ALERT-JUNE 21ST HBCC COUNCIL MEETING

REMINDER
At the upcoming City Council meeting this Tuesday, June 21st at 6:00 p.m., the City Council under Agenda Item #23, will vote on amendments to our City Charter that will be placed on the November 8th, 2022 ballot.

We do not believe they will vote for an amendment that removes the City Clerk, Treasurer and Attorney from elected positions and changes them to appointed, but rather, they will use law-fare and legalese to add language to section 309 in our City Charter that allows the Council to hire outside attorneys. This legalese language they add will nullify the elected City Attorney and render him appointed.

Unfortunately, the majority of this Council cannot be trusted with any Charter amendments for fear they will draft convoluted language that will deceive the voters. As such, the message is clear: NO amendments to our City Charter.

There is too much at stake to risk amending our City Charter which is the Constitution of Huntington Beach.

Please come and speak this coming Tuesday the 21st at 6:00 p.m. and tell our City Council NO on any amendments to our City Charter.

Thank you everyone for all of your help and time dedicated to this critical issue.

Subject: City Charter amendment
Hi city council members,
This is my first email to any city council member. I write this email to all 7 members.

I moved to Huntington Beach in 1976 and purchased our first home. We were very blessed to have raised our children and grandchildren in the great city.

We have seen this city durning it's good times and bad times. But I have always supported all the hard work the city council members have done to keep our city going forward and at the same time seeing the value of keeping our unique status as a Charter City. The original Charter writers saw the importance of keeping the people of the city as the decision makers. That has always been important to everyone I know in HB.

Please, please, please do not change or amend our City Charter at this time!!! Like the world, our lovely city is just about split down the middle on many things. Because of this please keep the decision to change/amend our City Charter off the books until it's not so damaging to the people in this city.

There are so many more important things to work on for the city. Take a breath. Don't think about what looks good for you, but what's best for the future harmony of the city.

Whether it is true or not, your actions "appear" to be more political than helpful to the citizens of HB. Please think ahead. There is no big rush.

By putting this on hold you will be giving our city time to heal. This will make you look good.

You will only be making things worse by pursuing something like this at this time. Just like a good parent, you need to give some grace right now and sacrifice yourself for what's best for the the heart of the city.

Please hear me!
I am a average, loyal, long time citizen of this city. Even though I know in my heart my letter may mean nothing to you because you have already made your decisions and you believe you know what's best for the citizens of the city. But I have to write you in hopes you reconsider perusing any changes to our city Charter for gUPPLEMENTAL I would be happy to help you in anyway to get the city more united. I absolutely oppose any changes to the city charter that take your right to vote for the City Attorney, Clerk and Treasurer
Having an independent City Attorney, Clerk and Treasurer ensures that we have a check on the power of the city Council.

I want our city attorney to continue successfully defending the city against lawsuits and the over reach of Gavin Newsom and the State of California The City Attorney has recently recovered over $5 million owed to the city by the state and will possibly get another $20 million in addition Leave our City Charter as written!

Dear Council Members,
My husband & I have been a resident of HB for 25 years. We have been very happy with our city until the past several years as we have seen numerous changes like an abundance of dense housing, especially on Edinger Ave by Bella Terra.

We have also seen some unacceptable proposals like the replacement of our elected district attorney, Michael Gates.

Now you are proposing an election to vote on charter amendments. I strongly urge you to oppose Amendment 23, charter amendments.

Thank you for your time to read this email.

As tax payers and voters of Huntington Beach, we implore you Not to take away voters rights to elect our Treasurer, Clerk and City Attorney. These positions have always been elected in Huntington Beach. These positions need to be independent of City Council. Treasurer, Clerk, & City Attorney are held accountable by the voters of Huntington Beach not by the City Council. This proposed amendment by City Council is seen as a power grab from voters and will lead to corruption.

Please do Not amend the City Charter to alter these positions.

In my forty years as a resident of Huntington Beach I have never seen such an underhanded and corrupt city council... with the exception of Eric Peterson...this council is a disgrace. To try, by any means necessary, to take away our right to vote for our City Attorney and appoint one of your choice to do your bidding is unethical and dishonest. I no longer trust this city council to work in the best interest of the residents of our city as they have shown repeatedly that they work for the highest bidder which is generally big developers. I am appalled and disgusted with your sneaky attempt to take our vote away. Shame on you.

As a very concerned citizen of Huntington Beach of over 40 years, I urge you to Vote NO on any changes to the City Charter.

Michael Gates has been a great defender for our city.

The dealings of the city need to be visible and not hidden behind closed door meetings Recently there has been too much negative press about our CC and it makes me wonder who you really are representing.

I urge you to vote no on the charter changes, especially regarding the ability to hire outside attorneys. We have a great city attorney who has a terrific track record of winning. We do NOT need to pay double for the services he already provides.

We as citizens of HB expect this council to shoe fiscal responsibility. This does not.

In addition, as most of this council is Democrat, and one of the Democrat mantras is that Republicans are taking away the rights to vote.... Which is exactly what this is doing. So stick to what your party is screaming.. and VOTE NO. The citizens do not want there voting rights taken away.

I respectfully request that you reconsider you position on the charter amendments concerning the city attorney.

The requirement for ten years experience: a good attorney won't want to give up a lucrative practice to work for a city.

The requirement for term limits: again, a good attorney won't want to face the prospect of reestablishing his/her practice after abandoning it several years before.

Re: resolutions of legal conflicts of interest being decided by the council: why would you trust legal laymen to make the final decisions in legal matters?
After reading the responsibilities of the city attorney as recommended in the charter review, I think what the city council actually wants is a law clerk who manages the records for the city. Hiring a law clerk would actually save the city a substantial amount of money, and hiring outside council would rarely be necessary as no one would ever disagree with them.

And, by the way, I thought that the people of Huntington Beach were the clients and that the attorney and council were working for us.

Humbly yours

I am writing to express my concern with you trying to silence the voices of the citizens by changing the city charter to change the way our city attorney is employed. I am 100 percent against ANY change in the charter. I do not trust the ethics of the majority on the city council. There are too many behind the scenes deals that have been made, many teetering on corruptness.

This move, on your part, is not to do what is in the best interest of the citizens and Huntington Beach, but to do what is in your best interest as a power grab. So that you have a puppet who is beholden only to you and your desires for more power. Dan Kalmick and Mike Posey have shown us they are not to be trusted in many instances, but more recently in their unethical and corrupt behavior to do with OCPA. Kim Carr and Natalie have ties to a public official that is currently under an FBI investigation for corruption. Barbara Degleize is more interested in finding lint at the bottom of her purse than listening to the voices of concerned citizens Rhonda Bolton is not a voted council person so should have no say whatsoever. So in light of all of this, how can we trust anything that you put forth. We cannot. until we have a city council that is not tarnished with unethical behavior, corrupt actions, is actually interested and concerned with what the citizens have to say, we say NO ON ANY CHARTER AMENDMENTS!
I think you forget that you serve the people and not strictly those who line your pockets! Please respond that this email has been received and read.

Please stop the madness!! I am ashamed and embarrassed to admit that I am a citizen of HB because of the horrible efforts this corrupt and unethical city council is doing in an effort to take away the votes of the citizens they were elected to serve.

This council clearly has no understanding what it means to serve, it does NOT mean to self serve, it does not mean serve only those who lined your pocket with campaign or other money, it does NOT mean to serve those you made unethical promises to to get them to line your pockets, it means to serve those who elected you. It means to serve the community in an honest and ethical manner. Ethics and Honesty are severely lacking in those of you trying to take away our vote.

Subject: Help our vulnerable mobile home park residents & home owners 1 am NOT a mobile home owner or resident, but l've been a homeowner in Huntington Beach for over 40 years and strongly believe the Council should work together to support these residents. They are caught in a situation where they have few options to deal with institutional investor groups that have taken over ownership of the mobile home park land their homes sit on. Rents have soared and California's Tenant Protection Act doesn't cover mobile home parks and HB's City Charter doesn't have a "carve-out" protection for mobile home parks...

Please work together to help protect these residents and owners from exorbitant rent increases in these days of high inflation. Many are on fixed incomes, have worked hard to have a good life in HB and are in danger of losing their homes, way of life, etc.

I DO believe that HB residents would support a plan guided by our Council to work to find potential solutions for this problem...Amend the City Charter, help write/support a November ballot measure to protect mobile home park residents, explore/support government assistantance programs for low-income seniors and residents in mobile home parks...

These folks need your help!
Thank you!

Also, this new electricity thing is crazy! I should not have to opt out of a new program. If I want to join your new system, I should be opting in. I don't want the new system, but have not received anything to tell me how to opt out.

On a more positive note, I love the closure on the second block of Main Street. It's great to see all the outdoor seating and people strolling along the street. Downtown seems more alive and has a more positive atmosphere. I hope it becomes permanent! It would also be nice if the third block was closed again, especially for summer.

Dear Mayor Delgleize, Mayor Pro-Team Posey, Councilpersons Carr, Peterson, Karmic, Moser, and Bolton:

I am appalled that you, as elected members of our Huntington Beach community, who are supposed to represent what WE THE VOTERS want, what to change our city charter to include term limits to our city attorney and change the charter from elected city attorney, city clerk, and treasurer to appointed positions! How dare you try to take away our right to vote in who we want as our city attorney, clerk, and treasurer! Our charter has served HB well over the decades and for you as a council to think you can do what YOU want and not what WE THE VOTERS want is giving you too much power and taking away our voices. If we don't like what the city attorney, clerk, or treasurer are doing, WE THE VOTERS will not re-elect him/her the next time elections come around.

I urge you all to VOTE NO TO ANY AND ALL CHANGES TO OUR CITY CHARTER! WE LOVE OUR CITY ATTORNEY, MICHAEL

GATES, WHO

I believe the Charter needs to be updated as many other cities have already done to change the elected positions of City Attorney, City Clerk and Treasurer to appointed positions. These are professional positions and the best person for the job should be hired. In addition, these positions should not be at cross purposes with a majority Republican or Democratic City Council. Elections can make the people at cross purposes based on Party loyalties and that makes our city governance less efficient.

As much as I see voting as a critical part to play in a democracy, voters don't have the ability to discover information about past job performance and experience. Information that the City Council can obtain.

I support item 23 on tonight's agenda for the city council to approve charter ammendments that would allow future city councils the responsibility to appoint the positions of City Attorney, Clerk, and Treasurer. Further, I support these appointments because it will provide access to the best qualified professionals to serve the council and therefore the people of Huntington Beach. Often times these positions run unopposed in our elections. I don't understand how this serves our democracy and the best interest of the business of the city. In addition, Huntington Beach is the only city in Orange County where these positions are elected! All other cities in Orange County appoint these positions to provide the technical and specialized services of these positions.

Our city has been fine until the last few years. I've lived here through going to Smith school until Perry was built (first year Perry). Went to Dwyer then HBHS. I've never heard so much about a charter. It seems the charter isn't the problem. Why so much pressure to get certain things done. Buildings going up and being bought for reasons the people should vote on. It's a ton of money. If it's too hard to work With the people in open sessions and actually listen, then maybe you should step down. I believe council people should like working with a diversity of citizens. Not just someone you appoint because they identify with your philosophy.

Although the recall didn't work did you see how many citizens are unhappy with some of you? Do you really listen and try to get ideas from the citizens? My Lord, some of them are really smart in certain areas. They offer Free advice which you can take or leave. Same as all these companies you hire for info but pay a heap of money too. It's almost election time, but still time to hear people and talk about the things the people are worried about. Don't ignore us. At least acknowledge and care about the feelings of those who bother to try to better our beautiful City. Thank you

I am writing to urge each of you to not vote to make changes to the Huntington Beach City Charter. Removing to the right of the citizens to elect our City Attorney, Treasurer, and City Clerk is most un-American idea I have ever heard of. I realize your vote tonight is to let the people decide if they want to change the city charter, but in reality your vote tonight is affirming your support to disenfranchise the voters of Huntington Beach while at the same time giving too much power to too few people. With outside forces medaling in local politics such as ballot harvesting the citizens can no longer trust in the fairness and integrity of public elections where so much is at stake. Please vote NO and leave our City Charter alone.

I firmly believe the voters of HB will not take kindly to our city council revoking or limiting our voting rights and our ability to choose for ourselves who represents us in various city offices.

This city council has been doing a very poor job looking out for the best interests, financial, safety, and lifestyle of the citizens, which is what you are elected to do.

This council has lost my trust and more importantly- my vote.
