Meeting Date: July 1, 2026
SUBJECT:

GANN SPENDING LIMIT FOR FISCAL YEAR 2026-2027
BACKGROUND:

As required by Proposition 4, which was passed in 1979, now under Article XIIIB of the California Constitution, the City of Imperial (like all California Cities) has had to determine compliance with Proposition 4 by multiplying the “base” spending limit established for each City back in the year 1979 using the two factors provided by the California Department of Finance: (1) population change, and (2) inflation rate change, annually.

For FY 2026-2027, here is the calculation of the Gann Spending Limit, adding 100% to each factor to allow multiplication of the compounded percentages against last year’s limit:
$24,322,787 x 1.005 x 1.034 = $25,275,550
In Imperial, the appropriations in the budget are subject to a $9,905,500 limit, well below the $25,275,550 spending limit calculated using population and inflation percentage adjustments.

FISCAL IMPACT:

None
REQUESTED ACTION:

Staff recommends Council adopt Resolution #2026-44 establishing the Gann Spending Limit at $25,275,550 for FY 2026-2027.

CITY MANAGER RECOMMENDATION:

Approved as presented.

RESOLUTION NO. 2026-44

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IMPERIAL,

CALIFORNIA ADOPTING THE GANN SPENDING LIMIT FOR APPROPRIATIONS FOR THE FISCAL YEAR ENDING JUNE 30, 2027
BE IT AND IT IS HEREBY RESOLVED by the City Council of the City of Imperial as follows:

WHEREAS, the Gann Initiative, hereby referred to as Article XIIB of the Constitution of the State of California, was passed by the people; and
WHEREAS, Article XIIB mandated appropriations limits on various units of government, including the City of Imperial; and
WHEREAS, that limit has been calculated by the Administrative Services Department of the City of Imperial using current guidelines by the State Department of Finance; and WHEREAS, the City Council of the City of Imperial desires to formally adopt the Gann Spending Limit to certify that the adopted FY 2027 budget complies with the Limit.

NOW, THEREFORE, the City Council of the City of Imperial, in accordance with Article XIIB of the Constitution of the State of California hereby adopts an appropriation limit for the City of Imperial for Fiscal Year 2026-2027 at $25,275,550, an increase of $952,763 over the Fiscal Year 2025-2026 limit of $24,322,787, using the California Department of Finance data, which reflects a 0.05% population increase and a 3.4% inflation increase for the new fiscal year.

The appropriations subject to the limit for FY 2026-2027 total $9,905,550, which is well below the FY 2026-2027 appropriations limit of $25,75,550.

Good morning,
As you may already be aware, on June 16, 2026, the Imperial County Board of Supervisors established the Data Center Advisory Committee to advise the Board in evaluating potential land use, zoning, and policy options relating to data center development within the unincorporated areas of the County. A copy of the adopted resolution is attached for your reference.

The Data Center Advisory Committee consists of 19 members. The Board has designated one seat for a representative appointed by each incorporated city within Imperial County, and we wanted to ensure you were aware of this opportunity.

The County has established an application process for committee membership, which may be found here:

Imperial County Invites Applicants to Serve on Data Center Advisory Committee - Imperial County. Although the application includes an option for individuals to indicate that they wish to serve as a city representative, the authority to select the city’s representative rests solely with each respective city. Any application received by the County indicating an interest in serving as a city representative will be forwarded to the appropriate city for its consideration and action.

Currently, County staff anticipate presenting the applications for the non-city appointments to the Board of Supervisors on July 14, 2026 for their consideration. If your city has appointed its representative by that date, we would welcome the opportunity to acknowledge that appointment during the Board’s consideration of the committee membership. However, the County will, of course, honor city appointments made after that date as well.

We hope your city will participate in this important effort and assist the County by appointing a representative to serve on the Data Center Advisory Committee.

If you have any questions, please feel free to contact me at [email protected] or 442-265-1001.

Sincerely,
Dr. Kathleen Lang
Imperial County Executive Officer
