To: CITY COUNCIL (INCL. CMO STAFF); [email protected] Subject: Agenda Item # 26-776 (Tarvin v. City of Huntington Beach) Date: Monday, August 31, 2026 4:26:41 PM
Mayor, City Council, and City Attorney:

It is entirely feasible that when Michael Gates left the Federal Department of Justice and wanted to return to Huntington Beach, that he would reach out to the City for reemployment, right?

If he did prepare an employment application - provide it as appropriate under the CA Public Records Act. If he did not prepare an employment application (the more likely scenario), then there is no document to provide, and that would be the reply to the CPRA request.

Wouldn't it be easier and cheaper to simply acknowledge that there was no employment application completed by Michael E. Gates for the position of Chief Assistant City Attorney?

Stop wasting taxpayer dollars on these lawsuits, please.
