Subject: A Resolution Approving the Amended City of Hughson’s Legislative Program
Enclosure: Amended City of Hughson Legislative Program
Presented By: Dominique Romo, City Manager
Approved By: ______________________________
City Manager
Recommended Council Action:
Adopt Resolution No. 2025-01, amending the City of Hughson’s Legislative Program.
Background:
Historically, the City of Hughson has conducted legislative advocacy through its work by designated members of the City Council with the League of California Cities (LOCC). Due to limited staffing resources, the establishment of a Legislative Program has served the City of Hughson well over the last several years.
Occasionally, the City of Hughson is asked to consider taking positions of support or opposition on Federal and State Legislation, and such requests are handled on a case-bycase basis by the Hughson City Council through its regular or special meetings. This occurred back in August 2024, when Assemblyman Juan Alanis’ office reached out to Mayor Carr to share that one of his top priorities was the repeal of Proposition 47 and reversal of the many negative impacts it has placed on Californians, including unintended consequences leading to an increase in retail theft, store closings, and created barriers to encouraging people to seek drug and mental health treatment. The City Council discussed the item and unanimously adopted Resolution No. 2024-31, in support of Proposition 36 – The Homelessness, Drug Addiction and Theft Reduction Act.
In other times, letters of support or opposition are requested urgently through LOCC. With an approved Legislative Program, the City Manager or the Mayor could handle these emergency items immediately without causing the delay of taking the position to the City Council for discussion. Matters not brought forward will be shared with the City Council in a regular meeting. This approach will ensure that staffing resources are utilized wisely to CITY COUNCIL AGENDA ITEM NO. 3.3
SECTION 3: CONSENT CALENDAR
18 only conduct related work and analysis on those legislative matters consistent with the adopted Hughson Legislative Program.
A Legislative Program also serves as a tool that the City Council and staff may utilize to support the City of Hughson’s adopted Strategic Priorities. The City can identify issues, values, and priorities that may be addressed through legislative advocacy while doing it in a way that is cost-effective and efficiently utilizes City resources. To ensure its alignment with the Strategic Priorities, the Legislative Program can be amended as necessary.
Adoption of a Legislative Program enables the City Council and staff to react to most legislative issues as they arise throughout the year promptly. The document can also be provided to State and Federal representatives so they are made aware of the issues that are important to Hughson and can advocate for those issues on the City’s behalf.
Amendments to the Program:
Staff thoroughly reviewed the program and updated it to include additional items related to preserving local control, housing, assisting vulnerable populations including veterans, enhancing economic development, addressing opioid misuse and tobacco usage, and assisting with funding for parks, trails, open spaces, and the public library, etc. Staff are committed to advocating for policies that protect local authority, enhance infrastructure and public services, and promote economic development while safeguarding the well-being of our citizens and residents.
We will continue to monitor and engage in legislative matters that align with our community’s priorities and long-term vision.
Fiscal Impact:
Implementation of the City of Hughson’s Legislative Program will occur through existing staff and budgeted allocations. Fiscal impacts that may arise will be incorporated into the City’s annual budget process.

Legislative Program
Adopted February 24, 2025
I. Legislative Principles
Home Rule
We support self-governance by locally elected officials as provided in the State's Constitution. We believe local governments should control their rights-of-way, have condemnation authority, be immune from tort liability, and be free to voluntarily cooperate with other public and private entities, as well as the State government, to ensure the best level of service for our citizens. We oppose actions at the state level that erode representative democracy or local self-determination.
Preserve Local Control
We value our ability and authority to exercise local control, protect and enhance our quality of life, and offer excellent public services for our residents, citizens, and businesses. We oppose legislation that reduces municipal authority in areas of zoning, planning, and development review.
Annexation
The ability of the City of Hughson to promote and plan for growth is crucial to the success of our community and Stanislaus County. We support the ability of cities to use their annexation powers as established in state statute and oppose any change that limits this authority.
Rights-of-Way
We oppose legislation that would restrict the ability of cities to control public property and rights-of-way or the ability of cities to franchise those entities that use the rights-of-way, including the implementation of statewide franchises.
Unfunded Mandates
We oppose unfunded mandates. If the state or federal governments seek to promote policy objectives, an appropriate level of funding should accompany such mandates. We support legislation that addresses financial burdens of existing unfunded mandates, increases funding to cities, protects local revenue sources, and prevents the imposition of new unfunded mandates.
Housing
We acknowledge California's housing shortage and support legislation and policies to develop affordable housing that meets the needs of our community while complying with 22 local land use plans. We support funding to increase housing supply and affordability and advocate reforms that retain local authority over housing laws.

Subject: Resolution Accepting the 2023 Surface Improvements Project Enclosure: Notice of Completion
Presented By: Carla Jauregui, Community Development Director Approved By: _________________________
Recommended Council Action:
1. Adopt Resolution No. 2025-02, accepting the 2023 Surface Improvements Project as complete.
2. Authorize the City Clerk to file the Notice of Completion with the Stanislaus County Clerk Recorder’s Office.
Background and Discussion:
The 2023 Surface Improvements Project was awarded to Dryco Construction, Inc. on August 14, 2023, under Resolution No. 2023-41, for an original contract amount of $1,355,158.60, with a 10% contingency for unforeseen conditions and a 10% set-aside for construction testing and inspections totaling $1,626,190.32. The project was funded through a combination of Measure L Local Streets and Roads Tax, Public Facilities Streets Development Impact Fees, Trench Cut Fees, and Gas Tax revenues.
The scope of work included:
• Type II Slurry Seal (approximately 2,500 SF)
• 2’ Grind Overlay (approximately 52,100 SF)
• Dig Out and Replacement (3” AC / 6” AB, approximately 11,350 SF) • Striping of various streets
The contractor was given a notice to proceed on October 23, 2023, however due to weather and scheduling delays, construction commenced on July 29, 2024, and was substantially completed on October 25, 2024 with a few punch list items remaining. A final walkthrough was conducted by City staff, the contractor, and the City’s contracted engineer, confirming that all work was completed per contract specifications and industry standards. Minor punch list items were addressed, and the project has been deemed complete.
CITY COUNCIL AGENDA ITEM NO. 3.4
SECTION 3: CONSENT CALENDAR
25 It is important to note that the sections of streets previously earmarked for deferred treatment due to planned utility work remain excluded from this project and will be addressed in future roadwork efforts once those projects are completed.
Slurry Seal, Crack Sealing, and Loose Aggregate:
During the City Council meeting on November 25, 2024, concerns were raised regarding the final appearance of the slurry seal project. Below is an overview of the process and findings:
Slurry Seals
Slurry seals are applied to rejuvenate and protect asphalt surfaces by sealing minor cracks, preventing further deterioration, and extending the pavement’s lifespan. The process restores the appearance and functionality of roadways. The current condition of the slurry seal treatment throughout the City of Hughson aligns with expected results.
Crack Sealing
Crack sealing is a critical pre-treatment step where all cracks wider than 1/4” are filled to prevent water infiltration and crack propagation. Due to the difference in flexibility between the rubberized crack filler and the slurry seal, some reflective cracking is expected in the months following the project. It is recommended that the City reassess and apply additional crack seal treatment approximately one year post-project.
Loose Black Rock (Pellets)
The black pellets observed on streets are an integral part of the slurry seal process. These small aggregates provide structure, durability, and skid resistance. It is normal for some loose rock to appear post-application, especially in high-turn areas. Per contract requirements, the contractor conducted a sweeping operation seven days after application.
This material poses no environmental hazard, as it is the same used in traditional paving projects.
Summary of Project Effectiveness:
The 2023 Surface Improvements Project overall meets industry and performance standards has successfully extended the pavement life for approximately 60-70% of the City’s roads at a cost-effective rate. Additionally, as an alternative to liquidated damages, the contractor agreed to slurry Santa Fe Avenue (220,000 SF) at no additional cost to the City.
Fiscal Impact:
The final construction cost of the project, including contingency use, remained within the allocated budget of $1,626,190.32 coming in at a total cost of $1,422,334.60. 26 CITY OF HUGHSON

Subject: Ordinance Amending Municipal Code Chapter 3.08 – Surplus Property Sale of Title 3 – Revenue and Finance
Enclosures: Hughson Municipal Code Chapter 3.08 Surplus Property Sale Ordinance No. 2025-01
Presented By: Ashton Gose, Executive Assistant/City Clerk Andy Pinasco, City Attorney
Approved By: ________________________
Dominique Romo, City Manager
Recommended Council Action:
Introduce and waive the first reading of Ordinance No. 2025-01, amending Chapter 3.08 – Surplus Property Sale of Title 3 – Revenue and Finance of the Hughson Municipal Code relating to disposition of surplus property.
Background and Discussion:
Surplus Real Property is City property including lands, tenements, and hereditaments. The proposed ordinance allows Surplus Real Property to be declared unnecessary for City use and subject to disposal procedures, including notices to eligible entities, negotiations, and sale requirements, with exemptions for specific cases.
Surplus Personal Property is all other property which is declared not necessary for the City’s use. The ordinance reflects the current interpretation of the Surplus Land Act to ensure that Surplus Personal Property is disposed of through auctions, (including the use of online auction, which the Council has annually approved by Resolution since the COVID-19 Pandemic), donations, disposal, or incidental sales.
The ordinance gives the City Manager the authority to determine how to dispose of Surplus Personal Property, except that the City Council approval will be required for disposition when the total estimated market value of any item is greater than, or equal to $2500.00.
Chapter 3.08 of the Hughson Municipal Code (HMC) has not been amended since 1978 and does not currently include a process for the disposition of real property in accordance with the California Department of Housing & Community Development (“HCD”). The proposed CITY COUNCIL AGENDA ITEM NO. 5.1
SECTION 5: PUBLIC HEARING
30 ordinance amends the definitions and regulations regarding the disposition of surplus real and personal property by the City and allows for a streamlined disposal process.
The proposed changes were drafted in coordination with the City Attorney’s Office, and a Public Hearing Notice was posted and published, and the public is encouraged to provide input at the City Council meeting.
Fiscal Impact:
There is no fiscal impact to the City with adoption of this ordinance; however, there will be minimal additional staff time necessary to prepare and maintain records which identify all Surplus Real/Personal Property disposed of, the method of disposal, and the amounts received from the disposal.
All proceeds received from the sale of Surplus Real/Personal Property shall be delivered to the Finance Director for deposit in the City’s general fund, or in that fund from which the property was originally purchased.

A. “Disposition” in the context of Real Property as defined in HMC 1.04.010 (N), means either the sale of Surplus Real Property or the entering of a lease for Surplus Real Property for a term longer than 15 years, inclusive of any extension terms in a lease entered on or after January 1, 2024. B. “Exempt Surplus Property” means Real Property, as defined in HMC 1.04.010 (N), that is not required to follow the public notice and bidding requirements, as described under HMC 3.08.020 or the Surplus Land Act because it meets one or more criteria under Government Code Section 54221(f)(1).
C. “Surplus Personal Property” means Personal Property, as defined in HMC 1.04.010 (K), owned by the City, for which the City declares at a regular public meeting is not necessary for the City’s use.
D. “Surplus Real Property” is Real Property, as defined in HMC 1.04.010 (N), owned by the City, for which the City declares at a regular public meeting is not necessary for the City’s use.
3.08.020 Disposition of Surplus Real Property
A. Prior to disposing of any Real Property the City owns, the City shall declare Real Property as either “Surplus” Real Property or “Exempt” Surplus Property, as supported by written findings. The City shall provide a copy of the written declaration to the California Department of Housing & Community Development (“HCD”) at least 30 days prior to Disposition.
B. If HCD determines that the property is Exempt Surplus Property, the City is not required to follow Disposition requirements under this Section and instead may dispose of the Exempt Surplus Property in any way consistent with State and Federal law and approved by the City Council.
C. If HCD determines that the Real Property is not Exempt Surplus Property, the following Disposition requirements apply:
35 1. By December 31 of each year, the City shall prepare an inventory of all Surplus Real Property it owns and submit an annual report to HCD identifying this Surplus Real Property using forms prescribed by HCD.

c. Regional Park authorities with proper jurisdiction where the Surplus Real Property is located.
3. Eligible entities have sixty (60) days from the date the City issues the NOA to submit a written notice of interest in purchasing or leasing Surplus Real Property. If a timely notice is received, the City must engage in good faith negotiations with the entity for a minimum of ninety (90) days, beginning with the day immediately after the conclusion of the 60-day notification period. If no eligible entity expresses interest within 60 days of the notice or if negotiations do not result in a sale, the City Council may then authorize the City Manager to sell the property to other prospective buyers for a price equal to or greater than the minimum price established by a current appraisal. No appraisal shall be required if the City Manager reasonably determines the property’s estimated fair market value is less than $5,000.00.

2. Online Auction. Sales at an online auction shall be to the highest bidder. Sale may occur through any publicly accessible online auction platform customarily used for the sale of surplus government property.
3. Donation. The City may donate Surplus Personal Property to any other City department, public agency, or to any other party as may be authorized by state law.
4. Disposal. If the head of a department, in consultation with the City Manager, determines that an item has little or no resale value, or that the item is broken and irreparable, the department or office may dispose of the item without further action.
5. Incidental Sale. A department or office may sell any item of Surplus Personal Property by “incidental sale” when it determines that the item:
a. Is scrap or salvage material, including but not limited to, a discarded fire hose, a tire casing, a dead storage battery, or worn-out or wrecked automobile or machine part; b. Is perishable; or
36 c. Has been offered for public sale and no offer to purchase has been received within 60 days.
B. The City Manager may reject a bid received for any item, but only if one of the following situations apply:
1. The highest bid fails to meet the reserve amount set by the City prior to the auction.
2. There is reasonable evidence of collusion, unethical behavior, or conflicts of interest on the part of the bidder.
3. There is a pending lawsuit between the bidder and the city.
4. The bidder has unpaid utility bills, liens, assessments, or other debts owed to the City.
C. The City Manager, or his or her designee, shall have the authority to determine whether and how to dispose of Surplus Personal Property pursuant to this Chapter except that the City Council approval is required for Disposition of Surplus Personal Property when the total estimated market value of any item is greater than or equal to $2,500.00.
D. The City Manager, may, from time to time, require that the head of each department in the City submit a list of all Surplus Personal Property belonging to such City department.

Consider a recommendation from the Parks, Recreation, and Entertainment Commission to reduce the fees for the Hughson Youth Baseball/Softball League for the 2025 regular season for the rental fees pertaining to their use of Lebright Fields and Rolland Starn Park/Keith Crabtree Field.
Background and Overview:
Since 2014, the City Council has partnered with Hughson Youth Baseball and Softball (HYBS) by approving annual fee reductions for Lebright Fields and a fee waiver for Starn Park in exchange for their commitment to completing park improvement projectsfor both Lebright Fields and Starn Park/Keith Crabtree Field. In exchange, HYBS provides a list of projects and/or improvements to the parks that they will complete during the season. The fee reductions and waiver have been approved by the City Council based on the public interest they serve and that the planned improvement costs often exceeded what would be generated in park rental/usage fees.
For several years HYBS has received a significantly discounted rate (total cost of $800 annually) for the rental and usage of Lebright Fields and total fee waiver for Starn Park/Keith Crabtree Field from January 1 through June 1. The City Council has also established a fee specifically for HYBS, for the use of Lebright Fields set at $200 per month.
There is currently no fee established for HYBS for the use of Starn Park/Keith Crabtree Field.
CITY COUNCIL AGENDA ITEM NO. 6.1
SECTION 6: NEW BUSINESS
38 In July 2024, the City Council approved the establishment of a rental fee for the new concession stand installed at Lebright of $50 per day.
Discussion:
The total park fees due in accordance with the applications submitted are as follows:
Lebright Fields
Rental and Use by HYBS
$200.00 per month
(January 1 through June 1) $1,000
Rental and Use of the Concession Stand
$50.00 per day $ 6,550
(January 1 through June 1)
Estimated Total $ 7,550
Starn Park/Keith Crabtree Field
Rental and Use of Field
$30.00 every 3 hours
(January 1 through June 1)
Estimated Total $ 11,790
TOTAL $19, 340
The list of improvements and some of their estimated costs were submitted by HYBS and are quoted as follows:
• Clean storage area, dump all old trash from the previous organizations. • Grade and put gravel in storage yard. Gravel for inside of storage area we are hoping to keep below $3,500. Plus we will be extending fence. Not sure of cost, thinking probably around 2k for fencing. That’s not including the broken gate we are going to replace.
• Extend fence and our goal is to invest in nicer storage units to clean up that area within the next couple years
• We are looking into dug out covers for t-ball. It’s too hot on them. • We will do our yearly maintenance of course.
o Clay, soil, weed and gopher control. We have already cleaned all the graffiti off this year and started on spraying weeds and cleaning dug outs. • Every field work day in the end of February we go through each field and replace whatever is needed. Ie: back drops, home plates, base pegs, dugout benches, etc. 39 We won’t know what needs to be fixed on fields until at march when we have our field work day.
• Clean out storage and take all old equipment trash left from programs and cutting back debris and helping level storage area this week. He is estimating it to be around $1,000.
The total cost of these proposed improvements would not exceed the generated park rental/usage fees for Starn Park. Although the City of Hughson values its partnership with HYBS and recognizes the role it plays in providing recreational opportunities for the youth in our community, maintaining our parks and ensuring their long-term viability requires sustainable funding sources. Most of the projects submitted by HYBS are maintenance items that are already or can be completed by the City’s public works staff. Since the City has purchased Lebright Park/Fields, the City has invested its resources available into improving it completely for the entire community’s use and enjoyment.
Keith Crabtree Field at Starn Park, and Lebright Fields are owned and maintained by the City. The City’s significant improvements to Lebright Park include spending over $1,000,000 in funds since 2022 on the installation of a new concession stand with restroom facilities, new parking lot pavement, ADA walkways and improvements, two (2) new backstops, etc.
The City has also made about $35,000 in improvements to Rolland Starn Park since 2022, including new cameras, restrooms doors and timer locks, and shade replacement. These improvements come with ongoing maintenance costs that must be accounted for in the City’s budget. To maintain the park and these improvements, and to be able to provide for their anticipated repairs, replacement, updates, and other improvements as needed, the rental fees established for the parks need to be assessed and collected as adopted by the City Council.
HYBS staff have advised city staff that the fees are infeasible and that they have a hardship in paying them. It was advised that the program has roughly 550 kids and this year’s registration fees were reported to be $120 per child. This revenue does not include any donations, concession stand revenues, fundraising activities, or sponsorships paid by businesses that typically cover uniform costs for their team(s).
City staff believe that the improvements submitted in exchange for fee reductions can be or are currently addressed and completed by staff at a reduced cost and would primarily benefit HYBS for the duration of their use of the park/fields (afternoons, evenings, and Saturdays) for the timeframe indicated. It is important to note that in partnering with HYBS by fostering a space to provide parks and recreation activities for the community, Council has already established a $2,870 discount on the rental fees for Lebright Fields, by establishing a flat rate of $200 per month for HYBS. No other local non-profit organization receives a discount on their parks/field rental fees.
It is also important to note that the City allows both HYBS and Hughson Youth Football and Cheer (HYFC) to store their equipment onsite in a private area of the park in storage containers, at no cost to either organization. This area is fenced off from the public and currently unavailable for potential future park use. Additionally, thanks to the installation 40 of the restrooms, HYBS no longer incurs the cost of renting porta-potties for Lebright Park every season, which is an additional cost savings to the organization. HYBS does, however, pay for lighting at Starn Park when needed, at $23.00 per hour, per the approved fee schedule.
Staff believe that a long-term lease/maintenance agreement would be beneficial to better address the use of the private storage space and future park area needs and intend to pursue this item in the future. The City remains committed to working collaboratively with HYBS while ensuring that the park facilities remain financially and operationally sustainable.
The ideal goal that is recommended is that the City Council consider the recommendation from the Parks, Recreation and Entertainment Commission and/or consider a fee reduction for the 2025 season while simultaneously ensuring the long-term sustainability of the city parks and their facilities.
Parks, Recreation and Entertainment Commission Meeting:
At the February 11, 2025, meeting, Sarah Cunningham, representing HYBS, shared during her presentation that HYBS has donated $36,000 in field improvements since 2017. As indicated previously, the City Council has approved fee reductions for the field rental fees since 2014 in exchange for these field improvements. Mrs. Cunningham discussed HYBS’s revenues and expenditures and updated the Commission that this season they have 330 kids: with the registration costs being $90 for Tee Ball, $110 for Baseball and $100 for Softball for an approximate revenue of $55-$60k. She also shared the following main costs they incur to operate the league: $11,500 for Insurance, $3,000 to the League they are members of, $1,000 for accounting, $4,700 field equipment, $26,000 payroll, and $12,000 in sponsor signage. Mrs. Cunningham further advised that the concession stand revenues pay for the umpires and that the sponsorship revenues pay for the sponsors’ signage and team uniforms. In addition, they have one (1) fundraiser per year and have about $5,000- $6,000 left annually when the season closes, but that can fluctuate depending on the revenues and expenses for each season.
Mrs. Cunningham later mentioned that the fields are not used until mid-February and that the snack bar will not be operational until March 29th. City staff have applied the adopted fees based on the updated information provided in the meeting:
Lebright Fields
Rental and Use by HYBS
$200.00 per month
(February through June 1) $ 800
Rental and Use of the Concession Stand
$50.00 per day
(March 29 through June 1)(55 days) $ 2,750
Estimated Total $ 3,550
41 Starn Park/Keith Crabtree Field
Rental and Use of Field
$30.00 every 3 hours
(February 17 through June 1)(90 days x $90 daily)
Estimated Total $ 8,100
TOTAL $ 11,650
The Parks, Recreation and Entertainment Commission unanimously approved a recommendation to the City Council to approve a fee reduction for HYBS. The Commission recommended HYBS pay $2,000 towards their rental fee costs as a final discount. In accordance with the updated information provided at the meeting, this is a fee reduction of approximately $9,650.00. The Commission then encouraged HYBS to examine a solution that would cover the costs of using the facilities in the future, with the example being raising the registration fees.
Fiscal Impact:
The revenue that would be generated through the use of Lebright Fields and Starn Park/Keith Crabtree Field by HYBS based on the revised time frame given at the February 11th meeting for the 2025 season is $11,650, not including the costs for lights. It is important to reiterate that in the past ten (10) years, the City Council has granted fee reductions to HYBS estimated at approximately $127,900. This year the proposed improvements and labor proposed by HYBS are estimated at $6,500, leaving a balance of $5,150 due to the City’s General Fund, which pays for the ongoing maintenance and upkeep of the facilities, including water, which last fiscal year cost the City $12,582.74. 42
