Re: Agenda Item 6.1
Dear Mayor Carr and Council Members,
I am writing to express our concern over your proposed expenditure of Public Facilities Development Impact Fee Funds. According to the staff report this money will be used to replace/remodel equipment that was originally purchased in 2016 as part of a City Hall Remodel Project. At that time, the remodel presumably expanded City Hall's capacity to serve a growing population, and the service expansion was roughly proportional to the fees imposed on new development, making the use of impact fees appropriate
However, the current proposal appears to address operational issues such as equipment obsolescence, compatibility problems, and declining support as referenced in the staff report, rather than a proportional increase in service capacity. As such, this expenditure falls under operations and maintenance, which is not an eligible use of impact fee revenue under the Mitigation Fee Act (Govemrnent Code §66006).
The BIA supports the principle that new development should pay its fair share for expanded public service capacity. We oppose the use of impact fees for expenses that do not directly increase that capacity.
We ask the Council not to approve Item 6. 1, as doing so would constitute an invalid use of impact fees and a violation of state law.
Joffi R. Beckman
Chief Executive Officer
