RE: SB 346 (Durazo) Local agencies: transient occupancy taxes: short-term rental facilitator.
Notice of SUPPORT (As Amended on July 7.,2025l
Dear Senator Padilla and Assemblymember Gonzalez.
The City of Imperial supports SB 346. which would better equip cities to enforce local ordinances related short-term rentals. including the collection and remiltance oftransient occupancy taxes (TOT).
Short-term rentals are regulated exclusively at the local level via the adoption ofan ordinance that often includes regulations on permitting. tax compliance. noise. parking. occupancy' as well as other responsibilities for hosts and short-term rental facilitators. In some instances. ordinances limit the number of shorl-term rentals allowed to operate lawfully. other ordinances ban shortterm rentals entirely.
Short{erm rentals can present numerous challenges to neighborhoods and adjacent property owners. They may create additional noise. traffic, parking. and public safety issues, decrease available housing stock. and in some cases tum residential neighborhoods into de-facto hotel rows. collectively creating additional demands on local public sen'ice providers.
Unfortunately. the enforcement ofTOT ordinances and the collection and remittance ofthese taxes from short-term rentals can be inconsistent, even when voluntary collection agreements are in place with a short-term rental facilitator. Cities lack access to property addresses or other property-related information. even under these agreements. resulting in a dilficult choice to either accept tax payments without any way to verifl their accurac)'and legality or attempt to collect taxes directly lrom property owners - a costl).' and time-consuming process. Meanwhile. short-term rental facilitators have full know'ledge ofthese properties' locations and resist disclosing this information. Cities can only compel short-term rental lacilitators to disclose this -l

critical information through certain legal action. such as subpoenas. This is not how oversight of public dollars should work.
SB 346 would address the above issues by providing cities with the physical address ofeach short-term rental listed on the facilitator's website and full audit authority ofTOT dollars. These changes would ensure the correct amount ofTOT is being collected and remitted and would allow for more efficient enforcement against unlicensed units.
For these reasons, the City ol Imperial supports SB 346.
Sincerely.

To meet regulation and permit requirements, Wastewater Treatment Plant staff must perform scheduled maintenance on its ultraviolet (UV) disinfection system. Many parts, including the UV lamps, have a limited effective lifespan and must be replaced to stay in compliance.

Dear Honorable Councilmembers
Requested Action:
l. Accept Task Order Proposal for On-Call Land Surveying Services from Dynamic Consulting Engineers, Inc. for Record of Survey. Right-of-Way Dedication, and Record of Survey for APN 064-020-025
Background:
On September 18.2024, the City Council awarded two contracts for On-Call Land Surveying Services:
One to Dynamic Consulting Engineers from Imperial, California, and Desert Land Surveying & Engineering from Yuma. Arizona.
Public Services staff issued a task order request on July 22, 2025, for land surveying services related to the Water Treatment Plant. The extension of Banta Road (or Fifth Street), east of La Brucherie Road. is cityowned and utilized as a part oflhe waler treatment plant. Maps show this area outside the city limits in the County of Imperial. There is a section of La Brucherie Road that does not appear to be dedicated on any maps. Small portions of B Street are county righlof-way. There are no survey maps ofthe water treatment plant. The intent of this project is to clean up the survey-related issues at the water treatment plant and proximal roadways.

Dear Honorable Councilmembers:
Requested Action:
L Accept Task Order Proposal for On-Call Land Surveying Services from Desert Surveying & Engineering for Record ofSurvey and Right-of-Way Dedication for APN 064-180-006 Background:
On September 18, 2024, the City Council awarded two contracts for On-Call Land Surveying Services:
One to Dynamic Consulting Engineers from Imperial, Califomia, and Desert Land Surveying & Engineering from Yum4 Arizona.
Public Services staff issued a task order request on July 22, 2025, for land surveying services related to the Claypool Sewer Pump Station. No records or maps show that the area where the location of the pump station has ever been dedicated to the City of Imperial. It is located in the fairground parcel. which is owned by the County of Imperial. The Marshall Street right-of-way within said parcel has also not been dedicated. a:o sourH lr9'l r r^L Avrrir]r ' rMPrxr^!,c492251 . rr!(760]l55al7r. f^)( 1760) t55.a/r8 . wnrY,rir.ti^!.(^.6ov t

The Land Surveying sewices in this proposal include, but are not limited to, the following:
I . Attend a kickoff meeting with city staff.
2. Research and obtain all existing survey maps and documentation. The city has ordered the Preliminary Title Report (PTR), which is attached to this task request.
3. Prepare a topographic survey ofthe immediate sunounding area (200 feet radius from the existing pump station, not the entire fairgrounds parcel), including existing above-ground utilities and signs, roads, buildings, and other structures. Search and find all existing monumenls as needed for the survey. lf no monument is found, note "Searched, not found."
4. Locate right-of-way boundaries and show on the map.
5. Prepare street right-of-way dedication (to the City of Imperial) documentation for Marshall Avenue and the pump station within the fairgrounds parcel. II appears that it was never formally dedicated to the city and is likely prescriptive. Prepare legal descriptions. Note all existing easements or other encumbrances.
6. Prepare a Record of Survey (ROS) for the fairgrounds parcel and city parcel and submit it to the County of lmperial Surveyor's office for review and approval. Tie the Record of Survey to the lound recorded monuments.
7. lnstall up to I 8 monuments (lf necessary) per the approved Record of Survey.
8. All work will comply with the Subdivision Map Act and the hofessional Land Surveyors Act (latest editions).
The city received two cost proposals
( I ) Desert Surveying & Engineering $38.760.00
(2) Dynamic Consulting Engineers $32.250.00
After discussing the projecl with Dynamic Consulting Engineers, Public Services Staff recommends awarding the project to Desert Surveying & Engineering for $38,760.00. Although Dynamic Consulting Engineers has a lower proposed cost, il has the capacity to complete only one of the recently issued task order requests.
Fiscal Impact:
Funds will be expended from wastewater enterprise funds through account 54-861-5210. The project is in the FY 25-26 Capital Improvement Plan.
