Cheryl Quinones recommended that City Council consider appointing a former councilmember or candidate immediately. She supported the appointment of Councilmember McKay.

Karl Bradley was opposed to the City Council making an appointment at the meeting. He feared the City Council’s conservative majority appointing someone may not reflect the City's voters. He advocated for a special election to ensure democratic representation.

David Nearing urged City Council to move forward with an appointment and recommended appointment of Councilmember McKay.

Shirley Nakawatase recommended appointing an existing Councilmember to avoid the cost of an election. She expressed support for Councilmember McKay but stated she would support the appointment of any sitting Councilmember.

She highlighted the need for strong leadership due to ongoing issues like the sewage crisis and upcoming economic challenges and encouraged the City Council to take the time needed to make the right decision.

Councilmember Fisher acknowledged the tough decision that City Council faced and emphasized that disagreements are natural in governance. The City Manager handles the day-to-day operations, and the City Council’s role is to make balanced decisions despite limited funds. He expressed concern about spending money on an election that would only fill a short term position, potentially cutting important City programs. He spoke in support for appointing someone already familiar with City Council’s work to avoid costs and disruption.

Mayor Pro Tem Seabury nominated Councilmember McKay to be appointed as Mayor, citing his availability as a retiree, his deep local ties, his understanding of key City issues like sewage and business impact, and the impracticality and cost of a special election.

Councilmember McKay accepted the nomination to become mayor. He said that he has been a resident of the area for 60+ years (South Bay, Nestor, Imperial Beach) and has deep community ties. He is honest and transparent about his background and reputation. ITEM TITLE: RESOLUTION 2025-048 AMENDING THE FISCAL YEAR 2024-25 BUDGET AND RATIFYING PREVIOUS ACTIONS OF THE COUNCIL. (0330-30)
ORIGINATING DEPARTMENT:

Finance
EXECUTIVE SUMMARY:

The Fiscal Year (FY) 2024–25 municipal budget, adopted in May 2023, represents the second year of a two-year budget cycle. FY 2024–25 concluded on June 30, 2025. Staff has analyzed the adopted General Fund budget in comparison with authorized modifications related to personnel, operational costs, and City Council resolutions. Resolution 2025-048 will ratify and consolidate prior City Council actions and direct staff to complete an additional FY 2024–25 budget amendment to adjust certain accounts to more accurately reflect actual results of operations.

Staff is currently preparing for the FY 2024-25 annual audit, which is scheduled to take place in late September. It is anticipated that the final Financial Statements will be prepared and presented to the City Council in early December 2025.

RECOMMENDATION:

Staff recommends that the City Council adopt Resolution 2025-048 ratifying and consolidating previous actions of the City Council related to the City of Imperial Beach Budget and approving additional amendments to the FY 2024-25 Budget.

OPTIONS:
 Adopt Resolution 2025-048
 Direct staff to provide additional information
BACKGROUND/ANALYSIS:

The municipal budget serves as the primary document linking the City Council’s priorities with the funding necessary to achieve them. It is a living document that is amended throughout the budget period as financial needs evolve. The City Council periodically adopts resolutions to amend anticipated revenues and expenditures in the General Fund. Through a series of such amendments, the authorized expenditures in the FY 2024–25 General Fund budget have increased. Staff continues to closely monitor the City’s revenues and expenditures with the goal of maintaining fiscal balance.

The FY 2024–25 fiscal year ended on June 30, 2025; however, certain revenues received and expenditures incurred through August 31, 2025, must also be recorded in FY 2024–25. Since June, staff has been recording these transactions along with other required year-end adjustments in preparation for the City’s annual audit.

P a g e | 2
As part of the year-end closing process, both revenue and expenditure budgets are reviewed and adjusted as necessary. These adjustments bring the initial budget estimates closer to the actual results of operations, ensuring the final budget is more accurate and more useful for future budget planning.

GENERAL FUND
General Fund Summary
The projections in this staff report are preliminary and may change as the fiscal year is finalized.

Final revenue and expenditure amounts will not be confirmed until the annual audit is completed and the financial statements are issued in mid-November 2025. Staff will provide the audit results to the City Council in December 2025.

Revenues
The FY 2024-25 adopted General Fund revenue budget was $30,557,300 and the current amended budget is $30,571,331.

Staff is proposing an overall increase in the General Fund Revenue budget of $1,687,400 for FY 2024-2025 to align revenue accounts with larger variances with current trends. Amendments are proposed for recurring revenues as opposed to one-time items and/or items where large year-toyear fluctuations are expected, such as grants. While the amendment increases and decreases affect multiple accounts, the most prominent adjustments are as follows:
 Increase of $338,800 to 101-0000-318.1005 (Franchise Tax – Solid Waste) for higher than anticipated solid waste franchise tax collections
 Increase of $223,400 to 101-0000-311.6006 (RPTTF Residual) for higher than anticipated property tax revenues
 Increase of $211,700 to 101-0000-341.7401 (Building Plan Check) for higher revenues resulting from the passage of the new fee schedule
 Increase of $202,100 to 101-0000-313.4002 (Measure I Sales Tax) for higher than anticipated revenues
 Increase of $187,300 to 101-0000-341.7403 (Planning & Zoning Fees) for higher than anticipated revenues resulting from the passage of the new fee schedule  Decrease of $221,300 to 101-0000-313.4001 (7.75% Sales Tax – City) for lower than anticipated revenues
 Decrease of $180,000 to 103-0000-376.8803 (Community Benefit Contribution) for lower than anticipated revenues
The full details of the adjustment can be seen in the year-end revenue budget amendment (“Attachment 2”).

Expenditures
The General Fund adopted expenditure budget was $30,002,400, and the current amended General Fund budget is $31,034,762. During FY 2024-25, the City Council approved the following budget amendments using funds from General Fund reserves for one-time capital improvement project expenditures:
 Transfer to CIP Fund for Fire Station HVAC Improvements - $195,000  Transfer to CIP Fund for IT Department HVAC Improvements - $110,000  Transfer to Facilities Fund for Miscellaneous Facility Repairs - $100,000

P a g e | 3
Additionally, open purchase orders for projects approved in FY 2023-24, as well as budgets for previously approved capital projects, were carried over into the FY 2024-25 budget.

Staff is proposing an overall decrease in the General Fund expenditure budget of $289,300 for FY 2024-2025 to reflect operational needs and cost trends in accounts that experienced larger variances. While the amendment increases and decreases affect multiple accounts, the more prominent adjustments are as follows:
 Increase of $223,800 to account 101-3040-424.2016 (Plan Check Services) due to unexpected increases in consulting expenses resulting from staffing shortage  Increase of $200,600 to account 101-5010-431.1001 (Street Department – Salaries FullTime) due to unexpected staffing costs  Increase of $177,700 to account 101-3040-424.2006 (Building – Professional Services) due to unexpected increases in consulting expenses resulting from staffing shortage  Increase of $162,600 to account 101-3020-422.1003 (Fire – Overtime) due to unexpected overtime staffing costs
 Decrease of $252,300 to account 101-3010-421.2006 (Sheriff - Professional Services) due to the use of available SLESF (Supplemental Law Enforcement Safety Funding) Funds to offset certain law enforcement costs
 Decrease of $229,600 to account 101-3040-424.1001 (Building – Salaries Full-Time) due to position vacancies
 Decrease of $191,500 to account 101-6010-451.1001 (Parks & Recreation – Salaries FullTime) due to structural personnel changes A full listing of the proposed expenditure budget adjustments can be seen in the year-end expenditure budget amendment (“Attachment 3”).

SEWER ENTERPRISE FUND
Fund 601 – Sewer Enterprise Fund
The Sewer Enterprise Funds adopted revenue budget was $6,751,800 while expenditure budget was $6,764,100. The current amended revenue budget remains the same, while expenditure budget increased to $9,691,481 as open purchase orders and previously approved capital projects were carried over into the FY 2024-25 budget from prior years. Staff is proposing an overall increase in expenditures for this fund related to overtime, stand-by-pay, and technical services.

A full listing of the proposed Internal Service and Sewer Fund budget adjustments is included as “Attachment 4” to this report.

SPECIAL REVENUE FUNDS
Fund 201 – Gas Tax Fund & Fund 207 RMRA (SB1) Gas Tax Fund Several revenue decreases budget amendments are being requested as gas tax revenues came in softer than projected.

Fund 202 – Proposition “A” (Transnet) Fund
Several budget adjustments are being requested to “true-up” actual Prop “A” and RTCIP revenues, as well as Transnet funded expenses to project activity.

Fund 210 – CDBG Fund
A budget adjustment is requested to true-up a funding transfer for the fire truck lease.

Fund 212 – SLESF (Supplemental Law Enforcement Services Fund) Fund A minimum of $100,000 of funds (per City) are allocated annually from the State through the Citizens’ Option for Public Safety (COPS) program. Imperial Beach budgets for the minimum $100,000 in revenue, but often receive a greater amount. Budget amendments are being requested to true-up the SLESF funding received and the actual FY 2024-25 expenditures recorded.

Fund 216 – Housing Authority
Fund 216 accounts for activity within the City’s housing fund. Activity is sporadic and minimal, and, as a result, the fund usually does not have an approved budget. Recently, there has been legal oversight for a potential housing project within the City. As such, the City has incurred expenses within the fund. Staff is requesting a budget amendment to true-up FY 2024-25 expenditures.

Fund 420 – Parks Major Maintenance Fund
A budget adjustment is requested to true-up impact offset fees collected.

A full listing of the proposed Special Revenue Funds budget adjustments is included as “Attachment 5” to this report.

ITEM TITLE: RESOLUTION NO. 2025-049 AUTHORIZING AMENDMENT NO. 1 TO INCREASE

THE CONTRACT AMOUNT FOR THE REPLACEMENT OF THE ROOF OF THE SPORTS PARK BUILDING WITH A. PREMAN ROOFING, INC. (0920-40)
ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY:

Resolution No. 2025-049 is to amend the current contract with A. Preman Roofing, Inc. (Preman) for the replacement of the roof of the Sports Park Building. The original agreement has a not-toexceed amount of $130,000; staff is requesting an amendment to increase the agreement amount to a not-to-exceed total of $150,000.

This amendment to our current contract will allow Preman to install flashings for waterproofing associated with the HVAC ductwork. At the time of Preman’s bid, the current HVAC ductwork was not in place and was not included in Preman’s bid. The additional funds are needed to complete the project.

RECOMMENDATION:

Adopt Resolution No. 2025-049 authorizing the City Manager to execute Amendment No. 1 with A. Preman Roofing, Inc. for a not-to-exceed amount of $150,000.

OPTIONS:
 Adopt Resolution 2025-049 to authorize the City Manager to sign Amendment No. 1 with A. Preman Roofing, Inc. for a not to exceed amount of $150,000; or  Request additional information and an additional report.

BACKGROUND/ANALYSIS:

The roof replacement portion of the Project was advertised for construction bids on February 15, 2024. A mandatory job walk was held on Wednesday, February 21, 2024, and a public bid opening was held on Thursday, March 7, 2024. Upon review of the bids, the lowest responsible and qualified bid was submitted by A. Preman Roofing, Inc. On May 15, 2024, Resolution No. 2024- 034 originally appropriated $130,000 to A. Preman Roofing, Inc. for the replacement of the roof of the Sports Park Building.

Through the Project’s progression, it was determined that flashings will be needed to waterproof the HVAC ductwork roof penetrations. The additional work will add unanticipated material and labor costs.

ITEM TITLE: INTERVIEWS OF CITY COUNCIL APPLICANTS WITH DISCUSSION AND

POSSIBLE ACTION TO MAKE APPOINTMENT TO FILL VACANCY IN CITY COUNCIL POSITION, DISTRICT 3. (0410-40)
ORIGINATING DEPARTMENT:

City Manager
EXECUTIVE SUMMARY:

Former Mayor Paloma Aguirre was elected to be the Division 1 San Diego County Supervisor on July 1, 2025. She was sworn into office on July 22, 2025, and as such, there was a vacancy in the office of the Mayor. Pursuant to State law, a majority of the City Council voted at their meeting on August 6, 2025 to appoint Councilmember Mitch McKay as the Mayor to serve out the remainder of former Mayor Aguirre’s term of office, which runs through the November 2026 election. He was sworn into office on August 20, 2025 and resigned his Council seat. Therefore, as of August 20, 2025, there is a vacancy in the office of the District 3 Council seat. Per State law, the City Council has 60 days from August 20, 2025 to either make an appointment to the vacant office or to call a special election to fill the office. At the August 20, 2025 Council meeting, the Council directed Staff to advertise for the City Council position vacancy and accept applications for possible appointment. On September 4, 2025, City Staff hosted an Applicant Information Forum. The applications were due by September 10, 2025 by 5:00 p.m. Eight applications were received. This agenda item allows the Council to interview candidates, narrow the candidate pool, discuss its options, provide direction to Staff on its choices, and possibly make an appointment tonight.

RECOMMENDATION:

Staff recommends that the Council: Allow applicants to make presentations, accept public comment, conduct any City Council follow-up questions of the applicants, select applicants to move to the next phase and either (1) select an applicant for appointment to take office at a future Council meeting; (2) select applicants to participate in a second round of interviews or some other process; (3) and/or provide direction to Staff about the next steps to fill the vacancy.

OPTIONS:
 If Council wishes to appoint to the vacant seat, select a person to fill the vacant seat and provide direction to Staff about a future meeting date to adopt a resolution of appointment, present the certificate of appointment, and administer the oath of office to the appointee.  If Council wishes to hold a second round of interviews, Council should select the applicants to move to the next phase and provide direction to Staff about the procedures for the second round of interviews.

Page 70 of 171 ends

P a g e | 2
 If the Council wishes to conduct some other process related to appointment and/or calling a special election, Council can provide direction to Staff about the next steps.

BACKGROUND/ANALYSIS:

Pursuant to State law, a majority of the City Council voted to appoint Councilmember Mitch McKay as the Mayor to serve out the remainder of former Mayor Aguirre’s term of office, which runs through the November 2026 election. As of August 20, there is a vacant Council seat for District

3. The City Council needs to fill Mayor McKay’s prior seat pursuant to the process in Government Code section 36512 as specified below:
(b) If a vacancy occurs in an elective office provided for in this chapter, the council shall, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. (1) If the council calls a special election, the special election shall be held on the next regularly established election date not less than 114 days from the call of the special election. A person elected to fill a vacancy holds office for the unexpired term of the former incumbent.
(2) If the council fills the vacancy by appointment, the person appointed to fill the vacancy shall hold office pursuant to one of the following:
(A) If the vacancy occurs in the first half of a term of office and at least 130 days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the next general municipal election that is scheduled 130 or more days after the date the council is notified of the vacancy, and thereafter until the person who is elected at that election to fill the vacancy has been qualified. The person elected to fill the vacancy shall hold office for the unexpired balance of the term of office. (B) If the vacancy occurs in the first half of a term of office, but less than 130 days prior to the next general municipal election, or if the vacancy occurs in the second half of a term of office, the person appointed to fill the vacancy shall hold office for the unexpired term of the former incumbent. (italics added)
Any person who fills Mayor McKay’s vacated Council seat would need to be from the same district (District 3). Mayor McKay’s prior term of office runs through the November 2026 election.

The City Council has the following options which are described in more detail below:

1. Appointment

2. Special Election

1. Appointment
The Council may fill the vacancy by appointment. Doing so requires a majority vote of the four remaining Councilmembers present at the meeting — meaning at least three affirmative votes are needed. Please note that an abstention vote per the City Council Policy Manual is treated as a “no” vote.

A person appointed to Mayor McKay’s prior Council seat must meet the following legal requirements:
 Must be a resident of Imperial Beach;
 Must be a resident of District 3;

Page 71 of 171 ends

P a g e | 3
 Must be a registered voter; and
 Must be at least 18 years of age.

State law does not provide a specific process for the City Council to follow if it wants to appoint a person to fill the vacancy. Therefore, the process is up to the Council’s discretion. At the August 20, 2025 City Council meeting, the Council directed Staff to advertise for interested persons to fill the vacant seat and bring this item to the Council to allow the Council to interview applicants and perform some sort of narrowing process prior to appointment. Per Council direction, on September 4, 2025, City Staff hosted an Applicant Information Forum which approximately 12 members of the public attended. Applications were due September 10, 2025 by 5:00 p.m. The City received and verified eight applications by the deadline.

Applicants will each have up to 4 minutes to present their qualifications and application to the City Council at this Council meeting. The order of presentations will be determined by random selection during the Council meeting. Following all presentations, there will be public comment on the agenda item. After public comment, each member of the City Council will have approximately 3 minutes per applicant to ask and hear the answers to any follow-up questions based upon the presentation and application materials. After the questions and answers, each member of the City Council can select up to 2 applicants to move to the next phase of the process.

After the Council has voted to select up to 2 applicants to move to the next phase, the City Council has various potential options which may or may not include: further questions, interviews, voting in rounds, and/or voting to select a specific candidate.

An appointment could occur at this Council meeting or the Council could provide direction to continue the process to a future Council meeting. If the Council does select an applicant at this Council meeting, the Resolution of Appointment, Certificate of Appointment, and Oath of Office would be agendized for the October 1, 2025 Council meeting. If the Council does not make a decision at this Council meeting and needs further information or time to consider the applicants or appointment process, Staff would recommend that any process be continued to no later than the October 1, 2025 Council meeting so that the Oath of Office could occur no later than October 15, 2025.

2. Special Election
At the August 20, 2025, City Council meeting, the Council directed staff to advertise for interested persons to fill the vacant seat via appointment. If the City Council does not appoint someone to the vacant seat, the City would be responsible for covering the costs to hold a special election for the remainder of the term, which runs through November 2026. The City Clerk has received cost estimates between approximately $125,000-$250,000 for conducting a special election in District 3 on the next established election date — April 14, 2026, pursuant to Elections Code section 1000. The lower estimate reflects an all-mail election, while the higher estimate assumes a vote center model. Calling such a special election requires a majority vote of the four remaining Councilmembers — that is, at least three votes in favor. A special election in April must be called by the Council on or before October 19, 2025.

ENVIRONMENTAL DETERMINATION:

Not a project as defined by CEQA.

FISCAL IMPACT:

There is no fiscal impact if the City Council appoints to the vacant seat. If the City Council decides to hold a special election, it will cost the City in the range of approximately $125,000-$250,000 in addition to staff time and associated expenses.
