RESOLUTION NO. 2023-78
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IMPERIAL BEACH, CALIFORNIA,
ADOPTING AND RESTATING IN ITS ENTIRETY THE CITY OF IMPERIAL BEACH MASTER
FEE SCHEDULE AND REPEALING ALL PRIOR ENACTMENTS INCONSISTENT WITH THIS
RESOLUTION
WHEREAS, the City Council has determined that City staff provides many types of services involving requests by City customers (“Applicants”), and the City charges service fees, user fees, regulatory fees, and development-related fees (collectively “Fees”) upon Applicants to recover the costs of staff time, and other expenses related to providing these services; and
WHEREAS, current Fees charged for the City’s services do not adequately recoup the City’s costs of providing certain services and thus, a significant amount of these costs are currently paid out of the City’s general fund and, therefore, borne by the general public; and WHEREAS, the City Council finds that providing these services is of special benefit to Applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from Applicants who have sought the City’s services by revising its Master Fee Schedule; and
WHEREAS, the City desires to adjust certain fees up to the actual costs incurred to the City in providing these services and has conducted a study of such costs and fees by an independent consultant, NBS, who created the Comprehensive Master Fee Study dated June 26, 2023 (“Study”) which was presented to the City Council for review on August 2, 2023 and received and filed by the Council at that time; and
WHEREAS, California cities may impose user and regulatory fees for services and activities they provide through provisions set forth in the State Constitution, Article XIII C § 1.
Under this legal framework, a fee may not exceed the reasonable cost of providing the service or performing the activity. In this instance, the service or underlying action causing the City to perform the service is either discretionary and/or is subject to regulation. As a discretionary service or regulatory activity, the Fees considered in this Study fall outside of the definition and statutory requirement to impose general taxes, special taxes, and fees as a result of property ownership. Additionally, pursuant to California Constitution Article XIII C § 1 (e) (4) and (5), the City is not limited to the costs of service when charging for entrance to or use of government property, or when imposing fines and penalties; and WHEREAS, notice of this public hearing has been given pursuant to State law, and written notice has been provided to interested parties who filed written requests for mailed notice of meetings on new or increased development-related fees or service charges; and WHEREAS, the City Council conducted a duly noticed public hearing on October 4, 2023 at which time the public was invited to make oral and written presentations as part of the meeting prior to the adoption of this Resolution; and WHEREAS, not less than ten (10) days prior to the public hearing referenced above, the City made available for public inspection information required under Government Code Section 66000, et seq.; and

Resolution No. 2023-78
WHEREAS, the City published notice of the public hearing as described above in accordance with State law for the various fees specified in this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Imperial Beach as follows:
1. The above recitals are true and correct and are included herein as findings.
2. The City Council hereby adopts the Study and finds and determines that the existing, new or increased fees, rates, and charges established in Exhibit “A” to this Resolution are in an amount reasonably necessary to recover the costs of providing the service, review, document, facility, or commodity for which such fee, rate, or charge is levied or authorized to be levied. The fees proposed in Exhibit “A” will not exceed the estimated cost to provide the services.
3. Exhibit “A” is incorporated herein by reference and adopted as the City of Imperial Beach Master Fee Schedule.
4. The new rates, fees, and charges set forth in this Resolution shall become effective on January 1, 2024, for those related to Parks, Recreation, and Community Services, and March 1, 2024, for other rates, fees, and charges.
5. The City Council hereby repeals all prior enactments of fees or prior master fee schedules that are inconsistent with the Master Fee Schedule as stated in Exhibit “A” as of January 1, 2024, for rates, fees, and charges related to Parks, Recreation, and Community Services, and March 1, 2024, for all other rates, fees, and charges. As of January 1, 2024, for rates, fees, and charges related to Parks, Recreation, and Community Services, and March 1, 2024 for all other rates, fees, and charges as listed in Exhibit “A” will supersede and replace the prior adoption of the same fee. Any remaining fees that have not been modified in the adoption of this Master Fee Schedule from prior resolutions will remain in full force and effect.
6. The City Manager or designee is authorized to carry out all actions necessary to implement and collect the fees under the Master Fee Schedule. The Master Fee Schedule may be annually adjusted (increased) by CPI (CPI-U for San DiegoCarlsbad, CA) at the beginning of each fiscal year (July 1), effective July 1, 2025 but not to exceed the reasonable cost of providing the services as determined by City Staff based on a review of the factors in the report done each year.
7. The City Council hereby adopts the Parks, Recreation and Community Services categories stated in Exhibit “B” and repeals all prior enactments setting such categories.
