SUBJECT: PUBLIC HEARING: ORDINANCE 815 RELATED TO MEDICAL AND ADULT
USE CANNABIS IN THE CITY OF IMPERIAL
I. ADOPTION OF ORDINANCE 815 TO AMEND THE CODIFIED ORDINANCES OF THE CITY OF IMPERIAL REGARDING MEDICAL AND ADULT USE CANNABIS.
DEPARTMENT INVOLVED: City Manager·s Office/Community Development/City Attorney BACKGROUND/SUMMARY:
Whereas the City of Imperial City Council has directed City staff to initiate the amendment process of Ordinance 795 as it relates to medical and adult use cannabis in the City of Imperial. Currently, the City's Ordinance allows for one all-exclusive permit to operate a cannabis facility within the City of Imperial.
Specifically, within a C-2 Zone, pending the operation site is not within a 600 sq. ft radius of a sensitive zone as defined by the California Bureau of Cannabis Control. The current permit allows for uses within all seven categories allowed in the Statue of California. The proposed ordinance 815 to amend would expand from one (1) all-exclusive permit to two (2) all-exclusive permits, with the second only being for cultivation and manufacturing.
A Public Hearing was held March 9, 2022 by the Imperial Planning Commission as the first step of the process in a newspaper of general circulation. The Commission adopted Resolution PC 2022-03 with a 4-0 vote contingent on the following recommendations be taken into consideration by the City Council during the Public Hearing Process: Expanding current permitted zones from C2 to include I-1 and I-2 zones as eligible locations for the second facility; the second permit be restricted up to 600 ft from major arterial streets as identified in the City's general plan; and that the city enforce strict design standards on the second facility.
A public hearing of the City Council was noticed for June 1, 2022. Please see the attached Ordinance 815 for more information.
