials are essential for responsive, visionary leadership and effective and efficient city operations.

Zoning
Cal Cities believes local zoning is a primary function of cities and is an essential component of home rule. The process of adoption, implementation and enforcement of zoning ordinances should be open and fair to the public and enhance the responsiveness of local decision-makers. State policy should leave local siting and use decisions to the city and not interfere with local prerogative beyond providing a constitutionally valid procedure for adopting local regulations. State agency siting of facilities, including campuses and office buildings, should be subject to local notice and hearing requirements in order to meet concerns of the local community. Cal Cities opposes legislation that seeks to limit local authority over parking requirements.

Housing Element
Housing issues should be addressed in the general plan as other planning issues are. The housing element should be prepared for the benefit of local 27 Page 369 of 395

governments and should have equal status with the other elements of the general plan.

Encourage Full Community Participation
Foster an open and inclusive community dialogue and promote alliances and partnerships to meet community needs.

Well-Planned New Growth
Recognize and preserve open space, watersheds, environmental habitats, and agricultural lands, while accommodating new growth in compact forms, in a manner that:
• De-emphasizes automobile dependency;
• Integrates the new growth into existing communities;
• Creates a diversity of affordable housing near employment centers; • Provides job opportunities for people of all ages and income levels.

1. Scope and Purpose

1.1 Scope

This Administrative Policy Instruction (API) applies to City of Hollister (City) City Council Members and other City Council appointed commissioners and committee members (travelers) who travel on official business for the City of Hollister.

All travel arrangements, reconciliations and reimbursements shall be performed within the scope of delegated authority and in compliance with all applicable Federal statutes, State, and City codes, and policies.

This policy shall be formally adopted by the City Council and any changes thereto shall also be adopted by City Council.

1.2 Purpose

The City of Hollister recognizes the constructive value of professional conferences, seminars, meetings, and training and provides travel funds for Travelers who attend such official events. Travelers shall be entitled to reimbursement for their reasonable expenses associated with travel, meals, lodging and other actual and necessary expenses associated with attending such events in a manner and in the amounts as set forth in this policy. The purpose of this policy is to establish business travel guidelines for City Council and other City Council appointed commissioners and committee members that are fair, accountable, and transparent.

2. Policy

2.1 Responsibilities

A. Finance Department: Administers and monitors compliance of the travel policy and processes Traveler requests for travel prepayments, advances, and reimbursements.

B. City Manager’s Office Staff: Available to facilitate travel arrangements and reservations, complete travel request forms, provide access to Traveler’s available travel budget balance, agenda reports for City Council approval, and other administrative support relating to travel and complying with this travel policy.

C. City Council (or designee): Approves travel requests before travel. The City Council may delegate this authority, but they are ultimately responsible for ensuring that all approved travel requests comply with the travel policy and that funds are available within the Traveler's budget for the approved travel. An approval of the City Council means a majority vote of the City Council at a public City Council meeting.

D. City Manager (or designee): Approves travel reconciliations and reimbursements of Traveler after travel. The City Manager may delegate this authority, but they are ultimately responsible for ensuring that all approved reconciliations and reimbursements comply with the travel policy and that funds are available within the budget for the final reimbursement. If the budget is exceeded after approved travel occurred, the Traveler would need to let the Traveler

know and agendize a budget amendment for City Council approval.

E. Traveler: Represents the City of Hollister at an approved event (meeting, training, conference, etc.) and verifies the accuracy of bills and other travel documents before accepting or paying said bills, reports all expenses promptly and accurately with the required documentation, and requests reimbursement for necessary and reasonable expenses.

2.2 General Provisions

A. Travelers are responsible for understanding and complying with this travel policy and are expected to exercise good judgment with respect to travel expenses.

B. It is the policy of the City of Hollister that no Traveler shall experience personal financial loss for reasonable and necessary costs as a result of representing the City of Hollister, as long as the expenses are within the guidelines set forth in this policy.

C. Each City Council Member will have a travel budget set annually during the budget adoption. City Council Members may not exceed their travel budget. City Council may approve increases to a travel budget.

D. Non-City Council Members traveler budget amounts will be set annually during the budget adoption as a pool of funds available for all non-City Council member travel.

E. Business travel commences when the Traveler leaves his/her home or City Hall for official City business for a destination at least 25 miles outside the City. Generally, business travel ends when the Traveler returns to their residence or City Hall. Same Day Travel: Trips of less than 25 miles one way from Hollister are considered local travel and do not qualify for an overnight stay or per diem rates.

F. Attendance at out-of-state conferences and meetings should be limited to events where comparable conferences or meetings are not available within the state or online.

G. Travelers shall provide brief reports at the next regular meeting on their business travel and meetings attended at the expense of the City (as required by Government Code 53232.3(d)).

H. If a trip includes both business and personal travel, Travelers are personally responsible for any personal travel expenses.

I. Reimbursement of travel expenses is limited to travel by the most direct and common route and by the most economical means of transport. That portion of any travel, which is unnecessarily done by indirect route, is not in the interest of the City, or is for personal business, will not be reimbursed.

J. Expenses which are not approved or which are not in compliance with this policy, such as delinquent submission of travel documents or outstanding balances owed to the City, will become the Traveler's personal responsibility and may result in any one or more of the following consequences (as outlined in Government Section 53232.4):

1. Notification to the full City Council regarding violations of this policy.

2. Reporting travel advances or expense reimbursements as taxable income to the Internal Revenue Service (IRS) and State of California taxing authority.

Page 373 of 395 ends

4 | Pag e

3. Suspension of travel privileges at the discretion of the City Council.

4. Formal disciplinary procedures at the discretion of the City Council.

5. Require the Traveler to return any travel funds that were advanced.

2.3 Authorization for Travel

A. Travelers must obtain City Council or authorized designee approval prior to making travel arrangements.

B. Travelers are personally responsible for any changes or upgrades in transportation and/or accommodations that are not approved by the City Council or designee.

2.4 Examples of types of travel which are covered by this policy are as follows:

A. Attendance at City events, an approved conference, convention, hearing, training, seminar, or other meeting.

B. Communicating with representatives of regional, state, and national government on City adopted policy positions.

C. Attending educational seminars designed to improve Traveler's skills and knowledge levels.

D. Participating in regional, state, and national organizations whose activities affect the City's interests.

E. Implementing a City-approved strategy for attracting or retaining businesses.

F. Other such activities requiring travel which is clearly necessary and in the best interest of the City.

2.5 Travel Funded by Another Entity

In advance of travel, the City Council must determine if the Traveler is to be reimbursed at either the City's or the other entity's per diem rate. If the travel costs are borne by the City, reimbursement from the other entity shall be paid to the City. If another entity's funds are used, no City advance shall be made unless approved by the City Council or authorized designee.

2.6 Public Records Requirement

All documents related to reimbursable City travel expenditures are public records and may be subject to disclosure under the California Public Records Act (Government Code §6250-6270). The City's Records Retention Schedule requires that travel documents be retained for five (5) years.

3. Travel Arrangements

3.1 Advances for estimated out-of-pocket expenses will not be issued for less than $100.

3.2 In order to assure timely arrangements, advances, prepayments, reconciliations, and reimbursements, Travelers should consider the following timelines:

3.4 Emergency Travel

In this occasion, the City Council or their authorized designee must approve the travel request as soon as possible after the fact. Generally, conferences and meetings do not constitute emergency travel. City policy regarding transportation, lodging, meals, registration, and mileage are still applicable.

4 Lodging

4.1 Lodging Reimbursement

Reimbursement of lodging is limited to the actual cost of a single room. When making arrangements for lodging, the government, group, conference, or promotional rates shall be requested. The City will not reimburse the Traveler for luxury upgrades (e.g., ocean views, king-size beds, suites, etc.). When lodging at a conference facility is full, lodging at a comparable hotel shall be acceptable. An original, dated and itemized hotel receipt must accompany completed claims for lodging.

4.2 Cancellations

Hotel cancellations are the responsibility of the Traveler. Hotels generally require a 48-hour advance notice for cancellations. Any cancellation charges incurred will be billed to the Traveler unless reasonable justification is provided and approved by the City Council or authorized designee.

4.3 Companion Travel

When a spouse, domestic partner, or other companion travel with a Traveler on official business, reimbursement for the Traveler's lodging will be at the single occupancy rate for the accommodations.

If the Traveler arranges for the lodging it is the responsibility of the Traveler to obtain the lodging rate for both single and double occupancy.

4.4 Lodging in a Private Residence

Travelers who stay in a private residence with relatives or friends while traveling on business are not eligible for reimbursement of lodging costs.

5 Meals

5.1 Reimbursement Rates

Reimbursement for meals shall be made only when travel extends for a minimum of six (6) hours except when specifically approved otherwise by the City Council or authorized designee.

Reimbursement shall be at the current per diem rate established by the U.S. Government General Services Administration (GSA).

If the meal expense exceeds the per diem maximum, a memorandum or e-mail justifying the additional expenses must be approved by the Administrative Services Director or authorized designee. Itemized receipts are required for all meal reimbursement claims that exceed the per diem amount.

6 Transportation

Travel will be by the most economical means available, taking into consideration requirements for meal reimbursement, lodging, and Traveler time. When a private vehicle is used as the means of transportation, reimbursement will be in an amount not to exceed the lowest available airfare.

However, if a location is not served by an airline, reimbursement will be provided for travel by the most direct route.

6.1 Air Travel

A. Arrangements

1. Air travel arrangements for Travelers are to be made by the Traveler through the Internet, travel agency, or directly through the common carrier.

2. The Traveler will arrange for reservations and tickets for approved travel requests. The most economical means available fare will be used for air travel. As a general rule, Travelers will be expected to accept flights departing within two (2) hours of the desired departure time.

B. Changes, Cancellations and Unused Tickets

Generally, tickets are non -refundable and non-transferable and fees will be incurred for any changes made once the reservations are booked. Flights with cancellation penalties should be carefully monitored by the Traveler. If cancellation occurs due to a City -related change or circumstances beyond the Traveler's control, the Traveler’s budget will pay for the penalty cost.

However, if the cancellation occurs due to a Traveler's personal request, the Traveler will be required to pay the penalty. Unused tickets or portions of unused tickets must be returned to the department. For tickets purchased through the Internet, the Traveler should work with the City Manager’s office to ensure credit is received for unused tickets or portions of unused tickets.

C. Privately-owned Aircraft

Travelers are prohibited from piloting or traveling in privately -owned aircraft (i.e., non-commercial airlines), while conducting City business without written approval of the City Council. Written approval will be maintained by the City Manager’s office.

D. Frequent Flyer Mileage

6.2 Car Rental

A. Travelers should use public transportation (taxis, airport shuttles, buses, etc .) whenever it is more economical than a rental car. City Council may approve car rentals. Generally, a rental car should be requested when:

1. Multiple business meetings require travel between locations and public transportation is impractical.

Page 377 of 395 ends

8 | Pag e

2. Two travelers are attending the same meeting and one rental car for the group would be more economical.

3. It is less expensive to rent a car overall compared to alternative forms of transportation.

B. Arrangements

Travelers should request car rental arrangements through the Enterprise Rent-a-Car App on the City’s intranet page. This agreement was established for use by the State of California, whose rates (which includes insurances) have been made available to the City.

C. Insurance

Because the City of Hollister assumes risk for a Traveler conducting official City business, it is not necessary for the Traveler to purchase extra insurance coverage when renting a car for City business use. Additionally, Travelers are encouraged to use rental agencies that have contracts with the State of California because those rates generally include the Collision Damage Waiver and Liability Coverage. Travelers may choose to purchase additional insurance, but it will not be reimbursed by the City.

D. Fuel

Travelers must fill the gas tank before returning a rental car to avoid fuel surcharges. Or, if it is the most economical means available a Traveler can use the prepaid fuel option. Receipts are necessary for reimbursement of fuel costs unless the Traveler uses a City-issued CaIcard.

6.3 Travel by City Vehicle

A. Travelers who use City vehicles must follow the provisions of the City's Policy.

B. If more than one Traveler is traveling on the same trip, all reasonable efforts will be made to minimize transportation costs by use of a single vehicle.

6.4 Travel by Private Vehicle

A. Authorization

City Council or designee approval is required when the Traveler requests to use a private vehicle.

B. Reimbursement

The City will reimburse for mileage at the current IRS standard rate per mile which includes gas, maintenance, and vehicle related costs. Gas costs will not be reimbursed separately. The City's maximum mileage reimbursement will not exceed the cost of the lowest available airfare.

C. Carpooling Travelers

Mileage reimbursement will be payable only to the owner of the vehicle in which the Travelers are carpooling.

B. Rental Cars

Travelers who are involved in vehicle collisions while driving a rental car must report the accident to Risk Management within 24 hours (48 hours if the accident occurs on a weekend). The Traveler should keep a copy of all pertinent information and provide copies to Risk Management to assist in settling claims.

6.6 Other

Trains, buses, ferries, or other means of ground transportation may be used. Reimbursement will not exceed the cost of the most economical means available.

7 Additional Reimbursements

7.1 Incidental per diem.

For each day of travel, the employee will receive a reimbursement at the current GSA daily rate for incidental travel expenses. Personal telephone calls, baggage handling, and bellhop tips are examples of incidental costs covered by this per diem.

10 | Pag e

7.3 Non-reimbursable Expenses

A. Airline-related: Airline club membership dues, air-phone usage, in-flight headsets B. Alcoholic beverages
C. Auto-related: Rental upgrades, personal auto repairs, accident insurance, parking tickets, traffic violations, personal auto expenses other than mileage
D. Claims submitted for reimbursement more than twenty (20) working days following the Traveler's return from the approved trip
E. Expenses associated with a non-City employee who accompanies the Traveler on official City business (e.g., spouse or domestic partner's transportation, lodging, and/or meals) F. Hotel-related: Health club fees, room upgrades, movie rentals, mini-bar usage G. Loss or theft of personal funds, property or luggage H. Non-essential program activities associated with a conference/seminar unless approved by City Council, such as sports tournaments, social activities, tours, etc., that are not included with the conference registration
I. Personal expenses: Personal credit card annual fees, babysitting or dependent care, pet care (including kennel and pet sitting fees), computer rental for personal use, barber, hairdresser, laundry, spa services (sa unas, massages, facials, etc.), toiletries, shoeshine, etc.

7.4 Extended Personal Travel

Travelers who combine personal travel with business travel must identify and pay for the personal segment of the trip. The City will not reimburse a Traveler for expenses incurred beyond the most economical means available portion of the business travel when the Traveler chooses to extend his/her time at the destination for personal reasons (i.e., the Traveler takes vacation or stays through the weekend). Reimbursable expenses will cease to accrue when the Traveler is outside the most economical means available portion of the business portion of the trip. Reimbursement for car rental and airport parking must be prorated to allow reimbursement for only those costs associated with City business.

8 International Travel

The most economical and practical accommodations available considering the purpose of the meeting, transportation costs, time and other relevant factors will be reimbursed. Receipts for international travel must be itemized and accompanied by an exchange rate calculation.

International travel should have prior approval from the City Council.

Related pending matter.

Berrychino LLC submitted a General Planning Application to the Development Services Department on July 27, 2026, requesting a Zoning Verification Letter for this same parcel. This Public Records Act request is intended to complement, not duplicate, that application. Please see the Exclusions section below. Definitions. "Records" means all writings as defined in Government Code section 7920.540, in any format, including applications, plans and plan sets, permits, approvals, conditions, plan check and departmental review comments, submittals and deferred submittals, revisions, inspection records, correction notices, final sign-offs, certificates, notices, citations, staff reports, photographs and photo logs, case notes, routing comments, internal memoranda, and correspondence including email. Exclusions To reduce the City's search burden and expedite production, this request expressly excludes the following: A. Monterey Bay Alternative Medicine. Records relating to Monterey Bay Alternative Medicine, its applications, permits, entitlements, inspections, or occupancy of Suite 104. The requester is the tenant of that suite and already holds those records. Records relating to other tenants, suites, or the building as a whole remain within the scope of this request even where Monterey Bay Alternative Medicine is incidentally referenced. B. Subject matter of the pending Zoning Verification Letter. The conclusory zoning and land use determinations requested in the July 27, 2026 Zoning Verification Letter application, specifically the parcel's current zoning and General Plan designations and permitted uses, legal nonconforming status, specific plan and overlay district applicability, airport land use compatibility and avigation easement effects, and Special Flood Hazard Area status. This exclusion applies to the extent the City's written response to that application addresses those subjects. This request does seek the underlying documentary record described in item 9 below, which a Zoning Verification Letter does not produce. Search instructions Please search every department reasonably likely to hold responsive Records, including the City Clerk, Building, Fire Prevention, Code Enforcement, Development Services, and Public Works, and each system those departments maintain, including parcel files, permit tracking, code enforcement, planning, and fire prevention files. Suite designations. The suites at this Property were re-designated by an Address Assignment Notice dated May 12, 2026, which assigned six suite addresses. Anne Thompson This request is being made under the California Public Records Act. I am requesting copies of the following documents. My understanding based on the guidelines for local governments issued by the California State Archives is that the document retention period may vary with the type of record. I believe the retention period for most of the records requested below is seven years so I am requesting information over the prior seven years. Because the Annual Comprehensive Financial Report (ACFR) was known as the Comprehensive Annual Financial Report during part of the document retention period, all references to the ACFR audit may include the audit of the Comprehensive Annual Financial Report depending on the terminology used in a given year. Records Description Request for proposals and/or requests for bids for external audit services for the annual comprehensive financial report (ACFR). Copies of all proposals and bids received for the request for proposals and/or bids for external audit services for the ACFR, including proposals received from firms who were not selected. Records documenting the government’s evaluation of the proposals described above including, but not limited to, scoring and comparisons of the proposals. Documents supporting the government’s recommendation for the selection of the external auditor and the government’s decision for external auditor selection Fees paid to the external auditor over the past seven years. If possible, please provide the requested documents electronically to [email protected]. This request is being made for educational purposes and not for commercial use.

Therefore, I am requesting a waiver of all fees. However, if you are unable to grant a fee waiver, please provide an invoice for the fees before you fulfill the request. Feel free to contact me at [email protected] if you have any questions. Thank you in advance for your consideration of this request. Sincerely, Anne Thompson Anne M. Txais Xiong To the Records Custodian / City Clerk, City of Hollister: Under the California Public Records Act (Cal. Gov. Code § 7920.000 et seq.), I request a copy of the following identifiable public record: The permit issuance report or export generated by City of Hollister's building/permitting system (e.g. Accela) listing all building permits issued from January 1, 2020 through the date this request is processed.

This is the standard permit-activity report your department's system already produces for tracking issued permits — I am not asking you to create a new record, only to run/export the existing report for the date range above. Requested as a bulk electronic export (CSV, Excel, or delimited text) rather than individual PDFs, containing the following fields where available: - Permit number - Application/permit type (AP Type) - Permit status - Category - Work type - Apply date - Issued date - Finaled date - Plans required (Y/N) - Building square footage (Bldg Sq Ft) - Builder / contractor name - Valuation - Parcel number (APN) - Project address - Subdivision - Lot number - Description of work - Number of dwelling units (where applicable) I am requesting all permit types (residential, commercial, industrial, and any other building permits) — please do not filter to a subset unless doing so is necessary to avoid burden. If 2020–present is still considered overbroad or burdensome to run, please let me know and I will narrow further (e.g., to the most recent 5–7 years, or a specific permit sub- type) rather than have the request denied outright. Format: Please provide records electronically (email or download link) to keep costs at or near zero. A direct database export is acceptable and preferred. Fee waiver / estimate: If you anticipate any duplication or programming fees, please notify me with an itemized estimate before incurring them so I can authorize or narrow the request. The Act requires a response within 10 calendar days (Gov. Code § 7922.535) stating whether you have disclosable records. If any portion is withheld, please cite the specific exemption and release all reasonably segregable non-exempt material. Thank you for your assistance. 26-398 07/02/2026

Dev Rastogi I request all publicly releasable records relating to the January 21, 2026 armed confrontation involving Muhammed Hussein (also reported as Mohamed Husien) in Hollister, San Benito County, California. According to publicly available information, after allegedly committing an armed carjacking in San Jose, the suspect fled to Hollister, where he exchanged gunfire with officers from the Hollister Police Department and deputies from the San Benito County Sheriff's Office, stole another vehicle, and fled north toward San Jose, where the incident ultimately ended in an officer-involved shooting. This request pertains only to the Hollister Police Department's involvement in this incident. Please provide all publicly releasable records, including body-worn camera footage, in-car/dash camera footage, CAD history, calls for service, dispatch logs, radio traffic recordings, 911 audio, incident reports, offense reports, supplemental reports, use-of-force reports, crime scene photographs, evidence photographs, surveillance video obtained during the investigation, witness statements and recorded interviews, evidence inventories, property logs, search warrant returns and inventories (if applicable), and any other publicly releasable records associated with this incident. Please provide all video and audio recordings in their original native digital format as maintained by your agency, without unnecessary recompression, transcoding, downscaling, or reduction in resolution or bitrate. If multiple versions exist, please provide the highest-quality version available for public release. If recordings are segmented into multiple files, please provide all segments in their entirety rather than excerpts whenever available. If any portion of a record is exempt from disclosure, please redact only the specific information required by law and release all reasonably segregable non-exempt portions. mugshot files
