Subject: Consideration to Re-appoint Chris Barth and Alina Combs to the Parks, Recreation and Entertainment Commission
Presented By: Ashton Gose, Deputy City Clerk
Approved By: __________________________
City Manager
Staff Recommendation:

Re-appoint Chris Barth and Alina Combs to the Parks, Recreation and Entertainment Commission.

Background and Overview:

The Hughson Parks, Recreation and Entertainment Commission provides recommendations to the City Council regarding policies for the acquisition, development, maintenance, and improvement of park facilities. The Commission is also responsible for formulating and recommending appropriate fee schedules, policies, rules and regulations for park sites and other recreation facilities. The Commission consists of five members appointed by the Mayor, with a majority of the City Council, to alternating two-year terms.

Currently, there are two (2) Commissioner terms set to expire on December 31, 2022, Chair Chris Barth and Commissioner Alina Combs. Typically, staff would advertise and accept applications for scheduled vacancies such as this. However, there is already one (1) unfilled vacancy, advertised since December 2021, with no applications submitted.

Both Commissioners have expressed their interest in re-appointment to the Commission. If appointed, the new terms will begin on January 1, 2023, and expire on December 31, 2024. Staff conferred with Mayor George Carr regarding the recommendation to re-appoint these applicants. Mayor Carr agreed with the recommendation and asked staff to present the item to the City Council for a majority vote.

CITY COUNCIL AGENDA ITEM NO. 3.3
SECTION 3: CONSENT CALENDAR
At this time, the City Council has the opportunity to discuss this recommendation, and ultimately re-appoint the Commissioners with a majority vote. Discussion would require the item to be pulled from the Consent Calendar by a member of the City Council.

Since there is still one unfilled vacancy on the Commission, staff will continue to advertise for applications until filled.

Fiscal Impact:

There is no fiscal impact associated with this item.

Subject: Adopt Resolution No. 2022-52, Approving the Addition of a Second Customer Service Clerk to the Annually
Budgeted Positions, Effective Immediately
Enclosure: Exhibit A – Customer Service Clerk Job Description Presented By: Anna Nicholas, Director of Finance & Admin. Services Approved By: ____________________________
City Manager
Staff Recommendation:

Adopt Resolution No. 2022-52, approving the addition of a second Customer Service Clerk to the annually budgeted positions, effective immediately.

Background and Overview:

Through ongoing analyses in all municipal departments, City staff strive to improve operations, implement best practices, and identify any departmental needs, including staffing levels, which could have potential impacts on operations and customer service. City staff have identified staffing deficiencies within the organization that impacts deliverables to the community and optimal levels of internal and external customer service. To assist in mitigating these impacts, staff recommends the addition of a Customer Service Clerk that will be a shared position among the Finance and Community Development departments.

Discussion:

The customer service counter inside City Hall serves customers in-person, via phone and electronic mail, and provides internal customer service to all municipal departments. Various customer service functions include, but are not limited to:
assisting and routing all incoming calls to the City; assisting utility customers with inquiries and payments; assisting businesses with start-up paperwork, inquiries and payments; oversight of all facility rentals, which includes reservations, tours and deposit maintenance; preparation of the City newsletter and other documents; accounts receivable for all City cash intake; and provide customer service to CITY COUNCIL AGENDA ITEM NO. 3.5
SECTION 3: CONSENT CALENDAR
community members that come in to City Hall with a variety of inquiries and concerns.

As the City has experienced growth the increased demand of customer service has superseded the staff capacity. This increase demand is expected to continue with the continued development and completion of Euclid South, Euclid North, and Parkwood subdivisions. Staff propose an additional Customer Service Clerk that will help with the current staffing deficiency and help with the continued growth planned for the City. Due to existing staffing levels, City Hall has experienced intermittent closures when there is no staffing back-up to cover breaks, meal periods, and absences for the customer service counter.

The proposed Customer Service Clerk position will help to reduce the closures due to having additional customer service coverage. In addition, this position will assist the Community Development Department with customer service and clerical items, which will reduce the amount of customer service time the Community Development Specialist and Community Development Director currently has to expend. The addition of the Customer Service Clerk will assist the departments in achieving their goal of delivering superior customer service for the City.

Fiscal Impact:

The addition of a second Customer Service Clerk will have a fiscal impact of $68,811 (based on current FY 2022-23 amounts), per fiscal year and allocated as such:

Fund 100 General Fund $22,937
Fund 210 Sewer Fund $22,937
Fund 240 Water Fund $22,937
This cost is inclusive of salary and benefits.

Meeting Date: November 14, 2022
Subject: Approval to Extend Bilingual Pay to Management and PartTime Employees, Effective November 16, 2022 Presented By: Merry Mayhew
Approval: _____________________________
City Manager
Staff Recommendation:

Approve extending bilingual pay to management and part-time employees, effective November 16, 2022.

Background Discussion:

On May 24, 2021, the City Council approved the Memorandum of Understanding (MOU) between the City of Hughson and the Operating Engineers Local Union No. 3 on Behalf of the City of Hughson, for the period July 1, 2021 to June 30, 2024.

Included in the MOU was a modification of incentive pay to include bilingual pay to city employees covered under the MOU. Management and part-time employees are not covered by the MOU and therefore the bilingual pay was not extended to them.

This was an oversight that the City now seeks to correct.

It is the City’s intention to have a workforce that is culturally representative of and responsive to our diverse community. Maintaining a bilingual pay program supports the City’s ability to meet the needs of Hughson’s residents.

The MOU currently in place offers represented employees an additional 1.5% for speaking Spanish and 2.5% for speaking and writing Spanish. Currently, six represented employees receive 1.5% bilingual pay for speaking Spanish. No represented employees receive 2.5% for the ability to speak and write Spanish.

CITY COUNCIL AGENDA ITEM NO. 3.6
SECTION 3: CONSENT CALENDAR
Staff recommends paying the City’s one unrepresented part-time employee at a rate of 1.5% bilingual pay and setting management bilingual pay at a flat amount monthly:
$125/month – spoken
$200/month – spoken and written
Currently, there are three management employees who would receive $125/month in bilingual pay for speaking Spanish and one management employee who would receive $200/month in bilingual pay for speaking and writing Spanish. In addition, the City’s one part-time Code Enforcement Officer would receive an additional 1.5% bilingual pay.

Management bilingual pay would be subject to authorization by the City Manager and managers would be subject to the same certification process as represented employees.

Approval of this recommendation provides fair and equitable compensation and benefits for certified bilingual employees and will enhance the City’s ability to effectively serve our bilingual community.

Fiscal Impact:

The annual cost of bilingual pay for a part-time employee and four management employees would be approximately $7,300. The cost would be paid for according to how staff salaries are distributed, the majority would be paid for from the Water, Sewer, and General Funds, with a small portion paid for in Landscape Lighting Districts, Benefit Assessment Districts, and Community Service Districts.

Meeting Date: November 14, 2022
Subject: Adopt Resolution No. 2022-53, Approving the Revised Salary Schedule
Enclosure: Exhibit A-Salary Schedule
Presented By: Anna Nicholas, Director of Finance & Admin. Services Approved By: ____________________________
City Manager
Staff Recommendation:

Adopt Resolution No. 2022-53, approving the revised Salary Schedules for fiscal years 2022-23 and 2023-24.

Background and Overview:

City Staff performs ongoing analyses in all municipal departments to improve operations and implement best practices. Through analysis, the Human Resources Department has identified areas of the Salary Schedule that need to be revised for clarity and accuracy. The revised Salary Schedule will replace the existing Salary Schedule, and contains “clean-up” items, as no monetary salary changes are proposed with this revision.

Discussion:

The existing City of Hughson Salary Schedule needs certain revisions made due to operational changes that have occurred with positions over the years and to “clean up” items for reasons listed below. These revisions are needed for accuracy and clarity and for the best practice of having the Salary Schedule aligned with the City’s Organizational Chart.

The items that are included in this revision are:
• Remove unbudgeted and unfilled positions for the published fiscal years:

For several years, unbudgeted and unfilled positions have remained on the published Salary Schedule, which can cause confusion as to what positions are staffed within the City. While these positions are not budgeted and filled for the two fiscal years of the revised Salary Schedule, many of the job CITY COUNCIL AGENDA ITEM NO. 3.7
SECTION 3: CONSENT CALENDAR
descriptions remain on file should the City need to budget for and fill these positions in the future. These revisions will align with the current Organizational Chart for the City, which may be revised should any staffing additions occur.
• FY 2022-23: Correct Range 185, Step A of the Director of Finance and Administrative Services from $9359.88 to $9358.88. This is a typo only on the published salary schedule, and the financial software is correct, so no employee wage impact occurred.
• Revise the Planning and Building Assistant position title to Community Development Specialist, per the job description and position title change approved per Resolution No. 2022-42.
• Revise the Assistant to the City Manager/City Clerk position title to Executive Assistant/City Clerk and update the salary range for the position from 134 to 143.

Fiscal Impact:

There is no fiscal impact with the approval of this item. The salaries presented in the City of Hughson Salary Schedule have already been accounted for in the annual operating budget process. This item does not change the salaries and only contains clean-up items that have no impact on the operating budget.

WHEREAS, the unbudgeted positions will be removed from the published Fiscal Year 2022-23 Salary Schedule, and the Range 185, Step A of the Director of Finance and Administrative Services salary corrected from $9359.88 to $9358.88, and the Planning/Building Assistant position title changed to Community Development Specialist; the Assistant to the City Manager/City Clerk position title changed to Executive Assistant/City Clerk and salary range for such said position changed from 134 to 143; and

Subject: Adopt Resolution No. 2022-54, Approving the Position Title Change, Job Description Revision, Salary Range
Change and Position Reclassification, Effective November 16, 2022
Enclosure: Job Description
Presented By: Anna Nicholas, Director of Finance & Admin. Services Approved By: ____________________________
City Manager
Staff Recommendation:

Adopt Resolution No. 2022-54, approving the following, effective November 16, 2022:

1. The position title change and job description revision from Assistant to the City Manager/City Clerk to Executive Assistant/City Clerk;

2. The amended salary range for said position from Range 134 to Range 143;

3. The reclassification of the current Management Analyst to the Executive Assistant/City Clerk position.

Background and Overview:

City Staff performs ongoing analyses in all municipal departments to improve operations, implement best practices, and identify strategic operational changes to implement agency wide. The Administrative and Human Resources Department has identified specific changes that will provide for continued optimal City-services, better align job duties with the position, and revise corresponding items (job description/salary schedule). In addition, the proposed changes provide the City an opportunity to better position itself with employee retention in the current competitive labor market.

Discussion:

Over time, once budgeted and staffed positions within the organization become vacant for various reasons, such as resignation and retirement. Certain positions CITY COUNCIL AGENDA ITEM NO. 3.8
SECTION 3: CONSENT CALENDAR
and related job duties can evolve as City-operations evolve. The position of Assistant to the City Manager/City Clerk was staffed several years ago but has since been an unbudgeted and unfilled position. The duties of the position have primarily been accomplished through the work of the Management Analyst, who also serves as the City Clerk. After careful review of the job description for the Assistant to the City Manager/City Clerk and the Management Analyst, it became evident organizational changes were needed to revise these positions to better align with current City operations.

City staff propose the following changes:

1. Position title change and job description revision from Assistant to the City Manager/City Clerk to Executive Assistant/City Clerk:

Staff recommends the position title change from Assistant to the City Manager/City Clerk to the Executive Assistant/City Clerk to better align with the current operations of the agency and to provide clarity in the position title of the actual duties.

2. The salary range will change from Range 134 to 143 to align the compensation with the current breadth of responsibilities for the position. The position has been vacant for many years; therefore, the position was not included in salary surveys performed for equity adjustments in recent years.

3. Currently, the Management Analyst serves as the Deputy City Clerk. This position performs all the City Clerk duties, in addition to other executive assistant duties. Staff recommends reclassifying the current employee who is the Management Analyst to the Executive Assistant/City Clerk position. At a future time, and through ongoing analysis, the Management Analyst position will be reviewed to determine the functions and the need to fill the position. The Management Analyst currently serves as the Deputy City Clerk and it is prudent to have a backup to the City Clerk on an ongoing basis as the position administers essential functions in local government.

Fiscal Impact:

The proposed reclassification of the Management Analyst to the Executive Assistant/City Clerk will result in an additional $18,616 for the fiscal year. This change will be effective November 16, 2022, with an estimated cost for the remainder of the fiscal year of $10,860. The position is funded by the General Fund (Fund 100). For future budget years, or other intervals in between, a review of the positions may require the City to budget for both the Management Analyst and the Executive Assistant/City Clerk positions.

Process and the Formation of a New HOME Consortium
Enclosure: First Amendment to Intergovernmental Cooperation Agreement Stanislaus Urban County Community

Presented By: Carla Jauregui, Community Development Director Approved By: _________________________
City Manager
Staff Recommendations:

1. Adopt Resolution No. 2022-55, supporting the approval of the First Amendment to the Intergovernmental Cooperation Agreement for the Stanislaus Urban County Community Development Block Grant Program and an update on the Stanislaus Urban County Requalification Process and the formation of a New HOME Consortium.

2. Authorize the City Manager to sign the First Amendment to Intergovernmental Cooperation Agreement for the Stanislaus Urban County Community Development Block Grant Program.

Background:

In 2002, Stanislaus County was designated an Urban County by the Federal Housing and Urban Development Department (HUD) and receives an annual allocation to be shared among Stanislaus County and the cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank and Waterford. With this designation, Stanislaus County qualifies as an “entitlement” jurisdiction which means that the County receives Community Development Block Grant (CDBG) funds and Emergency Solutions Grants (ESG) Program funding from HUD without participating in the competitive application process. The County together with these cities forms what is known as the Stanislaus County Community Development Block Grant (CDBG) Consortium (hereafter referred to as the Urban County).

CITY COUNCIL AGENDA ITEM NO. 3.9
SECTION 3: CONSENT CALENDAR
Historically, the City of Turlock has administered both the CDBG and the HOME programs; however, beginning in 2022, Stanislaus County was set to take over and administer these programs. Council approved the following Agreements on June 27, 2022 with Stanislaus County:

1. Resolution No. 2022-26, approving the One-Year Home Investment Partnership Consortium Agreement;

2. Resolution No. 2022-27, approving the Three-Year Home Investment Partnership Consortium Agreement between the County of Stanislaus and the City of Hughson for participation in the HOME Investment Partnership Program; and Authorization for the City Manager to execute the agreements and implement the program.

However, due to a misinterpretation by Housing and Urban Development (HUD) of the existing HOME Consortium Agreement between the City of Turlock and the County, the wrong end date for the City was included in the new Agreement for both the Stanislaus Urban County and the new HOME Consortium. The effective date for the withdrawal of the City of Turlock as the lead entity for the HOME Consortium is June 30, 2023 instead of June 30, 2022. HUD has made the adjustment in their processing of the Agreement and the County is scheduled to take over as the lead entity for the HOME Consortium effective July 1, 2023.

Discussion:

The City of Hughson, in partnership with Stanislaus County and the cities of Ceres, Newman, Oakdale, Patterson, Riverbank, and Waterford form the Stanislaus Urban County for purposes of receiving Federal Housing and Urban Development Community Development Block Grant Program (CDBG) and Emergency Solutions Grants (ESG) Program funding. Stanislaus County is the "lead entity" with responsibility for implementing and administering CDBG and ESG funding.

Together, the Stanislaus Urban County and the City of Turlock will form the Stanislaus HOME Consortium (hereafter referred to as “the Consortium”).

Every year HUD provides funding for community development programs to the Stanislaus Urban County, specifically Community Development Block Grant (CDBG) and Emergency Solutions Grants (ESG) funding. HOME Investment Partnerships Program (HOME) funds are also received annually from HUD by participating jurisdictions and HOME Consortiums.

CDBG funds are used by the Stanislaus Urban County primarily for public services, infrastructure improvements, planning and administrative costs. ESG funds are utilized for Homeless Prevention, Rapid Re-Housing, Shelter, and Homeless Management Information System (HMIS) activities and administrative costs. HOME funds can be used to finance a variety of affordable housing activities that generally fall into four categories: rehabilitation of owner-occupied housing; assistance to homebuyers; acquisition, rehabilitation, or construction of rental housing; and tenant-based rental assistance.

Stanislaus Urban County Requalification Process
As per HUD Notice CPD-22-07 issued on April 25, 2022, Stanislaus County is scheduled to follow the requalification process for Fiscal Years 2023-2025 for the Stanislaus Urban County. Every 3 years the lead entity for an Urban County must go through a requalification process for HUD Entitlement status. The County must enter into a cooperation agreement with the units of local government that select to remain or become part of the Urban County. These cooperation agreements legally bind a unit of local government to cooperate in the use of its power in carrying out essential activities in accordance with the Urban County’s HUD program.

On May 24, 2022 the Stanislaus Board of Supervisors authorized the Chief Executive Officer to sign the Stanislaus Urban County 3 Year Intergovernmental Cooperation Agreement for Fiscal Years 2023-2025. The Agreement was submitted to HUD on June 30, 2022 to continue the Urban County Requalification Process.

Upon review by HUD’s legal division, an ask for further clarification and edits have resulted in the need for an amendment to the Intergovernmental Agreement.

The following are the requested changes to the Intergovernmental Agreement:
• The Federal Fiscal Years must be added in addition to the Program Years that the agreement is effective.

The table below identifies the Federal Fiscal Years and the Program Years that have been added to the Intergovernmental Agreement.

Federal Fiscal Years Program Years
10/1/2022-9/30/2023 7/1/2023-6/30/2024
10/1/2023-9/30/2024 7/1/2024-6/30/2025
10/1/2024-9/30/2025 7/1/2025-6/30/2026
• The date that was included in the Recitals, regarding the City of Turlock’s end date as the lead entity for the HOME Consortium must be updated.

Due to a misinterpretation by HUD of the existing HOME Consortium Agreement between the City of Turlock and the County, the wrong end date for the City was included in the new Agreement for both the Stanislaus Urban County and the new HOME Consortium. The effective date for the withdrawal of the City of Turlock as lead entity for the HOME Consortium is June 30, 2023 instead of June 30, 2022.

HUD has made the adjustment in their processing of the Agreement and the County is scheduled to take over as lead entity for the HOME Consortium effective July 1, 2023.
• Authorize the County’s Director of Planning and Community Development to amend, revise or supplement the Agreement by Administrative Amendment with written notice to the Cities if such amendment is necessary to comply with applicable laws and regulations.

Paragraph 23 of the Agreement has been deleted in its entirety and replaced with the following:
“23. Amendments. The County’s Director of Planning and Community Development may amend, revise or supplement the Agreement by Administrative Amendment in order to maintain compliance with applicable laws and regulations upon written notice to the other Parties. The Administrative Amendment shall be effective upon execution by the County’s Director of Planning and Community Development and delivery to all Parties. Amendments which modify the substantive terms of the Agreement shall be approved by the County’s Director of Planning and Community Development and the City Manager of each of the Cities or his/her designee.” • The recitals to the Agreement state that the County and the Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, Turlock and Waterford will enter into a HOME Consortium Agreement. However, per HUD guidance, the Consortium Agreement may only be between the City of Turlock, a metropolitan city, and Stanislaus County, an Urban County. The Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, and Waterford will participate in the Consortium as members of the Stanislaus Urban County as defined in Section 102(a)(6) of the Housing and Community Development Act (HCDA) of 1974, as amended. (24 CFR 101(b)).

The County and the City of Turlock will enter into a separate Consortium Agreement relating to the HOME Program. (24 CFR 92.101(b)).

The First Amendment to the Intergovernmental Agreement and Resolution requires Board approval and authorization before it can be submitted back to the HUD Field Office.

Update on the New HOME Consortium
On May 24, 2022 the Stanislaus Board of Supervisors authorized the Chief Executive Officer to sign the Stanislaus HOME Investment Partnerships (HOME) Consortium Agreement for Fiscal Years 2023-2025 and the Stanislaus HOME Consortium 1 Year Agreement for Fiscal Year 2022.

Forming a consortium is a way for local governments that would not otherwise qualify for funding to join with other contiguous units of local government to directly participate in the HOME program.

On June 30, 2022, as per HUD guidance the County submitted both agreements in an attempt to align the Stanislaus Urban County and the new HOME Consortium’s qualification periods. During the review process by HUD’s legal division, it was found that the City of Turlock’s current HOME Consortium Agreement was still in effect and does not expire until June 30, 2023. The City of Turlock was notified on September 22, 2022 that they would need to accept to remain as the lead entity for one more year or the FY 2022-2023 HOME funding would be forfeited. HUD has continued with the process to form a new HOME Consortium with Stanislaus County as the new lead entity as of July 1, 2023.

HUD’s legal division also directed County staff on the following changes to the Stanislaus Home Investment Partnerships Program Consortium Agreement One Year Agreement:

First Amendment:
• The Program Year for the Consortium had to be the fiscal year for the Consortium and was edited to begin July 1, 2022 and end on June 30, 2023.

HUD also requested that the following be added to the Agreement:
“The requirements of 24 CFR, Part 92, Subpart H (Other Federal Requirements) are applicable to the Agreement including the following:
§ 92.350 Other Federal requirements and nondiscrimination. § 92.351 Affirmative marketing; minority outreach program. § 92.352 Environmental review.
§ 92.353 Displacement, relocation, and acquisition.
§ 92.354 Labor.
§ 92.355 Lead-based paint.
§ 92.356 Conflict of interest.
§ 92.357 Executive Order 12372.
§ 92.358 Consultant activities.
§ 92.359 VAWA requirements.”
Second Amendment:
• The Agreement was edited to include that each member of the Consortium and its subrecipients shall abide by California State Executive Order N-6-22 (Russia Sanctions). Language was also added to authorize the County to amend the Agreement in order to add new Consortium members if an opportunity arises without the need of a majority vote of the Consortium.

Third Amendment:
• Modify the Agreement and resolutions approving the Agreement to clarify the program year as follows:

Federal Fiscal Year Program Year
10/1/2022-9/30/2023 7/1/2023-6/30/2024
• To align with the Urban County requalification period, modify the Agreement by adding two Federal fiscal years and Program years as follows:
• Modify the Agreement so that the only Parties are the City of Turlock and Stanislaus County. Per HUD guidance, the Agreement may only be between the City of Turlock, a metropolitan city, and Stanislaus County, an Urban County.

The Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, and Waterford will participate in the Consortium as members of the Stanislaus Urban County. (24 CFR 92.101(b)).
• Paragraphs 5-9 of the Original Agreement and Paragraph 1 of the First Amendment shall be deleted in their entirety and replaced with the following:
“5. Notwithstanding anything to the contrary in the Agreement or in the resolutions approved by the County and the Cities reflecting the approval of the Agreement, the Agreement is applicable to the following Federal fiscal year and the following Program year:

Federal Fiscal Year Program Year
10/1/2022-9/30/2023 7/1/2023-6/30/2024

6. Notwithstanding anything to the contrary in the Agreement or in the resolutions approved by the County and the Cities reflecting the approval of the Agreement, the Agreement is hereby extended for the following Federal fiscal years and the following Program years:

Federal Fiscal Years Program Years
10/1/2023-9/30/2024 7/1/2024-6/30/2025
10/1/2024-9/30/2025 7/1/2025-6/30/2026

7. Because of the extension of the Agreement in paragraph 2 above, the HOME Three Year Agreement is hereby terminated and is of no force and effect.

8. The effective date for the withdrawal of the City of Turlock as Lead Agency for the HOME Consortium is June 30, 2023; and the County has agreed to take over as Lead Agency for the HOME Consortium effective July 1, 2023.

9. The Parties to the Agreement shall hereinafter be the City of Turlock and Stanislaus County. The Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, and Waterford shall hereinafter participate in the Consortium as members of the Stanislaus Urban County as defined in Section 102(a)(6) of the Housing and Community Development Act (HCDA) of 1974, as amended. (24 CFR

92.101(b)).”
Federal Fiscal Years Program Years
10/1/2023-9/30/2024 7/1/2024-6/30/2025
10/1/2024-9/30/2025 7/1/2025-6/30/2026
All amendments to the Stanislaus Home Investment Partnerships Program Consortium Agreement One Year Agreement have been submitted to the HUD Field Office and approved.

The proposed Consortium Agreement is consistent with the City and County policies encouraging cooperation between agencies on issues of regional significance such as affordable housing.

The proposed Consortium Agreement will promote public health, safety, and welfare by enabling the City and County to participate in the U.S. Department of Housing and Urban Development’s HOME Program; thus, making available funds for a variety of housing, economic development, and public services programs not otherwise available.

While the City has had limited staffing to implement a HOME program, it is important to be part of the Consortium. If Hughson cannot spend the allotment, the funds will revert to other cities or county projects and the funds will stay in this region.

Fiscal Impact:

There is no impact to the City General Fund as all program delivery and administrative costs will be funded through the HOME Program allocation.

Subject: Adopt Resolution No. 2022-56, Awarding the Driveway Improvements at Starn Park to Dirt Dynasty, in the Not to Exceed Amount of $42,000 and Authorizing a 10%
Construction Contingency; and Authorizing the City
Manager to Execute the Final Construction Contract
Enclosure: Starn Driveway Improvements Quotes
Presented By: Carla Jauregui, Community Development Director Approved By: _________________________
City Manager
Staff Recommendations:

1. Adopt Resolution No. 2022-56, awarding the driveway improvements to Starn Park to Dirt Dynasty in the not to exceed amount of $42,000, and authorizing a 10% construction contingency.

2. Authorize the City Manager to execute the construction contract with the lowest responsible bidder, inclusive of any final edits by the City Attorney.

Background and Overview:

Starn Park receives a high volume of use throughout the year as it provides two rental facilities, a playground, and recreation fields which are used year-round. The entrance to the parking lot, located on Tully Road, includes two driveways which when constructed were sloped at a grade that has been a concern for low-sitting vehicles. In order to mitigate the potential damage to property in the future, staff instructed the City Engineer to assess the driveways. After the assessment, it was determined that improvements would need to be made and the next course of action would be to proceed with a request for quotes to improve the slopes to meet the City’s Standard commercial driveway (3-C.9).

Discussion:

In September, as discussions of the Tully Road Sewer Improvement Project relating to the commencement ensued, staff determined that it would be an opportune time to include the improvements to the driveways at Starn Park. Staff requested that CITY COUNCIL AGENDA ITEM NO. 6.1
SECTION 6: NEW BUSINESS
the City Engineer obtain quotes for the driveway improvements from the contractor that was awarded that project, United Pavement Maintenance. Additionally, the City Engineer requested two additional quotes and received one from Dirt Dynasty along with V. Rivera Construction. The original intent was to complete each driveway separately to not impede the use of the parking lot. However, it became apparent that to create a more cost-effective project, the driveways would need to be completed at the same time, closing off the parking lot for a short period of time.

Staff received the following quotes:

United Pavement Maintenance: $49,400
Dirt Dynasty: $42,000
V.Rivera Concrete: $54,188
Staff has determined that the lowest responsible quote was received from Dirt Dynasty in the amount of $42,000. With the start of baseball season in the near future, staff is proposing to start these repairs as soon as weather permits.

Additionally, since the Tully Road Sewer Improvement Project has commenced work on Tully Road, staff will make sure that both contractors work together to complete both project side by side as seamlessly as possible.

Fiscal Impact:

The improvements will be funded through the General Fund. If approved, Finance will increase budget appropriations in the General Fund by $46,200.

Professional Services Agreement with JB Anderson Land
Use Planning and CSG for On-Call Contracted City
Planning Services
Enclosures: Professional Service Agreements
Presented By: Carla C. Jauregui, Community Development Director Approved By: ____________________________
City Manager
Staff Recommendations:

1. Adopt Resolution No. 2022-57, approving the Professional Services Agreement with JB Anderson Land Use Planning and CSG for on-call contract City Planning Services.

2. Authorize the City Manager to execute the Professional Services Agreement with JB Anderson Land Use Planning and CSG inclusive of any final edits by the City Attorney.

Background and Overview:

The Community Development Department has received an increase in development interest, particularly within the industrial, commercial, and high-density residential zoned parcels. Currently, staff has 3 applications seeking entitlement as well as an additional three in the queue for pre-development. With the current vacancy in the department, as well as multiple public works, building and economic development projects in various stages, along with daily departmental management including reporting, meetings with agencies, developers, and the public, staff has reached out to several firms to request statements of qualifications to provide contract services on an “on call” basis to aid in assisting with project entitlement and Planning specialties.

The City received two qualified proposals, and City Staff interviewed both firms. Staff has decided to contract with both firms to provide for a more streamed line entitlement process for applicants. Should one firm have a long lead time, the other CITY COUNCIL AGENDA ITEM NO. 6.2
SECTION 6: NEW BUSINESS
can supplement, providing a positive and efficient application process. The specific agreements with detailed terms are attached for reference and have been reviewed to form by the City Attorney.

Discussion:

In order to provide a streamlined and positive development process for prospective developers as well as current applicants, staff has determined that there is a need to create a list of qualified planning firms to assist with planning projects on an “oncall” basis. These firms will have the ability to devote their full attention and staff to facilitate the entitlement process for development within the City. Staff is confident that the two proposed firms will provide the quality of service that development applicants expect from the City and will complement the customer forward focused service that the City prides itself on providing.

J.B. Anderson provides a highly educated staff with experience in Urban Planning, Design, Public Policy Development and Land Use Entitlements. They have provided contract planning services for Hughson in the past and currently provide services for numerous local cities including Waterford, Oakdale and Riverbank, to name a few.

Additionally, CSG brings specialized Planning & Environmental expertise, a depth and breadth of highly experienced staff, an office in Newman in proximity to the City, and the ability to adapt to the City’s changing needs. In addition, CSG has an existing successful relationship with the City, providing building plan review and inspection services
Fiscal Impact:

Staff is contracting with both firms to provide project-specific services on an “on-call” basis, most of which will be billed directly to project proponents. However, should the City need assistance with City implemented projects in the future, staff may look to the firms for assistance. City project-specific costs will come before Council prior to implementation as needed.

Re: Statement of Qualifications for Planning & Environmental Services Dear Ms. Jauregui,
Thank you for the opportunity for CSG Consultants (CSG) to present an overview of our Planning & Environmental services qualifications to the City of Hughson. 2 Overview of Services

C U R R E N T & A D V A N C E P L A N N I N G
At CSG we believe that changing environmental conditions, increased need for housing, diminishing raw land supply, complex mobility issues, urban infill opportunities, and affordability are all becoming pivotal factors driving projects and the future of development. Our team is capable of fusing thoughtful creativity with function, practicality with aesthetics, and connecting places with people. Our staff have the expertise to work on various current and advance planning projects.

Current Planning
CSG’s Planning team provides contract staff support, entitlement services and project management for a variety of types of projects. We excel at interfacing with public agencies and elected officials, tackling a wide range of current planning issues, and serving as case planners, applicant liaisons, or even assisting the public at the counter. Our staff planners perform daily planning activities, such as (but not limited to): zoning review and compliance, project entitlement services, Subdivision Map Act compliance, site plan review and design review. Our planning staff also serve as extension of city or City staff in a number of jurisdictions, preparing staff reports, and making presentations to Planning Commissions, City Councils or Boards of Supervisors.

Advance Planning
CSG’s planners are well versed in the creation and management of long-range policy documents, and assist communities with visioning, goal setting and implementation, as well as project coordination for applicants and their consultant teams. Our team has prepared General Plans, Specific Plans as well as Community and Area Plans, Design Guidelines, Zoning Code updates, and Economic Development Plans.

E N V I R O N M E N T A L P L A N N I N G
CSG has the environmental staff resources to manage and prepare clear, concise, and legally defensible environmental documents under the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA) for projects of all types, including development, infrastructure improvements, ecological enhancements, and policy adoption documents, such as General Plans and Specific Plans. CSG will serve as an extension of City staff to ensure that the entire environmental review process is conducted in a comprehensive manner. CSG will consider recent legislation, court decisions pertaining to CEQA and NEPA and agency requirements. Our objective is to provide premium services to our clients, along with highly accurate technical documentation and impact determinations. Our approach entails an efficient process to ensure that studies are comprehensive, objective, technically accurate, and complete, while maintaining a focus on the schedule established for the review. Our approach includes consistent and regular interaction and communications between staff, our team and other interested/responsible governmental agencies and parties, as appropriate, allowing for frequent exchange of information without loss of time or resources.

Our range of types of CEQA studies includes Categorical Exemptions, Initial Studies, Negative Declarations, Mitigated Negative Declarations, Project/Program/Focused/Supplemental/Subsequent and Addendum Environmental Impact reports (EIR’s), consistency checklists, as well as mitigation monitoring programs. We can assist the City with recommendations and scoping for the appropriate CEQA and NEPA documentation and, should an EIR be the determined clearance, CSG can lead the preparation of response to comments and any required findings of facts/statement of overriding considerations. We are also ready to assist the City with project stakeholder coordination, filing of public notices, participation in public hearings and complete project management services throughout the environmental review process.

3 Methods and Approach
CSG views every assignment and project as a way to build long-lasting, meaningful working relationships with our clients. We always seek to excel in maintaining a clear line of communication with every client, stakeholder, agency, decisionmaker and project team members to ensure assignments and projects are achieving and exceeding expectations. We work with positive attitudes, focused on teamwork and have a shared determination in exhibiting professionalism in everything we do. Our mission is to consistently meet or exceed our client’s expectations in a responsible and efficient manner.

At CSG, we act as project managers in most of our efforts, but we are first and foremost planners. Our goal is to always perform as a “partner planner” for our clients, providing additional support and services to existing agency staff members. CSG’s project managers bring decades of project management experience, implementing best practices, while delivering work products on time and within budget while.

We believe that a comprehensive approach to project management includes attention to land planning, economic feasibility, urban design, and the environment. Our project management philosophy is built upon the anticipation of, and preparation for, all issues that may arise throughout the project process. By constantly considering and developing the appropriate process and plan to address political, environmental, social, and design challenges/opportunities, we can better serve the City while delivering the highest quality product. Our management team of senior professionals will work in close partnership with City staff to ensure continuous coordination of our proposed services. They will assist the City in determining planning and environmental review requirements with support from additional CSG planners and technical staff that allow our team to provide a wide range of services in a cost-effective manner.

P L A N N I N G
CSG's approach to current and long-range planning is to “dig in” and become familiar with the City’s General Plan, Zoning Code, ongoing projects, and development trends so that we may best assist the City. Our approach includes:
 Analyzing a project’s compliance with the City’s
plans, policies and regulations. Our staff is familiar
with conducting plan checks and design review;

discretionary applications;
 Researching, compiling and analyzing social, economic, environmental and associated data;  Preparing the necessary long-range planning documents and amendments;  Meeting with developers, their consultants and other project proponents, such as property owners and other interested groups, for any project. We recognize that these are important groups and individuals to any project; and

4 Members of our staff are currently actively working in agency offices, holding regular office hours, and answering public inquiries by email, mail, or telephone. However, given COVID-19 restrictions, we also provide services remotely for several jurisdictions. Our staff are available to attend community meetings and present at public hearings; prepare staff reports, resolutions, ordinances; and prepare oral and/or electronic presentations.

E N V I R O N M E N T A L P L A N N I N G
CSG planners are environmental stewards for our natural and built environments. CSG’s approach to any environmental documentation (whether for CEQA or NEPA) is to understand and analyze each project based on the environmental issues that are pertinent to a project. CSG’s approach to environmental documentation emphasizes technically solid, impartial analysis, and active management to keep projects on schedule and within budget. We pride ourselves on our ability to turn products around quickly and effectively without sacrificing quality and accuracy.

CSG recognizes that future City projects, depending on their type, size and issues of concern, may require several different types of CEQA and NEPA processes. For NEPA, the evaluation and associated environmental assessment will be prepared in accordance with the format and content specified by the NEPA lead agency.

For CEQA, the work program will be initiated following the completion and confirmation of the Project Description. As directed by the City, CSG can then proceed with the preparation of an Initial Study pursuant to Appendix G of the CEQA Guidelines. The Initial Study will provide a screening and threshold review for each topical area in order to confirm and proceed with the appropriate CEQA clearance review.

Additionally, and more specifically, we embrace the following steps in the review process:
 Establish a communications protocol and technical leads, including subconsultants and other key team members to ensure project critical information is efficiently and accurately conveyed across the team.
 Ensure roles/responsibilities are clear for efficient management of assignments and quality control of services and deliverables.
 Utilize experienced staff with extensive relevant experience who will do the job right the first time.
 Agree on initial project schedule and budget and a protocol for updating status on both during all project phases.
 Determine key project description details with the City early to facilitate accurate and consistent reviews and analysis.
 Verify that the technical approach/scope of services, as conveyed in the proposal, meet City expectations following completion of the Project Description.  Collaborate up front with the City on standard templates for project deliverables, including peer review technical memoranda and CEQA document components.

Consultant agrees to cease all work under this Agreement on or before the effective date of any notice of termination. All City data, documents, objects, materials or other tangible things shall be returned to City upon the termination or expiration of this Agreement.

14.2. If City terminates this Agreement due to no fault or failure of performance by Consultant, then Consultant shall be paid based on the work satisfactorily performed at the time of termination. In no event shall Consultant be entitled to receive more than the amount that would be paid to Consultant for the full performance of the services required by this Agreement.

15. GENERAL PROVISIONS

15.1. Consultant shall not delegate, transfer, subcontract or assign its duties or rights hereunder, either in whole or in part, without City’s prior written consent, and any attempt to do so shall be void and of no effect. City shall not be obligated or liable under this Agreement to any party other than Consultant.

15.2. In the performance of this Agreement, Consultant shall not discriminate against any employee, subcontractor, or applicant for employment because of race, color, creed, religion, sex, marital status, sexual orientation, national origin, ancestry, age, physical or mental disability or medical condition.

15.3. Consultant agrees to comply with the regulations of City’s “Conflict of Interest Code.” Said Code is in accordance with the requirements of the Political Reform Act of 1974.

Consultant covenants that it presently has no interest, and shall not have any interest, direct or interest, which would conflict in any manner with the performance of service required hereunder.

The term “conflict” shall include, as a minimum, the definition of a “conflict of interest” under the California Fair Political Practices Act and the City of Hughson Conflict of Interest Code, as that term is applied to consultants.

15.4. In accomplishing the scope of services of this Agreement, Consultant(s) may be performing a specialized or general service for the City, and there is a substantial likelihood that the consultant’s work product will be presented, either written or orally, for the purpose of influencing a governmental decision. As a result, employees of the Consultant or the Consultant itself may be subject to a Category “1” disclosure of the City’s Conflict of Interest Code. If in fact this applies to the Consultant a form 700 must be filed.

15.5. The captions appearing at the commencement of the sections hereof, and in any paragraph thereof, are descriptive only and for convenience in reference to this Agreement.

Should there be any conflict between such heading, and the section or paragraph thereof at the head of which it appears, the section or paragraph thereof, as the case may be, and not such heading, shall control and govern in the construction of this Agreement. Masculine or feminine pronouns shall be substituted for the neuter form and vice versa, and the plural shall be substituted for the singular form and vice versa, in any place or places herein in which the context requires such substitution(s).

15.6. The waiver by City or Consultant of any breach of any term, covenant or condition herein contained shall not be deemed to be a waiver of such term, covenant or condition or of any subsequent breach of the same or any other term, covenant or condition herein contained. No term, covenant or condition of this Agreement shall be deemed to have been waived by City or Consultant unless in writing.

15.7. Consultant shall not be liable for any failure to perform if Consultant presents acceptable evidence, in City’s sole judgment, that such failure was due to causes beyond the control and without the fault or negligence of Consultant.

15.8. Each right, power and remedy provided for herein or now or hereafter existing at law, in equity, by statute, or otherwise shall be cumulative and shall be in addition to every other right, power, or remedy provided for herein or now or hereafter existing at law, in equity, by statute, or otherwise. The exercise, the commencement of the exercise, or the forbearance of the exercise by any party of any one or more of such rights, powers or remedies shall not preclude the simultaneous or later exercise by such party of any of all of such other rights, powers or remedies.

In the event legal action shall be necessary to enforce any term, covenant or condition herein contained, the party prevailing in such action, whether reduced to judgment or not, shall be entitled to its reasonable court costs, including accountants’ fees, if any, and attorneys’ fees expended in such action.

15.9. If any term or provision of this Agreement or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, then such term or provision shall be amended to, and solely to, the extent necessary to cure such invalidity or unenforceability, and in its amended form shall be enforceable. In such event, the remainder of this Agreement, or the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby, and each term and provision of this Agreement shall be valid and be enforced to the fullest extent permitted by law.

15.10. This Agreement shall be governed and construed in accordance with the laws of the State of California.

15.11. If either party initiates an action to enforce the terms hereof or declare rights hereunder, the parties agree that the venue thereof shall be the County of Stanislaus, State of California. Consultant hereby waives any rights it might have to remove any such action pursuant to California Code of Civil Procedure Section 394.

15.12. All documents referenced as exhibits in this Agreement are hereby incorporated into this Agreement. In the event of any material discrepancy between the express provisions of this Agreement and the provisions of any document incorporated herein by reference, the provisions of this Agreement shall prevail. This instrument contains the entire Agreement between City and Consultant with respect to the transactions contemplated herein. No other prior oral or written agreements are binding upon the parties. Amendments hereto or deviations here from shall be effective and binding only if made in writing and executed by City and Consultant.

15.13. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original and all of which taken together shall constitute one and the same instrument. Each party agrees that this Agreement and any other documents to be delivered in connection herewith may be electronically signed, and that any electronic signatures appearing on this Agreement or such other documents are the same as handwritten signatures for purposes of validity, enforceability, and admissibility.
