Staff Report to the City Council
O Street Vacation between 2nd Street to 3rd Street
Aerial View
Discussion /Analysis
Pursuant to California Government Code 565402, the City may vacate a public right-of-way only if the action is consistent with the adopted General Plan. A review ofthe City of Imperial General Plan, including the Land Use and Circulation Elements, confirms that the proposed vacation of O Street between 2nd Street and 3rd Street is consistent with planned circulation patterns and roadway functionaI classifications. The Circulation Element classifies roadways based on the traffic volumes, connectivity, and network function they are intended to serve.
O Street is classified as a local street and is neither designated nor improved as a Major or Secondary Arterial. Furthermore, field observations indicate that portions of O Street remain unpaved and experience negligible vehicular activity, demonstrating that the segment does not function as a critical link in the City's transportation nefwork. In contrast, P Street, located one block to the east, is classified as a Secondary Arterial. N Street, located one block to the west, is classified as an Industrial Collector that primarily serves industrial development along the rail line, and also provides an alternative mode of travel. Both N Street and P Street provide sufficient capacity and connectivity to accommodate any minor redistribution oflocal traffic resulting from the proposed vacation without adversely affecting circulation or roadway operations on P Street. The proposed right-of-way vacation will not result in significant traffic impacts, will not degrade roadway operations, impede emergency response, or adversely affect access to surrounding properties. No public utilities or emergency access routes will be adversely affected by the proposed vacation.
The project aligns with the General Plan's Land Use Element by promoting economic growth and development within the Rail-Served Industrial Zone. The vacation of the proposed portion of O Street will improve site functionality and accommodate on-site circulation needs.
Once finalized, the project is expected to attract a more diverse business community, encourage redevelopment and revitalization, and foster economic prosperity while enhancing the area's overall appearance and operational efficiency, and contribute to the il

Fee Schedule/Pricins
The incumbent City Attomey currently provides the services outlined in this RFP for a fixed monthly retainer of eight thousand dollars ($8,000), covering sixty (60) hours ofservice per month. However, as the City's legal requirements have evolved over recent years. it is anticipated that the scope ofthe new contract will exceed the current arrangement. Proposers should take this expected growth into account when drafting their proposed fee schedules. The existing agreement is available upon request through the City Clerk's Office.
A description of the sort of matters that would not be included in the monthly retainer. The City expects to be charged an hourly rate for litigation in which the City is a defendant, and the matter is excluded from coverage under its self-insurance program. It is also understood that certain specialized matters may require the services ofoutside counsel. Those matters would be determined on a case-by-case basis.
If the proposal will require hourly compensation for time spent beyond a specified number of hours in a month, please provide an hourly rate for all of the individuals who may be working with the City from the Applicant's office for services not included in the retainer.
The proposal should provide the amount ofthe monthly retainer and the number ofhours included in the retainer.
