Subject: Appoint a Qualified Candidate to Fill the City Council Vacancy
Presented By: Ashton Gose, City Clerk
Andy Pinasco, City Attorney
Staff Recommendation:
Appoint a qualified candidate to fill the City Council vacancy.
Discussion:
At this time the City Council can discuss the interviews, nominate, and ultimately appoint an individual to fill the Council seat vacancy for the remaining term, expiring in December 2024.
Nomination Process:
The City Clerk shall ask each council member for a nomination for the purpose of creating a group of finalists to consider. Once the group is created, Councilmembers may deliberate on such matters as criteria for selection and the nominated group of candidates.
After deliberation, there will need to be a motion to appoint one of the nominees to fill the City Council vacancy, with a second motion, and a majority vote of the Council. If needed, voting will continue until a nominee receives a majority vote of the Council.
If an appointment is made, the City Clerk will administer the Oath of Office to the newly appointed Council member and conduct the seating and roll call of the new Hughson City Council at the regularly scheduled meeting on October 9, 2023.
Pursuant to California Government Code section 36512(b), the City Council, within sixty (60) days from the commencement of the vacancy, is required to either fill the vacancy by appointment or call a special election to fill the vacancy. So, should the City Council choose to not move forward with appointing an individual to fill the Council seat vacancy, direction would need to be provided to City staff to prepare and bring back a Resolution to the next regularly scheduled meeting, calling a CITY COUNCIL AGENDA ITEM NO. 2.2
SECTION 2: UNFINISHED BUSINESS
Special Election to fill the Council seat vacancy for the term expiring in December 2024.
Fiscal Impact:
Per the Hughson Municipal Code, Hughson City Council members are compensated $250.00 per month and are reimbursed for actual and necessary expenses incurred in the performance of official duties.
