The City Council returned from Closed Session at 6:04 PM.
City Attorney Andy Pinasco reported that three members of the Council were present during the session.
Mayor George Carr was recused, and Councilmember Susana Vasquex was absent (excused). City Attorney Pinasco provided the following statement:
The Council has concluded its closed session. I am authorized to report the following on behalf of the City Council.
The Council received a report from outside legal counsel regarding an independent workplace investigation conducted on behalf of the City by a third-party investigator. The Council has been fully briefed on the outcome of that investigation. The investigation resulted in sustained findings.
The Council acknowledges those findings and takes them seriously. The conduct at issue is not consistent with the standards the City holds for itself as an institution, and the Council believes it is important to say so plainly and on the record.
The Council recognizes that it is a self-governing, elected body, one that is accountable to the residents of Hughson through the democratic process. There is no external body that regulates the conduct of city council members in California. That responsibility rests with the Council itself, and ultimately with the voters. The Council takes that responsibility seriously. Accordingly, the Council renews its prior direction to staff and legal counsel to return a revised Code of Conduct for Council members for formal consideration at the next regular Council meeting. The Code of Conduct represents the Council's collective statement about the character and integrity it expects of its members, a standard that applies equally to everyone who holds this public trust.
The Council looks forward to that conversation happening publicly, transparently, and in front of the community this body serves. That concludes the report out of closed session.
3. ADJOURNMENT:
STRAIN/CROOKER 5-0 motion passed to adjourn the meeting at 6:07 PM.

Subject: Adopt an Ordinance Amending Municipal Code Section 10.40.020 Relating to Exceptions to Speed Limits
Enclosure: 2023 Engineering and Traffic Survey & Documents Presented By: Carla C. Jauregui, Community Development Director Approved By: ____________________________
City Manager
Recommendation:
Introduce and Waive the First Reading of Ordinance No. 2026-01, Amending Municipal Code Section 10.40.020 Relating to Exceptions to Speed Limits.
Background and Overview:
A Draft Engineering and Traffic Survey (hereinafter Speed Survey) was started in 2015 and brought before the Hughson City Council in November 2016. The primary purpose of the 2016 Speed Survey was to justify the use of radar for speed limit enforcement as enforcement helps ensure streets are safe for all users. For radar speeding tickets to be valid in traffic court, the California Vehicle Code requires busier, or “non-local” roads as defined by the California Road System undergo a Speed Survey every 5 years (CVC Section 40802(a)(2)).
For Hughson, these non-local roads are Santa Fe and Whitmore Avenues and Hatch, Whitmore, Tully, and Euclid Roads. The 2016 Speed Survey analyzed these streets and justified modifying the speed limits. The remaining streets in Hughson are categorized as local streets under the California Road System and have a default or “prima facie” speed limit of 25-mph per the CVC (Section 22352(b)(1)). Many streets in Hughson, including residential streets, fall into this category. Local streets are not subject to the 5-year speed survey requirement (Section 40802(b)(1)) and so are not studied as a part of the Speed Survey.
Reducing or increasing speed limits on any city street (i.e., local and non-local) can occur if justified by a speed survey and established by ordinance (CVC Section 22357). Once a speed limit is changed, it must be justified every 5 years through a radar speed survey. The speed limits have not been changed on any Hughson streets since enacting the initial CITY COUNCIL AGENDA ITEM NO. 4.1
SECTION 4.1: UNFINISHED BUSINESS
improvements as recommended by the 2016 Speed Survey. These revised speed limits are codified in the Hughson Municipal Code. A caveat in California Code permits the recertification/restamping of an existing approved Speed Survey when the jurisdiction’s law enforcement is up to date on the training required to operate a speed gun and cite drivers for exceeding the posted mph. As such, City staff recommended that the 2016 updated Speed Survey be extended since all Hughson Police Services officers had the required training necessary to allow for such an extension.
Discussion:
A new Speed Survey was conducted in 2023 to reassess the speed limits based on updated traffic data and conditions; however, due to unforeseen circumstances, the study was not finalized until 2024. The survey was reviewed and certified by licensed Traffic Engineer Mike Becker of MPB Design.
This item was previously presented to the City Council at the April 28, 2025, meeting. At that time, Council directed staff to revisit the recommended speed limit for Tully Road between Fox Road and Hatch Road. Council expressed concern that this segment is located within a residential zone and indicated that the speed limit should be reevaluated to determine whether a 25-mph speed limit would be more appropriate in connection with the surrounding residential designation.
In response to Council’s direction, staff worked with the City’s Traffic Engineer to further analyze this roadway segment. Based on the updated evaluation and consideration of the residential land use designation, the revised survey concludes that a 25-mph speed limit is warranted for Tully Road between Fox Road and Hatch Road. This recommendation is consistent with the residential character of the area and supports neighborhood traffic safety.
The table below summarizes the roadway segments for which speed limit changes are recommended based upon the updated data. These consist of a 5 mph higher speed limit at four locations and maintaining a 25-mph speed limit for the residential segment of Tully Road between Fox Road and Hatch Road. In addition, a segment of Euclid Avenue is recommended to be posted at 45 mph if the roadway is to be radar enforced.

The results of the 2023 Speed Survey indicate that traffic speeds have remained generally consistent with previous findings, with some areas warranting slight increases to reflect actual driving behavior while maintaining safety and enforcement feasibility.
Although some speed limits are increasing, these adjustments reflect real-world driver behavior. Appropriately setting limits based on the 85th percentile reduces unsafe speed differentials, improves driver compliance, and allows law enforcement to target truly dangerous behavior.
Local streets in Hughson are categorized under the California Road System with a default speed limit of 25 mph (CVC Section 22352(b)(1)) and are not subject to the five-year Speed Survey requirement. These streets were not included in the study.
Adjustments to speed limits are based on the 85th percentile speed, collision rates, and roadway conditions. The California Manual on Uniform Traffic Control Devices (CA MUTCD) and CVC regulations provide justification for these modifications. The recommended changes align with traffic engineering principles that balance safety and enforcement.
The accompanying ordinance, if adopted, will amend Section 10.40.020 of the Hughson Municipal Code to formally implement the updated speed limits.
If adopted, the ordinance will take effect 30 days after the second reading and after the updated regulatory signs are installed.
Adopting the revised speed limits ensures radar enforcement remains legally valid under California law, maintaining the City’s ability to issue enforceable speeding citations that support public safety.
Fiscal Impact:
There is no additional cost associated with this action. Gas Tax funding to replace regulatory signs including speed limit signs will be included in the FY 2026-27 Final Budget.

Subject: Authorize a Letter of Intent and Technical Assistance Request - Riverview Mobile Home Estates Water Consolidation Project Presented By: Dominique Romo, City Manager

Approved By: ___________________________
City Manager
Recommendation:
Authorize staff to submit a non‑binding Letter of Intent to consider a water consolidation project with Riverview Mobile Home Estates and to submit a Request for Technical Assistance to the State Division of Drinking Water.
Background and Overview:
Riverview Mobile Home Estates (RMHE) is a small community water system in Stanislaus County (Water System No. 5000090) serving 173 connections and approximately 540 residents. The system’s median household income is $58,828, classifying RMHE as a Severely Disadvantaged Community.
In May 2016, RMHE received a compliance order from the Stanislaus County Department of Environmental Resources for exceeding the uranium Maximum Contaminant Level of 10 µg/L. Multiple local projects were implemented to address contamination, but none produced a permanent, compliant source of drinking water.
The State Water Resources Control Board, Division of Drinking Water (DDW), assigned Self-Help Enterprises (SHE) to RMHE on August 31, 2020, to provide technical assistance.
From August 2020 through January 2023, SHE and Black Water Consulting Engineers evaluated long-term solutions. A Feasibility Study (April 2021) identified consolidation as the preferred alternative and evaluated three potential consolidation partners: Stanislaus Regional Water Authority, City of Modesto, and City of Hughson.
City staff partnered with SHE to complete a Median Household Income survey required for State funding eligibility. In late 2025 the State Department of Finance closed out the MHI survey work due to updated guidelines; under the 2025–26 Intended Use Plan the City of CITY COUNCIL AGENDA ITEM NO. 4.2
SECTION 4: UNFINISHED BUSINESS
Hughson now qualifies as a Small Moderate-Income Community, reducing the need for further income survey technical assistance for Hughson.
Discussion:
In January 2026, DDW staff contacted the City to revisit Hughson’s potential role as a consolidation partner for RMHE. DDW indicated the RMHE consolidation project is listed in the 2025–26 Intended Use Plan Appendix B as eligible for Drinking Water Grant/Principal Forgiveness and that consolidation incentive funding may be available if Hughson voluntarily agrees to pursue consolidation. Incentive funding could be applied to a drinking water project that benefits Hughson and may be offered as 0% financing or grant funding, depending on eligibility.
DDW has requested two actions from the City:
• A Letter of Intent indicating Hughson’s willingness to consider consolidation; and • A Request for Technical Assistance to assign State technical resources to advance project development.
DDW have advised that consolidation will require multiple years for design, approvals, and Division of Financial Assistance contracting. Early commitment from Hughson would allow the State to begin preparatory work at RMHE while Hughson continues its own compliance and supply planning. DDW has confirmed the City of Hughson is on track to return to compliance sooner than RMHE’s projected timelines.
City staff are concurrently evaluating Hughson’s future water supply options, including a potential connection to the Stanislaus Regional Water Authority (SRWA) and development of an additional groundwater well. The 2021 Feasibility Study identified SRWA as a consolidation/supply option. While SRWA capacity and cost present hurdles, DDW has indicated consolidation incentive funding could potentially offset SRWA connection costs or support well development if Hughson elects to consolidate RMHE.
Staff will continue to emphasize that any consolidation must not compromise Hughson’s system reliability or impose undue operational or fiscal burdens on existing customers. Staff will perform thorough operational, capacity, and fiscal analyses and will require grant funding, environmental review, and full City Council approval before any final consolidation decision.
Fiscal Impact:
Submitting a non-binding Letter of Intent and a Request for Technical Assistance has no direct capital cost.
