ITEM TITLE: RESOLUTION NO. 2022-30 ADOPTING THE 2018 EDITIONS OF THE

STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION AND THE SAN

DIEGO REGIONAL STANDARD DRAWINGS AS THE CONSTRUCTION STANDARD REFERENCE DOCUMENTS FOR PUBLIC WORKS CONSTRUCTION PROJECTS. (0720-95) ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY: Adoption of Resolution No. 2022-30 will approve updated standard reference documents for public works construction projects. It is necessary and prudent to have public works improvements constructed using common properly vetted standards across all public improvements. The two documents that serve that purpose are:
 Standard Specifications for Public Works Construction (2018 Edition)  San Diego Regional Standard Drawings (2018 Edition)
These are periodically updated by professionals from the construction and engineering communities. The Standard Specifications for Public Works Construction (2018 Edition) and the San Diego Regional Standard Drawings (2018 Edition) replace the previously adopted 2015 editions.

RECOMMENDATION:

Adopt Resolution No. 2022-30 adopting the Standard Specifications for Public Works Construction (2018 Edition) and the San Diego Regional Standard Drawings (2018 Edition) as the standards for public works construction in the City of Imperial Beach.

OPTIONS:
 Adopt Resolution No. 2022-30 updating the standard public works reference documents for public works construction projects;
 Reject Resolution No. 2022-30, leaving the previously adopted standard reference documents as the applicable reference documents for public works construction projects; or
 Request additional information and an additional report.

On September 16, 2015, City Council adopted Resolution No. 2015-7628 adopting the Standard Specifications for Public Works Construction (2015 Edition). On April 19, 2017, City Council adopted Resolution No. 2017-7796 approving the San Diego Regional Standard Drawings (2015 Edition).

City Council has the authority to establish appropriate reference documents as the construction standard within the City when performing public works projects. Each succeeding edition of the construction standards documents are prepared to reflect the constantly changing technology and advanced thinking of the construction industry. These documents are designed to aid in furthering uniformity of plans and specifications accepted and used by those involved in public works construction and to take such other steps that are designed to promote more competitive bidding by private contractors.

ITEM TITLE: RESOLUTION NO. 2022-31 AWARDING A CONSTRUCTION CONTRACT AND

SOLE SOURCE PURCHASE CONTRACT TO GREENFIELDS OUTDOOR FITNESS FOR THE

SENIOR FITNESS EQUIPMENT PROJECT AT VETERANS PARK AND APPROPRIATING $10,694 TO THE PROJECT BUDGET. (0920-70 & 0650-33)
ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY:

Resolution No. 2022-31 (Attachment 1) awards a construction contract and a sole source purchase contract to Greenfields Outdoor Fitness for the Senior Fitness Equipment Project (Project). Additionally, the Resolution authorizes an appropriation of $10,694 to the Project’s budget from the Parks Major Maintenance Fund. Greenfields Outdoor Fitness is the sole source supplier of the outdoor accessible senior fitness equipment selected for the Project.

Staff has reviewed potential sites at Veterans Park and is proposing installation at the northwest side of Veterans Park off of 8th Street (Attachment 2), which provides high visibility and access to walkways, restrooms, and easy access to and from the Senior Center.

On January 19, 2022, Resolution 2022-01 accepted and appropriated CDBG-Cares Act funds in the amount of $238,818 to the FY22 budget for this project. The proposed Resolution will provide $10,694 in City funding to address any unforeseen contingency costs, resulting in a total project cost of $250,000.

RECOMMENDATION:

Adopt Resolution No. 2022-31 to award a construction contract in the amount of $111,440 and a sole source purchase contract in the amount of $128,072 to Greenfields Outdoor Fitness for the Senior Fitness Equipment Project and authorize the appropriation of $10,694 to the Project’s budget from the Parks Major Maintenance Fund.

OPTIONS:
 Approve resolution and recommendation from staff.
 Reject the project and provide direction to staff on how to proceed.  Request additional information and an additional report.

BACKGROUND/ANALYSIS:

In April of 2020, the City was notified by the U.S. Department of Housing and Urban Development

(HUD) of CARES Act funding available to the City of Imperial Beach. This funding has strict eligibility requirements and was ultimately approved to be used for outdoor exercise equipment geared toward seniors in Veteran’s Park. The City of Imperial Beach was awarded a total Community Development Block Grant (CDBG) – Cares Act allocation of $238,818.

On May 19, 2021, the Community Development Department presented Council with Resolution 2021-29. This Resolution requested authorization to complete a Community Development Block Grant Cares Act Application for the Senior Fitness Equipment Project as well as requesting authorization for the City Manager or designee to execute the appropriate agreements with the County of San Diego.

City staff received the notice to proceed on November 30, 2021 from the County of San Diego and began contacting contractors for bids on the Project. It became clear that this type of outdoor accessible senior fitness equipment is proprietary and as such subject to sole-source procurement provisions. Greenfields Outdoor Fitness is the sole source provider of the selected fitness equipment and from whom the City will purchase the equipment directly. Greenfield Outdoor Fitness will provide component installation under a construction contract, as the City is utilizing the California Uniform Construction Cost Accounting Act to expedite construction of the project.

The Project is designed to provide free, outdoor exercise equipment for seniors and will also include accessible equipment to be used by those of all ability levels. There are twelve exercise stations allowing for multiple users to be on the equipment at one time. Attachment 5 is an depiction of the proposed fitness equipment.

Staff proposes the equipment be installed at the northwest side of Veterans Park immediately to south of the main entry walkway off of 8th Street. Upon approval of the proposed Resolution, the Project will begin with ordering the equipment and shade sails with installation scheduled for completion this fall.

ITEM TITLE: RESOLUTION NO. 2022-32 ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2022-2023 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017. (0390-86)
ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY:

The Road Repair and Accountability Act of 2017 (SB 1) attempts to address transportation funding shortfalls statewide by increasing per gallon fuel excise taxes, diesel fuel sales taxes, vehicle registration taxes and providing for inflationary adjustments to rates in future years. The Act allocates funds from new taxes through a new Road Maintenance and Rehabilitation Account (RMRA). In order to be eligible for RMRA funding, the City must adopt a resolution approving the list of projects to receive RMRA funding in FY 2022-2023.

RECOMMENDATION:

Staff recommends that the City Council adopt Resolution 2022-32 approving the FY2022-2023 Project List for Senate Bill 1 (Road Repair and Accountability Act of 2017) Road Maintenance and Rehabilitation Account funding.

OPTIONS:
 Adopt the resolution approving the Project List for Fiscal Year 2022-2023.  Amend the resolution or provide staff direction.

BACKGROUND/ANALYSIS:

The state of California imposes per-gallon excise taxes on gasoline and diesel fuel, sales taxes on gasoline and diesel fuel and registration taxes on motor vehicles with allocations dedicated to transportation purposes. These allocations flow through the Highway Users Tax Account (HUTA), the familiar gasoline tax revenues that have been in place for decades, and the Road Maintenance and Rehabilitation Account which allocates much of the revenue from SB 1. SB 1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. In order to be eligible for funding, the City must adopt a resolution approving the list of projects to receive RMRA funding in FY 2022-2023. Staff recommends that the funding be applied towards the City of Imperial Beach SB 1 Project List for FY 2022-2023 shown on Attachment 2 which will be included in the Proposed Budget for FY 2022-2023. In accordance with the City’s Pavement Management Program, this Project List will implement road maintenance
