10. REPORTS
10.e UPDATE ON ACTIONS TAKEN TO ADDRESS THE CONCERNS RAISED BY
THE RESIDENTS OF THE MIRAMAR MOBILE HOME PARK IN IMPERIAL BEACH. (0660-30)
City Manager Hall reported that the City Council gave direction to staff to work with the owner of the Miramar Mobile Home Park to address some of the concerns raised by the residents. He commented on the complexities of the matter considering the park is under the jurisdiction of the State yet located in Imperial Beach. He was hopeful that the park owner would enter into an agreement with the City to address the residents' concerns. The problem is that the City circulated an agreement to the owner and the City has yet to hear back if this is the direction the owner wants to go. He gave an overview of some of the concerns and conditions listed in the agreement. He is hopeful that the City will receive feedback from the owner.
Julie Paule, with the WMA, a trade association that represents mobile home park owners and whose core value is against rent control ordinances, said her association has had success fostering agreements and reached out to City Manager Hall when she heard about the situation at Miramar Mobile Home Park.
She does not represent the owner. She said it's important to manage expectations, not every point will be able to be resolved in the agreement, and not every issue will not be resolved if rent control is passed. She provided the City with conflict resolution resources as well as resources at HCD.
ATTACHMENT 1
7 The following speakers spoke about negative experiences with the owner and poor conditions at the mobile home park: Rachel Orozco, Steve Runningwolf, Chloe Stegall, Michael Harrelson, Connie Villalpando, Oscar Toscano and Juan Nevarez.
Councilmember Aguirre thanked everyone for their attendance and for having the courage to speak up. She said it is outrageous that people feel fear to share concerns about what they are experiencing in their community. She further stated that no one should be subjected to this type of treatment and patience has run out. She said that Mr. Martinez has had ample opportunity to respond. She is inclined to include everything in the MOU to be an ordinance.
Councilmember Leyba-Gonzalez appreciated Mr. Runningwolf for taking the time to show him around the park. He said the site is unacceptable and spoke of the need to come up with a solution.
Councilmember Spriggs said they are out of patience because the situation is not getting better. If the owner is not willing to sit at the table to work out an MOU that is mutually acceptable and is enforceable as a contract, then the City needs to look at an ordinance. He spoke about the need to help the people that live in the community.
City Attorney Lyon said that a formal action is not required. A majority of City Council can give direction to the City Manager on the issue.
A majority of City Council supported direction to staff to create an ordinance.
Mayor Pro Tem Fisher commented this is a very unique situation for the City. He encouraged the parents to tell their children what they are learning about the City and about exercising their rights. He thanked everyone for attending the meeting.
9. PUBLIC HEARINGS
9.b MATT MORGAN, IB FORUM (APPLICANT): CP-22-0015, CUP-22-0012, DRC22-0028, SPR-22-0029, & CEQA EXEMPTION PER CEQA GUIDELINES 15303 FOR A 527 SQUARE FOOT PATIO EXPANSION TO THE EXISTING IB FORUM AT 1079 SEACOAST DRIVE. USE-22-0092. (0600-20)
Mayor Pro Tem Fisher declared the Public Hearing open.
Senior Planner Openshaw gave a PowerPoint presentation on the item.
Matt Morgan, owner, spoke about the need for expanding the kitchen which took away seating. He is hopeful to gain seating back with the extended patio. He said that customers typically walk, bike, ride the bus or take a ride share to the restaurant so parking is not a problem.
Erika Lowery expressed concern about parking.
ATTACHMENT 1
8 Dante Pamintuan spoke in support of the project.
William Long spoke in support of the project.
Stosh Thomas, architect, said he is available to answer questions.
Councilmember Spriggs commented on how he has enjoyed being a patron of the restaurant. He expressed concern about City Council approving projects one at a time with inadequate parking and creating a bigger problem for the Seacoast commercial and residential neighborhoods. He commented on the need to make public investments for parking and lighting to make the area successful for businesses and safe for the public.
Councilmember Leyba-Gonzalez shared positive experiences he had at the restaurant and spoke in support of the item.
Councilmember Aguirre concurred with Councilmember Spriggs' that there is a need to look at the medium and long term to address parking issues, however, the matter to consider is the expansion. She commented that it is unfortunate four parking spaces will be lost, however, the restaurant will provide more jobs, services and a great dining experience for the community. She supported the project and said City Council needs to look at the parking issue and how it will be addressed in the future.
Mayor Pro Tem Fisher said it is amazing that a business needs to expand postCOVID and asked questions of Mr. Morgan about the seating in the restaurant and patios.
Regarding the improvements that could be made along the commercial portion of Seacoast Drive, Councilmember Spriggs spoke about the need to look at other areas (such as Little Italy, Orange Ave. in Coronado, Gaslamp and Third Street in Chula Vista) which have public infrastructure making for a better nighttime walkable experience.
Without descension of City Council, Mayor Pro Tem Fisher closed the public hearing.
Motion by Councilmember Leyba-Gonzalez
Seconded by Councilmember Aguirre
To adopt Resolution 2022-74, approving Regular Coastal Development Permit (CP-22-0015), Conditional Use Permit (CUP-22-0012), Design Review Case (DRC-22-0028), Site Plan Review (SPR-22-0023) and Categorical Exemption pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15303 Class 3e (New Construction or Conversion of Small Structures) for the proposed attached 527 square foot exterior covered patio addition to the existing IB Forum restaurant at 1079 Seacoast Drive (APN 625-392-23-00) in the C/MU-2 (Seacoast Commercial & Mixed-Use) Zone.

10.a INVESTMENT UPDATE PRESENTED BY CHANDLER ASSET
MANAGEMENT. (0350-90)
Finance Manager Flyte introduced the item.
Karl Meng, Portfolio Strategist, gave a PowerPoint presentation on the item. He responded to Councilmember Spriggs’ concern about unrealized loss and gap of the portfolio earnings and the interest rate (real negative rate).
Councilmember Spriggs commented that due to the State imposed requirements for very conservative investments of municipal funds we are getting further behind the inflation rate. The return we get is so small and while all the prices go up our purchasing power does not.
Dante Pamintuan questioned the total value of the City's investment.
Mr. Meng gave background on unrealized gains and loses with a fixed income portfolio.
City Manager Hall announced there is a City Council Policy requiring a majority vote of the City Council to extend the meeting beyond 10:00 p.m.
City Council discussion ensued.

Dennis Larson, Nexus Planning, gave a presentation on the public outreach, community engagement and the project design.

She suggested an arborist determine if the project will kill the tree. She also requested that parking be restricted to dawn to dusk. She expressed concern about moving the bike lane by Beazer Homes.
Edward Brackmanis spoke in support of establishing a bird and butterfly garden by Bayside Elementary School.
Dante Pamintuan questioned how much has been spent on this project. He spoke in support of water activities to attract visitors.
Councilmember Leyba-Gonzalez expressed concern about safety on the bikeway. He spoke about the need to separate people on bikes and pedestrians for safety reasons. Both type of users need to co-exist.
Councilmember Aguirre expressed concern about safety. She supported pedestrian only trails and better signage. She expressed concern about electrical bikes in prohibited areas.
Mr. Larson addressed Councilmember Aguirre's questions about multijurisdictional collaboration, the success of ecotone slopes and marsh migration implementation in other areas, joint-use park with the schools and closure when schools are in session.
Councilmember Spriggs appreciated input from the community. He said it would be nice in the future to have workshops that include the Councilmembers. He supported exploring the option to restore Pond 10A and rerouting the bike path.
In response to Mayor Pro Tem Fisher question, Director Helmer, spoke about when the highest tides and flooding occur.
Mayor Pro Tem Fisher liked the rerouting of the path, requested hydration stations, and said that the space by Bayside Elementary is an underused space.
In response to Councilmember Spriggs question, Director Helmer stated the area from Public Works to Bikeway Village is not included in the 30% design plans because it is outside the sea-level rise projections. However, he expects that section of the bike path to be part of the improvements made.

ITEM TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IMPERIAL BEACH,
CALIFORNIA, CONTINUING THE PROCLAMATION OF A STATE OF AN ONGOING LOCAL EMERGENCY RELATED TO COVID-19. (0210-25)
ORIGINATING DEPARTMENT:
City Manager
EXECUTIVE SUMMARY:
On March 12, 2020, the City’s Director of Emergency Services proclaimed the existence of a local emergency within the City, and on March 16, the City Council approved Resolution No. 2020-13 to ratify the proclamation of the City’s Director of Emergency Services. The law requires that the local emergency declaration be reviewed periodically. The Council has reviewed the need for and approved resolutions periodically since March 2020 to continue the ongoing state of emergency.
The local emergency related to COVID-19 continues to exist, and the attached resolution is before the Council to declare the continuation of the local state of emergency. The Governor’s declaration of emergency is set to terminate on February 28, 2023, and the City Council will consider termination of this local emergency at the February Council meeting.
RECOMMENDATION:
Approve Resolution No. 2023-02.
OPTIONS:
Approve resolution; or
Provide direction to the City Manager.
BACKGROUND/ANALYSIS:
Since the City Council approved Resolution No. 2020-13 on March 16, 2020, the COVID-19 emergency has continued. The Health Officer of the County of San Diego issued the current Limited Order of the Health Officer and Emergency Regulations which delineates its current regulations.
The number of cases throughout the County, State, and country still increase on a daily basis, especially due to variants. COVID-19 therefore has and will continue to cause conditions of peril to the health, safety, and welfare of persons and property in the City.
Preparing for, responding to, mitigating, and recovering from the spread of COVID-19 requires the City to divert resources from normal day-to-day operations and alter normal day-to-day operations. The City needs the ability to take all necessary actions to comply with all County, State and Federal orders as applicable. City Staff believes that the response to COVID-19 has
and will continue to impose extraordinary requirements on and expenses to the City which will be beyond the control of the services, personnel, equipment, and facilities of the City of Imperial Beach.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT: unknown

RE: Extension Request for Resolution 2019-8056
Dear Meagan,
Addison Technology Properties LLC (Addison) is the property owner at 550 Highway 75 & 624 7th Street and is requesting a 6-month extension from the City of Imperial Beach on the above resolution associated with the project know as Blue Wave Hotel and Residences. We are aware that this project has been approved previously via the extension process. We have prepared a brief narrative below that explains the reasons for the extension and the next steps that will be taken post-approval.
As you are aware, Addison has been the owner of the 1st and 2nd position secured debt on this property which has been under the ownership of Blue Wave Enterprises (BWE) until January 9th, 2023. BWE has been in default on his debts for several years and the project has been tied up first in legal delays and then through BWE’s filing of Chp 11 bankruptcy last spring, which delayed the natural reversion of the property to the secured lender (Addison). Though the delays have been extensive, as of January 9th, it has finally been released to Addison through the foreclosure process. With free and clear title to the property, Addison is eager to proceed with the project as soon as practical.
Reasons to grant the extension request
1) Both BWE and Addison want this extension. There isn’t anybody who doesn’t want this extension to be granted. The former manager and owner of BWE has formally requested an extension in December, and I have also formally requested an extension in December under my rights to do so as the then, 1st position secured lender to protect my investment. 2) The bottleneck to progress has been removed. The previous company and its manager are no longer part of the project. As of January 9th, this project will be under 100% different ownership and management.
3) Nothing could be done to progress the project forward due to Bankruptcy of the Previous Owner. The foreclosure that was set to occur on April 26th, 2022, was halted by BWE filing Chp. 11 bankruptcy, which delayed the inevitable foreclosure; and subsequent delays within the umbrella of the bankruptcy, extended it for 9 months rather than the normal 60 days. While I was eager to proceed within the original 6 month extension granted, my hands were completely tied due to the bankruptcy, until the judge released the hold on my ability to foreclose. 4) Nobody else would purchase this property and develop it without the entitlements. With the 3 separate recent appraisals of the property, none have the value of the land anywhere close to the 7.3 million that is owed on the 1st and 2nd secured positions on the property, even with the entitlements. Therefore, it would be extremely difficult to for this property to not just become just another vacant land eyesore.
Attachment 2
5) It will visually improve this section of the city. In its current state, it is detracting from the city both visually and economically. Development of this project will dramatically improve the look and feel of this highly visible area of the city.
6) Revenue generated for the city. This project should generate significant revenue for the city for years to come, rather than be an eyesore.
7) I have put my money where my mouth is: I have spent over $350,000 in legal fees and just last month, approximately 4 million dollars cash to get this project back on track to be developed. I would not have done this if I weren’t beyond serious about making this happen. Just the daily interest being lost on the 4 million alone is enough incentive for me to make this happen, and make this happen as timely as possible.
8) There may even be legal rational for granting the extension. The California Code requires up to 10 year extension requests be granted for maps, and this may be relevant to this project and most likely was enacted to protect the investments of those who have expended resources to prepare these documents. At a minimum, it could be viewed as a guideline for how to handle extension requests in
general. https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=GOV&sec tionNum=66452.6
9) Why not? I think one of the most compelling reasons to grant this extension request is simply that there are literally zero reasons not to. There is no cost or risk to the city to grant the extension, and in fact will do the opposite and generate revenue for the city. 10) Its the right thing to do. I believe all my years of effort and dollars spent investing on the vision of this project is worth giving me the chance to see this through both to realize the project but to also be given the opportunity to recover some of the losses I have incurred.
Next Steps
Once the extension has been approved, we will be able to hit the ground running. Our next steps include the following:
• Finalizing the permitting process including finishing the corrections on the building permits, satisfying the $5,000 outstanding balance with the city, and any other outstanding items. • COA Fulfillment. We intend to fulfill all the Conditions of Approval (COA) contained in the entitlement documents. Our team will review all the COA and continue to work with the city on completing these items.
• GC selection. We will work with our project management team, design consultants, and legal team to prepare a Request for Proposal that will be issued to a carefully selected group of General Contractors (GC) in the local area. After a thorough evaluation, the client will select a GC with a view to execute an AIA form of contract and commence the grading. • We will open lines of communication with other local agencies such as the Power Company, municipal water department, and CALTRANS.
We are committed to constructing this exciting project timely and effectively and continuing the growth and benefitting the future of the City of Imperial Beach together. Attached to this letter is an approximate timetable of the actions highlighted above (Attachment A).
If you have any questions, please feel free to email or call me (below). Thank you for your time and attention to this very important project for me.
Sincerely,
Ed Fleming

The project involves the construction of an approximately 56,998-gross-square-foot multi-use facility on three parcels located at 550 Highway 75 and 624 7th Street in Imperial Beach. The project site primarily fronts Palm Avenue/Highway 75 and a portion of the site extends to 7th Street. The surrounding area is zoned C/MU-1 (General Commercial & Mixed-Use), similar to the subject project site. The property to the north is the recently constructed Bayside Landing development (previously “Bernardo Shores”), which is comprised of 187 residential units, and a mix of commercial and residential uses are located to the east, south, and west. The primary building elevation would face Palm Avenue, which is consistent with the surrounding commercial and mixed-use uses along the Palm Avenue Corridor, and 7th Street would be used for vehicle exiting via an overhead gate.
Uses: The facility would
include a four-story Zshaped hotel/residential
building that follows the
northern perimeter of the
site and a two-story
rectangular restaurant
building along the
southwestern perimeter.
Overall, the project would
provide 40,149 square
feet of residential dwelling
unit space (51 units),
18,148 square feet of
hotel units (47 units),
6,680 square feet of office/shop/restaurant space. The project would also include courtyard patio space, a rooftop pool terrace, fitness area, and outdoor deck space/amenities.
The residential component would consist of 30 one-bedroom units and 21 two-bedroom units, for a total of 51 dwelling units. Two units would be designated as very low-income units, subject to an agreement with the City. The applicant is not requesting a density bonus or development incentives, but has requested a reduction of development process fees as referenced in Imperial Beach Municipal Code (IBMC) Section 19.65.060.B.2 (this would not include any required impact fees). A pool would be provided to serve the residential component of the project and may include occasional outdoor daytime events.
The hotel component would consist of 47 hotel units with three unit-types: micro, standard, and deluxe. The first and second floors would provide 19 micro hotel units measuring approximately 217 square feet, 20 standard hotel units measuring approximately 463 square feet, and eight deluxe hotel units measuring approximately 653 square feet and equipped with cooking facilities/kitchenettes.
The office/shop/restaurant space would consist of a two-story building, totaling 6,680 square feet. The first floor would contain a lobby, front desk/reception area, and office space, in addition to a lounge seating area, a kitchen and associated pantry area, as well as restrooms. A roll-up wall would be located at the westerly end of the lounge area, which would provide access to an 1,810-square-foot outdoor courtyard patio area. The second floor would consist of a 1,749- square-foot deck area, restaurant/lounge seating, bar area, storage, office space, restrooms,

proposing to implement transportation demand management strategies to offset any demand for parking.
Transportation Demand Management Strategies: The project would provide Transportation Demand Management (TDM) features to encourage transit use, carpooling, pedestrian/bike (multimodal) use, and transportation network company use, such as Uber and Lyft. The following is a list of proposed TDM features:
The project will cater to military personnel and would provide a shuttle to-and-from the base
14 bicycle racks will be provided on-site for the general public Motorcycle parking
Resident bicycle storage racks
Ridehail/rideshare pick-up zones on-site
Discount with proof of public ridership or alternative transportation Parking validation ticket for Lounge Area
Shuttle services from adjacent parking lot, as needed/required Flex-parking for hotel purposes (e.g. Uber/Lyft and/or rental) California Coastal Commission: The project is located in the Appeal Jurisdiction of the California Coastal Commission. As such, City staff solicited and received comments from the Coastal Commission during the City’s review so that general concerns could be addressed. In general, the Commission was concerned with the provision of visitor accommodations and proper export of graded materials. The 24-room El Camino Motel was previously located on the site and was demolished in 2012 after it had fallen into disrepair. Following demolition, Commission staff advised that a Coastal Development Permit should have been issued for the demolition and that any future permit application should include an after-the-fact demolition of the structure and address the loss of overnight visitor-serving accommodations. The applicant was aware of such concerns and prepared an overnight accommodation memorandum that addressed lower cost visitor accommodations and average daily rates (see Attachment 5). The memorandum notes that 30 of the new hotel rooms would provide lower costs (24 replacement rooms and 6 new rooms) and 17 would be market rate. The applicant proposed to incorporate conditions related to the hotel units that include general occupancy requirements, length-of-stay provisions, prohibition on conversions, lower-cost unit provisions, and monitoring, which the Coastal Commission staff has accepted. Resolution 2019-8056 includes this condition, in addition to a condition regarding the export of graded materials and an after-the-fact demolition of the previous motel.
Design Review Board: The Design Review Board reviewed the project on March 21, 2019 and with a vote of 4-0 (1 absent) recommended approval of the project’s design with the following considerations: 1) provide landscaping on the north dense enough to mitigate privacy and noise; 2) provide two affordable units that must remain affordable subject to an agreement with the City or other way or monitoring; 3) provide sound attenuation for residences through the use of building materials; 4) minimize traffic noise from vehicles exiting 7th Street; 5) provide window alignment on the north property line to maximize privacy; 6) provide narrative for screening properties to the east. The applicant has addressed these items as noted below:
1. Provide landscaping on the north dense enough to mitigate privacy and noise. -Response: The developer concurred and stated that the design would reflect a more, dense landscape palette on the north property line of the project.

2. Provide two affordable units that must remain affordable subject to an agreement with the City or other way or monitoring.
-Response: The developer would sign an agreement with the City indicating two units would be affordable units for the life of the project.
3. Provide sound attenuation for residences through the use of building materials. -Response: The developer takes no exception taken and sound attenuation would be consistent with best practices and the California Building Code.
4. Minimize traffic noise from vehicles existing 7th Street. -Response: The developer concurred and indicated that the design would address this topic consistent with best practices.
5. Provide window alignment on the north property line to maximize privacy. -Response: The developer concurred and stated that window alignment of the project would maximize the privacy of adjacent residents.
6. Provide narrative for screening properties to the east. -Response: Along the east property line the CMU wall would have climbing vegetation such a vine, trumpet vine, or similar planting with the intent to provide a “good neighbor” view for the adjacent property owners.
These recommendations have been incorporated as conditions of approval within Resolution 2019-8056.

(MND; SCH# 2019059022) pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15073 was published and circulated for a 30-day public comment period on May 9, 2019. The Draft MND was also transmitted to the State Clearinghouse for a 30-day agency review. The public comment period closed on June 10, 2019. A Final MND was prepared that responded to the one comment letter was received and also identifies a Mitigation Monitoring and Reporting Program (MMRP) that would implement mitigation measures that would avoid or reduce all potentially significant environmental effects to below a level of significance (Attachment 6).
Below is a brief discussion of the project’s potential impacts and proposed mitigation measures that would reduce the impacts to below significance:
Hazards and Hazardous Materials: Due to the age of the existing residential structures that would be demolished for the project, there is potential for lead based paint and asbestoscontaining materials to be present. The project would be required to use proper abatement and disposal protocol per Occupational Health and Safety Administration, Environmental Protection Agency, etc.
Noise: A Noise Analysis report prepared by RECON Environmental determined that exterior mitigation on the rooftop pool deck would be required to reduce noise levels to comply with the City’s compatibility standards. As such, the project would include a 3.5-foot-high barrier adjacent to the rooftop pool to reduce these exterior noise levels. In addition, sound resistant construction for walls adjacent to specific receiver areas would be necessary to reduce sound transmission to affected residential units and hotel rooms.
Traffic: The City of Imperial Beach General Plan and the Otay Mesa-Nestor Community Plan identify several vehicular capacity enhancing projects; however, in order to be conservative, no circulation network changes or improvements were assumed for the Year 2040 traffic conditions. The traffic study summarized the year 2040 roadway segment operations with and without project traffic and no significant impacts as a result of this project were identified.
COASTAL JURISDICTION:
This project is located in the coastal zone as defined by the California Coastal Act of 1976. The City Council public hearing will serve as the required coastal permit hearing and the City Council will consider the findings under the California Coastal Act. Pursuant to the City of Imperial Beach Zoning Ordinance Section 19.87.050, review of the proposal will consider whether the proposed development satisfies the required findings prior to the approval and issuance of a Coastal Development Permit. The project is located in the Appeal Jurisdiction of the California Coastal Commission as indicated on the Local Coastal Program Post Certification and Appeal Jurisdiction Map and, as such, is appealable to the California Coastal Commission under Section 30603(a) of the California Public Resources Code. The coastal development permit would include an after-the-fact demolition of a motel that was demolished circa 2012.

ITEM TITLE: REPORT ON THE IMPERIAL BEACH STORM WATER MANAGEMENT PROGRAM. (0770-90)
ORIGINATING DEPARTMENT:
Environmental & Natural Resources
EXECUTIVE SUMMARY:
The City of Imperial Beach implements a Storm Water Management Program that is required by the Municipal Storm Water Permit issued by the San Diego Regional Water Quality Control Board (RWQCB). This permit requires the City and other agencies in San Diego County to work together to implement plans and programs that aim to protect and improve the quality of receiving water from urban runoff pollution. The Environmental and Natural Resources Department is responsible for coordinating the program and ensuring that the City complies with the permit requirements.
Every department in the City plays a part in meeting the regulatory requirements of the permit.
The purpose of this staff report and presentation is to give Council an overview of the Storm Water Management Program in the City and how it supports the protection water quality at the local and regional levels. City staff will provide information about the watershed coordination efforts in the City, the main elements of the Jurisdictional Runoff Management Program (JRMP) in the City, and the extensive water quality monitoring programs related to the Permit.
RECOMMENDATION:
Receive report and presentation on the City’s Storm Water Management Program.
OPTIONS:

BACKGROUND/ANALYSIS:
Under the Municipal Storm Water Permit, the City of Imperial Beach is responsible for coordinating the development and implementation of Water Quality Improvement Plans (WQIPs) for the Tijuana River and San Diego Bay watersheds. These plans involve collaboration among "Copermittees," or responsible agencies, within each watershed. There are 12 agencies involved in the San Diego Bay WQIP and 3 in the Tijuana River WQIP. The watershed approach to storm water management aims to address water quality issues specific to each sub-watershed area and
P a g e | 2
allows the Copermittees greater flexibility in prioritizing storm water management efforts. Each city is expected to implement a set of baseline water quality improvement programs and additional, targeted efforts to address the most pressing water quality issues in their respective sub-watersheds.
The Imperial Beach Jurisdictional Runoff Management Program (JRMP Link to document) is the work plan that outlines the steps the City takes to protect water quality and reduce pollution to “the maximum extent practical”. The JRMP aims to improve water quality by organizing and describing the strategies that the City will use. The main components that make up the JRMP include:
Storm Water Code Enforcement: to proactively identify and eliminate illegal discharges to the storm water conveyance system
Development Planning: to require storm water engineering design conditions during the planning phase for any new public or private construction project Construction Management: to provide inspection and enforcement of storm water rules through the construction phase of projects
Existing Development: to implement, maintain, and inspect storm water BMPs at existing commercial businesses, residential areas, and municipal areas and activities under jurisdictional control
Education and Participation: to provide storm water education and opportunities to participate in community activities to residents, businesses, and municipal staff Water quality and bioassessment monitoring is another important and major component of the Regional Storm Water Permit. The City directly supports numerous monitoring programs that help inform WQIP priorities and activities to address storm water pollution. The Copermittees place a high standard on collecting and analyzing monitoring data because results are used by the RWQCB to enforce compliance and validate new regulatory changes to the Regional Storm Water Permit. The primary monitoring programs that are funded by the Copermittees include:
MS4 Outfall Monitoring: Water quality monitoring is conducted by each jurisdiction during both wet and dry weather conditions at storm drain outfalls to assess the loading of pollutants being discharged into receiving waters from different types of land use areas. Receiving Water Monitoring: Water quality monitoring is conducted by each watershed in select creeks and rivers throughout the county to track long-term trends in the quality of the receiving waters.
SMC Bioassessment: The Regional Bioassessment Monitoring Program involves the assessment of the ecological health of bodies of water such as streams, rivers, and bays.
To do this, biological assessments of aquatic insects are conducted, as well as toxicity analysis of sediment, which allows the identification of specific pollutants in storm water that can affect these biological indicators.
Regional Monitoring Special Studies: Each watershed conducts special monitoring studies to inform the adaptive management of storm water management programs. The Southern California Bight Regional Monitoring Program is an example of one of the major special studies supported by Copermittees to gather information on marine indicators in the bays, estuaries, and ocean from Point Conception to Punta Colonet. This information is used to adaptively manage storm water management programs in the Southern California Bight.

The implementation of storm water management programs requires support and staff time from every department and division in the City. The Environmental and Natural Resources Department coordinates the local JRMP program implementation, regional WQIP implementation, and reporting submittals to the RWQCB. Looking ahead to 2023, the RWQCB will be releasing a new Municipal Storm Water Permit that will require a comprehensive update to storm water management programs across the County. As a small jurisdiction, the City is able to leverage and adapt existing operation and maintenance programs and CIPs to not only meet the permit requirements of the State but also make Imperial Beach a more sustainable and resilient community. It is important for every department and division to work together and support the implementation of these programs in order to ensure compliance with the Municipal Storm Water Permit and improve the overall health of our waterways.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT:
The cost of implementing the City’s storm water program is covered under exiting department budgets and spread across the entire City because each Department and associated Division shares a role in implementing the components of each water quality improvement activity. The City is required to provide a Fiscal Analysis report each year to the RWQCB that summarize the CIty’s efforts in meeting the Permit. The storm water management program cost for FY22 reported to the State was $2,100,000 JRMP implementation, $17,000 for capital projects, and $800,000 for WQIP implementation.
