Dane Crosby supported the $250 cap.
Sean Franks supported the $250 cap.
Yvonne Vasquez opposed the $250 cap and supported $2,400 limit or something in that range.

Mayor Aguirre thanked everyone who came out to express their views, she thanked everyone who attended the ad hoc committee meetings, and she thanked Mayor Pro Tem McKay for his participation on the ad hoc committee. She supported her proposal because being closer to the sociodemographic cities that are similar to Imperial Beach is good and fair. For the mayoral race it should be a little more than for the City Council races. As for SB 1439 (Councilmembers having to recuse themselves if they have received contributions over $250), she said that not everybody has business before the City Council so they may want to contribute a little more.
Mayor Pro Tem McKay thanked Mayor Aguirre for her participation on the ad hoc committee, he recognized staff for their efforts, and thanked the residents for attending the workshops. He spoke in support for having a cap of $250 to match SB 1439.
Councilmember Leyba-Gonzalez was opposed to restricting someone from doing something based upon what they feel in their heart, and it isn't something City Council should dictate.
Councilmember Seabury spoke about her grassroots efforts when she ran for office and supported the $250 limit.
Councilmember Fisher commented that knocking on doors is how people win, not the money. He supported the $250 limit.
Mayor Aguirre agreed that door knocking wins elections. She also said that connecting to the people and demonstrating leadership also wins.

Sandra Brillhart said it is too early to decide on this service, elimination now would be a mistake, and it is a lifeline to those without transportation.
Jen Crumley was opposed to the elimination of the bus service. Such a move would disenfranchise low-income individuals and marginalized communities who heavily rely on public transportation. She also said that access to public transit is crucial for South Bay residents.
ATTACHMENT 1
8 Lenora Porcella spoke in opposition to the bus route. She also said that it is clear that there is no need for the route on 3rd Street and questioned why there would be a need on 9th Street. She was opposed to the extra noise, extra traffic, and the pollution.

Jarrod Caswell suggested the addition of one more bus to the two current routes. A lot of people agree that the buses should not go down residential neighborhoods. Ali Mariko Dressel, with Climate Action Campaign, said the rapid bus Route 227 is a critical transit route for local and regional connectivity and it plays an important role in climate action by lowering carbon emissions.
Rick Bates spoke in support of the Rapid 227. He spoke about how the bus line can provide added economic opportunity to local businesses on Seacoast, especially in the upcoming summer months. It also provides quicker and more direct shot to the trolley station than the other bus routes. He encouraged the City Council to recommend that MTS proactively engage with the public and educate them on the benefits of this new rapid transit bus line.
Encarnacion Sanchez (translated by Paulina Alvera) spoke in support of Rapid 227. She spoke in support of public transportation over having more cars. She also said that there are young people who use public transportation to get to school.

9 whether you can take a job or not. She also said that the line connects the communities of Imperial Beach, San Diego and the border area.

Paulina Olvera Canez spoke in support of Route 227. She spoke about the need for options for people to be able to travel to Imperial Beach and that it is too soon to pull the plug on this bus.
Jose Lopez spoke in support of Route 227. He said that having a bus route like 227 is a game changer and spoke of the need to make sure more people know about this bus, not get rid of it. Other options should be explored to make sure that we can keep the bus.
Lyle Pauuls spoke in support for keeping Route 227. He said that he has relied on public transit his whole life, and it is exceptionally important to not forget issues related to accessibility. He said there are so many people in this county who are disabled, and they deserve the right to be able to get rapid access to the beaches. He spoke in support of more marketing of the route to optimize ridership over the next couple of years and that rushing to eliminate a route is going to lead to further inequity.
Ilian Sandoval spoke in support of Route 227. He said that although ridership is low, this is something that's going to grow. More time is needed for the ridership to build up. He expressed concern about a group of people wanting to get rid of the route.

Carolina Martinez, with the Environmental Health Coalition, requested further analysis that considers the negative economic impacts of service removal.

Maria Cerda asked that Route 227 not be eliminated as families and students need the option to travel from Otay Mesa to Imperial Beach.

10 Written comments were submitted by:
Rose McGiff: Replace the larger busses with smaller shuttle busses. Large busses are destroying roads and too loud.
Bobby Douthit: Move route from 3rd Street to an option better suited for this kind of traffic.
Theresa Reel: Bus rider and advocate, is concerned about violence on buses; Keep the long bus 227, rerouting is an option and she is okay with changing it to 9th Street.
Connie Avila-Wehrly: Keep adding more public transportation as real estate developers keep adding more car traffic to our underdeveloped streets paid for by our tax dollars; Add more buses for Mother Earth and for the community.
Rosa Sandoval: In support of public transit and for keeping Rapid Route 227 Matthew Pendergraft: Suggested the frequency West of Iris Ave. could be reduced.
There would be more riders per bus (in IB) and less-frequent buses for residents and for riders.
Yvonne Vasquez: Knows many people who depend on bus services with many friends using the route in question and cannot afford to use private services. She is hopeful that the city is looking out for the citizens.
Sara Gonzalez-Quintero: The MTS Rapid 227 line is essential to our community.
Anna Webb: Opposed elimination of any form of public transportation including the 227 bus route.
Pat Flowers: Supported keeping the express Route 227. It is helpful to those who have to connect to the trolley at the Iris Street Station.
Connor Proctor: Supported the Rapid 227 bus route as it is a vital connection to the Blue trolley line.
Mayor Aguirre spoke about why the current transit system doesn't work for families, economy, health and environment. She spoke about her responsibility to bring the greater good for the highest number. She spoke of her support for public transit and the multiple benefits it brings. She said public transit is important because it provides the community with an alternative mode of transportation, especially for those who are transit dependent, such as the elderly, low-income families without a car, and different able residents. It also connects youth and young adults with job opportunities. She is proud to have supported youth opportunity passes so young low-income students 18 and under don't have to choose between their next meal and a bus pass.
In an effort to manage expectations, Councilmember Fisher explained that decisions will not be made tonight. The City Council will be providing direction to Councilmember LeybaGonzalez in an advisory role to bring back to the MTS Board. He expressed concern about safety on 3rd Street. Councilmember Leyba-Gonzalez agreed with Councilmember Fisher's comments regarding safety. He was hopeful that everyone can work together to resolve the issues and find solutions that can appeal to everyone. He was not in support of eliminating the route and he expressed concern about the length of the buses.
Mayor Pro Tem McKay spoke about the need for City Council, as the Planning Commission, to be made aware of these types of new routes and changes and that they need to be involved in the process up front. He also expressed concern about the size of the buses especially their turning radius in residential areas such as 3rd Street. He suggested procurement of 40-ft buses.
Mr. Desmond answered questions about opportunities to use other bus size options when MTS reviews ridership data and considers route changes, or service changes. He also spoke about the possibility of changes in bus frequency.
Councilmember Leyba-Gonzalez is in opposition to eliminating the route, he supported moving the rapid route to 9th Street or 13th Street, opposed to elimination of existing shelters and is in favor of implementing new shelters should the route go on 9th Street or 13th Street.
Mayor Pro Tem McKay is in opposition to eliminating the route, supports moving the route to 9th Street, no additional bus shelters, and those that are currently in place that aren't going to be used by the 227 should be removed. He would like regular updates on the ridership numbers and have an understanding when those reviews happen.
Councilmember Seabury spoke in support for rerouting 227 to 9th Street.
Mr. Desmond responded to questions from Mayor Aguirre regarding how long it takes for MTS to collect data before they make a decision on eliminating or keeping a bus route and the time comparison between the 933/934 and the 227.
Mayor Aguirre spoke about her personal struggles as a student with using public transit to commute from Imperial Beach to the University of San Diego. She said that when the beaches are reopened, there will be a large portion of visitors that will be lost if there is not a rapid bus route in Imperial Beach. She was sympathetic to the residents on 3rd Street and said there was a disconnect between the outreach that was expected by the City Council and City staff and what happened. She was open to looking at alternative routes such as 9th Street or 13th Street with shelters and is in opposition to eliminating the route.

She said that the Taxpayer Protection and Government Act, if approved, taxes and fees adopted after January 1, 2022, that do not comply with the new rules, are void unless reenacted. This means that the Imperial Beach Measure R (TOT) would need to go back to the voters within 12 months with specific language from this ballot measure or it would be void, an estimated loss of $400K to the City per year.
No public comments.
City Council discussion ensued. CalCites was recognized for their efforts in addressing matters that are important to cities. There was support for communicating information to constituents about how the Taxpayer Protection and Government Act would adversely affect the City. 11.a RESOLUTION NO. 2024-014 AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT WITH THE SAN DIEGO COUNTY AIR POLLUTION CONTROL DISTRICT FOR AIR MONITORING SENSORS. (0230-10)
CAO Cortez-Martinez introduced the item.
David Sodeman, Chief of the Monitoring & Technical Services at San Diego County Air Pollution Control District (SDCAPCD), gave a PowerPoint presentation.
No public comments
In response to questions of City Council, Mr. Sodeman stated that the SDCAPCD does not have authority of the Tijuana River Valley and the cross-border pollution matter because that falls under the federal government and it is Mexico's responsibility to fix that issue. They can, however, collect data, bring awareness to the issue, and put political pressure on on the federal government.
Mayor Aguirre commented that there exists, under OSHA standards, exposure of hydrogen sulfide and sulfur dioxide for wastewater treatment workers. She further stated that there needs to be standards developed for the general public, and that is something that the SDCAPCD can champion and bring forward to the California Air Pollution Control Board, which has local elected officials that represent this region on that board. She requested that the SDCAPCD and the California Air Pollution Control Board do more and that it is not acceptable to just say, there are no standards. She wants them to figure out how to how to create standards and how to issue notices of violation. She requested that a public outreach and education session be co-hosted in the City.

ITEM TITLE: PUBLIC HEARING ON RESOLUTION NO. 2024-015 OF THE CITY OF IMPERIAL
BEACH, CALIFORNIA ADJUSTING THE REGIONAL TRANSPORTATION CONGESTION IMPROVEMENT PLAN FEE FOR FISCAL YEAR 2024-2025. (o680-95) ORIGINATING DEPARTMENT:
Public Works
EXECUTIVE SUMMARY:
The TransNet Extension Ordinance Regional Transportation Congestion Improvement Plan (RTCIP) fee is a transportation mitigation fee collected by local jurisdictions to fund improvements to the regional arterial roadway system. Each year, the SANDAG Board of Directors (Board) may adjust the minimum fee charged. On February 23, 2024, the Board approved a 4.9 percent increase to the minimum RTCIP fee from $2,741.97 to $2,875.06 per dwelling unit. Resolution No. 2024-015, if adopted, will increase the minimum RTCIP fee to $2,875.06 beginning July 1, 2024.
RECOMMENDATION:
Adopt Resolution No. 2024-015 approving the increase in the RTCIP mitigation fee charged for each new residential dwelling unit constructed in Imperial Beach in Fiscal Year 2024-2025 from $2,741.97 to $2,875.06.
OPTIONS:
Adopt Resolution No. 2024-015 increasing the Transportation Mitigation Fee to $2,875.06; Request additional information and an additional report BACKGROUND/ANALYSIS:
In accordance with the TransNet Extension Ordinance and Expenditure Plan 04-01, the Imperial Beach City Council adopted Ordinance No. 2008-1067 to establish a transportation mitigation program to ease the regional transportation impacts of new development on the arterial roadway system. On March 19, 2008, the City Council adopted the Regional Transportation Congestion Improvement Plan (RTCIP) fee of $2,000 per new residential dwelling unit. The TransNet Extension Ordinance and Expenditure Plan 04-01 states that “the fee amount per residential unit shall be adjusted annually on July 1 of each year beginning July 1, 2009, based on the Engineering Construction Cost Index as published by the Engineering News Record or similar cost of construction index. Any increase shall not exceed the percentage increase set forth in the construction index. In no event, however, shall the increase be less than two percent per year.
The purpose of this annual adjustment is to retain purchasing power in anticipation of future inflation.
P a g e | 2
On March 7, 2024, a notice declaring a public hearing would be held at the March 20, 2024 City Council Meeting regarding raising the RTCIP fee 4.9% was published in the Eagle & Times – Imperial Beach/South County newspaper.
In recent years the fee has provided funding for a variety of improvements on State Route 75, including portions of the Bicentennial Park Improvement Project. Future funds are proposed to be allocated to improve traffic signal connectivity and pedestrian access improvements on or along State Route 75, which is the only City roadway included in the Regional Arterial System.
ENVIRONMENTAL DETERMINATION:
The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) on the State CEQA Guidelines.
FISCAL IMPACT:
Adoption of the fee adjustment will allow the City to recover costs that would otherwise be absorbed by the General Fund or diverted from other funds that could be used for other eligible projects. The increase of the fee by $133.09 per new dwelling unit will have a negligible fiscal impact on the City’s budget. This fee is designated for roadway capital improvements on or adjacent to State Route 75.

BACKGROUND/ANALYSIS:
On November 2, 2022, the City Council authorized a Memorandum of Understanding (MOU) between the City of Imperial Beach and Sweetwater Union High School District (SUHSD) for the use of the Mar Vista High School Aquatics Facility. The joint use agreement includes access to the pool by the community for lap swims and programs at various hours during the week and weekends which is being managed by the Parks, Recreation, and Community Services Department. The new MOU between the City of Imperial Beach and SUHSD includes open community swim time, youth and adult swim lessons, water fitness classes, and public safety personnel training.
The term of the MOU began on January 1, 2023, to June 30, 2024 with the option to renew the agreement for three (3) consecutive one (1) year renewal periods. Representatives from SUHSD and the City will meet at least every six (6) months to review the administration of the MOU. The MOU requires that the City contract with the County of San Diego to pay for the full costs of one full time School Resource Officer (SRO). Representatives from SUHSD and the City have a meeting scheduled to review the administration and costs of the MOU.
P a g e | 2
The community swim program started in October 2023 with lap swim lane rentals and in December 2023 grew to include swim lessons for both youth and adults. Adult lap swim pool lane rentals are currently held on Tuesday, Thursday and Friday from 5:30 am – 7:00 am, Saturday from 6:30 am – 8:00 am and Sunday during the open facility time from 9:00 am – 3:00 pm.
Per the MOU with SUHSD for use of the Mar Vista High School Aquatics Facility, the City of Imperial Beach is responsible for providing lifeguard services, swim instructors, water exercise teachers and city staff onsite during all hours of use for the community swim program. Since the City does not currently employ pool lifeguards, the city contracts with EXOS to provide lifeguard services, swim instructors, and water exercise teachers. The Imperial Beach Parks, Recreation and Community Services (PRCS) Department operates the registration, marketing, and collection of fees for the community swim program. The PRCS Department also opens and closes the aquatics facility and has staff onsite during all programming per the City’s agreement with SUHSD. SUHSD is responsible for the daily maintenance, utilities, pool chemicals and repairs of the aquatics facility.
At the January 17, 2023 City Council meeting Parks, Recreation and Community Services (PRCS) Department staff was directed to return with an update on the unique registered participant count and associated costs to the City to operate the Mar Vista Aquatics Facility community swim program.
During the months of October 2023 to February 2024, the PRCS Department with EXOS offered lap swim lane rentals and “learn to swim” classes for registered participants, ranging from six months of age to adults. Per the MOU, the City provides a full time School Resource Officer (SRO) at Mar Vista High School.
The community swim program is not a cost-neutral program but does provide the opportunity for residents of all ages and abilities in Imperial Beach to take learn to swim classes and have opportunities for low impact physical activity.
