With some federal agencies in Washington attempting to ban “identity months” such as Black History Month, it is especially important for local governments to publicly recognize and celebrate the contributions of African Americans to our society. Perhaps in the future, the City can hold some educational community events to make these proclamations even more meaningful. Diversity is something we should all be proud of and learn from, so I sincerely hope you will approve this Proclamation.

Respectfully,
Sandy Brillhart

It is unfortunate that this was not passed as an emergency ordinance when it was first introduced, as it could have helped some of our vulnerable neighbors, but I hope you will adopt it tonight to hopefully help others who face evictions for remodels and no fault of their own.

knowing what will and won't be audible to us and no one can control speeches, singing, laughing, yelling, dancing. 73 or more people will not make any noise? Where did the 65 decibel limit come from? They want this recorded music 3 x per week which is 156 events per year !!! My guess is that they are talking about a DJ playing recorded music. This raises lots of noise questions. Recorded music 3 x week with dozens and dozens and dozens of people and we won’t hear it? This is not realistic and this request should be denied. The roof is open; I can hear people in normal conversation who come up there to look around & the people who water the plants.

C. Restaurant-Style Ambient Music (inaudible beyond property line) - they want this daily.

That remains to be seen if we would hear it. Will amplification for the “ambient music” be inside? Ambient music should not play onto the roof which is totally uncovered & wide open.

D. Even events without music can cause a great disturbance. Lots of people make lots of noise.

Any permit should be temporary and subject to changes as needed if the community is negatively impacted as it most certainly will be.

WHAT KIND OF REMEDY DO WE HAVE IN THE COMMUNITY WHEN NOISE VIOLATIONS OCCUR AND OUR PEACE IS DISTURBED? Do we call the Sheriff and interrupt the events? Noise complaints & court hearings? Flood City Council with calls? OR will the Applicant have an on-site manager and contact person? This is crucial.

This Applicant, in my opinion, duped the community years ago in obtaining the permit to build this ugly project in that the representations they made throughout their lengthy application mentioned that the rooftop deck would be a “public amenity” for everyone to enjoy, “sunset viewing”, etc. Clearly, they never actually intended that. Not once in meetings with members of the community did they mention that they would need a noise permit / CUP for a live music party deck. In fact they indicated their intention to comply with local noise ordinances. (Initial agenda page 114).

How much more is our community supposed to sacrifice so this Applicant can turn a profit while we suffer diminishing quality of life? Anyone who wishes to view their statements in their initial application Agenda can easily do so (Agenda pages 96, 114, 117). “The Applicant intends for the commercial tenant spaces to be occupied by restaurants and an open roof deck area that would be provided as an amenity to serve the community.”

Page 96 ends

We were obviously wrong to believe them.

City Council members are urged to come out here and see how negatively granting the permit will impact numerous residents. This project is surrounded by residents on all sides even Seacoast and Ocean Lane to the west. Would you want live music next door to you or directly above your front door? Do you want party goers looking onto your deck and into your living room? Please put the well being of the community residents ahead of the needs of an absentee landlord/private developer.

How convenient for this Applicant that they waited until after the monster building was constructed to reveal their true intentions as to the rooftop deck. Shame on them. a.2 02/19/2025 Item No. 10.a

All,
Regarding the pending CUP for the commercial development at 951 Seacoast Drive, I have a few comments that are relevant to all the people living adjacent to that property.

On paper, this looks okay at first glance. Fairly reasonable, except for a few problems most of us anticipate having to deal with:
1) Under the category of Recorded Music, it says the music will be inaudible beyond property line. Obviously, that would be fine. But the language used rather implies a DJ three days/nights per week. Below that, ambient restaurant music is a separate category, which implies this is more than that. It mentions the use of microphones, suggesting a DJ. Now, anyone with three functioning synapses can tell you a DJ set up is always much louder than 65 dBs, including some loud crowd work. So I am doubting the honesty of that language. (We have good reason to doubt the owners, since they’ve shown residents little more than contempt) 2) Per live music events, the range of operating times isn’t a problem on its face, but if we’re going to get blasted for 11 hours on Saturdays, there’s going to be a LOT of complaints. Within that range, I would suggest a maximum length of the event. Say, 4-5 hours. That’s what they allegedly have for Pier Plaza. Across town, Novo Brewing’s event space faces the bay (not residences), yet they have far more stringent restrictions on events. 3) Lastly, there’s the question of enforcement of city codes. If they violate the CUP, the only real option for addressing a problem is the Sheriffs Dept. Do we have your word they will follow the law? During business hours M-Th, we can obviously contact you all. I suppose my question is, will we have a reasonable expectation that problems will be addressed? Given all the various failures of government happening around us today, it’s a perfectly reasonable question. So how willing is the City going to be to address issues that arise? That’s it.

Thanks for your time and have a great day,
Rick Emilson

To whom it may concern,
I've lived in Imperial Beach for a few years now, and would love to see more locations available for social and community events, especially those along Seacoast and in view of our iconic pier.

I urge the passing CUP Application USE-24-0029, which seeks to allow live entertainment and events on the roof deck of the new building at 951 Seacoast Drive.

It seems that the applicant's reasonable restrictions will help ensure the neighborhood is well protected from noise, may encourage increased commercial activity in the area, and visitor interest.

Thank you for your attention to this matter.

Best, Jill Derickson

Dear City of Imperial Beach Community Development Department, I am writing in support of CUP Application USE-24-0029, which proposes live entertainment and events on the roof deck of the building at 951 Seacoast Drive. This project will provide a unique space for community gatherings, ranging from birthday celebrations to wedding ceremonies, and will allow residents to enjoy stunning views. Its location near Pier Plazaalready a hub of activity-ensures that the area remains vibrant without disrupting a quiet residential environment. Additionally, the applicant's sensible restrictions on event numbers and hours offer necessary protection against potential noise issues.

Thank you for your time and thoughtful consideration of this project. ---

Dear IB Community Development Department,
I'm writing to say how excited I am about CUP Application USE-24-0029! The idea of hosting live events on the roof deck at 951 Seacoast Drive is fantastic. It will give us a great new spot for bi1ihdays, baby showers, and more, with amazing views to enjoy. I love that the event limits are logical, keeping eve1ything under control while still being fun and lively.

Being right across from Pier Plaza, it's perfectly placed for attracting visitors and boosting local businesses.

Thanks for considering my suppo1i!
Cheers,

Hello City of IB,
I wanted to share my enthusiastic support for CUP Application USE-24-0029. Allowing live entertainment and events on the roof deck at 951 Seacoast Drive would be an incredible addition to our community.

Being directly across the street from Pier Plaza, this location is ideal for an event space, as it is already the hub of festive events and community gatherings. The area is a commercial zone, surrounded by similar establishments like the hotel and various restaurants. This isn't a quiet residential neighborhood—it's a vibrant area that already experiences a lively atmosphere due to the many events held at Pier Plaza.

Creating a venue like this would enhance the community by providing a beautiful gathering place, increasing opportunities for social events, and giving residents and visitors a chance to enjoy breathtaking views. It would add to the vibrancy of the area, supporting local businesses and making Imperial Beach an even more attractive destination.

On a personal note, I genuinely believe that a project like this would be a fantastic addition to Imperial Beach. I’m excited about the possibilities it could bring to our community.

Thank you for the time and thoughtful consideration for this project. I truly believe it would benefit our neighborhood and enhance our community’s social and cultural landscape.

Best regards,

Dear City Council Members,
I am writing with regards to the live entertainment proposal for the roof deck at 951 Seacoast Drive. My partner and I reside next door at 933 Seacoast and would not like to see this permit granted for the following reasons.

Sound carries throughout this area. It would not be possible for the sound to stop at the property line. Since there are many buildings built in close proximity, we have noticed that sounds often echo from building to building and are amplified into our living room. We would be subject to any music (live or through speaker) in our living room and bedroom with no choice but to bear it. We have already experienced sounds that invade our space from street performers at the pier (who do not amplify) and even restaurants down the street. A rooftop venue next door would definitely intrude in our personal space and would perhaps be the loudest sound source for us.

Unfortunately, these sounds drown out the main attraction of the area, the ocean. We were intentional when moving here as we both love living by the sea. One of our favorite things is to open our windows to the sea breeze and listen to the calming rhythm of the waves. With the new sound permit next door, we would not only be unable to hear the ocean, but would also have our apartment filled with music we haven’t chosen.

We are both working professionals. I am an elementary school teacher while my partner is a software engineer who works from home. We both need quiet environments throughout the day, Because my partner Steven uses our home as his office, continuous loud noises are not preferred. I also go to bed around 8 or 9 each night and wake up early for work. I fear that granting this permit will disturb my sleep with restaurant style ambient music and my partner’s work schedule with music playing virtually all the time.

We are also planning to start our family soon. When we moved here, we moved into a relatively sleepy beach neighborhood and would like for it to remain so. We are excited to start our family but would be disappointed in seeing sound pollution affect our personal lives so much, including the sleep schedule of a newborn child.

Thank you for your time and consideration.

Sincerely,
Gizelle O’Loughlin

THIS COMMUNICATION IS INTENDED TO BE READ BY COUNCIL MEMBERS

BEFORE VOTING ON THIS AGENDA ITEM, AND TO BE MADE PART OF THE

PUBLIC RECORD ON THIS AGENDA ITEM
Honorable Mayor, City Councilpersons, and Staff;
I have a few clarification questions and suggestions regarding the above project. The proposal as outlined in t
his Agenda item, is somewhat confusing. This is apparently for the roof deck area only.

1. First, is a restaurant contemplated on the roof deck? It was initially presented as an open area with no mention of a restaurant.

2. IA. provides for a limit of 8 days per year, but incorporates lB, but should inco1porate and/or be subject to the provisions of 2A and B.

3. Recorded music can be as loud or louder than live ente1iainment. I don't know what 65 decibels sounds like or how it is measured.

4. I do not know what "restaurant-style ambient music" means and should be defined, but again is it live, recorded, or? how is it measured?

5. Allowable Event Times. This section conflicts with the wording on the first paii. It allows live music at times the same as recorded music. And I believe the time restrictions should be the same to avoid confusion - until 7 :00 p.m. any day/time permitted. This would allow for the additional clean up time. Also, a provision should be added to extend that time for 1 of the 8 times per yeai· upon application to the City Manager.

Thank you for your service and cooperation with t
his matter.

Dear Council,
As someone who recently helped my son and soon to be daughter-in-law find a wedding venue in San Diego, I know how difficult it can be to find an available space, especially one with ocean views. This location in Imperial Beach looks amazing and I hope it gets approved to host weddings and other family gatherings so more people can enjoy those views.

I support this CUP. Thank you for your consideration.

The developer stated at the original meet up with the local community and Tyler Foltz saying ,the roof top would be a restaurant style with the best views in town. and confirm this to city council. Now they want to turn it into private events with music.

The city council gave them a CUP for this project. No parking on the property not even a handicap parking space. And voted to break the once sacred height limit , that a city ordinance the law of the people, by some kind of legal loophole. Maybe legal but I see it as completely Morally wrong. And a very dangerous precedent for the future.

Now they want more, Another conditional use permit for live music.

This will effect many peoples quality of life. even if it was one person that would be one too many.

This will affect all the wildlife mostly the birds in the area, there are many studies about this but after hearing the noise they will leave the area and not come back.

There were many complaints about the music at Mike Hess ,Tepic, and Luieges --The music did not work for the residents in the surrounding areas And yes there are many residents southwest south east and north of this project. k.1 02/19/2025 Item No. 10.a

There are so many things wrong with this.

Yes the developer will do fine without live music. He has been giving a large gift with no Parking and breaking the height limit, now he is just getting over the top greedy wanting to pollute are small

All of the council and planners are behind the imperial beach mission statement Maintain a small town atmosphere ,at night time noise in our neighborhood will affect quality of life, including mental and physical health.
