FISCAL IMPACT:
Adoption of this ordinance is not anticipated to have a direct fiscal impact on the City's operating budget, outside of publication costs and updating of the City’s Municipal Code on the City’s website (estimated at $1,000). Potential indirect costs include:
• City Attorney time for complaint review, Council consultation, and any independent investigator coordination, which would be billed at the City's existing contract rate. • Costs of retaining an independent investigator, if authorized by the Council in a specific matter. These costs are not predictable in advance and would be subject to Council authorization.
• Harassment prevention training costs for Council members, if not already current.
These costs are typically modest and may be available through the League of California Cities or similar resources.

CITY OF HUGHSON
STANISLAUS COUNTY, CALIFORNIA
ORDINANCE NO. 2026-02
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUGHSON, CALIFORNIA, AMENDING TITLE 2 OF THE HUGHSON MUNICIPAL CODE TO ADD CHAPTER 2.05, ENTITLED "CITY COUNCIL CODE OF CONDUCT"
RECITALS
The City Council of the City of Hughson hereby finds and declares as follows:
WHEREAS, the City of Hughson is a general law city organized and operating under the laws of the State of California; and
WHEREAS, the members of the City Council are elected officials entrusted with legislative authority and public responsibilities, and are not employees of the City; and WHEREAS, the City Council previously adopted a Code of Conduct for Elected Officials on February 9, 2004, by Resolution No. 04-19 (the "2004 Code of Conduct"), which established behavioral guidelines for Council members in a policy document format; and WHEREAS, the 2004 Code of Conduct was adopted by resolution and is not codified in the Hughson Municipal Code; and
WHEREAS, the City Council has determined that the 2004 Code of Conduct, while reflective of sound aspirational principles, does not provide an enforceable governance framework, does not contain structured procedures for receiving and reviewing complaints, does not establish governance-based response measures grounded in and limited to the City's lawful authority under California law, and does not address harassment, social media, or other areas of contemporary governance concern; and
City of Hughson | Ordinance No. 2026-02
1912544-1
WHEREAS, the City Council has further determined that a codified ordinance is the appropriate and more legally defensible vehicle for a Council Code of Conduct because, unlike a resolution, an ordinance requires two readings, public notice, a waiting period before it takes effect, and a higher procedural threshold to amend or repeal, thereby providing greater stability and enforceability; and
WHEREAS, the City Council intends that this Ordinance, upon taking effect, shall supersede Resolution No. 04-19 in its entirety, render it of no further force and effect as to Council member conduct, and constitute the sole and exclusive governance-based code of conduct applicable to City Council members; and
WHEREAS, the City Council has determined that adoption of this Ordinance is reasonably necessary to promote lawful, effective, and respectful governance; to establish clear and enforceable standards of conduct applicable to Council members; to protect persons who participate in City governance from misconduct by Council members; to provide a structured and transparent framework for responding to alleged misconduct within the limits of California law; and to protect the City from legal, financial, and reputational risk; and WHEREAS, the City Council recognizes that its authority to discipline, suspend, remove, or compel action by an elected official is strictly limited under California law, and that this Code of Conduct is adopted as a governance and risk-management framework, not as an employment policy or criminal enforcement mechanism; and
WHEREAS, all legal prerequisites to adoption of this Ordinance have been satisfied.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUGHSON, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Findings.
The City Council hereby adopts the foregoing recitals as its findings in support of this Ordinance.
Section 2. Amendment to Title 2 of the Hughson Municipal Code.
Title 2 (Administration and Personnel) of the Hughson Municipal Code is hereby amended to add a new Chapter 2.05, entitled "City Council Code of Conduct," to read in its entirety as follows:

• Reduce legal, financial, and reputational risk to the City. (b) Scope. This Chapter applies to all persons serving as members of the Hughson City Council, including the Mayor, on and after the effective date of this Ordinance. (c) Governance Framework Only. This Chapter is a governance and risk-management framework.
It does not create an employment relationship, impose employment discipline, create criminal liability, or establish a private right of action. Nothing in this Chapter supersedes, limits, or displaces any right, remedy, or obligation established by applicable state or federal law, including without limitation the California Fair Employment and Housing Act (Gov. Code §§ 12900 et seq.) and the Ralph M. Brown Act (Gov. Code §§ 54950 et seq.). (d) Prospective Application. This Chapter applies prospectively to conduct occurring on or after its effective date.

The City Council does not have authority under California law to suspend, remove, dock the compensation of, or impose employment-style discipline upon an elected City Council member absent express statutory or constitutional authority not currently conferred on general law cities. (c) Nothing in this Chapter shall be construed to create any authority not conferred by applicable law. Any provision of this Chapter that, if applied, would exceed the City's lawful authority shall be deemed inoperative to the extent of such excess.
§ 2.05.040. Standards of Conduct.
City Council members shall conduct themselves in a manner that upholds the integrity and lawful functioning of City government. In connection with City Business or Official Capacity, City Council members shall:

§ 2.05.050. Harassment and Discrimination Prohibited.
(a) Policy. It is the policy of the City of Hughson that all persons who interact with the City Council in connection with City Business, including fellow Council members, City employees, contractors, and members of the public, are entitled to do so in an environment free from harassment, sexual harassment, and unlawful discrimination.
(b) Prohibited Conduct. No City Council member shall, in connection with City Business or in Official Capacity:
• Engage in sexual harassment, as defined under the California Fair Employment and Housing Act (Government Code § 12940), toward any person in connection with City Business, regardless of whether a formal employment relationship exists between the Council member and the person affected;
• Engage in harassment on the basis of race, sex, gender, gender identity or expression, sexual orientation, national origin, religion, age, disability, marital status, or any other characteristic protected by applicable law;
• Make unwelcome sexual advances, requests for sexual favors, or engage in other verbal, visual, or physical conduct of a sexual nature when such conduct creates a hostile, intimidating, or offensive environment for the person subjected to it; or • Engage in conduct that a reasonable person would consider severely or pervasively offensive, intimidating, or hostile toward another Council member or City employee. (c) Complaints. Any person who believes they have been subjected to harassment or discrimination in violation of this section by a City Council member may file a complaint pursuant to Section
2.05.070.
(d) No Retaliation. No City Council member shall take or attempt to take any adverse action, in Official Capacity, against any person because that person filed a complaint, reported concerns, provided information, or participated in any review or proceeding under this Chapter. (e) Preservation of Other Remedies. This section does not limit, replace, or supersede any right, claim, or remedy available under state or federal law, including without limitation the right to file a complaint with the California Civil Rights Department or to pursue civil litigation. Nothing in this section creates an independent private right of action against the City. § 2.05.060. Social Media and Electronic Communications. (a) Purpose and Scope. This section establishes standards governing the use of social media and electronic communications by City Council members. It is adopted with express recognition of the complex and unsettled constitutional law applicable to public officials' social media conduct and with acknowledgement of the significant limits on the City's authority to regulate social media

• Shall not post, share, or amplify content that constitutes harassment, sexual harassment, threats, or unlawful discrimination toward any identifiable individual in violation of Section 2.05.050;
• Shall not disclose nonpublic, confidential, or legally privileged City information, including closed session communications; and
• Shall not use City-Owned Social Media Accounts for personal campaign or political purposes unrelated to City Business, except as permitted by applicable law. (d) Council Member Social Media Accounts, Conduct Standards. A Council member’s independently owned and operated social media account is not subject to City ownership, City control, or City regulation as a City asset. The City's authority to regulate a Council member's conduct on such an account is therefore significantly limited by the First Amendment. The following standards apply only to the narrow extent consistent with the City's lawful governance authority:
• A Council member shall not use a Council Member Social Media Account to post, share, or amplify content that constitutes sexual harassment or other unlawful harassment toward a City employee, fellow Council member, or other person in connection with City Business, in violation of Section 2.05.050 of this Chapter. This standard applies based on the independently unlawful nature of the underlying conduct, not based on the medium through which it occurs.
City of Hughson | Ordinance No. 2026-02
1912544-1
• A Council member shall not use a Council Member Social Media Account to disclose nonpublic, confidential, or legally privileged City information, including closed session communications, in violation of Sections 2.05.040(f) or 2.05.040(g). This standard applies because the obligation to protect confidential City information arises from the member's official duties, not from the platform used.
(e) What This Section Does Not Regulate. To avoid any ambiguity, this section does not:
• Require or prohibit any Council member from creating, maintaining, or using any social media account;
• Regulate the content, tone, or viewpoint of any Council member's personal or political speech on any account the Council member owns and controls; • Require any Council member to allow public access to, or prohibit any Council member from managing, a Council Member Social Media Account, including decisions about blocking, muting, or restricting other users, except as may be required by applicable law independent of this Chapter;
• Impose any obligation based solely on the label, title, or appearance of a Council Member Social Media Account; or
• Purport to determine or establish that any particular Council Member Social Media Account constitutes a public forum or is subject to First Amendment constraints as against third parties. That question is governed by applicable constitutional law and is not within the City's authority to resolve by ordinance.
(f) The State Action Question. Whether a Council member's social media conduct on a personallyowned account constitutes state action subject to First Amendment constraints as to third parties is a fact-specific legal question governed by federal constitutional law, as addressed by the United States Supreme Court. That determination is made by courts, not by the City. Nothing in this section shall be construed as a City determination that any Council member's account does or does not constitute state action for purposes of any constitutional claim. (g) Public Records Notice. Council members are advised that communications made or received in connection with City Business, including communications through social media or personal electronic devices, may constitute public records subject to disclosure under the California Public Records Act (Gov. Code § 7920 et seq.). Council members should consult the City Attorney regarding public records obligations as applied to their specific communications. § 2.05.070. Reporting Alleged Misconduct.
(a) Submission of Complaints. Any person may submit a written complaint alleging that a City Council member has engaged in conduct in violation of this Chapter. Complaints shall be submitted to the City Clerk.
(b) Contents of Complaint. A complaint should, to the extent reasonably practicable, include:
• The name of the Complainant and contact information;
• The name of the Respondent;
City of Hughson | Ordinance No. 2026-02
1912544-1
• A description of the conduct alleged, including dates, locations, and persons present, to the extent known;
• Any supporting documentation or evidence the Complainant wishes to submit; and • A statement describing the impact of the alleged conduct on City Business, City governance, or the Complainant's ability to participate in City governance. (c) Anonymous Complaints. Anonymous complaints may be accepted and considered, but the City's ability to investigate or respond may be limited by the absence of identifying information. (d) Routing.
The City Clerk shall promptly transmit complaints received under this section to the City Attorney and the City Manager. If the complaint involves the City Manager, the Clerk shall transmit to the City Attorney only. If the complaint involves the City Attorney, the Clerk shall transmit to the full City Council.
(e) Preservation. The City Clerk shall preserve all complaints and related records received under this Chapter in accordance with the City's document retention schedule and applicable law. § 2.05.080. Review and Response Procedures.
(a) City Attorney Review. Upon receipt of a complaint under Section 2.05.070, the City Attorney shall conduct a preliminary review to determine whether the complaint, if true, would constitute Misconduct under this Chapter, and whether the matter falls within the scope of this Chapter. (b) Preliminary Findings. The City Attorney shall prepare a written summary of the complaint and the City Attorney's preliminary assessment and transmit it to the City Council (in closed session where authorized by law) within thirty (30) calendar days of receipt. (c) Notice to Respondent. Upon determination that a complaint is within scope, the City Attorney shall provide written notice to the Respondent that a complaint has been submitted, a general description of the nature of the concern, and an opportunity to respond in writing within fourteen (14) calendar days.
(d) Council Consideration. The City Council shall consider the complaint, the City Attorney's summary, and the Respondent's written response (if any) in closed session to the extent permitted by the Brown Act. The City Council shall then determine, by majority vote of the members present (excluding the Respondent if the Council determines recusal is appropriate), whether to:
• Take no further action;
• Issue a written finding that Misconduct has not been substantiated; • Issue a written administrative admonition;
• Refer the matter to an external authority pursuant to Section 2.05.100; or • Proceed to formal censure pursuant to Section 2.05.110. (e) Independent Investigator. The City Council may, by majority vote, authorize the City Attorney to retain an independent investigator or outside counsel to conduct a more detailed inquiry where
City of Hughson | Ordinance No. 2026-02
1912544-1
the Council determines an independent review is warranted. Any investigation shall be conducted on a voluntary and non-coercive basis as to elected officials, consistent with applicable law. (f) Timeline. The City Council should endeavor to complete review under this section within ninety (90) days of receipt of a complaint, except where the matter has been referred to an external authority or where an independent investigation is underway. (g) Closed Session. To the extent permitted by the Ralph M. Brown Act (Gov. Code § 54957), the City Council may discuss matters involving individual Council members in closed session. The City Attorney shall advise the Council on the availability and scope of closed session for each matter as it arises.
§ 2.05.090. Governance-Based Measures.
The following governance-based measures are available to the City Council upon a finding of Misconduct under Section 2.05.080, subject to the limitations in Section 2.05.030:
(a) Written Administrative Admonition. The City Council may issue a written administrative admonition to a Council member, setting forth the conduct found to constitute Misconduct, the Council's expectations going forward, and any corrective actions recommended. An administrative admonition is not a legal sanction.
(b) Required Training. The City Council may require a Council member to complete specified training, including harassment prevention training, ethics training, or Brown Act training, as a condition of continued participation in City Business, to the extent such a requirement is lawful.
The City Attorney shall confirm the legal basis for any such requirement before imposition. (c) Removal from Committee Assignments. The City Council may, by majority vote, remove a Council member from a Council committee, subcommittee, or advisory board assignment to which that member was appointed by the Council. This authority does not extend to elected positions or to assignments established by state law.
(d) Limitation on City Resource Use. The City Council may, by majority vote, restrict a Council member's access to City resources, facilities, or staff support above the minimum necessary for the Council member to fulfill statutory duties, where the Council member has engaged in Misconduct involving the misuse of such resources.
(e) Progression. Governance-based measures need not be imposed in any particular order. The City Council shall select measures proportionate to the nature and severity of the Misconduct, the risk to City governance, and the record established.
§ 2.05.100. Referral to External Authorities.
The City Council may, by majority vote, refer alleged Misconduct by a Council member to any of the following external authorities as appropriate:
City of Hughson | Ordinance No. 2026-02
1912544-1
• The Stanislaus County District Attorney's Office, where the alleged Misconduct may constitute a criminal offense;
• The California Fair Political Practices Commission (FPPC), where the alleged Misconduct may involve a violation of the Political Reform Act;
• The California Civil Rights Department (formerly the Department of Fair Employment and Housing), where the alleged Misconduct may constitute harassment, discrimination, or retaliation in violation of the California Fair Employment and Housing Act; • The State Controller's Office or other applicable agency, where the alleged Misconduct involves misuse of public funds; or
• Any other federal, state, or local authority with jurisdiction over the alleged conduct.
Referral to an external authority does not preclude the City Council from simultaneously imposing Governance-Based Measures or formal censure within its lawful authority. § 2.05.110. Formal Censure.
(a) Authority. The City Council may formally censure a Council member by majority vote of the members present at a duly noticed public meeting. Formal censure is an expressive, governancebased measure. It carries no legal consequence, does not impose any disability, and does not compel any action by the censured member.
(b) Procedure.
• A motion to censure may be introduced by any Council member. The motion shall identify the specific conduct alleged to constitute Misconduct and the provision of this Chapter alleged to have been violated.
• Prior to a vote, the Respondent shall be provided written notice of the proposed censure and the specific conduct at issue at least fourteen (14) days before the meeting at which the vote will be taken, except in cases of urgent necessity as determined by the City Attorney. • The Respondent shall be afforded an opportunity to address the Council at the meeting, subject to applicable time limits.
• The vote on censure shall be conducted at a public meeting, by roll call, and the result shall be recorded in the minutes.
(c) Contents of Censure Resolution. A resolution of censure shall set forth: the specific conduct found by the Council to constitute Misconduct; the provision(s) of this Chapter violated; the Council's findings; and, if applicable, any corrective actions requested of the Respondent. (d) First Amendment. The City Council recognizes that censure involves expressive conduct by the Council as a body and implicates First Amendment interests of the Respondent. A resolution of censure shall not be used to punish protected political speech, lawful dissent, or the casting of votes in accordance with a Council member's judgment.
City of Hughson | Ordinance No. 2026-02
1912544-1
§ 2.05.120. Safeguards and Limitations.
(a) No Retaliation. No City Council member shall take or attempt to take any adverse action, in Official Capacity, against any person for filing a good-faith complaint, reporting concerns, providing information, or participating in any review or proceeding under this Chapter. (b) Good Faith Requirement. Complaints submitted under this Chapter should be made in good faith and to the best of the Complainant's knowledge. Submission of a complaint known to be materially false may itself constitute Misconduct under Section 2.05.040(f). (c) No Prejudgment. Nothing in this Chapter shall be construed to require or permit any Council member to prejudge any complaint or to take any action premised on a finding of Misconduct before the procedures in Section 2.05.080 have been followed. (d) Due Process. Prior to the imposition of any Governance-Based Measure or formal censure, the Respondent shall be afforded notice and an opportunity to be heard as described in this Chapter. (e) Conflict of Interest in Proceedings. A Council member who is the subject of a complaint under this Chapter shall not participate in any vote on that complaint, except that the Council member may address the Council during the public comment period applicable to the matter. (f) No Private Right of Action. Nothing in this Chapter creates a private right of action against the City, any City official, or any City Council member. This Chapter does not limit any right of action arising under applicable state or federal law.
§ 2.05.130. Relationship to Rules of Decorum.
Nothing in this Chapter limits the authority of the presiding officer to maintain order and decorum during City Council meetings pursuant to the applicable provisions of the Hughson Municipal Code and state law. Rules of decorum applicable to members of the public remain fully in effect and are not modified by this Chapter.
As applied to City Council members, the standards of conduct and response procedures in this Chapter govern Misconduct occurring inside or outside City Council meetings and supplement, and where applicable supersede, decorum provisions addressing Council member conduct during meetings.
§ 2.05.140. Acknowledgement.
Within thirty (30) days of the effective date of this Ordinance, and within thirty (30) days of assuming office following any election or appointment, each City Council member shall execute a written acknowledgement confirming receipt of, understanding of, and responsibility to comply with this Chapter. Executed acknowledgements shall be filed with the City Clerk and maintained as public records.
City of Hughson | Ordinance No. 2026-02
1912544-1
Failure to execute an acknowledgement does not relieve a Council member of the obligations of this Chapter.
§ 2.05.150. Severability.
If any provision of this Chapter, or its application to any person or circumstance, is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions or applications. The City Council declares that it would have adopted this Chapter and each provision thereof irrespective of the invalidity of any other provision.
Section 3. Supersession of Resolution No. 04-19.
Upon the effective date of this Ordinance, Resolution No. 04-19 (City of Hughson Code of Conduct for Elected Officials, adopted February 9, 2004) is hereby superseded in its entirety and shall be of no further force or effect as to the conduct of City Council members. To the extent any provision of Resolution No. 04-19 relates to the conduct of City staff, members of the public, or other non-Council participants at City meetings, that provision is not affected by this Ordinance and remains in effect only to the extent it is otherwise supported by applicable law or separate City policy.
From and after the effective date of this Ordinance, Chapter 2.05 of the Hughson Municipal Code shall constitute the sole and exclusive codified governance-based code of conduct applicable to City Council members. No provision of Resolution No. 04-19 shall be used as an independent basis for imposing any governance-based measure on a Council member, censure, admonition, or other consequence governed by this Chapter.
Section 4. California Environmental Quality Act.
The City Council finds that adoption of this Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), in that it can be seen with certainty that adoption of governance standards for elected officials has no possibility of a significant effect on the physical environment.
Section 5. Effective Date.
This Ordinance shall take effect thirty (30) days after its adoption, as provided in California Government Code Section 36937.
Section 6. Certification and Publication.
The City Clerk shall certify to the adoption of this Ordinance and cause it to be published or summarized in a newspaper of general circulation within the City of Hughson, as required by California Government Code Section 36933.

Enclosures: Letter from Luis Arroyo
Proposed Signage Rendering and Details
COH Parks-Facilities Naming Policy
Presented By: Carla C. Jauregui, Community Development Director
Approved By: ____________________________
City Manager
Recommendation:
Consider and provide direction regarding the naming of the play area at Euclid Park in memory of Dinella “Danee” Madrigal.
Background and Overview:
On March 9, 2026, the City Council considered a request to honor Dinella “Danee” Madrigal through the renaming of Euclid Park. The request was brought forward by members of the Madrigal family and community members seeking a lasting recognition of Danee’s memory within the Hughson community.
During Council discussion, the City Council considered the request, alternative potential memorial concepts, as well as funding and maintenance considerations. Discussion also included consideration of the potential precedent related to City-funded memorial requests and the importance of ensuring any proposed memorial improvements remain appropriate and consistent with City policy.
At the conclusion of the discussion, the City Council provided consensus direction for staff to continue working with the Madrigal family to explore naming the play area within the park in memory of Dinella “Danee” Madrigal, including incorporation of a permanent feature or element intended to honor her legacy in perpetuity. Staff was directed to return to the City Council with additional information and conceptual renderings for consideration. No formal action was taken at that time.
CITY COUNCIL AGENDA ITEM NO. 4.1
SECTION 4: UNFINISHED BUSINESS
Discussion
Since the March 9, 2026 City Council meeting, staff has coordinated with the Madrigal family regarding potential memorial concepts, design elements, and naming considerations for the play area. Based on those discussions and prior Council direction, staff is bringing forward prepared conceptual renderings and proposed design elements intended to provide a lasting tribute to Dinella “Danee” Madrigal while remaining compatible with the overall character and design of the park.
The proposed signage is consistent with the City’s Parks & Facilities Naming/Re-Naming Policy, which provides opportunities to honor individuals who have made significant and lasting contributions to the community and encourages naming considerations that reflect community values, local heritage, and meaningful public recognition. The proposal also remains consistent with the policy’s community-based review process, as the request has previously been considered by the City Council and developed in coordination with the Madrigal family.
Staff is requesting City Council consideration and determination regarding the proposed naming of the play area and associated memorial features as presented in the attached renderings and conceptual designs.
Fiscal Impact:
There is no fiscal impact related to the approval of this item, as the signage and maintenance will be funded by the applicant/Madrigal family.

Re: Naming of city park for long-time Hughson resident
Dear Community Development Director,
I am writing this letter to request the naming of a city park To: Community Development Director
From: Luis Arroyo, Hughson Resident
Re: Proposal to Name City Park in Honor of Dinella Madrigal Dear Community Development Director,
I am writing to passionately advocate for the naming of a city park in honor of a remarkable long-time resident of Hughson, Dinella Madrigal, affectionately known as “Danee.” Her profound impact on our community and her enduring spirit make her a deserving candidate for this recognition.
Dinella’s unexpected passing on May 4th, 2025, left a void in our community that is deeply felt by all who knew her. However, it is not her loss that we should mourn, but rather celebrate the extraordinary life she led—a life characterized by compassion, unwavering support for her neighbors, and a genuine commitment to service.
As a lifelong resident of Hughson and a second-generation citizen, Dinella exemplified what it means to care for one’s community. She was actively involved in local events and sports, dedicating countless hours to improve the quality of life for all residents. A shining example of her dedication can be found in her work with the Hughson Historical Society, where she played an instrumental role in getting a headstone approved for Howard Hiram “Hi” Hughson—a significant achievement that underscored the importance of preserving our town’s rich heritage.
Dinella’s influence extended far beyond the historical; she was a vital leader in the community, particularly as an active participant in the PTC at Lucas Elementary School.
Her exceptional fundraising abilities raised thousands of dollars for vital programs, demonstrating her deep-seated commitment to nurturing the next generation. Dinella helped establish the Lucas Scholarship Fund, fostering opportunities for local students and strengthening community bonds.
Moreover, her dedication to the community was evident through her nearly twenty-year involvement with KAT Country. By bringing artists to local venues, she not only elevated the entertainment scene but also created a sense of pride in our local culture. Dinella's efforts to enhance our community were tireless—she truly embodied the spirit of Hughson.
Outside of her many roles, Dinella was a devoted mother and friend. Whether she was cheering on her daughters at sports events or welcoming new families to town, her infectious spirit made everyone feel valued and included. The community’s response to her passing spoke volumes, with nearly 1,000 individuals attending a vigil to honor her memory.
The sheer number of attendees at her visitation is a testament to the warmth and connection she fostered within our town.
I propose that we name the park located at 1539 Euclid Rd—nestled in the Fieldstone development and in the heart of the community Dinella cherished—in her honor. Erecting a sign and plaque will serve as a lasting tribute to her legacy, ensuring that future generations understand the extraordinary person she was and the indelible mark she left on all our lives.
The vision and mission statements of our town emphasize preserving Hughson’s unique spirit and continually improving our community. Dinella embodied these ideals in everything she did. By honoring her memory with the naming of this park, we will not only pay tribute to her contributions but also reinforce the values that make Hughson a truly great place to live.
Thank you for considering this heartfelt request.

Adopted by the City Council 9/8/2025
Resolution No. 2025-31
Parks & Facilities Naming/Re-Naming Policy
Introduction
The naming or renaming of parks and facilities is complex and sometimes emotional since assigning a name is a powerful and permanent identity for a public place and/or facility. The naming and renaming of parks and/or facilities often require significant resources in terms of changing names on signs, maps, and literature. In addition, excessive and constant name change can be the source of confusion to the public. The purpose of this policy is to provide clear and consistent guidance to those that have an interest in the naming and/or renaming of the City’s parks and/or facilities.
The City values tradition, community heritage, respect for local history, and seeks to ensure names reflect these priorities.
Purpose
The purpose of this policy is to provide clear and consistent guidance to those that have an interest in the naming and/or renaming of the City’s parks and/or facilities. This ensures the names:
a. Reflect the geographic, historical, cultural, and environmental heritage of the City. b. Provide opportunities to honor individuals, organizations, or events that have made significant, lasting contributions to the City.
c. Prevent duplicate or confusing names.
d. Maintain a transparent, community-based process for considering naming proposals.
Honoring Our Heroes
The City of Hughson deeply values the sacrifices of fallen law enforcement officers, soldiers, and veterans. Due to the limited number of parks and facilities, the City acknowledges the challenge of honoring one life over another and strives to approach naming decisions with respect and equity.
Naming Process Overview
Submission: Requests must be submitted to the Community Development Director.
Requests should clearly state the proposed name and reasoning, including how it reflects the City’s local history, geography, or values.
Adopted by the City Council 9/8/2025
Resolution No. 2025-31
Review Process
Commission Review: The Parks, Recreation and Entertainment Commission will review requests. The Commission may seek public input and will provide a recommendation in accordance with the naming criteria in this policy to the City Council.
City Council Review: The City Council will review the Commission’s recommendations at a public meeting. The City Council’s decision is final.
Family Notification: Prior to final approval, city staff shall contact family members of any potential namesakes to ensure their support of the
recommendation.
Conclusion: The naming process concludes upon City Council’s final approval.
Naming Criteria
The name of a park or facility is a permanent and meaningful act. Names should reflect the history, geography, and community values of Hughson. Final selection of names is subject to the sole discretion of the City Council, with strong consideration for consistency with this Policy.
Names proposed for City parks and facilities should:
1. Reflect historical or cultural significance of the area (demonstrated through research and documentation).
2. Include prominent geographical locations (e.g., nearby streets, subdivisions, schools).
3. Not duplicate or closely resemble names of other parks or public facilities in the City or immediate area.
4. Avoid names that could be deemed controversial, divisive, or inconsistent with the community’s values and character.
5. Only be considered for individuals when honoring those with exceptional, long-term service or contributions to the City or the surrounding area. o Individuals currently holding public offices, current City employees, or living people will not be considered except in truly exceptional cases as determined by City Council with clear community support.
6. Not commemorate companies, commercial entities, organizations, or causes for the purpose of advertising or publicity, except as authorized by an approved naming rights/sponsorship agreement.
Adopted by the City Council 9/8/2025
Resolution No. 2025-31
Renaming of Existing Parks or Facilities
Proposals to rename parks and/or facilities whether for a major gift or community request are generally discouraged, due to significant costs, potential disruption of neighborhood identity, and other practical considerations. Names that have become well-established and embraced by the community will be retained except in cases where compelling reasons exist, supported by strong and clear public sentiment from the broader community. Wherever possible, historical or commonly recognized place names will be preserved.
The City Council may add to an existing name, rather than replacing it outright, in special circumstances to recognize new contributions or historical developments.
Community contributions toward signage costs may be considered during the approval process.

Meeting Date: May 26, 2026
Subject: Consideration of a Resolution Formally Censuring Mayor George Carr for Conduct Inconsistent with the City’s Code of Conduct for Elected Officials
Enclosures: Resolution No. 2026-11, Formally Censuring Mayor George Carr Presented By: Andy Pinasco, City Attorney
RECOMMENDATION:
The City Council is requested to consider Resolution No. 2026-11. No staff recommendation is offered. The decision to censure an elected official is a matter within the exclusive political judgment and discretion of the City Council.
BACKGROUND AND OVERVIEW:
In November 2025, a complaint was filed with the City alleging that Mayor George Carr engaged in inappropriate conduct toward a fellow member of the City Council. The City retained an independent outside investigator to conduct a workplace investigation into the allegations. The investigation included interviews of relevant witnesses and a review of pertinent documents.
The investigation was completed, and a confidential investigation report was submitted to the City. The investigation report and all related investigative materials are confidential and protected by the attorney-client privilege and attorney work product doctrine. The City provided written notice to both the complainant and Mayor Carr summarizing the investigator’s findings in general terms. The City provided written notice to the parties of the general outcome of the investigation. The City Council was briefed on the matter through properly noticed closed sessions and, based on its own independent legislative judgment, has determined that the matter warrants formal action under the Code of Conduct.
The City Council was briefed on the investigation findings through properly noticed closed session proceedings held pursuant to Government Code section 54956.9 (anticipated litigation). Following those briefings, the Council directed the City Attorney to prepare and agendize a resolution for formal censure of Mayor Carr.
CITY OF HUGHSON AGENDA ITEM NO. 6.1
SECTION 6: NEW BUSINESS
1916415-2
APPLICABLE AUTHORITY:
The City of Hughson adopted a Code of Conduct for Elected Officials pursuant to Resolution No. 04-19 (February 9, 2004). The Code of Conduct establishes professional conduct standards applicable to all members of the City Council, including the Mayor, and expressly authorizes the Council to impose sanctions, including formal censure, upon any member who fails to comply with those standards.
The Council’s authority to censure a member is an implied power incident to its authority to govern its own proceedings, recognized under California law. Government Code section 34903 provides that the elected mayor is a member of the City Council and has all the powers and duties of a council member. Accordingly, the Council’s censure authority applies to the elected mayor on the same basis as any other member. A censure resolution is an expressive legislative act that does not constitute removal from office and does not deprive the official of any statutory power, duty, or compensation.
A majority vote of the total membership of the Council is required to adopt the resolution, pursuant to Government Code section 36936. On a five-member Council, three affirmative votes are required. Mayor Carr must recuse from the vote as the subject of the proposed censure. Mayor Pro Tem Crooker will preside over the item.
DISCUSSION:
The proposed resolution reflects the City Council’s independent legislative finding that Mayor Carr engaged in conduct toward a fellow councilmember inconsistent with the professional standards required by the Code of Conduct. The Council’s finding is its own determination and does not incorporate, rely upon, or place at issue the contents of the confidential investigation report. The censure does not rest on Mayor Carr’s political positions, policy views, legislative votes, or any conduct protected under the First Amendment.
The resolution is an expressive legislative act. It does not remove Mayor Carr from office, reduce his compensation, or divest him of any statutory authority or duty. Mayor Carr retains all rights and authorities of the Office of Mayor under state law and City ordinances. The voters’ right to determine who holds the office of Mayor is unaffected by this action.
The censure is grounded exclusively in conduct findings from the independent investigation and does not implicate any right of political expression protected under the First Amendment or Article I of the California Constitution.
The investigation report and all related privileged materials are confidential and are not incorporated into the resolution. The City Council is not relying on the report as the basis for the censure, is not asserting the adequacy or scope of the investigation as a justification for this action, and is not placing the report at issue. The Council’s censure is an independent legislative act. The City expressly reserves all applicable privileges and protections with respect to the investigation report and related materials.
1916415-2
Mayor Carr has been provided written notice of the proposed censure action and an opportunity to address the Council prior to the vote. This matter has been considered in properly noticed public proceedings.
PROCEDURAL NOTE – RECUSAL:
Mayor Carr must recuse from the vote on this resolution as the direct subject of the proposed censure. He may address the Council during the public comment period before the vote.
Mayor Pro Tem Randy Crooker will assume the chair when this item is called.
Councilmember Vasquez has been advised by the City Attorney to recuse from this vote. The basis for that recommendation is that Councilmember Vasquez is the complainant whose allegations form the sole factual basis for the investigation. A person may not serve as a judge in their own cause. Her personal credibility and reputational interest are directly implicated in the outcome of the censure vote, creating an unacceptable probability of actual bias. This is a non-financial personal conflict and no financial interest is required for the disqualification to apply under California law. Recusal cannot be compelled, and whether Councilmember Vasquez recuses or votes remains her determination. The City Attorney’s recusal recommendation and the legal basis for it are a matter of record. The Council is advised of the following risk scenarios: If Councilmember Vasquez votes and her vote is one of exactly three affirmative votes necessary to achieve the required majority, the resolution is subject to being set aside as void. The City faces near-certain judicial invalidation upon a writ petition filed by the subject of the censure. If Councilmember Vasquez votes but three other members independently cast affirmative votes making her vote superfluous to the majority, the mathematical outcome is not altered by her participation. However, her participation in deliberations, not merely her vote, may independently taint the proceeding. The California Attorney General has concluded that participation by a member with demonstrable bias generally taints an adjudication because it is impossible to know what effect it had on other members of the body. This scenario presents a lower but non-trivial litigation risk. If Councilmember Vasquez recuses, the three remaining disinterested members must all vote affirmatively to satisfy the required majority. This is the only procedurally clean pathway to a legally defensible resolution.
FISCAL IMPACT:
There is no fiscal impact associated with adoption of this resolution. Costs incurred in connection with the independent workplace investigation have been submitted to the City’s risk pool in accordance with standard claims procedures.

CITY OF HUGHSON
CITY COUNCIL
RESOLUTION NO. 2026-11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUGHSON FORMALLY CENSURING
MAYOR GEORGE CARR FOR CONDUCT INCONSISTENT WITH THE CITY'S CODE OF CONDUCT
FOR ELECTED OFFICIALS
WHEREAS, the City of Hughson has adopted a Code of Conduct for Elected Officials pursuant to Resolution No. 04-19 (adopted February 9, 2004) (the "Code of Conduct"), which establishes standards of professional conduct applicable to all members of the City Council, including the Mayor, and which expressly authorizes the City Council to impose sanctions, including formal censure, upon any elected official who intentionally and repeatedly fails to comply with those standards; and
WHEREAS, the City Council possesses implied authority, incident to its power to govern its own proceedings and maintain standards for the conduct of its members, to formally censure a member for conduct inconsistent with established standards; California courts have recognized this implied censure power in general law cities; Government Code section 34903 provides that the elected mayor is a member of the City Council and has all the powers and duties of a member of the City Council, such that this implied censure authority applies to the elected mayor on the same basis as any other member; and the Code of Conduct adopted pursuant to Resolution No. 04-19 constitutes an exercise of that authority and provides the procedural framework for this action; and
WHEREAS, a complaint was filed with the City alleging that Mayor George Carr engaged in inappropriate conduct toward a fellow member of the City Council; and WHEREAS, the City retained an independent outside investigator to conduct a workplace investigation into the complaint; the investigation included interviews of relevant witnesses and review of pertinent documents; and the investigation was completed and a confidential investigation report was submitted to the City; and
WHEREAS, the investigation report, all related investigative materials, and all legal advice provided to the City in connection with the investigation are confidential, are protected by the attorney-client privilege and attorney work product doctrine, and have not been publicly disclosed; nothing in this Resolution is intended to, or shall, constitute a disclosure of the contents of the investigation report or related privileged materials, and this Resolution does not incorporate those materials by reference; and
WHEREAS, the City provided written notice to the subject of the investigation that the investigation had been completed and that allegations of inappropriate conduct had been sustained; the City Council has been briefed on the investigation through properly noticed closed session proceedings;
1916414-2
WHEREAS, the City Council has reviewed the matter, has been briefed on the outcome of the investigation through properly noticed closed session proceedings, and, based on its own independent legislative judgment, finds that Mayor Carr engaged in conduct toward a fellow councilmember that is inconsistent with the professional standards required of all members of the City Council under the Code of Conduct; and
WHEREAS, the City Council has provided Mayor Carr with written notice of the proposed censure action and an opportunity to address the Council prior to this vote, has considered the matter in a properly noticed public proceeding, and has taken all procedural steps required to ensure that this action is taken by disinterested members of the Council; and WHEREAS, Mayor George Carr, as the subject of this censure resolution, is recused from participating in deliberations or voting on this Resolution; Mayor Pro Tem Randy Crooker has assumed the chair for this item; Mayor Carr has been afforded the opportunity to address the Council during public comment prior to the vote; and the Council’s action is taken without his participation; and
WHEREAS, Councilmember Susana Vasquez, as the complainant whose allegations form the sole factual predicate for the independent investigation, has been advised by the City Attorney that she is subject to disqualification from participating in deliberations or voting on this Resolution under the California common law doctrine against conflicts of interest; a person may not serve as a judge in their own cause; and the City Attorney’s recusal recommendation and the legal basis for it are a matter of record; and
WHEREAS, Councilmember Susana Vasquez, as the complainant whose allegations form the sole factual predicate for the independent investigation, has been advised by the City Attorney that she is subject to disqualification from participating in deliberations or voting on this Resolution under the California common law doctrine against conflicts of interest; a person may not serve as a judge in their own cause; and the City Attorney’s recusal recommendation and the legal basis for it are a matter of record; and
WHEREAS, this Resolution constitutes a purely expressive act of formal censure; it does not remove Mayor Carr from office, reduce his salary, or divest him of any statutory authority, duty, or privilege of his elected office; the right of the voters of Hughson to determine who holds the office of Mayor is unaffected by this Resolution; and recall under the Elections Code and quo warranto under Code of Civil Procedure section 803 remain the exclusive mechanisms by which an elected official's continued tenure in office may be challenged; and WHEREAS, this censure is grounded exclusively in conduct findings arising from an independent workplace investigation, is not based on Mayor Carr's political positions, policy views, or official legislative votes, and does not implicate any right of political expression protected under the First Amendment to the United States Constitution or Article I of the California Constitution;
1916414-2
WHEREAS, the City Council finds that issuance of this formal censure is in the best interests of the City of Hughson, is consistent with the City's obligations to maintain a professional and respectful working environment for all elected officials and city employees, and is necessary to reaffirm the standards of conduct that all members of this Council are expected to uphold;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hughson as follows:
Section 1. Findings Incorporated.
The City Council hereby finds and determines that the recitals set forth above are true and correct and are incorporated into this Resolution as findings of fact. The vote on this Resolution was taken by disinterested members of the Council, with Mayor Carr recused as the subject of the censure action.
Section 2. Formal Censure.
The City Council of the City of Hughson hereby formally censures Mayor George Carr for engaging in conduct toward a fellow member of the City Council that is inconsistent with the professional standards established by the City's Code of Conduct for Elected Officials. This censure is issued in the name of the City Council as a body and reflects the Council's formal, public expression of disapproval of that conduct.
Section 3. Preservation of Privilege.
Nothing in this Resolution shall be construed as a waiver of the attorney-client privilege, attorney work product protection, or any other applicable privilege or protection with respect to the investigation report, related investigative materials, or any legal advice provided to the City in connection with the investigation. The City Council is not relying on the investigation report as the basis for this Resolution, is not asserting the adequacy, scope, or thoroughness of the investigation as a justification for this action, and is not placing the investigation report at issue. The Council’s finding of misconduct is its own independent legislative determination. Those materials remain confidential, are not incorporated into this Resolution, and the City Council expressly reserves all applicable privileges and protections.
Section 4. No Deprivation of Office or Authority.
Nothing in this Resolution is intended to, or shall have the effect of, removing Mayor Carr from the office of Mayor, reducing his compensation, or depriving him of any statutory power, duty, or privilege of his elected office under the Government Code or any other provision of law. Mayor Carr retains all rights and authorities of the Office of Mayor under state law and City ordinances.
Section 5. Expectation of Future Conduct.
1916414-2
The City Council expects that conduct of the nature described in this Resolution will not recur. Mayor Carr is advised that engaging in similar conduct in the future may result in additional action by this Council to the full extent permitted by law.
Section 6. Code of Conduct Remains in Effect.
The Code of Conduct adopted pursuant to Resolution No. 04-19 remains in full force and effect. All members of the City Council, including the Mayor, are expected to comply with the standards set forth therein. The Council's direction to staff to develop an updated Code of Conduct ordinance is a separate and ongoing matter and does not affect the validity or applicability of the existing Code of Conduct or this Resolution.
Section 7. Effective Date.
This Resolution shall take effect immediately upon adoption.
Section 8. Certification.
The City Clerk shall certify to the adoption of this Resolution and shall enter it in the book of original resolutions.

Meeting Date: May 26, 2026
Subject: Consideration of Reassignment of Mayor George Carr from City Council Committee and Board Appointments
Enclosures: Proposed Resolution No. 2026-12, Appointing Replacement Members to Council Committee and Board Seats
Presented By: Andy Pinasco, City Attorney
RECOMMENDATION:
No staff recommendation is offered. Whether to reassign Mayor Carr’s committee and board appointments, and to whom, is a matter within the exclusive political judgment and discretion of the City Council. If the Council determines to act, it should adopt Resolution No. 2026-12 with named replacement appointees inserted for each affected seat before the vote is taken, and direct the City Manager to provide written notice to affected external bodies.
BACKGROUND AND OVERVIEW:
In November 2025, Councilmember Vasquez filed a complaint with the City alleging that Mayor George Carr engaged in conduct toward a fellow member of the City Council inconsistent with the City’s Code of Conduct for Elected Officials (Resolution No. 04-19, adopted February 9, 2004). The City retained an independent outside investigator. The investigation included interviews of relevant witnesses and review of pertinent documents and was completed February 4, 2026. All three allegations were sustained in whole or in part.
The City provided written notice of the general outcome to both parties.
The City Council was briefed on the investigation findings through properly noticed closed session proceedings held pursuant to Government Code section 54956.9. Mayor Carr and Councilmember Vasquez were recused from those sessions. Following those briefings, at its April 27, 2026 regular meeting, the Council directed the City Attorney to prepare and agendize:
(1) a resolution for formal censure of Mayor Carr, and (2) a resolution reassigning his committee and board appointments. Both items are before the Council tonight as separate agenda items. Each is presented as a separate resolution and each is intentionally severable from the other, so that the Council may act on either or both independently.
MAYOR CARR’S CURRENT 2026 APPOINTMENTS:
The Council approved the 2026 City Council Appointments to Boards and Committees on December 8, 2025 (Agenda Item 3.4). The following seats are currently held by Mayor Carr as CITY OF HUGHSON AGENDA ITEM NO. 6.2
SECTION 6: NEW BUSINESS
1916502-1
primary representative. None were made for a specified term; all are held at the pleasure of the appointing power under Government Code section 1301.
1. 2+2 Fire District Committee (meets every other month; Mayor Pro Tem Crooker serves as co-primary)
2. Budget and Finance Subcommittee (as needed, 3 to 4 times per year; Councilmember McFadon serves as co-primary)
3. League of California Cities Executive Committee (quarterly or as needed; Councilmember McFadon serves as alternate)
4. StanCOG Policy Board (third Wednesday of each month; Councilmember McFadon serves as alternate)
APPLICABLE AUTHORITY:
Government Code Section 40605 and Section 36802.
Section 40605 provides that in a general law city with an elected mayor, the mayor, with the approval of the city council, makes all appointments to boards, commissions, and committees.
The 1998 Attorney General opinion (81 Ops.Cal.Atty.Gen. 75) confirmed that section 40605 extends to all council-appointed bodies, including internal subcommittees and external boards. The AG further confirmed that the council’s role under section 40605 is to approve or withhold approval of an appointment; the council’s approval authority is not an independent power to initiate appointments on its own.
Because Mayor Carr is legally disqualified from acting on this matter as its subject, Government Code section 36802 governs. Section 36802 provides that if the mayor is absent or unable to act, the mayor pro tempore has all of the mayor’s powers and duties. A mayor who is legally disqualified from acting on a specific matter is functionally unable to act on that matter. Under section 36802, Mayor Pro Tem Crooker exercises the mayor’s appointmentinitiation authority for this item. The Council then acts on those recommendations in its approval capacity under section 40605. This mechanism satisfies section 40605’s formal requirements and is consistent with the 2006 AG opinion (89 Ops.Cal.Atty.Gen. 178), which confirmed that exceptions to the mayoral appointment rule must be grounded in specific statutory authority.
Government Code Section 1301 — At-Will Appointments. Section 1301 provides that every office the term of which is not fixed by law is held at the pleasure of the appointing power.
The December 2025 appointments were not made for any specified term and are therefore held at the pleasure of the appointing power. No cause, prior notice, or hearing is required to modify an at-will appointment. The 2019 Attorney General opinion (102 Ops.Cal.Atty.Gen. 13) confirmed this principle in the context of a mid-year removal and replacement of a council’s representative to an external body: the council acted by majority vote in a single action combining removal and replacement, without a separate mayoral recommendation for the replacement, and the AG held the action valid.
Resolution No. 04-19 — 2004 Code of Conduct. The Sanctions section of the Code expressly authorizes loss of seniority or committee assignments as a consequence for councilmembers
1916502-1
who intentionally and repeatedly fail to comply with proper conduct standards. The independent investigation sustained findings of conduct inconsistent with those standards.
The Code of Conduct provides affirmative express authority supplementing the statutory grounds above.
VOTE THRESHOLD:
Government Code section 36936 requires a recorded majority vote of the total membership of the city council for a resolution. On a five-member council, that is normally three votes. The 2011 Attorney General opinion (94 Ops.Cal.Atty.Gen. 100) addressed the effect of legal disqualification on the section 36936 calculation. The AG held that a member who is legally disqualified from participating in a matter is not “present” for purposes of that matter and may not be counted toward the quorum or included in the total membership denominator for calculating the required majority.
Mayor Carr is legally disqualified from participating as the subject of this action. Accordingly, the effective total membership for this vote is four. A majority of four is three. Three affirmative votes from the four remaining members satisfy section 36936. Under the same analysis, if Councilmember Vasquez is also legally disqualified and recuses, the effective total membership is three, and a majority of three is two. However, staff recommends that all three remaining members (Crooker, McFadon, and Strain) be confirmed as affirmative votes before this item is agendized.
PROCEDURAL NOTE – RECUSAL AND CHAIR:
Mayor Carr must recuse himself from this vote as the direct subject of the action. Mayor Pro Tem Randy Crooker assumes the chair when this item is called. Under Government Code section 36802, Crooker acts in the mayor’s full capacity for purposes of this item. Mayor Carr may address the Council during public comment from the gallery before the item is called.
Councilmember Vasquez has been advised to recuse as the complainant whose allegations form the factual basis of the investigation underlying both this action and the concurrent censure item. The City Attorney’s recusal recommendation and the legal basis for it are a matter of record. Recusal cannot be compelled; whether she recuses remains her determination.
FRAMING THE ACTION:
The resolution combines removal of Mayor Carr from each seat and appointment of a named replacement in a single action, consistent with the model validated by the 2019 AG opinion (102 Ops.Cal.Atty.Gen. 13). The resolution must have named replacements inserted for each seat before the vote is taken. A motion to adopt the resolution without named replacements is not recommended. If the Council cannot reach agreement on replacements for a particular seat at this meeting, it may elect to defer action on that seat, act on others, or continue the entire item.
1916502-1
The resolution is separately numbered from the censure resolution and intentionally severable from it. The Council may adopt either resolution independently. Adoption of one does not require or presuppose adoption of the other.
DISCUSSION:
Option 1: Adopt the resolution reassigning all four seats with named replacements. If the Council is prepared to identify replacements for all four seats, this is the complete action authorized at the April 27 meeting. Named replacements must be inserted into the resolution before adoption.
Option 2: Adopt the resolution as to some seats only. The Council may act on a subset of seats if agreement on replacements cannot be reached for all four. The resolution should be revised before adoption to reflect only the seats being acted upon.
Option 3: Continue the item. If the Council is not prepared to identify replacements at this meeting, the item may be continued to a date certain.
Option 4: Take no action. Within the Council’s discretion. Declining to act after directing this item to be agendized will be read as a policy decision not to act.
NOTICE TO EXTERNAL BODIES:
If the resolution is adopted, the City Manager will transmit written notice to each affected external agency the next business day, identifying the new City representative for each applicable seat. Where an external body’s governing documents prescribe a specific substitution process, the City Manager will coordinate directly with that body to ensure compliance.
FISCAL IMPACT:
There is no fiscal impact associated with adoption of this resolution.

WHEREAS, Government Code section 1301 provides that every office the term of which is not fixed by law is held at the pleasure of the appointing power; the 2019 Attorney General opinion (102 Ops.Cal.Atty.Gen. 13) confirmed that a city council may remove its representative to an external body mid-year and appoint a replacement by majority vote in a single action where the appointment is held at will and was not made for a fixed term; and WHEREAS, the City of Hughson adopted a Code of Conduct for Elected Officials pursuant to Resolution No. 04-19 (February 9, 2004) (the “Code of Conduct”), which establishes standards of professional conduct applicable to all members of the City Council, including the Mayor, and which expressly authorizes the City Council to impose sanctions upon any elected official who intentionally and repeatedly fails to comply with those standards, including the sanction of loss of seniority or committee assignments; and
WHEREAS, the City Council approved 2026 City Council Appointments to Boards and Committees on December 8, 2025 (Agenda Item 3.4), which included the appointment of Mayor George Carr as primary representative to the following bodies: (1) the 2+2 Fire District Committee, (2) the Budget and Finance Subcommittee, (3) the League of California Cities Executive Committee, and (4) the Stanislaus Council of Governments (StanCOG) Policy Board; none of those appointments was made for a specified term, and all are held at the pleasure of the appointing power under Government Code section 1301; and

WHEREAS, Mayor George Carr, as the subject of this action, is legally disqualified from participating in deliberations or voting on this Resolution; Mayor Pro Tem Randy Crooker has assumed the chair for this item pursuant to Government Code section 36802; Mayor Carr has been provided written notice of this item and has been afforded the opportunity to address the Council during public comment prior to the vote; and the Council’s action is taken without his participation; and
WHEREAS, Councilmember Susana Vasquez, as the complainant whose allegations form the sole factual predicate for the independent investigation, has been advised by the City Attorney that she is subject to disqualification from participating in deliberations or voting on this Resolution under the California common law doctrine against conflicts of interest; the City Attorney’s recusal recommendation and the legal basis for it are a matter of record; under the 2011 Attorney General opinion (94 Ops.Cal.Atty.Gen. 100), any member who is legally disqualified from participating is excluded from both the quorum count and the total membership denominator under Government Code section 36936 for purposes of this vote; and WHEREAS, the City Council finds that this reassignment action is in the best interests of the City of Hughson, is consistent with the City’s obligations to maintain effective governance and appropriate representation on committees and external bodies, and is a lawful exercise of
1916503-1
