Fiscal Year 2022-23

City Manager
Staff Recommendation:

Adopt Resolution No. 2022-61, approving the revised Salary Schedule, retroactive to November 15, 2022, for Fiscal Year 2022-23.

Background and Overview:

City Staff performs ongoing analyses in all municipal departments to improve operations and implement best practices. Through analysis, the Human Resources Department has identified areas of the Salary Schedule that need to be revised for clarity and accuracy. The revised Salary Schedule will replace the existing Salary Schedule, and contains “clean-up” items, as no monetary salary changes are proposed with this revision.

Discussion:

The existing City of Hughson Salary Schedule was approved on November 14, 2022 due to operational changes that had occurred with positions over the years.

Recently, staff became aware that it is again necessary to revise the salary schedule for 2022-23, retroactive to November 15, 2022.

This revision is necessary as the City Council approved the hiring of a part-time Finance Project Manager to handle specific projects, in the absence of the Finance and Administrative Services Director. In doing so, the salary schedule needs to reflect the Finance Project Manager position with an hourly wage of $68.38. This revision is needed for accuracy and clarity and to ensure that all positions that are active in CalPERS retirement are reflected on the salary schedule.

Fiscal Impact:

There is no fiscal impact with the approval of this item. This item does not change any salaries and only contains the addition of the Finance Project Manager.

Presented By: Jose Vasquez, Public Works Superintendent Approved By: _____________________
City Manager
Staff Recommendation:

Approve the award and installation of new landscaping at City Hall to Black Castle Construction at a cost of $76,277.12 with a 10% contingency.

Background and Discussion:

On June 27, 2022, the Hughson City Council approved the project list for the American Rescue Plan Act (ARPA) funds that were received by the City of Hughson.

The project list included replacing the current turf at City Hall with a drought-resistant option due to current State water restrictions on ornamental turf. After reviewing drought-resistant options, City staff determined that this area would look best by converting to synthetic turf. As mentioned previously at a Council meeting, there is no interest in converting ornamental turf spaces to all concrete and synthetic turf provides a colorful alternative that does not require the use of water to maintain it.

In addition to the conservation of expensive, treated potable water, converting to synthetic turf will save time for public works employees who are responsible to mow and use a weed eater weekly for 10 out of 12 months a year. Currently, staff estimate they spend four hours weekly which will decrease to one hour weekly with the new landscaping.

A request for bids to install synthetic turf, pour a concrete base for the new Hughson Police Services sign, and replace the flagpole was placed on the Modesto Builders Exchange and was printed in the Hughson Chronicle. One bid was received from Black Castle Construction in the amount of $76,277.12. Included in the cost is traffic control, a mini excavator to dig up the turf and lay base rock that allows for adequate CITY COUNCIL AGENDA ITEM NO. 4.9

drainage, installation of a high-quality synthetic turf, pouring the concrete base for the new sign, and a crane with which to install a new flagpole.

Fiscal Impact:

The City Hall drought resistant project was referenced in Resolution No. 2022-31, “Exhibit A, ARPA Projects Listing”, which was approved by the City Council on June 27, 2022.

If this item is approved, Finance will increase budget appropriations for the Fiscal Year 2022-23 by $76,277.12.

Subject: Approval of Annual Report of AB1600 Fees for Fiscal Year Ending June 30, 2022 and Adoption of Resolution No. 2022- 62, Finding There Remains a Reasonable Relationship
Between Current Needs for the City’s Development Impact Fees and the Purposes for Which They Were Originally
Charged
Enclosure: Fiscal Year 2021-22 AB 1600 Report, “Attachment A” Presented By: Tina Envia, Finance Project Manager
Approved By: ________________________
City Manager
Staff Recommendation:

Approve the AB1600 Annual Report for the year ending June 30, 2022 and adopt Resolution No. 2022-62, finding there remains a reasonable relationship between current needs for the City’s Development Impact Fees and the purposes for which they were originally charged.

Background and Overview:

In 1978, following the passage of Proposition 13, many cities began charging fees on new development to fund public improvements and services such as streets, park facilities, sewers, water, and storm drains. These fees are commonly known as development impact fees. To ensure that these fees were spent in a timely manner and on projects for which they were being collected, the State Legislature passed a bill known as AB1600 (Mitigation Fee Act). This bill applies to developer fees that were increased or imposed on or after January 1, 1989. AB1600 enacts Sections 66000-66008 of the California Government Code, which generally contain four requirements:

1. A local jurisdiction must follow the process set forth in the bill and make certain determinations regarding the purpose and use of the fees and establish a “nexus” or connection between a development project or class of project and the public improvement.

CITY COUNCIL AGENDA ITEM NO. 4.10
SECTION 4: CONSENT CALENDAR

2. The fee revenue must be segregated from the general fund in order to avoid commingling of public improvement fees and the general fund.

3. If a local jurisdiction has had possession of a developer fee for five or more years and has not committed that money to a project or spent that money, then it must make findings describing the continuing need for that money. In addition, an annual report must be made of fees collected, interest earned, projects on which fees were expended, and any transfers for loans from the fee account. This report is to be reviewed by the local agency assessing the fees.

4. If a local jurisdiction cannot make the findings required under paragraph three, the City must refund the fees collected.

Discussion:

The City of Hughson scheduled fees covered by AB1600, and documented in the attached report, include the following:
• Fund 220 – Sewer Capacity Fee
• Fund 250 – Water Capacity Fee
• Fund 370 – Community Enhancement Development Impact Fee • Fund 450 – Storm Drain Development Impact Fee
• Fund 451 – Public Facility Development Impact Fee
• Fund 452 – Public Facility Streets Development Impact Fee • Fund 453 – Park Development Impact Fee
• Fund 454 – Parkland In Lieu
City staff examined each of the funds for the impact fees listed above to determine if any development fees remain unexpended five years or more after receipt. Based on the analysis, no refunds are due. Unexpended fund balances represent fees collected for respective Council approved projects which will be financed and implemented when financially feasible or practical.

Sewer Capacity Fees Fund
The sewer capacity fee is assessed in order to recover the costs of building the infrastructure necessary to extend sewer service to new development. The City contracted with Carollo Engineers to conduct an evaluation of its sewer system facility. This was driven by the recent collapse of a segment of the Tully Road industrial sewer line. This assessment will assist the City in exploring its options for improvements to meet the system’s current and future needs. Extended periods are necessary to achieve sufficient resources to finance the costs of Sewer Capital Improvement projects. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Water Capacity Fees Fund
The water capacity fee is assessed in order to recover the costs of building infrastructure necessary to extend water delivery service to new development.

Extended periods are necessary to achieve sufficient resources to finance the costs of Water Capital Improvement projects. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Community Enhancement Fund
The community enhancement impact fee is designed to fund improvements to the City’s visual and aesthetic appeal. With this funding the City can provide new landscaping, signs, statues, and other visible improvements that bring older areas of the City more in line with the newly developed sections. The City’s Draft CIP identifies the Hughson Avenue Improvement Project. Extended periods are necessary to achieve sufficient resources to finance the costs of community enhancement projects. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Storm Drain Fund
The storm drain impact fee is designed to recover the costs associated with the provision and expansion of storm drainage infrastructure. The City’s Draft Capital Improvement Plan (CIP) identifies upgrades to the South Fifth Street Lift Station and the Tully Road – Hatch Road Lift Station. Extended periods are necessary to achieve sufficient resources to finance the costs of storm drainage infrastructure.

Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Public Facility Development Fund
The public facilities impact fee is designed to recover the costs of providing general civil facilities such as City Hall, Corporation Yard, and community centers. Extended periods are necessary to achieve sufficient resources to finance the cost of facility development. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Public Facility Streets Development Impact Fee Fund
The public facility streets development impact fee is assessed in order to recover the costs of building infrastructure necessary to extend public roadways to new development. Extended periods are necessary to achieve sufficient resources to finance the costs of development projects. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Park Development Fund
The park development impact fee is assessed in order to recover the costs of providing parks for future residents. In addition, the City applied for a grant to develop Lebright Field, however the grant was denied. It is anticipated that development costs can be paid for through this funding. The City is also working with the local school district on completing major components of the Hughson Sports and Fitness Complex—a joint use facility and partnership to make it more functional.

Extended periods are necessary to achieve sufficient resources to finance the cost of park development. Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Park In Lieu Fund
The Quimby Act allows the City to require that new development set aside some amount of land (between three and five acres per 1000 people) for the purpose of providing parkland. In lieu impact fees provide funds for the City to procure parkland.

The City continues to explore opportunities to expand its park acreage to meet local needs as identified in community focus group sessions. Extended periods are necessary to achieve sufficient resources to finance the costs of parkland.

Accordingly, a need exists to continue the ongoing collection of this impact fee as well as the preservation of unspent balances for expected future project needs.

Summary:

To comply with AB1600, the City Council must make the findings that there is a reasonable relationship between the current need for the fees and the purposes for which they were charged. It is important these findings can be and are made to ensure continuance of funding resources for these important programs.

Although AB1600 requires fees collected from developers be expended within five years, the law also allows exceptions. Exceptions are provided in recognition that some projects require an extended planning period. There can be several reasons for reasonable exceptions including project costs being of a magnitude necessitating a greater than five-year timeframe to accumulate sufficient funds or necessary matching funds not being available within the five-year timeframe. The City has referenced projects demonstrating there remains a nexus between current needs of unspent development impact fees and the purposes for which they were originally established.

Fiscal Impact:

The July 1, 2021, beginning balance for the City of Hughson development impact fees totaled $6,665,456. The ending balance as of June 30, 2022, totals $4,292,981 for a decrease of $2,372,475. The acceptance of this report, including the attached Resolution, has no direct fiscal or budgetary impact on the City of Hughson, provided the collected impact fees are retained.

CITY OF HUGHSON

CITY COUNCIL
RESOLUTION NO. 2022-62

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUGHSON FINDING

THERE REMAINS A REASONABLE RELATIONSHIP BETWEEN CURRENT NEEDS FOR THE CITY’S DEVELOPMENT IMPACT FEES AND THE PURPOSES FOR WHICH THEY WERE ORIGINALLY CHARGED (GOVERNMENT CODE SECTION 66000 ET.

SEQ.) RELATED TO THE CITY’S ANNUAL REPORT ON DEVELOPMENT IMPACT FEES FOR THE FISCAL YEAR ENDED JUNE 30, 2022
WHEREAS, the City of Hughson has been authorized by Resolution to establish and collect development impact fees; and
WHEREAS, the City has established discrete accounts and fees to finance the construction of improvements as mitigation measures for continued development within the City; and
WHEREAS, the City prioritizes improvements and allocates funds during the budget cycle to construct improvements as mitigation for continued development in the City; and WHEREAS, improvements are scheduled to be constructed over time as sufficient funds become available; and
WHEREAS, there continues to be a distinct nexus between continued development and the necessity to mitigate development impacts; and
WHEREAS, fees collected in Storm Drain, Community Enhancement, Facility Development, Park In-Lieu, Parks Development, Sewer Capacity, Public Facility Streets, and Water Capacity fund accounts have not been expended in a timeframe exceeding five years, however are still necessary pursuant to AB1600 for the purpose in which they are collected, as project costs exceed current available resources and it will thus take longer to collect the necessary funds.

NOW, THEREFORE, BE IT RESOLVED that the Hughson City Council hereby:

Find and accepts the above Recitals as fact, approves the City’s AB1600 Report for Fiscal Year 2021-22, as reflected in Exhibit “A”, and does find there remains a reasonable relationship between the current need for the impact fees and the purposes for which they were originally collected.

2. Adopt Resolution No. 2022-64, Resolution Calling for a Special Election in the City of Hughson Public Safety and Maintenance Services Community Facilities District; and

5. Direct the Publication of the Notice of Public Hearing, at least seven (7) days prior to the Public Hearing
Background and Overview:

The City desires to at a minimum maintain the current level of municipal services throughout the City and in new development areas. A tool available for the City to accomplish its desire is the creation of Community Facilities Districts (CFDs) consistent with the provisions of the Mello-Roos Community Facilities Act of 1982 (the “Act’), for all future development in the City of Hughson.

On September 25, 2017, the Hughson City Council adopted a set of local goals and CITY COUNCIL AGENDA ITEM NO. 7.2
SECTION 7: NEW BUSINESS
policies concerning the formation of CFDs within the City and use of the Act. The purpose of this item is to proceed with the creation of a CFD for a new residential development.

DISCUSSION:

This item is to formally initiate the creation of the Hughson Public Safety and Maintenance Services Community Facilities District. The establishment of the District is being proposed for the purpose of levying a special tax, paid by new development, to help offset the costs of providing maintenance for certain other improvements and services (shown below).

The proposed CFD will provide funding for the following:
• Street Maintenance and Repairs including curbs, gutters, sidewalks and ramps;
• Parks;
• Street Lights including maintenance and electrical/utility costs; • Storm Drain Facilities including manhole covers, catch basins, pipes, drains, and treatment of stormwater run-off.
• Landscape Maintenance;
• Police services.

Should the City Council adopt the Resolution of Intent, a public hearing will then be held on January 23, 2023 to accept public comment on the formation of the CFD.

FISCAL IMPACT:

The fiscal impact on the City will be minimal. The proposed maximum annual special tax rate for Fiscal Year 2023/24 is $974.06 per unit and is designed to pay for the cost of the improvements and services provided.

CITY OF HUGHSON
RESOLUTION NO. 2022-63

RESOLUTION OF INTENT OF THE CITY OF HUGHSON CITY COUNCIL

TO ESTABLISH THE CITY OF HUGHSON, CITYWIDE PUBLIC SAFETY AND

MAINTENANCE SERVICES COMMUNITY FACILITIES DISTRICT TO LEVY A SPECIAL TAX THEREIN BEGINNING IN FISCAL YEAR 2023/24 AND APPROVING THE

DISTRICT BOUNDARY MAP

THE CITY OF HUGHSON CITY COUNCIL DOES HEREBY RESOLVE
THAT:

WHEREAS, under the Mello-Roos Community Facilities Act of 1982, Chapter 2.5 of Part 1 of Division 2 of Title 5, commencing at Section 53311, of the California Government Code (the "Act"), the City of Hughson City Council (City Council) is authorized to establish a community facilities district and to act as its legislative body; and WHEREAS, in accordance with Government Code Section 53321, the City of Hughson City Council intends to establish a community facilities district entitled “City of Hughson, Citywide Public Safety and Maintenance Services Community Facilities District”.

NOW, THEREFORE, IT IS ORDERED as follows:

SECTION 1. Authority. The City Council proposes to conduct proceedings to establish a community facilities district pursuant to the Act.

SECTION 2. Boundaries Described. The proposed boundaries of the Community Facilities District (the “CFD”) are as shown on the map on file with the City Clerk, which boundaries are hereby preliminarily approved and to which map reference is hereby made for further particulars. The City Clerk is hereby directed to record, or cause to be recorded, the map of the boundaries of the CFD in the office of the County Recorder within 15 days of the date of adoption of this Resolution, but in any event at least 15 days prior to the public hearing specified below.

SECTION 3. Name of CFD. The name proposed for the community facilities district is "City of Hughson Citywide Public Safety and Maintenance Services Community Facilities District”.

SECTION 4. Services. The type of services proposed to be financed by the CFD and pursuant to the Act shall consist of those listed in Exhibit A, attached hereto (the "Services"). The City Council hereby determines that the Services are necessary to meet increased demands for such services placed upon the City as the result of development occurring within the area of the CFD. The Services are in addition to those provided in the territory of the CFD as of the date hereof and will not supplant services already available within the territory of the CFD as of the date hereof.

SECTION 5. Special Tax. Except to the extent that funds are otherwise available to the CFD to pay for the Services, a special tax (the "Special Tax") sufficient to pay the costs thereof, secured by recordation of a continuing lien against all non-exempt real property in the CFD, will be levied annually within the CFD, and collected in the same manner as ordinary ad valorem property taxes, or in such other manner as the City Council or its designee shall determine, including direct billing of the affected property owners. The proposed rate and method of apportionment of the Special Tax among the parcels of real property within the CFD, in sufficient detail to allow each landowner within the proposed CFD to estimate the maximum amount such owner will have to pay, is described in Exhibit B attached hereto and hereby incorporated herein (the "Rate and Method").

The City Council hereby finds that the provisions of Section 53313.6, 53313.7 and 53313.9 of the Act (relating to adjustments to ad valorem property taxes and schools financed by a community facilities district) are inapplicable to the proposed CFD.

The Rate and Method may be altered in the future as described in supplements to the Rate and Method unanimously approved by the owner or owners of each parcel or parcels at the time that parcel or those parcels are annexed. No supplements to the Rate and Method will cause the maximum tax rate in the then-existing territory of the CFD to increase.

SECTION 6. Exempt Property. Except as may otherwise be provided by law or by the Rate and Method of the Special Tax for the CFD, all lands owned by any public entity, including the United States, the State of California, the County and/or the City, or any departments or political subdivisions thereof, shall be omitted from the levy of the Special Tax to be made to cover the costs and expenses of the Services of the CFD. In the event that a portion of the property within the CFD shall become for any reason exempt, wholly or in part, from the levy of the Special Tax, the City Council will, on behalf of the CFD, increase the levy to the extent necessary, up to the then maximum special tax allowable upon the remaining property within the CFD which is not exempt in order to yield the required Special Tax sufficient to pay the cost and expenses of the Services of the CFD, if any, subject to the provisions of the Rate and Method of the Special Tax.

SECTION 7. CFD Report. The City Officer (or designee thereof) is hereby directed to study the proposed Services and to make, or cause to be made, and file with the City Clerk a report in writing (the "CFD Report"), which shall be a part of the record of the public hearing hereinafter specified and which report shall present the following:
(a) A description of the Services that will be required to adequately meet the needs of the CFD.
(b) An estimate of the fair and reasonable cost of the Services including the cost of acquisition of equipment, training and related materials required in conjunction therewith and incidental expenses in connection therewith, and all other related costs.
(c) A boundary map of the CFD, showing the exterior boundaries of the area included in the CFD.

SECTION 8. Public Hearing. Monday, January 23, 2023, at 6:00 p.m. or as soon as possible thereafter, in the City Hall Council Chambers, 7018 Pine Street, Hughson, California, is hereby appointed and fixed as the time and place when and where the City Council, as legislative body for the CFD, will conduct a public hearing on the establishment of the CFD, and to consider and finally determine whether the public interest, convenience and necessity require the formation of the CFD and the levy of a Special Tax.

SECTION 9. Notice of Hearing. The City Clerk is hereby directed to cause notice of the public hearing to be given by publication one time in a newspaper published in the area of the CFD. The publication shall be completed at least 7 days before the date of the public hearing specified above.

The City Clerk may also cause notice of the hearing to be given to each property owner within the CFD by first class mail, postage prepaid, to each such owner's address as it appears on the most recent tax records of the County or as otherwise known to the City Clerk to be correct. Such mailing shall be completed not less than 15 days before the date of the public hearing.

Each of the notices shall be substantially in the form specified in Section 53322 of the Act, with the form summarizing the provisions hereof hereby specifically approved.

SECTION 9. Election. The levy of the Special Tax shall be subject to the approval of the qualified electors of the CFD at a special election. The proposed voting procedure shall be by mailed or hand-delivered ballot among the landowners in the proposed CFD, with each owner having one vote for each acre or portion of an acre such owner owns in the CFD.

SECTION 10. Effective Date. This resolution shall take effect upon its adoption.

Hughson Citywide Public Safety and Maintenance Services CFD Page | 16 D. METHOD OF APPORTIONMENT OF SPECIAL TAX
Commencing with Fiscal Year 2023/24, and for each subsequent Fiscal Year, the Administrator shall levy the Special Tax at the rates established in Section C on all Taxable Property within the boundaries of the CFD until the total amount of Special Tax levied equals the Special Tax Requirement. The Special Tax shall be levied each Fiscal Year as follows:

1. The Special Tax shall be levied proportionately on each Assessor’s Parcel of Developed Property up to one hundred percent (100%) of the applicable Maximum Special Tax.

2. If additional monies are needed to satisfy the Special Tax Requirement after Developed Property has been levied one hundred percent (100%) of their Maximum Special Tax, the remaining amount needed to satisfy the Special Tax Requirement shall be levied proportionately on each Assessor’s Parcel of Undeveloped Property at up to one hundred percent (100%) of the Maximum Special Tax.

E. EXEMPTIONS
The Administrator shall classify the following as Exempt Property: Public Property and Assessor’s Parcels with public or utility easements making impractical their utilization for any use other than the purposes set forth in the easement.

If the use of an Assessor's Parcel changes so that such Assessor's Parcel is no longer eligible to be classified as Exempt Property under this section, such Assessor’s Parcel shall be deemed to be Taxable Property.

F. PREPAYMENT OF SPECIAL TAX
The Maximum Special Tax may not be prepaid and shall continue to be levied in accordance with Section D of this Rate and Method of Apportionment of Special Tax on an annual basis on all Taxable Property in the CFD for the purpose of funding the ongoing Authorized Services.

Hughson Citywide Public Safety and Maintenance Services CFD Page | 17 G. TERM OF THE SPECIAL TAX
Parcels in the CFD will remain subject to the Special Tax in perpetuity, unless and until such time the City determines the revenues are no longer needed, in which case the Special Tax shall cease to be levied and the City shall direct the County Recorder to record a Notice of Cessation of Special Tax. Such notice will state that the obligation to pay the Special Tax has ceased and that the lien imposed by the Notice of Special Tax Lien is extinguished. The Notice of Cessation of Special Tax shall additionally identify the book and page of the Book of Maps of Assessment and Community Facilities Districts where the map of the boundaries of the CFD is recorded.

H. REVIEW/APPEALS
The Administrator may establish such procedures, as it deems necessary to undertake the review of any such appeal of any property owner. The Administrator shall interpret this Rate and Method of Apportionment of Special Tax and make determinations relative to the annual administration of the Special Tax and any property owner appeals, as herein specified.

Any property owner who believes that the amount of the Special Tax levied on their Assessor’s Parcel is in error shall first consult with the Administrator regarding such error.

If following such consultation, the Administrator determines that an error has occurred, the Administrator or designee shall take any of the following actions to correct the error:
• Amend the Special Tax levy on the property owner’s Assessor’s Parcel(s) for the current fiscal year,
• Require the CFD to reimburse the property owner for the amount of an overpayment to the extent of available CFD funds, or,
• Grant a credit against, eliminate or reduce the future Special Taxes on the property owner’s Assessor’s Parcel(s) for overpayment for the current fiscal year.

Citywide Public Safety and Maintenance Services CFD Page | 18 If following such consultation and action (if any by the Administrator), the property owner believes such error still exists, such person may file a written notice with the City Manager appealing the amount of the Special Tax levied on such Assessor's Parcel. If following such consultation and action (if any by the City Manager), the property owner believes such error still exists, such person may file a written notice with the City Council appealing the amount of the Special Tax levied on such Assessor's Parcel.

If the City Manager, City Council or designee determines an error exists, the CFD Administrator shall take any actions as described in this section, in order to correct the error. The decision of the City Council shall be final and binding to all persons.

I. INTERPRETATIONS
The City reserves the right to make minor administrative and technical changes to this document that does not materially affect the Rate and Method of Apportionment of Special Taxes. In addition, the interpretation and application of any section of this document shall be left to the City’s discretion. The City may make interpretations by ordinance or resolution for purposes of clarifying any vagueness or ambiguity in this Rate and Method of Apportionment of Special Tax.

J. MANNER OF COLLECTION
The annual Special Tax shall be collected in the same manner and at the same time as ordinary ad valorem property taxes; provided, however, that the Administrator, may, at the sole discretion of the City, directly bill the Special Tax, and may collect the Special Taxes at a different time or in a different manner as necessary to meet the financial obligations of the CFD or as otherwise determined appropriate by the Administrator.

K. REPEAL OF SPECIAL TAX
If the levy of the Special Tax is repealed by initiative or any other action participated in by the property owners of Assessor’s Parcels in the CFD, the City shall cease to levy the Special Tax and shall cease to be obligated to provide the Authorized Services for which the Special Tax was levied. The obligation to provide the Authorized Services previously funded by the repealed Special Tax shall become the joint obligations of the property owners of Assessor’s Parcels within the CFD.

Subject: Appoint Eric Nims with Neumiller & Beardslee as City Attorney and Thomas Terpstra as Deputy City Attorney
when Dan Schroeder Retires
Enclosure: Dan Schroeder Retirement Letter
Presented By: Merry Mayhew
Dan Schroeder, City Attorney
Approved By: ______________________________
City Manager
Staff Recommendations:

1. Appoint Eric Nims as City Attorney, effective January 1, 2023.

2. Appoint Thomas Terpstra as Deputy City Attorney, effective January 1, 2023.

Background and Discussion:

The City of Hughson has contracted with Neumiller & Beardslee to provide City Attorney services for many years and Dan Schroeder has been designated to serve as the City Attorney since 2010. Mr. Schroeder has recently announced his decision to retire from the practice of law and thus he will be stepping down from his role as City Attorney for the City of Hughson on December 31, 2022. Though Mr.

Schroeder will remain with Neumiller & Beardslee through the first quarter of 2023 to wrap up his practice, he believes that now is the time for Deputy City Attorney Eric Nims to take over as City Attorney so that he is available to assist Mr. Nims and the City with any issues that arise to ensure a smooth transition. He is also recommending that his colleague Tom Terpstra who has been working on matters for the City as well as his experience in working with the City of Ripon be named as Deputy City Attorney.

Mr. Nims and Mr. Terpstra have been working with the City of Hughson on many items in 2023 and are familiar with City staff and City business. Mr. Nims has also served as Deputy City Attorney providing legal guidance to the Planning Commission and has attended their meetings. Mr. Terpstra would assume that roll as Deputy City Attorney.

Re: Retirement of City Attorney
Honorable Mayor Carr and Council Members,
After more than 33 years of practicing law, 12 of them as the City Attorney of the City of Hughson (City), I’ve decided that it is time for me to retire. I have such fond memories of my time working for the City and with the various mayors, council members, city managers and staff over the years. Through all the difficult issues, the ups and downs of economic cycles, and inevitable changes the City has experienced, the common denominator that made it possible for the City to continue to endure and prosper has been the quality of the Council, Commissions, Committees, and staff, governing with a calm and steady hand. It has been my privilege to provide you legal counsel every step of the way.

When asked what I did before I retired, I will proudly respond “I was the City Attorney for the City of Hughson.” You will always have a special place in my heart.

Sincerely,
DANIEL J. SCHROEDER

Subject: Adopt Resolution No. 2022-65, Authorizing the City Manager to Execute a Contract with Municipal Maintenance Equipment, Inc., a California Corporation, for the Purchase of One Vac-Con V311LHA-P/1000 Mounted on a New
Freightliner 114SD 6x4 Truck Chassis, in an Amount Notto-Exceed $563,895.23; and Authorizing the Surplus and Online Auction of the 2006 Vactor 2100 Series Truck
Enclosure: Municipal Maintenance Equipment Inc. Contract Pricing Sheet
Presented By: Carla C. Jauregui, Community Development Director Approved By: ____________________________
City Manager
Staff Recommendations:

1. Adopt Resolution No. 2022-65, authorizing the City Manager to execute a contract with Municipal Maintenance Equipment, Inc., a California corporation, for the purchase of one Vac-Con V311LHA-P/1000 mounted on a new Freightliner 114SD 6x4 truck chassis, in an amount not-to-exceed $563,895.23, inclusive of any final edits by the City Attorney

2. Authorize the surplus and online auction of the 2006 Vactor 2100 Series truck.

Background and Discussion:

Currently, staff uses a 2006 Vactor 2100 series truck for the maintenance, inspection, and cleaning of storm drain and sanitary sewer lines. This truck is 16 years old, and in the past 6 months has been in the shop on a recurring basis, forcing the City to ask for assistance from neighboring cities (Oakdale and Waterford) in the event of an emergency. This has prompted staff to reach out to Sourcewell to obtain pricing for the replacement of this vehicle.

CITY COUNCIL AGENDA ITEM 7.4
SECTION 7: NEW BUSINESS
Sourcewell is a public agency that offers competitively solicited purchasing contracts for products and equipment to member agencies. The City has access to Sourcewell on unique purchases where the City’s buying power and staff expertise on the equipment are limited. Sourcewell issues Request for Proposals (RFP) on behalf of member agencies. This process streamlines procurement by developing RFPs for national distribution resulting in competitive solicitations that typically meet or exceed local requirements.

Recently, Sourcewell received bids for a Combination Jet/Vacuum Sewer Cleaner (storm/sewer truck). Vac-Con, Inc. was selected by Sourcewell and was issued Contract #101221-VAC. Vac-Con Inc. was selected because it met the specifications issued by Sourcewell and submitted the lowest bid. MME is the local distributor of Vac-Con units.

In light of the favorable pricing and Sourcewell’s widespread competitive bidding process, it is the opinion of staff that a formal bidding procedure for the storm/sewer truck is unnecessary and would not be in the best interest of the City because the expenditures of staff time and budget to compile the necessary bid documents for a small quantity of award is not likely to result in a better price or an outcome more advantageous to the City.

Staff proposes to keep the used vehicle for some time as a backup truck while staff obtain certification for the new truck as well as allowing time for training. After that period, staff proposes to place the vehicle on the surplus list for auction at the current suggested sales price. Section 3.08.030 states that except when otherwise authorized by resolution of the City Council, all property declared to be surplus shall be sold at public auction, and the auction shall be held every third Saturday in July every year at 2:00 p.m. Staff is asking Council for an exception to this code section given the availability to auction surplus goods electronically. Rather than hold a public auction, staff would like to use the website Municibid.com.

Municibid is an auction website exclusively used by government agencies, schools, authorities, and utilities to sell surplus and forfeitures directly to the public. All auctions take place online and are available to bid 24 hours a day. Over 3,000 government agencies, authorities, and schools use this website. Bidders pay a competitive buyer’s fee so that the City may receive 100% of the winning bid. The website provides large pictures to showcase items, there are real-time updates on items, bidders get reminders to bid, and most importantly, anyone who can pick up the item from Hughson can bid on the items. Municibid has been used in the past with good results.

Fiscal Impact:

Funds for this project are available through the Sewer Fixed Asset Replacement Fund 215, which has a balance of approximately $5,178,785, Water Fixed Asset Replacement Fund 255, which has a balance of approximately $275,880, and Storm Drain Fund 450, which has a balance of $832,112. If approved, City staff will make budget adjustments for Fiscal Year 2022-2023 in the following amounts: $338,338 in Fund 215; $112,779 in Fund 255; and $112,779. Additionally, the amount received for the surplus truck will be deposited in the Sewer and Water Funds and booked as revenue.
