RE: Support lor AB 762 Qrwin and Wilson) - Ban on Disposable Vapes - COALTTION SUPPORT Dear Assemblymcmbcr Bcrman,
On behalfofthe undersigned organizations, we write in strong support ofAB 762 (lrwin and Wilson), which seek to ban the sale of single-use disposable vaporizer products in Califomia. This critical legislation addresses the alanning cnvironmental, safcty, and public hcalth risks poscd by thesc hazardous products, protccting our communities, wastc infrastructurc, and natural ecosystcms from thcir dcstructive impact.
Single-use vapes contain embedded lithium-ion batteries, making them not only an unsustainable source of electronic waste but also a significant fire hazard. When improperly discarded-as is often the case-these devices ignite fires in garbage cans, collection trucks, and material recovery facilities (MRFS). These lithium-ion battery fires can reach temperaturcs of up to 1200"C--{quivalcnt to a wclding torch----causing rapid and uncontrollablc blazcs. Thc U.K. has alrcady linked disposablc vapc waste to a staggcring 77Yo increasc in waste facility fircs ovcr thc last ycar alonc.
Califomia waste and recycling operators are facing a similar crisis, with escalating fire risks and increased costs in managing this hazardous waste.

Beyond safety concems, single-use vapes contribute to an egregious waste ofvaluable resources. The lithium discarded in these dcviccs annually could otherwise powcr over 2,600 clcctric vchicles, undcrscoring thc recklcss dcpletion of critical materials. Additionally, thc mining and manufacturing of lithium and cobalt-kcy components of vape batteriescxacerbatc cnvironmental dcgadation and pcrpctuate environmental justicc issucs in vulncrable communitics.
Disposable vapes are rapidly becoming a dominant form ofelectronic litter, contaminating highways, parks, and beaches.
The Marine Conservation Society reports that these products are now routinely found along coastlines, where they pose an immediate thrcat to marinc lifc. Unlike cigarcttc butts, which take up to ten years to degradc, single-usc vapes introduce IongJasting toxic pollutants into ccosystems, including rcsidual nicotine, lead, and mercury, which can leach into soil and waterways.
The vast majority of consumers-72o/o--are unaware that these devices cannot be disposed of in standard recycling or garbage streams. The absence o la standzudized, effective collection and recycling process means that single -use vapes are, in rcality, unmanageablc toxic wastc. Thc currcnt status quo places the burden on local govemments and waste managcmcnt operators, forcing them to trcat these hazardous matcrials at exorbitant costs.
Disposable vapes have driven a troubling surge in youth nicotine addiction. According to recenl CDC dat4 14. l% of high school students and 3.3% of middle school students report using e-cigarettes, with a staggering 5 7.2% of high school uses and 45.8%o ol m iddle school users favoring disposab le vape products. Over 84.8% of teen users report using flavored vapcs, including fruit, candy, and mcnthol varietics, furthcr cnhenching nicotine dependencc.
Emerging research reveals that disposable vapes expose users to heightened levels ofvolatile organic compounds (VOCs) and toxic metals such as nickel, cadmium, mercury, and chromium- -compounds linked to increased risks of cancer, cardiopulmonary disease, and neurological disorders. This growing body of evidence underscores the urgent need for intervcntion to protcct public hcalth, particularly among vulncrable youth populations.
Califomia has long bccn a lcadcr in environmcntal protection and consumcr safcty, and this bill aligns with global momennrn to eliminate single-use disposable vapes. Countries includingthe U.K., France, Belgium, New Zealand, and Vietnam have already taken decisive action against these products, recognizing the irreversible harm they cause.
Califomia must act now to prevent further environmental degradation, public health crises, and economic burdens associalcd with their unregulated disposal.
For the sake of our environment, public health, and waste infiastructure, we urge you to support AB 762 and move it forward in the legislative process. We appreciate your leadenhip in tackling lhis urgent issue and stand ready to supporl effons to pass this critical bill.
Sincerely,
The Undersigned Organizations

SB 45 (Padilla and Blakespear) - Tethered Bottle Caps - Fact Sheet
SUMMARY
More tlran I 6,600 tons ol'plastic bottle caps a re littered or land filled iI Ca lilbmia annua lly. SB 45 is aimed at cutting plastic bottlc cap littcr in halfand doubling thc currentpla stic bottlc cap rccycling ratc.
SB -15 will requirc that specihcd plastic bcvcragc containers (soft drinks and water) undcr 2 liten havc bottlc caps tethcrcd to thc container to remain a(tached from consumer use to eventua I rccycling. Tethered caps would significantly reduce litter, enhancc rcc yc la b ility and matcrialcircularity, and protcct both tencstrial and marine wildlife from thc dangen of ingcstion, toxic buildup, a nd microplastic lcaching.
Of the nearly l5 billion plastic beverage containers generated in Califomia last ycar, roughly 70oZ wcrc rctumed forrecycling, and the majority ofthose werc ultimatcly rccycled. That is not thc casc with plastic bottle caps. Rcpofis suggest only 437o of plastic bottle caps cvcn get collectcd. And because of thcirsmallsize roughly halfof those wind up as residua land discards at M aterial Recovery ljacilities and Reclaimers.
By cnsuringthat caps rcnrain affixcd to bottlcs during thcir lifccyclc a nd material processing, SB 4 5 can cut plastic bottlc cap littcr in ha lf and double bottle cap rccycling mtes, prcvcnting pollution and inlproving materiai rccovcry cfforts.
Whcn dctachcd, thcse brightly coloredcaps arc frequently m ista kcn for food by wildlife, leading to fata I choking hazards and the bioaccumulation oftoxins that imperil species ranging from sea tunlcs to whales.
Duc to their bright colors, caps are often attractivc to wildlifc and m ista kcrr for food, posing a fatalchok ing ha zard, a s wcll a s long-tcrm bio-accumulation ofhazardous toxins and stan"tion ducto thc cap's irdigestibility. B CKCROUNI)/ST]MMARY:
The City of Imperial has been approached about the potential purchase of two (2) parcels/areas of land by two (2) different potential buyers. California State Law includes the Surplus Land Act that dictates a process for which a local agency can sell/dispose of parcels. 063-054-038 (35,280 square feet) (vacant land) is located west of Highway 85, North of west Belford Road adjacent to the Dahlia Drain. This is the remaining portion of land that was acquired from the California Department of Transportation. The balance of the original property now contains West Belford Road (terminating into Highway 85), Quick Quack Car Wash, a United States Post Office, McDonalds and Starbucks.
The attached Resolutions is the first step in this process. Note that taking the recommended action does not bind or commit the City Council to disposing of the subject parcels. only that they would now be designated as excess and that the balance of the process which includes making them available for potential purchase by a government agency or low to moderate income housing developers begins.
No action for these parcels to actually be sold or title transferred will occur without the express consent of the City of Imperial City Council.
063-121-004 (13,827 square feet) (vacant land) is located at the Northeast Corner of East 12th Street and North N Street. This is a parcel that is in an industrial zoned for Rail Served Industrial.

Contractor Reg istration
NOTIFICATION PAUSING ENFORCEMENT OF PW SYSTEM REQUIREMENTS - 1771.4(a)(3)
This is to notify interested parties that enforcement of contractor registration requirements as wetl as the requirement to submit etectronic certified payroll records (eCPRs) to the Labor Commissioner using DIR's ontine eCPR system is temporarily paused for the period of l2 months, which runs from 612212024 through 612212025.
Awarding Agencies wi[[ not be penatized for hiring unregistered contractors nor need to withhotd funds due to a contractor's inabitity to register nor provide eCPRs due to system issues. Additionatly, Awarding Bodies and Prime Contractors should not prevent contractors f rom bidding or working on a Public Works jobs as a result of their inabitity to register or submit certified payrot[ due to system issues.
Once the stay of enforcement is tifted, contractors wi[[ not be required to retroactivety submit eCPRs nor wit[ they be required to retroactivety register.
It is important to note that the requirement to submit eCPRs is separate and distinct from the obligation in Labor Code section 1776 which is unaffected by this notice.
The Labor Commissioner recommends that awarding bodies and generaI contractors consider this announcement in the administration of their pubtic works projects. Specif icatly, where eCPRs may be unavaitable during this time, awarding bodies and generat contractors shoutd rety on certified payrott records (on forms such as the DIR Form A-l-131) maintained as required by Labor Code section 1776 to ensure continued compliance with all other public works requirements.
Who ls Eligible to Register?
Contractors must meet the following requirements to register:
Have workers' compensation coverage for any employees and only use subc registered pubtic works contractors. How can we
x
help you
. Have Contractors State License Board license if appticabte to trade. today? . Not have any delinquent unpaid wage or penatty assessments owed to any errrpruycu u enforcement agency.
r Not be under federat or state debarment.
