City Manager Foltz gave a PowerPoint presentation on the item.
Written comments were submitted by Truth and Liisa Thomas. They were provided as Last Minute Agenda Information and made available to members of the City Council and to members of the public.
Councilmember Nakawatase expressed support for the exploration of an iconic public art piece, that is above-ground, interactive installation that encourages community engagement. She suggested the artwork include features that allow visitors to sit, interact with, or experience the art piece. She proposed the following locations: South Seacoast Drive or near 13th Street to help draw activity to other parts of the City and expand visitor engagement. She expressed a preference for pursuing external funding sources including grants from arts organizations such as the California Arts Commission and the San Diego County Arts Commission, rather than using City funds.
Councilmember Leyba-Gonzalez expressed support for installations distributed across each City Council district rather than concentrated in one area. He noted potential benefit of placing installations in multiple areas of the City, including near the Border to Bayshore Bikeway, to enhance visibility and accessibility as regional path projects are completed.
Mayor Pro Tem Fisher expressed support for public art, emphasizing durability, maintenance considerations and the importance of highlighting Imperial Beach's unique identity and existing artistic assets. He suggested a partnership with the Imperial Beach Arts Bureau, considering multiple locations including South Seacoast and 13th Street areas, and returning with refined concepts and funding strategies for future City Council consideration. He favored the IB Wave with the Woody Car in the upper right corner on slide 25.
Mayor McKay expressed his support for public art concepts, noting a preference for designs with visual interest and color, and identified potential locations including the south end of Seacoast Drive, 13th Street, and the new development that will have a park. He favored the art piece in the lower right corner on slide 25 but with more color, the Coastal Utopia art piece, and an art piece that is interactive.
Councilmember Seabury referenced prior examples of mosaic public art viewed at a CalCies conference vendor showcase noting that such installations appeared to be feasible and cost-effective. She expressed support for having an art piece in each district and favored the chair concept at the southwesterly location.

ITEM TITLE: APPROVAL OF RESOLUTION NO. 2026-031 PURSUANT TO PUBLIC CONTRACTS CODE SECTION 22050 FINDING THE CONTINUED EXISTENCE OF AN EMERGENCY DUE TO THE FAILURE OF SEWER PUMPS AT PUMP STATION NO. 8. (0830- 35)
ORIGINATING DEPARTMENT:
Public Works
EXECUTIVE SUMMARY:
Pump Station 8 (PS8) is a wet/dry well facility over 60 years old that has experienced ongoing pump issues in recent years. Staff has been working with Michael Baker International (MBI), the City’s engineering consultant, to develop plans and specifications for a comprehensive rehabilitation project that includes new pumps, plumbing, and electrical upgrades. The design is nearly complete and scheduled to go out to bid in the coming weeks.
PS8 contains three identical pumps, with two typically alternating workloads and the third serving as a standby for emergencies. In early October, two pumps failed, and on Saturday, October 11, 2025, the last remaining working pump failed. These pumps are obsolete, and no replacement parts or compatible pumps are available. As a result, the station was gravity bypassing to Pump Station 9 (PS9), which was putting excessive strain on that pump station. A few weeks later, staff was able to procure and install one (1) new pump at PS8 as an interim condition to avoid flows being redirected to PS9. Accelerating the PS8 project is critical to ensure the City has a reliable sewer system.
Public Contract Code Section 20168 provides that the City Council may pass by four-fifths (4/5) vote a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property. Upon adoption of such resolution, the City Manager may expend any sum required in the emergency and report the same to the City Council in accordance with Public Contract Code Section 22050. The Council approved the initial emergency resolution on October 15, 2025. This report is to follow-up on actions taken and to request the extension of the emergency pursuant to State law.
RECOMMENDATION:
Adopt Resolution No. 2026-031 to continue the existence of the emergency and ratify actions taken in furtherance of the emergency.
OPTIONS:
Adopt Resolution No. 2026-031;
Provide other direction to the City Manager to take a specific action; or Request additional information and an additional report

BACKGROUND/ANALYSIS:
The City of Imperial Beach operates and maintains eleven sanitary pump stations that collect and relay sanitary flows to varying locations in the City’s collection system for ultimate conveyance to the City of San Diego METRO system. The sanitary pump stations are of varying styles and include various types of pumps. Pump Station 8 (PS8), located at 895 Imperial Beach Blvd., adjacent to the Imperial Beach Fire Station, is one of two major pump stations (Pump Station 9 being the other) used by the City of Imperial Beach to convey collected sanitary flows directly to the METRO system (eventually entering the Point Loma Wastewater Treatment Plant for treatment) operated by the City of San Diego.
PS8 is a wet/dry well facility that is over 60 years old. It has had ongoing pump issues over the past few years. Staff has been working with Michael Baker International (MBI), the City’s engineering consultant, to put together plans and specifications for an overall rehabilitation project that includes new pumps, plumbing, and electrical upgrades. The design is near completion and would be put out to bid in the coming weeks.
PS8 has three identical pumps. Workload is typically alternated between two of the three pumps.
The third pump is for emergency purposes only. In early October, two pumps failed, and on October 11, 2025, the last remaining working pump failed. The three pumps at PS8 are obsolete, and no parts or replacement pumps are available. The station was gravity bypassing to PS9, which was putting excessive strain on that pump station. A few weeks later, staff was able to procure and install one (1) new pump at PS8 as an interim condition to avoid flows being redirected to PS9. Accelerating the PS8 project is critical to ensure the City has a reliable sewer system. In the event of a power loss or failure of the pumps, staff has an emergency generator and/or portable pumps that could be installed to keep the pump stations operational.
Pump Station 8 Construction Project has an approved budget of $1,500,000 for FY26 in the current Biennial FY26 & FY27 City of Imperial Beach budget. Funds were appropriated from the Sewer Enterprise Fund.
IBMC section 3.04.120A allows for competitive bidding to be dispensed with when the City Manager determines that an emergency requires an order to be placed with the nearest available source of supply in order to mitigate the threat to public health and safety.
The City Manager, acting pursuant IBMC section 3.04.120A, may determine the existence of a local emergency based on conditions of extreme peril to the safety of persons and property caused by the pump station failure.
Such resolution was approved at the October 15, 2025, special Council meeting. Between November 2025 and March 2026, the City Council held meetings on several dates to pass resolutions extending the ongoing emergency. The meetings included:
November 5, 2025
November 19, 2025
December 3, 2025
January 21, 2026
February 4, 2026
February 18, 2026
March 4, 2026
P a g e | 3
Each listed date corresponds to a meeting when an extension resolution was passed.
If such expenditure is ordered, the City Council shall review the emergency action at each regular meeting, to determine if there is a need to continue the action.
Pump Station 8’s failure constitutes an emergency within the terms of Public Contract Code Sections 20168 and 22050, which requires that the City Manager be able to act quickly and without complying with the notice and bidding procedures of the Public Contract Code to repair and protect such public facilities.
Since the last Council meeting on March 18, 2026, there has not been any new work performed at PS8.
Staff recommends Council approve Resolution No. 2026-031 to continue the emergency and ratify the expenditures and contracts made thus far in furtherance of the emergency.

ORIGINATING DEPARTMENT:
Environmental & Natural Resources
EXECUTIVE SUMMARY:
This resolution recognizes the importance of environmental awareness in the community by declaring April as “Earth Month” and recognizes several activities planned around the City during this month.
RECOMMENDATION:
Adopt Resolution 2026-030 to declare the month of April as “Earth Month” in the City of Imperial Beach.
OPTIONS:
Authorize the Resolution
Provide further directions to staff to recognize earth month in the community BACKGROUND/ANALYSIS:
The first Earth Day was celebrated in the United States on April 22, 1970. Since that time, through the collective efforts of government agencies, grassroots organizations, and engaged citizens, Earth Day has grown into a global event dedicated to environmental awareness and stewardship.
A central focus of many Earth Day activities is the protection of natural resources, the promotion of sustainable practices, and the preservation of water quality.
The Imperial Beach shoreline, Tijuana Estuary, and San Diego Bayfront are vital environmental assets that contribute significantly to the region’s ecological health and enhance the quality of life for residents and visitors. The month of April provides an appropriate opportunity, in the spirit of Earth Day, to highlight educational programs, community events, and initiatives that promote awareness of key environmental issues.
The City intends to leverage the increased environmental awareness during April to further engage the community in its waste and recycling management, stormwater, energy conservation, San Diego Bay, and Tijuana River programs. In recognition of Earth Day, staff recommends that the City Council adopt a resolution declaring April as “Earth Month.” A series of activities is planned throughout the month to encourage community participation, including:
The EDCO Environmental Times newsletter for April will focus on the Home Front Clean Up information coming on Saturday May 2nd, 8 am to 1 pm at the South Bay Union School
P a g e | 2
District on 601 Elm Avenue. Also, the container contamination minimization program continues to encourage residents to properly separate trash, recyclables, and organics. National Prescription Drug Take Back Day is coming up on April 25th from 10 am to 2 pm.
The Imperial Beach Sheriff’s Substation at 845 Imperial Beach Blvd participates in this event along with numerous locations across the region.
The Tijuana River National Estuarine Research Reserve will be hosting the Friday Stewardship sessions for long-term volunteers, Nature Walk, Bird Walk, and Nature Book Club. The “Junior Rangers” program continues this year. The program is free and children 7-12 are invited to take part in this exciting program every Saturday from 11:00 a.m. to 12:00 p.m. with different educational activities at each session. If interested, you can visit their website for more information.
ILACSD Annual Creek to Bay Cleanup: On Saturday April 25th the City sponsors the annual I Love a Clean San Diego Creek to Bay Cleanup as a collaborative watershed activity for the San Diego Bay and Tijuana River WQIP. More than 100 cleanup sites will be held throughout San Diego including the South Bay area. Register for the event at cleansd.org starting April 1st.
Annual Citywide Garage Sale: On Saturday April 25th the City will hold its annual Citywide Garage Sale for residents to sell and exchange used items. The City provides an online map and free advertisement for residents who participate in this one-day event. Early registration is recommended to be added to the map being published in the newspaper. The City’s Parks, Recreation, and Community Services Department will be hosting the Earth Day event on Wednesday, April 22nd, from 3:30 PM to 5:30 PM at the Community Garden. Also, the “Dia de Los Ninos” event at Veterans Park on Saturday April 25th. The City of Chula Vista will be hosting Day of the Child at Memorial Park on April 11th 10 AM to 3 PM and South Bay Earth Day on April 18th at Bayfront Park located at 980 Marina Way in Chula Vista from 11 AM to 3 PM. ITEM TITLE: EXTENSION OF PROJECT APPROVALS FOR THE CONSTRUCTION OF A
VERTICAL MIXED-USE BUILDING WITH GROUND FLOOR COMMERCIAL AND TEN RESIDENTIAL UNITS (ONE LOW INCOME) AT 645 FLORENCE ST. (APN: 626-24-22-2-00). (0600-20)
ORIGINATING DEPARTMENT:
Community Development
EXECUTIVE SUMMARY:
On March 1, 2023, the City Council adopted Resolution No. 2023-13 (Attachment 1) authorizing Tarek Dagher (“Applicant”) to demolish the existing structure located at 645 Florence Street, and construct a new three-story mixed-use building that includes 842 sq. ft. of commercial space, ten residential units (inclusive of one low-income affordable unit), a roof deck, and an eleven-car parking garage (“Project”). The property is located in the C/MU-1 (General Commercial & Mixed-Use) zone. Approval of the Project is set to expire at the end of business on March 16, 2026, unless vested by the initiation of substantial construction or if an extension is authorized. The Applicant has requested a one-year extension for the Project approvals (Attachment 2).
RECOMMENDATION:
That the City Council adopt Resolution No. 2026-034, extending for one year, Regular Coastal Permit (CP-21-0003), Conditional Use Permit (CUP-22-0006), Design Review Case (DRC-21- 0015), Site Plan Review (SPR-21-0016), and Tentative Parcel Map (PM-21-0016) for the Project located at 645 Florence Street (APN 626-242-22-00), subject to the conditions as specified in the attached resolution. (Attachment 3)
OPTIONS:
Adopt Resolution 2026-034 approving a one-year time extension; or Deny the extension request; or
Continue review of the extension request to a future meeting where additional information can be provided, and a decision can be rendered.
BACKGROUND/ANALYSIS:
On March 1, 2023, the City Council adopted Resolution No. 2023-13 authorizing the demolition of an existing 850 sq. ft. single-family residence, the consolidation of two existing parcels into one, and the construction a new three-story mixed-use building with 842 sq. ft. of commercial space, ten residential units (inclusive of one low income affordable unit), a roof deck, and an eleven-car parking garage.
Approval of the Project is set to expire at the end of business on March 16, 2026, unless the Project is vested by the beginning of substantial construction or if an extension is authorized. On
P a g e | 2
March 13, 2026, the Applicant requested a one-year extension for the Project approvals due to delays resulting from prolonged coordination with San Diego Gas & Electric for utility disconnection and revised structural fire-rating requirements identified by the City’s third-party reviewer. This is the Applicant’s first extension request for the Project.
Since the City Council’s approval on March 1, 2023, the Project design has undergone minor revisions to comply with building code requirements related to fire protection and Americans with Disabilities Act (ADA) standards. These updates include partially enclosing the balconies on the north façade, adding a rear staircase, enclosing the rooftop stairway, and reducing the number of parking spaces from 11 to 10 spaces.
The Applicant continues to propose one low-income affordable unit, along with Transportation Demand Management (TDM) measures, including ten (10) electric bike charging stations and bicycle parking, signage displaying nearby public transportation routes and schedules. The original proposal also included providing one electric bike per unit (ten total) and offering a 3% rent reduction for tenants without vehicles. However, the provision of rental bikes to tenants raised liability concerns for the Applicant, and the 3% rent reduction has proven cost-prohibitive. As a result, these components have been removed from the proposal.
The original analysis for the Project can be reviewed in the staff report from March 1, 2023 (Attachment 4).
ENVIRONMENTAL DETERMINATION:
Categorical exemption pursuant to CEQA guidelines 15332 (In-fill Development Projects).

The applicant has deposited funds to process the extension application.

BACKGROUND/ANALYSIS:
An application (USE-21-
0047) was submitted to the
City on November 18, 2021,
for Regular Coastal Permit
(CP-21-0003), Conditional
Use Permit (CUP-22-0006),
Design Review Case (DRC-21-0015), Site Plan Review
(SPR-21-0016), and
Tentative Parcel Map (PM-21-0016) proposing to
demolish the existing 850
sq. ft. single-family
residence, consolidate the
two existing lots into one lot,
and construct a new three-story mixed-use building that includes an 842 sq. ft. commercial space, ten residential units (inclusive of one low income affordable unit), a roof deck, and an eleven-car parking garage at 645 Florence Street (APN 626-242-22-00) in the C/MU-1 (General Commercial and Mixed-Use) Zone.
The project site is an existing 7,512 square foot (0.17-acre) lot fronting Florence Street. The project would demolish the existing 850 sq. ft. single-family residence, consolidate the two existing lots into one lot, and construct a new three-story mixed-use building that includes an 842 sq. ft. commercial space, ten residential units (inclusive of one low-income affordable unit), a roof deck, and an eleven-car parking garage. Vehicular ingress and egress to the property would be provided from the existing alley on the east side of the property.
The surrounding area is zoned C/MU-1 (General Commercial & Mixed Use), similar to the subject site and the surrounding uses are residential in character.
Building Orientation and Design: The proposed building orientation provides one new three-story building fronting Florence Street. Vehicular ingress and egress to the property would be provided from the existing alley on the east side of the property. Off-street parking areas are accessed from the existing alley in the form of an eleven-car parking garage at the ground level. Pedestrian access to the off-street parking area is accessed from Florence Street via a concrete walkway located on the southwest corner of the property. The concrete walkway also serves as an entrance to guide pedestrians to a stairway and elevator that leads to the upper floor apartment units and roof deck. The roof deck is to be used by the current tenants only, and the roof deck hours of operation are 10:00 AM to 6:00 PM Monday to Friday, and 10:00 AM to 8:00 PM Saturday to Sunday. In addition, solar panel would locate in non-habitable roof deck areas.
P a g e | 3
The project proposes a vertical mixed-use building that includes an 842 sq. ft. commercial space, ten residential units (inclusive of one low-income affordable unit), a roof deck, and an eleven-car parking garage. The utilization of the commercial space is to be determined. Each apartment unit varies in size (1,002 sq. ft. – 1,964 sq. ft.) and ranges from two-three bedrooms. The roof deck is 1,326 sq. ft. and roof access is provided via an elevator and a stairway. To provide variation and lend relief of the massing of the building, the project proposes a total of fourteen balconies that are provided on all proposed building elevations and provides a five-foot setback and stepback from the northern and southern property line on the first, second, and third floor. The floor to ceiling height of the ground floor commercial space is 18’ – 4”. The overall height of the building, including the roof decks, parapets, and elevator structure, is approximately 54’ – 11 13/32”.
However, parapets and roof structures housing elevators may extend above the height limit (ref.
IBMC Section 19.40.020). Not including the portions of the structure that may extend above the
P a g e | 4
height limit, the building height is 39’ – 11 3/32”, which complies with the building height requirements in the C/MU-1 General Commercial and Mixed-Use Zone.
Building Materials: The building architectural style would be modern with four different colors of exterior stucco including beige, light brown, dark brown, and navy. The building accents include terracotta rainscreens, light brown balcony doors, light brown vinyl window framing with tempered clear glass, aluminum railings, and aluminum/composite adjustable fence gate.
P a g e | 5
Landscaping: Typically, projects require 15% of the site to be landscaped. The project proposes to provide landscaping on the ground level of the northern and southern perimeter of the property, totaling 1,381 sq. ft. (18%) of site as planted landscaping at grade. The landscaping would include planted areas with (2) Sweet Shade Trees, (2) Brisbane Box Trees, (15) Carolina Cherry Trees, (15) Japanese Blueberry Trees, (60) drought tolerant plants such as Dianelle Revoluta, Cordyline Red Sensation, and Helen Von Stein Lamb’s Ear, and different types of ground cover such as decorative rocks and mulch that would locate throughout the property for aesthetic appeal and drainage purposes. In addition, the development proposes (1) six-foot tall green wall wooden fence on the south property line that would be covered with drought tolerant jasmine leaves, and (1) CMU Block Wall on the north property line.
Parking: The project requires a total of 16 parking spaces (15 parking spaces for the multiple-family residential and 1 space per 500 gross sq. ft. of commercial space). With the 25% reduction for vertical mixed-use and eligible waiver for commercial uses less than 1,000 sq. ft. the total required number of parking spaces would be 11. However, the approval of the 25% reduction for vertical mixed-use and eligible waiver for commercial uses less than 1,000 sq. ft. is at the sole discretion of the City of Imperial Beach City Council. The 11 parking spaces are provided in the form of a parking garage on the ground level with concrete surfacing. Additionally, the project would provide Transportation Demand Management (TDM), including bicycle parking, signage
P a g e | 6
for public transportation that shows bus routes and schedules, (10) electric bike charging stations, one (1) electric bike dedicated to each rental unit (10 electric bicycles total), and a 3.0% rent reduction incentive for tenants with zero vehicles.
Trash enclosure: A enclosed trash, recycling, and organics enclosure would be situated on the northeastern side of the property. Waste, recycling, and organics pick-up would occur from the existing alley on the eastern portion of the site.
Design Review Board:
The Design Review Board reviewed the project on November 17, 2022, and recommended approval of the project’s design with a vote of 3-1 (1 member absent, see Attachment 3) with the following conditions:
Consider reassessing the design of the project to reduce impact on parking; in particular, the commercial space, the available parking, and the number of units Add solar panels on roof deck
Consider replacing the material of the proposed railings with a stainless-steel finish Enhance the design and make the elevator enclosure more prominent Bring a 24” by 36” materials board to the next meeting Provide the proposed hours of use for the roof deck
Incorporate additional lighting throughout the pedestrian pathway Incorporate a wall treatment to create a permanent visual screening effect of the visible equipment areas (gas meters, water meters, etc.) such as stucco or composite wood. Add additional landscaping where possible, specifically, place additional evergreen trees in front of the balconies and elevations, and incorporate additional evergreen shrubs Replace the Leyland Cypresses with vertical evergreen soft trees such as sweet shade trees or Brisbane box trees
Replace the vines proposed on the fencing with a large evergreen shrub such as Carolina cherry, or Japanese blueberry
Replace the wood fencing with CMU block walls
Assess the feasibility of planting a street tree
The rocks located at grade should be less than 3/8 inch or larger than 6 inches to dissuade people from tossing them
Add a secured door on the path to the parking to secure the garage Show the location of the bike racks on the site plan
Show the location of the electrical main service panel and add more detail Most of the recommendations have been addressed and incorporated into the project/plans and/or have been provided as conditions of approval within Resolution 2023-13. Regarding the comment, “Consider reassessing the design of the project to reduce impact on parking; in particular, the commercial space, the available parking, and the number of units,” the applicant is proposing to 1) Allocate an electric bike for each unit. Total of 10 electric bikes; 2) Provide charging stations for each electric bike in the parking area; 3) Increase the number of parking spaces for Bicycles to 10 locations; 5) Provide rent incentives (3.0% reduction) for tenants with zero cars; 6) Provide guidance for all public transportation.
Additionally, regarding the comment, “Consider replacing the material of the proposed railings with a stainless-steel finish,” the applicant stated that after a careful study for stainless-steel materials it was found that aluminum would be more suitable and common for residential
P a g e | 7
properties and that aluminum would be more appropriate as it would match the aluminum store front panels.
Regarding the comment, “Replace the wood fencing with CMU block walls”, the applicant agreed to this request, but the applicant stated that the wood fencing on the south side of the building would remain as a wood fence with green/plant cover as it is adjacent to a parking lot.
Regarding the comment, “Assess the feasibility of planting a street tree,” the applicant stated that planting a tree on the front of the building on Florence Street has been considered and that trees are planted on the north and south side of the building on Florence Street. In the addition, the applicant stated that planting a street tree would not be feasible as there is no parkway adjacent to the property for trees to be planted.
General Plan Consistency;
The project is located in the C/MU-1 (General Commercial & Mixed Use) Zone. The purpose of the C/MU-1 Zone is to provide land to meet the local demand for commercial goods and services required primarily by the community. It is intended that the dominant type of commercial activity in the C/MU-1 Zone will be community and neighborhood serving retail and office uses such as retail stores and offices. The proposed vertical mixed-use project meets the purpose and intent of the land use designation.
Zoning Chart:
C/MU-1 Standards Provided/Proposed
Yard requirements for the C/MU-1 zone are as
follows:
A. Front Yard. Zero feet; up to forty percent of the
project frontage may be set back up to an
additional five feet. Front yards facing Donax
Avenue or Calla Avenue shall be a minimum
of fifteen feet.
A. The project fronts Florence
Street. The commercial
building is located along
Florence Street, and it is
intended that the street exterior
wall features, such as
variations in building colors,
window glazing, and
landscaping areas along the
street contribute to and
enhance the active
commercial use area. IBMC
Section 19.04.017 defines
active commercial uses as
those that generate/contribute
to a high level of pedestrian
activity, sidewalk traffic, and
active streets. The front yard
for the portion of the building off
Florence Street has a zero-font
yard setback.
P a g e | 8
B. Side Yard. There shall be a minimum side
yard of five feet.
C. Rear Yard. There shall be a minimum rear
yard of ten feet.
D. The open space and landscaping
requirements as stated in Chapter 19.50 of
this code shall be met.
B. The side yard of the project
abuts a residential property to
the north and south. The
project is maintaining the
minimum five-foot side yard
setback.
C. The rear yard of the project
abuts a commercial property.
The project is maintaining the
minimum ten-foot rear yard
setback.
D. 15% of the site must be
landscaped, and 18% is
provided.
“Active Commercial Uses” as defined in Chapter
19.05 are required for all buildings with frontage along Palm Avenue at a minimum of 60% of each building’s
ground floor lineal footage, have direct pedestrian
access from the Palm Avenue sidewalk or a plaza,
and have a minimum building depth of twenty-five
feet. The remaining forty percent must either be
primarily related to the commercial use, such as
parking, access, or other non-active commercial
purpose or, if related to non-commercial use, must be
designed either to encourage and promote pedestrian
activity or to visually screen required on-site parking (Section 19.26.020.A.1).
The project is not fronting Palm
Avenue, and as such is not required to
provide an active commercial use.
However, the applicant has provided a
commercial space fronting Florence
Street to promote pedestrian activity
and enhance the adjacent commercial
corridor.
For property with a side or rear yard abutting a
residential zone, the second floor shall be set back a
minimum of five feet from the abutting residential
property line and the third floor shall be set back a
minimum of ten feet from the abutting residential
property line. (Section 19.26.041)
The property does not abut a
residential zone.
Minimum lot size of 3,000 square-feet (Section
19.26.050).
The lot size measures 7,512 square
feet.
Minimum street frontage of 30 feet (Section
19.26.060).
The Florence Street frontage is
approximately 50.08’.
Maximum building height of four stories or 40 feet
(Section 19.26.070).
The overall height of the building,
including the roof decks, parapets, and
elevator structure, is approximately 54’
– 11 13/32” when measuring from the
average of the existing grade.
However, per Imperial Beach
Municipal Code Section 19.40.020
P a g e | 9
“Exceptions” parapets and roof
structures housing elevators may
extend above the height limit.
Therefore, the proposed building
height when measuring from the
average of the existing grade is 39’ –
11 3/32”, which complies with the
building height requirements found in
the C/MU-1 General Commercial and
Mixed-Use Zone.
The applicant would be required to
show conformance with the height
requirements as required by IBMC
19.04.400.
All commercial spaces on the ground floor shall have
a minimum fifteen-foot floor-to-ceiling height; and
single-story commercial buildings shall have a
minimum building height of twenty feet. (Section
19.27.070).
The project is proposing a floor-to-ceiling height of 18’ – 4” for the ground floor commercial space.
No buildings shall be located less than five feet from
any other building on the same lot. (Section
19.26.080)
No buildings shall be located less than
five feet from any other building on the
same lot.
Landscaping requirements are as follows (Section
19.50.030, Commercial Landscaping):
A. Not less than fifteen percent of the total site
shall be landscaped and permanently
maintained.
A. The 7,512 square foot lot
requires a minimum of 1,126.8
square feet of landscaping on
the site (15%) and 1,381
square feet of landscaping is
proposed (18%), which would
be comprised of planted areas
with (2) Sweet Shade Trees,
(2) Brisbane Box Trees, (15)
Carolina Cherry Trees, (15)
Japanese Blueberry Trees,
(60) drought tolerant plants
such as Dianelle Revoluta,
Cordyline Red Sensation, and
Helen Von Stein Lamb’s Ear,
and different types of ground
cover such as decorative rocks
and mulch that would locate
throughout the property for
aesthetic appeal and drainage
purposes. In addition, the
development proposes (1) six-Page 69 of 91
P a g e | 10
B. There shall be a five-foot-wide landscape area
between any parking area and any public
street right-of-way.
C. A portion of a property not used for buildings,
parking, walkways, loading or storage areas
shall be landscaped.
D. There shall be a minimum three-foot by fifteen-foot, or forty-five square foot, landscaped area within the parking area (not including
perimeter area landscaping) for every three
parking spaces or the equivalent. A minimum
width of three feet is required. A four-foot by
fifteen-foot area may be permitted for every
four spaces, five-foot-wide for five spaces, etc.
E. Prior to issuance of any building permits, a
complete landscaping plan shall be submitted
to the Community Development Department
for approval. Such approval shall be subject to
appeal in the manner set forth in Sections
19.84.070 through 19.84.090.

Wall on the north property line.
B. There is no parking area near
the public right-of-way.
C. Portions of a property not used
for buildings, parking,
walkways, loading or storage
are landscaped.
D. The project provides adequate
landscaping in the surface
parking spaces.
E. A complete landscape plan
would be required prior to
issuance of building permits.

ITEM TITLE: RESOLUTION NO. 2026-033 AUTHORIZING AMENDMENT NO. 2 TO EXTEND
THE CONTRACT FOR THE ANNUAL TREE MANAGEMENT AND MAINTENANCE SERVICES AGREEMENT WITH WEST COAST ARBORISTS, INC. (0940-60)
ORIGINATING DEPARTMENT:
Public Works
EXECUTIVE SUMMARY:
Adoption of Resolution No. 2026-033 authorizes the City Manager or designee to execute Amendment No. 2 with West Coast Arborists, Inc. (WCA) for tree management and maintenance services, which authorizes the second of the two (2) renewal options for three (3) years, which will take this contract to March 5, 2029.
The original contract states that if the City extends the contract, WCA can request an increase at a not-to-exceed prior year CPI rate or 2%, whichever is greater. On March 25, 2026 WCA submitted a request for a CPI increase of 2%.
RECOMMENDATION:
Adopt Resolution No. 2026-033 authorizing the City Manager or designee to execute Amendment No. 2 with West Coast Arborists, Inc. for a not-to-exceed annual amount of $200,000 and authorizes the second of the two (2) renewal options for three (3) years.
OPTIONS:
Receive this report; and
Authorize the City Manager or designee to sign Amendment No. 2 with West Coast Arborists, Inc. for tree management and maintenance services with a not-to-exceed amount of $200,000 annually; or
Request additional information and an additional report and return to a future meeting BACKGROUND/ANALYSIS:
The Public Works Department is responsible for the maintenance of approximately 1,900 palm trees and an additional 1,200 street trees located on City properties and right-of-way. The Public Works Department strategically uses a combination of contractual tree trimming services and in-house staff to maintain our urban forest consistent with best management practices. The City’s four-year Public Works contract for tree management and maintenance services with WCA expired in March 2023. The contract has two (2), three (3) year extension options. The first of two renewal options was approved in 2023 by Resolution No. 2023-61 and expired March 2026. Resolution No. 2023-61 also approved an annual cost increase, authorizing a not-to-exceed amount of $200,000 annually.
P a g e | 2
Each year, at the time of the option to renew, WCA can request an increase based on the prior year's CPI rate or 2%, whichever is higher. The City received a letter from WCA requesting a CPI increase of 2% on March 25, 2026 (Attachment 2), effective July 1, 2026.
WCA has continued to provide quality service to the City throughout the duration of its contract. For the aforementioned reasons, staff recommends authorizing the City Manager or designee to execute Amendment No. 2 in order to approve the second three (3) year renewal contract option, for tree management and maintenance services with WCA with a not-to-exceed amount of $200,000 annually.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT:
The amount appropriated for Tree Management and Maintenance Services for FY 2025/2026 is sufficient to cover the costs of the proposed contract for routine services and maintenance as follows:
Park Maintenance – WCA Palm Tree Trimming $115,000
Park Maintenance – WCA Shade Tree Trimming $27,300
Park Maintenance – Landscaping Services $15,000
Tidelands Maintenance – WCA Palm Tree Trimming $15,000

CPI Adjustment Requested:
Vice President, Business Development
As we approach the end of the current contract year, West Coast Arborists, Inc. would like to extend our gratitude to you and your team for your continued partnership. Throughout our partnership, we have worked together to safeguard the health and integrity of your community's urban forest. We look forward to continuing our contributions toward your urban forest goals.
We are writing to express our interest in extending our current agreement for an additional year. As we look ahead, we would like to request a slight cost adjustment.
This adjustment is driven by changes in the Consumer Price Index (CPI) for the region, as well as increases in labor costs, both of which have had an impact on our operational expenses. We respectfully request a cost adjustment based on the CPI for the area, as published by the Department of Labor’s Bureau of Labor Statistics.
We understand the importance of maintaining fiscal responsibility and have ensured that the requested adjustment is fair and reasonable, given the current market conditions. We look forward to another successful year ahead. Should you have any questions or require additional information, please do not hesitate to email me at [email protected] or call me at (800) 521-3714.

ITEM TITLE: INTRODUCTION OF AN ORDINANCE AMENDING CHAPTER 3.04 “PURCHASING” OF THE IMPERIAL BEACH MUNICIPAL CODE REGARDING AWARD AND EXECUTION OF CONTRACTS. (0380-95)
ORIGINATING DEPARTMENT:
City Manager
EXECUTIVE SUMMARY:
State law allows the City to set forth its own procedures for purchases of supplies, services, and equipment. Chapter 3.04 of the Imperial Beach Municipal Code contains the City’s local purchasing requirements for supplies, services, and equipment. In order to provide for more efficiency, City Staff is recommending that Council introduce the attached ordinance to increase the City Manager’s authority to enter into contracts up to $75,000 if the funds have already been budgeted by City Council.
RECOMMENDATION:
Introduce ordinance and perform first reading by title only, waiving full reading, and set for adoption at the next regular Council meeting.
OPTIONS:
Introduce Ordinance No. 2026-1260; or
Provide further direction to Staff.
BACKGROUND/ANALYSIS:
State law allows the City to set forth its own procedures for purchases of supplies, services, and equipment. Chapter 3.04 of the Imperial Beach Municipal Code contains the City’s local purchasing requirements for supplies, services, and equipment. Currently, the City Manager has the authority to award contracts for supplies, services, and equipment if they are less than $45,000.
Based on the rising costs of services and equipment, it would be more efficient for this threshold to be increased to provide for more authority to the City Manager, as long as the funds have already been budgeted by the City Council. City Staff is recommending that Council introduce the attached ordinance to increase the City Manager’s authority to enter into contracts up to $75,000 if the funds have already been budgeted by City Council. Any contracts for $75,000 or more will still require City Council approval prior to execution. Additionally, Staff has reviewed other jurisdictions within San Diego County, and this amount is within the normal range for City Manager authorization.
Additionally, Staff is currently performing a thorough review of the entire purchasing policies of the City and will submit additional recommendations and changes in the near future.

ITEM TITLE: PUBLIC HEARING ON RESOLUTION NO. 2026-032 OF THE CITY OF IMPERIAL
BEACH, CALIFORNIA ADJUSTING THE REGIONAL TRANSPORTATION CONGESTION IMPROVEMENT PLAN FEE FOR FISCAL YEAR 2027. (0680-95)
ORIGINATING DEPARTMENT:
Public Works
EXECUTIVE SUMMARY:
The TransNet Extension Ordinance Regional Transportation Congestion Improvement Plan (RTCIP) fee is a transportation mitigation fee collected by local jurisdictions to fund improvements to the regional arterial roadway system. Each year, the SANDAG Board of Directors (Board) may adjust the minimum fee charged. On February 27, 2026, the Board approved an adjustment to the RTCIP fee for Fiscal Year 2027, raising it from $3,047.57 to $3,109.88 per dwelling unit.
Resolution No. 2026-032, if adopted, will increase the minimum RTCIP fee to $3,109.88, effective July 1, 2026.
RECOMMENDATION:
Adopt Resolution 2026-032 approving the increase in the RTCIP mitigation fee charged for each new residential dwelling unit constructed in Imperial Beach in Fiscal Year 2027 from $3,047.57 to $3,109.88.
OPTIONS:
Adopt Resolution 2026-032 increasing the Transportation Mitigation Fee to $3,109.88; Request additional information and an additional report BACKGROUND/ANALYSIS:
In accordance with the TransNet Extension Ordinance and Expenditure Plan 04-01, the Imperial Beach City Council adopted Ordinance 2008-1067 to establish a transportation mitigation program to ease transportation impacts of new development on the arterial roadway system. On March 19, 2008, the City Council adopted the Regional Transportation Congestion Improvement Plan (RTCIP) fee of $2,000 per new residential dwelling unit. Under the TransNet Extension Ordinance and Expenditure Plan 04-01, this fee is subject to an annual adjustment—effective July 1 starting July 1, 2009—based on the Engineering Construction Cost Index, as published by the Engineering News Record or a comparable construction cost index. The fee increase will not exceed the percentage increase outlined in the index and will be no less than two percent per year, ensuring that the fee retains its purchasing power in the face of future inflation.
P a g e | 2
In recent years, the RTCIP fee has funded a variety of improvements on State Route 75. Looking ahead, future funds are proposed for allocation toward beautification enhancements at Bicentennial Triangle Park along State Route 75, the only City roadway included in the Regional Arterial System.
Additionally, on March 19, 2026, a notice was published in the Eagle & Times Newspaper announcing a public hearing to be held at the April 1, 2026, City Council Meeting regarding the proposed RTCIP fee increase.
ENVIRONMENTAL DETERMINATION:
The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) on the State CEQA Guidelines.
FISCAL IMPACT:
The adoption of the fee adjustment will enable the City to recover costs that would otherwise be absorbed by the General Fund or diverted from other eligible projects. The fee increase of $62.31 per new dwelling unit is expected to have a negligible fiscal impact on the City’s budget. These funds are designated for roadway capital improvements on or adjacent to State Route 75.

ITEM TITLE: WAKELAND HOUSING AND DEVELOPMENT CO. PROGRESS UPDATE PRESENTATION ON SENIOR HOUSING PROJECT LOCATED AT 455 PALM AVE. (0600-20) ORIGINATING DEPARTMENT:
Community Development
EXECUTIVE SUMMARY:
On November 16, 2022, the City Council adopted Resolution No. 2022-98 authorizing the demolition of existing buildings and the construction of a new 50-unit affordable senior housing development and neighborhood center located at 455 Palm Avenue (“Project”). The property is split-zoned between the R-1500 (High Density Residential) and R-1-6000 (Single Family Residential) zones. As part of the project approvals, the City Council required the developer to provide an update related to development progress and funding. This agenda item is a progress update presentation made to City Council by Wakeland Housing and Development Company (“Wakeland”).
RECOMMENDATION:
The Imperial Beach City Council accept and file the presentation from Wakeland and provide direction to staff as appropriate.
OPTIONS:
Accept and file the presentation; or
Request additional information and an additional report from Staff further detailing the construction of the 50-unit affordable senior housing development and neighborhood center at 455 Palm Avenue.
BACKGROUND/ANALYSIS:
On November 16, 2022, the City Council adopted Resolution No. 2022-98 authorizing the 50-unit affordable senior housing development and neighborhood center located at 455 Palm Avenue (APN 625-230-23-00). On November 6, 2024, the City Council adopted Resolution No. 2024-80 authorizing an extension of the Project’s approvals and resetting the Project’s expiration date to the end of business on December 6, 2026, unless vested with substantial construction or an additional extension is authorized. As part of Resolution No. 2024-80, the City Council required Wakeland to provide an update related to development progress and funding. Wakeland will be providing said update to City Council on progress made to date, including approximate timelines of construction, comments regarding the completion of financing for the Project, as well as be available to answer any other questions posed by City Council.
P a g e | 2
ENVIRONMENTAL DETERMINATION:
The Project was determined to be categorically exempt pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15332 (In-Fill Development Projects).
FISCAL IMPACT:
Wakeland has requested approximately $625,000 of Imperial Beach Housing Authority Funds and a waiver of City permitting and planning fees. This would be contingent upon the standing of the approvals of the Project entitlements by the City Council and would require future action by the City Council to approve both the transfer of funds and waiver of fees. No funds shall be expended or disbursed by the City or the Imperial Beach Housing Authority to assist with the costs of acquisition and development of the Project, unless and until a satisfactory Affordable Housing Agreement for the Project is considered or approved by the City Council or Housing Authority Board in the manner required by law. The approval or disapproval of such Affordable Housing Agreement shall be at the sole discretion of the City Council or Housing Authority, and the approval of these Project entitlements shall not bind the City or the Housing Authority to expend or disburse any such funds for the Project.

ITEM TITLE: DISCUSSION AND SELECTION OF PATRIOTIC AND COMMEMORATIVE STREET BANNERS FOR SEACOAST DRIVE. (0900-95)
ORIGINATING DEPARTMENT:
City Manager
EXECUTIVE SUMMARY:
This report presents recommendations for the selection and installation of patriotic and commemorative street banners along Seacoast Drive, replacing the annual flag display to celebrate the 250th anniversary of the United States. Staff reviewed banner sizing, materials, and placement to ensure durability and visual appeal, and collaborated with vendors to develop design options for both United States flag and commemorative anniversary banners. This report outlines several design options for the City Council to review, with plans for installation to coincide with Memorial Day, Labor Day, and the 4th of July. The goal of these improvements is to enhance the streetscape for everyone who works, lives in, or visits the area.
RECOMMENDATION:
It is recommended that the City Council approve the installation of both United States flag banners and commemorative anniversary banners. Staff further recommends that the Council select banner designs that best represent patriotic spirit and the significance of the anniversary, ensuring a welcoming and festive streetscape for residents and visitors alike.
OPTIONS:
Select from the design options for the United States flag and 250th anniversary banners; Request additional information and provide direction to the City Manager and return to a future meeting.
BACKGROUND/ANALYSIS:
In 1997, the City Council adopted Council Policy 610—Streetscape Banner Management Plan, to visually enhance the beachfront and promote the City to both tourists and residents through the use of street banners. These banners are displayed on streetlight poles along both sides of Seacoast Drive, between Imperial Beach Boulevard and Palm Avenue, with a total of 33 poles combined. All banner designs must be approved by the City Council based on their content, overall design, and public benefit.
According to the policy, banners should measure 94 by 30 inches. However, these dimensions are too large given our 30-foot poles. Therefore, staff recommends banners sized at 30 by 84 inches. The banners should be double-sided and printed on durable material suitable for coastal conditions, such as vinyl, sunbrella, or a similar durable fabric.
P a g e | 2
Each year, the City installs United States flags along Seacoast Drive and throughout other portions of the City between Memorial Day and Labor Day. Staff recommends installing patriotic street banners along Seacoast Drive as a replacement for the traditional flags, creating an attractive tribute to national pride. The banners are intended to preserve the spirit of the annual flag display while enhancing the streetscape for both residents and visitors.
In recognition of the 250th anniversary of the United States, staff also recommends displaying both U.S. flag banners and commemorative banners along Seacoast Drive. Patriotic buntings would be installed at the Dempsey Safety Holder Center's west and north patios for Independence Day. Additionally, six U.S. flags would be positioned on the flag poles at Pier Plaza from Memorial Day through Labor Day.
The plan is to install 33 United States flag banners along Seacoast Drive about one to two weeks before Memorial Day and remove them after Labor Day. Staff have collaborated with a company to create three design options for banners measuring 30 by 84 inches, made from Mainstreet Fabric with an expected lifespan of eight to nine years. The options listed below are available for City Council consideration and selection regarding the United States flag banners:
Option 1 Option 2 Option 3
In addition to the United States Flag street banners, ten commemorative 250th Anniversary street banners would be installed during the week of June 1 and removed the week of July 31. These banners would be alternated with the US flag banners. City staff partnered with a vendor to develop four design options for the 250th Anniversary banners, which are intended for display on both sides of Seacoast Drive. Each banner would be constructed of vinyl and would measure 30 by 84 inches. The installation would utilize an alternating arrangement with the United States Flag Street Banners. The following design options are provided for City Council review and selection in relation to the United States flag banners:
P a g e | 3
Option 1 Option 2 Option 3 Option 4
Once the City Council has selected each banner template, City staff would proceed to place the order. The estimated delivery timeframe is two to three weeks, after which staff would be responsible for installing the banners.
The City also has the option to sell the used 250th Anniversary banners once they are no longer needed. The sale price would reflect their condition, but it would never be higher than the amount the City originally paid.
Additionally, staff is developing banner options featuring the "Eat, Shop, Play and Stay Local" theme. More details about this initiative is intended to be shared soon.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT:
The estimated cost is $10,900, which includes 10 vinyl banners (30x84 inches) commemorating the 250th Anniversary, 33 United States Flag Banners (30x84 inches), and 33 spring-loaded brackets for installation. The spring brackets require a one-time investment of about $4,300. The City Manager's contingency account in the current operating budget has sufficient funds to pay for these expenses.
