ITEM TITLE: DISCUSSION ON ENERGY SERVICE PROJECTS INCLUDING SOLAR AND ELECTRIC VEHICLE CHARGING INFRASTRUCTURE AT CITY FACILITIES (0230-20) ORIGINATING DEPARTMENT:

Environmental & Natural Resources
EXECUTIVE SUMMARY:

On January 17, 2024, the City Council approved Resolution No. 2024-003, authorizing a Professional Services Agreement with Willdan Energy Solutions. This agreement is for the development of energy efficiency and generation projects at City facilities. State law empowers local agencies to engage energy services consultants to oversee the entire lifecycle of such projects–from design and engineering to procurement, construction, and installation, provided they yield operational cost savings. Over the past six months, Willdan has worked with City Staff to evaluate projects, operational costs savings, and financing mechanisms. Willdan has now completed its assessment of various energy-related projects that would yield operational cost savings for the City. Before proceeding any further, the City Council should review and consider the assessment of the projects and the financing options available. The financing options include entering into a tax-exempt lease purchase agreement, exploring other financing methods, or deciding not to proceed with implementation at this time.

RECOMMENDATION:

The City Council should receive, review, and consider the list of the energy service-related projects and provide direction to the City Manager to either proceed with the development of specific projects or not proceed at this time. If the City Council decides to move forward with implementation, direction will need to be given to the City Manager to engage with a financial advisor to determine the best financing method that aligns with the City’s goals.

OPTIONS:
 Provide direction to the City Manager to proceed with the one or a combination of energy service-related projects; or
 Request additional information and return at a future meeting; or  Provide direction to the City Manager not to proceed with any energy service-related projects – (No project option); or
 Provide direction to the City Manager.

BACKGROUND/ANALYSIS:

The City of Imperial Beach’s Climate Action Plan (CAP) outlines several strategies to reduce greenhouse gas emissions, which serve as the foundation for evaluating energy service-related projects. Key CAP strategies include the development of community-wide electric vehicle

Page 26 of 40 ends

P a g e | 2
charging infrastructure (Strategy T-1), implementation of a clean municipal fleet (Strategy T-2), and exploring opportunities to install solar energy systems at public facilities and parking lots (Strategy E-2) by 2030. Additionally, the California Advanced Clean Fleet rule mandates municipal agencies to electrify their operations.

Willdan conducted an investment grade audit to identify costs, scope of work, and cost savings associated with each energy-related project. City staff collaborated with Willdan to assess the feasibility of implementing the following energy service-related projects:

1. Solar installation at City Hall, Sports Park, and Public Works

2. Emergency backup power with battery storage at City Hall

3. Electric vehicle (EV) charging infrastructure

4. Replacement of MUSCO lights at Sports Park with LEDs

5. Replacement of bollard lights at Veterans Park with LEDs Willdan provided a comprehensive financial analysis that considered construction costs, operational savings, and financial incentives, including SDGE Power-Your-Drive rebates, benefits of Net Energy Metering (NEM) 2.0, and tax credits under the Inflation Reduction Act (IRA). Based on this analysis, the proposed projects have been narrowed down for City Council’s consideration, allowing for the implementation of projects that would yield operational cost savings for the City.

Pricing will be further refined once subcontractors are engaged and bids are received. The pricing shown represents rough order of magnitude pricing (ROM), plus or minus 10%.

Preliminary Energy Savings and Estimated Project Costs:

1. Civic Center - $1,822,000
 Solar installation at City Hall
 2 Level-2 EV charging stations and 4 make ready infrastructure, limited to the minimum required by California Building Code for new solar projects

2. Sports Park - $821,000
 Solar instantiation at Sports Park
 2 Level-2 EV charging stations and 4 make ready infrastructure, limited to the minimum required by California Building Code for new solar projects

3. Veterans Park - $273,000
 Replace existing light bollards with LED overhead lights

4. Sports Park LED Musco Lighting - $863,000
 LED lighting upgrades at MUSCO Sports Park Ballfield

5. Public Works - $250,000
 2 Level-2 EV charging stations and 6 make ready infrastructure, including SDGE Power-Your-Drive grant support
The Investment Grade Audit conducted by Willdan indicates that all the above options can be implemented under State law (Government Code sections 4217.10-4217.18), allowing the City to construct energy efficiency and energy generation projects using projected energy cost savings to cover the expenses. The greatest financial benefit is achieved by implementing solar projects that secure NEM 2.0 rates and take full advantage of IRA tax credits. However, additional work, while important as capital investments in the City, would reduce the cost-benefit ratio, resulting in less savings.

P a g e | 3
The City Council is being asked to consider the benefits of implementing energy efficiency projects that would lead to operational cost savings and to determine the preferred financing method for these projects. With approval and authorization from the City Council, Willdan would prepare design plans and specifications, identify financing options, bid the project, and hire contractors to construct the energy improvements for the City. Given the City’s preference not to use capital reserves or incur debt through a traditional loan, the most viable financing option is a tax-exempt lease purchase agreement (TELP), also known as a municipal lease. This financing method allows public entities to fund energy efficiency upgrades using the City’s operation and maintenance budget, which is cost-effective and aligns with the City’s goal of covering financing costs through energy savings from operating expenses. Unlike traditional loans, TELPs include a non-appropriation clause and do not offer options to buy, renew, or return the equipment at the end of the lease. They are commonly used to finance performance contracting and energy conservation projects, enabling the City to own the assets after the lease term ends.

Additional financing options are available if the City Council is open to financing this project through a traditional loan.

ENVIRONMENTAL DETERMINATION:

Not a project as defined by CEQA.

FISCAL IMPACT:

Upon direction from City Council, staff would consult with a financial advisor to determine the best financing method that meets the needs of the City. The intent of this project is to ensure that any cost to the City would be offset by the cost savings provided by implementing these projects. The contract with Willdan was structured such that the costs for services to perform the investment– grade audit ($25,000) would only be charged to the City if the City decides not to proceed with the implementation of any of the potential projects. Otherwise, if the City does eventually enter into a performance contract for the energy services project implementation, then the investment– grade audit fee would be incorporated into the future performance contract costs.

ITEM TITLE: RESO. 2024-064 REQUIRING IMMEDIATE ACTION FROM SANDAG TO

CREATE A LONG-TERM ENVIRONMENTAL MITIGATION FUND FROM THE OTAY MESA

EAST PORT OF ENTRY TO MITIGATE POLLUTION IMPACTS FROM TRANSBOUNDARY SEWAGE FLOWS FROM THE TIJUANA RIVER VALLEY.(0150-40 & 0210-26) ORIGINATING DEPARTMENT:

City Manager
EXECUTIVE SUMMARY:

The California State Route 11/Otay Mesa East Port of Entry (OME POE) project, managed by the San Diego Association of Governments (SANDAG), proposes to create a new, modern land port of entry for the San Diego-Baja California region. However, negative environmental impacts continue to grow affecting the daily quality of life for residents near the U.S. Southwestern Border.

The ongoing degradation of environmental and public health conditions represents unacceptable and untenable living conditions for Imperial Beach and adjacent communities. At the August 21, 2024, City Council meeting, the City Council requested the preparation of a resolution demanding the creation of a long-term Tijuana River Valley Mitigation Fund and Management Board. This fund, financed by revenues generated by the opening and on-going management of the OME POE, would be dedicated to the mitigation and restoration of the Tijuana River Valley and adjoining lands for the long-term benefit of Imperial Beach residents and neighboring areas.

Resolution No. 2024-064 requests immediate action from SANDAG to establish this long-term mitigation fund from the California State Route 11/Otay Mesa East Port of Entry project and provides authorization for a letter to be sent to California State representatives requesting legislative amendments to support this initiative.

RECOMMENDATION:

That the City Council adopt Resolution No. 2024-064 (Attachment 1) to request immediate action from SANDAG to establish a long-term Tijuana River Valley Mitigation Fund and Management Board for the California State Route 11/Otay Mesa East Port of Entry project and to send a letter to California State representatives requesting legislative amendments necessary to facilitate the creation of the fund.

OPTIONS:
 Adopt Resolution 2024-064; or
 Adopt Resolution 2024-064 with modifications; or
 Reject Resolution; or
 Request additional information and an additional report.

BACKGROUND/ANALYSIS:

At the August 21, 2024, City Council meeting, the City Council received a presentation from the San Diego Association of Governments (SANDAG) on the California State Route 11 (SR 11)/Otay Mesa East Port of Entry project (OME POE). The OME POE project proposes to create a new, modern land port of entry for the San Diego-Baja California region. Using state-of-art technologies, the OME POE is intended to improve mobility and air quality in the border region, while fostering economic growth and binational trade. The project includes a new four-lane toll road along SR 11, connecting directly to the OME POE, and a commercial vehicle enforcement facility. This is a joint venture between SANDAG and Caltrans, in collaboration with state and federal partners in the U.S. and Mexico.

Mexico is California’s number one trading partner, driving commerce and economic opportunity throughout the San Diego-Baja California binational region. The OME POE, complemented by Mesa de Otay II Port of Entry on the Mexican side, is expected to reduce border crossing wait times by providing a relief valve across the other San Diego land ports of entry. The 2021 Regional Plan includes strategies, transportation services, and technology solutions to improve travel times to and through the new POE.

Following the presentation, the City Council discussed the negative environmental and public health impacts associated with transboundary pollution. Concerns were raised about the expansion and intensification of border activities, transportation, and construction along the border, which could exacerbate transboundary pollution and sewage flows affecting the border and adjacent communities.

The City Council also discussed the legislative tolling setup for the OME POE. California State legislation designates the SANDAG Board of Directors as the toll authority (Attachment 2 - Senate Bill 1486 – Otay Mesa East Toll Facility Act). The toll authority establishes the rates of the tolls, based on a traffic and revenue study. The City Council requested that a fee be established from these toll revenues, earmarked for transboundary mitigation, specifically for wastewater infrastructure and related projects within the United States to address the sewage crisis. The Council was informed that establishing such an earmark would require a modification to legislation to allow for broader authority for use of the collected fees.

The City Council directed staff to prepare a resolution demanding that SANDAG establish a longterm Tijuana River Valley Mitigation Fund and Management Board, based on revenues generated by the opening and management of OME POE. These funds would be dedicated to mitigating and restoring the Tijuana River Valley and adjoining lands for the long-term benefit of the residents of Imperial Beach and neighboring areas. Additionally, the City Council authorized the preparation of a letter that would be sent to California State representatives requesting legislative amendments to allow for a long-term mitigation fund from the revenues generated by OME POE to be ear-marked for mitigation and restoration of the Tijuana River Valley and adjoining lands by way of wastewater infrastructure and related projects to address the sewage crisis and benefit of the residents of Imperial Beach and neighboring areas.

Resolution No. 2024-064 requests immediate action from SANDAG to establish a long-term Tijuana River Valley Mitigation Fund and Management Board, funded by the California State Route 11/Otay Mesa East Port of Entry. The resolution also authorizes sending a letter to California State representatives, requesting legislative amendments to facilitate this action.

AMENDED IN SENATE  APRIL 9, 2008
INTRODUCED BY   Senator Ducheny
(Coauthor: Senator Kehoe)
(Coauthor: Assembly Member Salas)
FEBRUARY 21, 2008
An act to add Chapter 7 (commencing with Section 31460) to Division 17 of the Streets and Highways Code, relating to transportation.

LEGISLATIVE COUNSEL'S DIGEST
SB 1486, Ducheny. Otay Mesa East Toll Facility Act.

Existing law authorizes regional transportation agencies, in cooperation with the Department of Transportation, to apply to the California Transportation Commission to develop and operate a value pricing program with high‐occupancy toll (HOT) lanes, under which single‐occupant vehicles may use designated high‐occupancy vehicle lanes at certain times of day upon obtaining a permit and paying a fee. Existing law authorizes the San Diego Association of Governments (SANDAG) to conduct, administer, and operate a value pricing and transit development demonstration program on a maximum of 2 transportation corridors in San Diego County.

This bill would enact the Otay Mesa East Toll Facility Act, which would authorize SANDAG to, among other things, solicit and accept grants of funds and to enter into contracts and agreements for the purpose of establishing highway toll projects to facilitate the movement of goods and people along the State Route 11 corridor in the County of San Diego or at the Otay Mesa East Port of Entry. The bill would provide SANDAG with various additional powers and duties, including, among others, authorizing SANDAG to issue bonds for the acquisition, construction, and completion of transportation facilities and to impose tolls and user fees for the use of the corridor, as defined. The bill would require toll revenues from the Otay Mesa toll facility project to be used to pay for specified costs, including, but not limited to, repaying bonds, the cost to SANDAG for operating the project, and the cost for capital improvements, pursuant to an expenditure plan, as specified. The bill would authorize SANDAG to enter into agreements with the County of San Diego or a city within that county to accept development impact fees for the construction of, and reimbursement for construction of, improvements in the county or city.

Because the bill would impose additional duties on local governmental agencies, the bill would impose a state‐mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1.  Chapter 7 (commencing with Section 31460) is added to Division 17 of the Streets and Highways Code, to read:

31460.  The Legislature finds and declares all of the following:
(a) It is essential for the economic well‐being of San Diego County and for the maintenance of a high quality of life that the people of the State of California receive the full benefits of international trade with Mexico.
(b) Trade is the fastest expanding component of the San Diego regional economy. Mexico is the United States' third largest trading partner, after Canada and China, and California's number one export market.
(c) Trade passing through San Diego County's portion of the United States‐Mexico border region benefits every state in the union and contributes heavily to the nation's trade with the countries of the Pacific Rim.
(d) Commercial traffic between the United States and Mexico using California's ports of entry is placing extreme demands on the state's border transportation assets which were not designed for these purposes.
(e) Congestion at the border causes increased wait times, which in turn increases commercial and noncommercial vehicle emissions. (f) Inadequate infrastructure capacity at the existing border crossings between San Diego County and Baja California currently creates traffic congestion and delays for crossborder personal trips and freight movements that cost the United States and Mexican economies an estimated $7.2 billion in foregone gross output and more than 62,000 jobs in 2007.
(g) Public revenues to provide for an efficient border region transportation system have not kept pace with the growth of traffic and goods crossing the international border with Mexico. (h) The state must seek all reasonable alternatives to address unmet border transportation needs and to improve existing transportation facilities.
(i) Public toll transportation facilities should be encouraged to supplement limited public resources and to support the development of new transportation system capacity.
31461.  This chapter may be cited as the Otay Mesa East Toll Facility Act. All references to the "act" in this chapter shall mean the Otay Mesa East Toll Facility Act.

bonds and any repayment or reimbursement obligations of SANDAG to any provider of bond insurance or letter of credit or line of credit facility determined to be appropriate by SANDAG to provide for the payment of debt service on any bonds of SANDAG, and the state hereby pledges to, and agrees with, the holders of bonds that the state will not limit, alter, or restrict the rights hereby vested in SANDAG to fulfill each pledge of revenues and any other terms of any agreement made with or for the benefit of the holders of bonds or in any way impair the rights or remedies of the holders of the bonds or the providers of bond insurance or letter of credit or line of credit facilities.
(g) Do all acts necessary and convenient for the full exercise of the powers granted in this chapter.
31467.  (a) Highway projects constructed pursuant to the act shall, at all times following construction, be owned by the department. International port of entry facilities constructed pursuant to the act shall, at all times following construction, be owned by a federal agency. All other property and facilities constructed pursuant to this chapter shall be owned by SANDAG, unless transferred to a state or federal agency upon agreement between SANDAG and the relevant agency.

The agreements entered into pursuant to this section shall be consistent with agreements between the department and the United States Department of Transportation relating to a project and may include procedures for enforcement by the Department of the California Highway Patrol.
(f) Any project utilizing the department's services shall be included in the department's capital outlay support program for workload purposes.
31468.  (a) The Legislature has recognized the merits of alternative project delivery methods such as the design‐build procurement process in the past by authorizing its use for projects undertaken by school districts, the University of California, specified local government projects, state office buildings, and public transit projects.
(b) It is the intent of the Legislature to provide optional, alternative procedures for bidding and building the international port of entry facility and ancillary border crossing projects pursuant to this act. SANDAG may utilize an alternative project delivery method authorized in this section on the international port of entry facility and ancillary border crossing projects, after evaluation of the traditional design, bid, and build process of construction and of the design‐build process in a public meeting, the governing board makes written findings that use of an alternative project delivery method on the specific project under consideration will accomplish at least one of the following objectives: reduce comparable project costs, expedite a project's completion, or provide features not achievable through the traditional design‐bid‐build method.
(c) SANDAG may utilize the following alternative project delivery methods if the conditions in this section are met:
(1) Design‐build.
(2) Design sequencing.
(d) If the conditions in this section for utilizing an
alternative delivery method are not met, SANDAG shall use the SB 1486 Senate Bill - CHAPTERED http://www.leginfo.ca.gov/pub/07-08/bill/sen/sb_1451-1500/sb_1486_bi... 4 of 7 8/29/2024, 10:38 AM

design‐bid‐build delivery method for construction of a project. (e) It is the intent of the Legislature that alternative project delivery methods as authorized in this section shall not be construed to extend, limit, or change in any manner the legal responsibility of public agencies and contractors to comply with existing laws. 31472.  This chapter does not authorize SANDAG or the department to do either of the following:
(a) Lease or otherwise convey a toll road to a private‐sector entity.
(b) Convert any existing nontoll or non‐user‐fee highway lane into a tolled or user‐fee highway lane.
31473.  (a)  The cities and county in the San Diego region are authorized and empowered to lease, lend, grant, or convey to SANDAG at its request upon such terms and conditions as the city or county considers reasonable and fair and without the necessity for any advertisement, order of court, or other action of formality, other than the regular and formal action of the governing body of the cities or county, any real property that may be necessary or convenient to the effectuation of the authorized purposes of SANDAG, including public highways and other real property already devoted to public use.
(b) If a reasonable price cannot be agreed upon, or if the owner is legally incapacitated, absent, unknown, or unable to convey valid title, SANDAG is hereby authorized and empowered to acquire by condemnation or by the exercise of the power of eminent domain any lands, property, rights, rights‐of‐way, easements, and other property, including highways or parkways, or parts thereof or rights therein, of any person, copartnership, association, railroad, public service, public utility or other corporation, municipality, or political subdivision considered necessary or convenient for the construction, repair, or improvement or the efficient operation of a project or necessary in restoration of public or private property damaged or destroyed, but not including any of the rights of any franchisee, lessee, or owner of airspace rights in the demonstration toll road project known as State Route 125 in the County of San Diego.
(c) Any proceedings pursuant to subdivision (b) shall be conducted in accordance with and subject to the relocation assistance guidelines in Chapter 16 (commencing with Section 7260) of Division 7 of Title 1 of the Government Code. Title to any property acquired by SANDAG shall be taken in the name of SANDAG or the department. (d) If the owner, lessee, or occupier of any property to be condemned refuses to remove his or her personal property from the property or give up possession of the property, SANDAG may proceed to obtain possession in any manner now or hereafter provided by law. 31474.  (a) SANDAG may only impose tolls and user fees for the use of the corridor.
(b) Within two years following the opening of a tolled project by SANDAG and at least biennially thereafter, SANDAG shall review the adequacy of the toll rates established to cover the costs of the project. The board shall make available any proposed revisions to toll rates to the public no less than 30 days prior to adoption by the board as described in subdivision (a) of Section 31476. (c) SANDAG's toll structure may include discounts and premiums to encourage efficient use of tolled projects and reduction of congestion and emission of greenhouse gases, including, without limitation, discounts for high‐occupancy vehicles, electronic toll collection, and off‐peak travel, and premiums for on‐peak travel. (d) SANDAG's toll structure may include adjustments to toll rates to reflect economic factors, including, but not limited to, the Consumer Price Index or other cost indices.
31475.  (a) Toll revenues from a project may be used to reimburse or finance the costs of state agencies and federal agencies incurred in connection with the implementation or operation of a project, including reimbursement of federal funds specifically allocated to SANDAG for a project by the federal government or other funds from funding sources that are not otherwise available to state agencies for transportation‐related projects. SANDAG shall be reimbursed for administrative costs in an amount that shall not exceed 3 percent of project revenues.
(b) Toll revenues shall be used to pay for costs in the categories below in the following priority:
