Subject: November 1 Council Meeting Agenda Item 25
Concerning Agenda Item 25 to direct staff to draft a zoning change to delete the prohibition of cannabis business and provide regulation for such businesses, I remain concerned that this is moving forward without adequate public notice and involvement. As we have seen with the Edwards Hill fiasco, the perception of the Council and the community as to the adequacy of public notice differs widely. Legalized recreational cannabis businesses popping up all over Huntington Beach will dramatically and forever change the character of the city, and in my opinion, for the worse. Whatever you think about the merits of cannabis, you cannot think it acceptable to make this change and have the community think they were never told about it.
I recommend you pause this freight train until adequate public notice and discussion has occurred. The two open house meetings held so far had very little public participation apart from people associated with the industry. I think a special meeting with notice mailed to all residents would not be too much.

Subject: Cannabis sales in HB
Date: Monday, July 25, 2022 1:54:19 PM
As a resident of Huntington Beach, I strongly support the sale and taxation of cannabis in our city.
There are liquor stores everywhere, and that is equivalent.
All we are doing at this point by not allowing this, is giving tax money that would go to us, to other cities nearby.
If someone in HB buys some (and many, many do) the taxes go to the city they bought it in.
Is our stance that we don't use cannabis here or somehow not selling it here will make it so? Well, we do use cannabis in the city of HB and we're losing tons of money by dragging behind the times.
Additionally, I support very much letting the voters decide how to spend the tax money from cannabis.
Thank you,
J. Trudnich

Dan, I noticed on the DRAFT for Cannabis Commercial Regulation that store hours are only 8 AM- 8 PM and non-Cannabis food cannot be distributed on the property.
I've thought about our previous exchange quite a bit, and I believe the biggest problem with ig guy Cannabis sales is the retail atmosphere. There is a lack of community culture surrounding Cannabis despite its legality in CA because Cannabis cannot be served an consumed on site unlike alcohol.
It you truly want revitalized areas down Beach Blvd, restaurants/venues open until 2 AM on Friday/Saturday that have live music or DJs, Cannabis infused meals, Cannabis infused drinks, and Cannabis smoking lounge areas on site is the way. As it is now, most Cannabis retail stores are mandated to be sterile corporate experiences that lack community. The regulations mapped out in the DRAFT nearly guarantee market dominance and working conditions of the Cannabis equivalent to Wal-Mart and Amazon (like we can clearly see in Long Beach). I do not want to see the same mistakes made in Huntington Beach.
Peace and Love,
John Kochevar

Hello
I would prefer the city completely outlaw cannabis sales in the city. Some will say it will generate sales tax revenue, but at what price? The price will be the further diminishing of public safety in our family friendly community to sell more drugs (legal or not).
As a former smoker of cannabis, I can tell you with first hand experience that there is no positive impact cannabis has on a community, but there are numerous downsides including:
Increased crime in the vicinity if cannabis retailers
Increased vagrancy in the vicinity of cannabis retailers Increased driving while high in the community
Increased acceptance of illegal drugs in the community. And yes cannabis is a gateway drug to harder drugs. It was for me, as it led me to use cocaine, amphetamines, psychedelics and alcohol in my youth.
Increased social acceptance and influence of legal and illegal drugs on children and young people in the community Please do not allow cannabis sales in the community of Huntington Beach! Sincerely

My question is on Municipal Code, 5.130.070. Consumption or Use Prohibited on Site and In Public - Cannabis event prohibited.
I rent out high-end functional art pieces retailed at $13k brand new (in attachment).
Rental services are usually for photoshoots/movies, weddings, education, and cannabis tastings.
Can I provide these services in residential homes to Huntington Beach home owners? or is this illegal due to, "a thing of value...related to provision of cannabis?" Has any bong rental businesses applied to the city? Can I advertise this on GoogleMaps in the city of HB?

My name is Niki Wetzel, and I have been a professional planner working for municipal governments for 25 years. I write to you today as a nearly 20 year resident of Huntington Beach.
I attended the city-sponsored cannabis open house on 10/16/22 and reviewed the information provided with city staff. While I feel that the testing of cannabis should be permitted in the city of Huntington Beach, I do not believe that manufacturing, cultivation, or retail sales should be allowed. I believe that the testing of small amounts of cannabis in labs would not have a negative impact on the community, but I believe that the odors, traffic, loitering, and potential crime that the other types of uses would bring would adversely impact our community. In addition, I noticed that a buffer from other sensitive uses is included in the plans, but a buffer from residential uses is not.
Should retail, manufacturing, or cultivation uses be permitted, I suggest that a buffer from residential uses would be crucial to minimize potential impacts to community residents.
The cannabis industry is strong and persuasive, but our city is under no obligation to allow for uses that would be detrimental to it.
Thank you for your consideration.

I found one in a presentation, but it is blurry when I try to enlarge it enough to try to see where our schools are location. If you have a map that shows school locations, that would be incredibly helpful. Here is the general area our district covers (south of Ellis):

Hello, I see there was an open house regarding public comment on cannabis businesses on October 15.. Unfortunately I was unable to attend.
Is there a recording of the speaking points at the event that I can view? Additionally,
I saw on the city's instagram a map was posted with highlighted sections along with a key indicating "zoning". Has the committee finalized ordinance requirements? I also saw a snippet of what looked to be a timeline or flow chart indicating the path to launching cannabis businesses in the City of HB. Is this something I can have access to, so l know how to plan for the future of Cannabis in HB?
I look forward to your reply,

I have a question with respect to actually legalizing dispensaries in the city. Is this something the City Council can do or must the issue be put on a ballot for voters to decide? I'm aware of the tax issue on the upcoming ballot, but it does not address above.

Dear Community Stakeholders:
This is inform you that the City Council will be discussing the policy related to cannabis businesses at the November 1, 2022 (Tuesday) Council meeting, which is tomorrow. City staff will be presenting key findings from the recent
Community Open House event held on October 15, as well
as the Ad-hoc Council Subcommittee's final
recommendation about zoning and buffer restrictions.
You should be able to access the City's presentation, staff report, and GIS maps here. Please know that the final
proposed buffer restriction for both retailers and non-retailers is 1,000 ft. from K-12 schools and 600 ft. from other sensitive uses including parks - same as what was presented at the open house. The meeting starts at 6pm, but this item is under Administrative Items later on the Agenda.

Honorable Mayor and City Council Members,
I urge you to pull Agenda Item 25 on tonight's calendar pending future public notice and community input.
Agenda Item 25 to directs staff to draft a zoning change to delete the prohibition of cannabis business and provide zoning regulation for such businesses. Legalized recreational cannabis businesses opening all over Huntington Beach will dramatically and forever change the character of the city, and in my opinion, for the worse.
