Dear Mayor, City Council Members, and City Staff,
My name is Thomas Canant, and I am writing as a concerned resident and systems-focused advocate regarding the ongoing environmental and public health crisis impacting Imperial Beach and the South Bay region.

For too long, our communities have been forced into a reactive cycle:

Beach closures.

Air quality concerns.

Infrastructure strain.

Emergency response costs.

Public frustration.

Political finger-pointing.

Meanwhile, residents continue paying the price physically, economically, and psychologically.

Imperial Beach has become one of the front lines of the Tijuana River sewage crisis, yet much of the public conversation still revolves around temporary reaction instead of permanent prevention.

We need to begin thinking differently.

The future of this region will not be secured through emergency declarations alone. It will be secured through transparent systems, resilient infrastructure, measurable outcomes, and long-term operational planning capable of handling surge events before contamination spreads through our communities.

That means:
• Real-time public transparency dashboards for air, water, and overflow conditions • Prevention-first infrastructure investments instead of endless cleanup cycles • Regional surge containment and equalization strategies during peak flow events • Independent public oversight and data visibility
• Coordinated federal, state, county, and binational pressure for durable solutions • Infrastructure designed for resilience, not optics
The public is exhausted because they feel trapped inside a system that responds after failure instead of preventing failure from occurring.

Imperial Beach has an opportunity to help lead a different model:

A city that embraces transparency.

A city that measures outcomes publicly.

A city that prioritizes public health and infrastructure resilience over political theater. a.1 05/06/2026 Item No 6
Last Minute Agenda Information
I also believe this crisis presents an opportunity for innovation and collaboration between engineers, public agencies, environmental experts, technologists, and community members willing to contribute constructive solutions.

The people of Imperial Beach deserve clean air, safe water, open beaches, and honest accountability regarding the conditions affecting their daily lives.

This issue is no longer temporary.

It is structural.

And structural problems require structural solutions.

Thank you for your time, your service, and your continued attention to the people most affected by this ongoing crisis.

Respectfully,
Thomas Canant
San Diego County Resident

Non-Agenda:

It was very pleasantly surprising to see the winner of the Art Contest was not a child. I also enjoyed hearing her story of going from Visitor to Certified IB Resident.

Her art was also colorful and impressive. It will truly look good plastered everywhere this year. I can’t wait to see it on something.

The Scripps UCSD student researchers did a really amazing job again, and reaffirmed some issues I’ve seen at the Air Pollution Control District – Specifically, that their Air Monitors have obviously NOT been working properly since before September 2025, when I first publically addressed the issue to the Board. Perhaps APCD and UCSD need to start coordinating to finally get the data accurately and effectively. That’s what I’m going to advocate for at the next APCD meeting.

The Atlas guy at the last meeting was a real car-salesman-type. His wannabe smooth-talking 15 minute monologue was worse than the actual presentation, which I didn’t think was possible. I was sold on nothing – no to “Urban Toolkits” for IB. 👎
Regarding SB707...When a City Attorney has to remind Council of “First Amendment Rights”, we have a problem. However, that shows how well of a job Jennifer has been doing, because not every City Attorney has brought up basic b.1 05/06/2026 Item No 6

Rights. There can be ignorant Council Members, but there should not be ignorant City Attorneys on Law.

Mayor – Don’t confuse Free Speech for Meeting Order. There’s only one that should have Guidelines.

At the last meeting, for the millionth time, Matthew brought up drinking TWICE. 🍺 🍺 I have considered making a montage of every moment Matthew has brought up drinking while at a Council meeting. It’s a crazy amount of times, especially when considering the multiple reports of him Drunk Golf Cart Driving.

And after hearing him say he’s “not worried about dying” from Mexican Sewage, I found it very disturbing.

It’s never too late to turn your life around, get clean, associate with better people, and start doing the right thing in life.

However...🤡Matthew seems to have NO intention of taking a just path – only the path of Most Corruption, just like all his Corrupt Union Buddies in Politics. Dear Council Members, I recommend adding a paragraph with some strong wording as the introductory paragraph. Here’s an example:
“Governor Newsome, one of the worst environmental and health crisis disasters is happening and worsening under your watch. We have moved beyond just ocean pollution along our shores. Scientists have proven that toxic waste, dangerous chemicals, carcinogenic air pollution, and a dramatic increase in raw sewage are constantly flowing across multiple communities in Southern California. There are constant beach closures at our beautiful local and state beaches in Coronado, Silver Strand, US Navy SEAL training facilities, Imperial Beach, and beyond. Children and other vulnerable populations are getting sick. Residents are suffering from the fumes and smell. Yet you’ve declined to declare a state of emergency. The time has come to step up and be the voice for your constituents who need you to take appropriate action.”

I have reviewed the draft letter requesting that Governor Newsom declare a State of Emergency and offer the following comments for your consideration:

In the third paragraph, where toxic aerosols are referenced, consider adding that they include known carcinogens to emphasize the seriousness of the situation.

In the penultimate paragraph, the phrase “public health concerns” understates the severity of the situation. I recommend stronger language such as “a worsening public health threat” or “an escalating public health crisis.”
In the final paragraph, consider explicitly requesting a meeting with the Governor and/or inviting him to visit the area for a tour and to meet directly with affected residents.

Thank you for taking this important action. We need strong, persistent and visible leadership at the local level to give the people of IB a voice.

Sincerely,
Sandy Brillhart

Happy to provide any charts with our latest results that can be included.

My main point is this should not be a polite request--you are asking the Governor to do his job and protect the residents of CA who are being harmed by every standard that is available.

Suggested Insert Blocks for the May 6, 2026 City Council Letter to Governor Newsom Re:

State of Emergency Declaration — Tijuana River Transboundary Pollution Crisis, Prepared by:

Kimberly Prather, Distinguished Professor, Scripps Institution of Oceanography, UC San Diego May 5, 2026
The following insert blocks are written in the existing letter's institutional voice and are intended to be incorporated directly into the draft. Each is labeled with its suggested location.

INSERT 0 — Legal Framing (Statutory Duty) Suggested location: Early in the letter — between the opening paragraph and the body of the argument. Sets the legal frame that governs everything that follows.

We write not to request a discretionary favor, but to invoke a statutory duty. California law does not leave the protection of residents from documented toxic air exposure to executive preference.

Under California Health and Safety Code §39650, the Legislature has expressly declared that "the people of the State of California have a primary interest in the quality of the physical environment in which they live, and that this physical environment is being significantly degraded by the emissions of air contaminants." The Code further establishes that it is the responsibility of the State, through the California Air Resources Board, to protect the public health from toxic air contaminants — language that is mandatory, not aspirational. When the documented record shows continuous exceedance of health-protective thresholds, with concentrations escalating year after year and with no precedent in any inhabited area on Earth, the conditions for State action are not a matter of judgment. They are a matter of compliance with the law the Legislature has already written.

INSERT 1 — Air Quality, Documented Exposure, and Affected Populations (consolidated) Suggested location: Replaces the existing paragraph beginning "This is no longer solely a water quality issue…" — and the paragraph immediately following it.

This is no longer solely a water quality issue; it is an air quality and public health crisis on a scale and duration that has no documented parallel anywhere on Earth. Polluted flows in the river are generating hydrogen sulfide — a potent neurotoxic gas with established respiratory, neurological, and cardiovascular health effects — alongside co-emitted toxic gases, volatile organic compounds, and airborne pathogens. Companion water chemistry analyses have identified IARC Group 1 carcinogens, including benzene, trichloroethylene, and carbon tetrachloride, at multiples of California maximum contaminant levels. The combined airborne exposure burden in the residential neighborhoods adjacent to the river is, on the documented scientific record, without parallel in any inhabited area in the United States.

The air-quality dimension of this crisis is now extensively and quantitatively documented.

Continuous monitoring at two community sites — the Nestor/Saturn Boulevard trailer and an Imperial Beach coastal station — establishes two findings of decisive importance. First, residents c.3 05/06/2026 Item No 11.a
Last Minute Agenda Information
are exposed essentially continuously to hydrogen sulfide (H₂S) above the U.S. EPA chronic reference concentration of 1.44 ppb: in late 2025 and early 2026, the 8-hour exceedance rate reached 95–99% of the time, month after month. Second, acute exposure to concentrations exceeding the California Air Resources Board and OEHHA 1-hour reference exposure level of 30 ppb has escalated sharply over the past year. On an 8-hour basis, March 2026 exceedances of the 30-ppb threshold were roughly seven times higher than March 2025, and April 2026 exceedances were nearly double those of April 2025. One-minute H₂S peaks have reached 4,494 ppb in 2026. Residents are now spending nearly half of every 8-hour window above California's acute health threshold.

Residents, workers, and first responders — including Border Patrol agents, U.S. Navy personnel, lifeguards, and schoolchildren in directly exposed zones — are reporting symptoms fully consistent with documented hydrogen sulfide exposure: respiratory irritation, headaches, nausea, dizziness, sleep disruption, and, in clinical settings, asthma exacerbation, particularly among children. These reports are not anecdotal. They correlate in time and location with monitored exceedance events, and the populations in which they appear are the same populations our continuous monitoring shows to be above California's chronic health threshold nearly every day. (See Attachment A: H₂S Threshold Exceedance, 1-hour and 8-hour averaging, 2024–2026.) INSERT 1B — Year-over-Year Escalation Suggested location: Immediately following Insert 1, to drive the escalation point home before pivoting to scale.

The escalation is not speculative; it is measured. Comparing identical months across years removes any seasonal confound. In March 2025, residents were exposed to H₂S concentrations above the 30-ppb acute threshold approximately 6% of the time on an 8-hour basis; in March 2026, that figure rose to approximately 45% — a sevenfold increase. April 2025 (~27%) to April 2026 (~48%) shows a near-doubling over twelve months. A trajectory of this magnitude, sustained, indicates that the next twelve months will be materially worse than what is documented today. A response measured in years is not commensurate with this rate of change.

INSERT 2 — Global Scale and Salton Sea Comparison Suggested location: Immediately after Insert 1B.

The scale and character of this exposure has no documented parallel. Approximately 80 million gallons per day of raw, untreated wastewater continue to enter California from across the border.

During the dry season — when the Tijuana River channel should carry zero flow — the river instead carries a continuous stream of raw sewage and industrial waste through populated California communities. There is nowhere else in the United States where this is permitted to occur. The result, on the documented scientific record, is the highest sustained concentrations of hydrogen sulfide ever measured in any inhabited area in the world. For context, peak H₂S c.4 05/06/2026 Item No 11.a
Last Minute Agenda Information
concentrations in South Bay are more than tenfold higher than those documented around the Salton Sea — a region where the State has already deployed significant emergency resources.

The exceptional nature of the harm is itself the case for an exceptional State response.

INSERT 3 — Closing the Federal-Land / International Loophole Suggested location:

Strengthens the existing paragraph beginning "Although this crisis involves federal infrastructure and international considerations…" — can replace or expand the bolded sentence.

Although this crisis involves federal infrastructure and international considerations, the impacts are being felt directly by Californians — and the State has consistently acted in analogous circumstances. Your Administration has declared States of Emergency for wildfires that ignited on federal land, because the harm fell on California residents and that was legally sufficient. The same principle governs here: California air quality standards are the ones being exceeded, California's medical and public-health system is absorbing the consequences, and California residents are the ones being harmed. Jurisdictional origin does not extinguish the State's obligation when the exposure occurs on California soil.

INSERT 4 — Government Code Citations Suggested location: Inside the paragraph invoking the California Emergency Services Act, immediately after the sentence "…a State of Emergency is appropriate when conditions of extreme peril exceed local and regional ability to respond." The legal threshold is clearly met under Government Code §8558(b), which defines a state of emergency as conditions of extreme peril to the safety of persons and property; under §39650(c), which establishes the State's affirmative responsibility to control toxic air contaminants; and under §8625, which grants the Governor the authority to proclaim a State of Emergency on these grounds. Each provision is satisfied by the documented record before you.

INSERT 5 — Transboundary Precedent Suggested location: As a short paragraph before the formal request.

State action across an international boundary is not legally novel. The New River Improvement Project established the precedent that California can lead remediation of transboundary contamination flowing into the State, and the Salton Sea response established that the State will deploy emergency resources for ambient air toxicity at concentrations far below those now being measured in South Bay. Both precedents support — and arguably compel — a State of Emergency declaration here.
c.5 05/06/2026 Item No 11.a
Last Minute Agenda Information
INSERT 6 — Operational Rationale for SOE Suggested location: As a paragraph explaining what a declaration would actually do, before the closing request.

A State of Emergency declaration is the operationally appropriate instrument for the present crisis. It would align the California Air Resources Board, the State Water Resources Control Board, the San Diego County Air Pollution Control District, and CalEPA under coordinated command, ending the current fragmentation across agencies. It would permit the redirection of resources already appropriated and personnel already in the field to the most acute persistent ambient air toxicity event documented in the United States. And it would provide the legal and budgetary instruments necessary to deploy interim protective measures — air filtration in schools, indoor-air remediation in affected homes, expanded medical surveillance — on a timeline measured in weeks, not years.

INSERT 7 — Sharper Closing Ask and Timeline Suggested location: As, or alongside, the closing request paragraph.

Under California Government Code §8625 and Health and Safety Code §39650, the protection of California residents from documented toxic air exposure is a statutory duty of the State, not a discretionary courtesy. We therefore call upon you to proclaim a State of Emergency for the affected South Bay communities on a timeline measured in days, not quarters. Long-term infrastructure investments are necessary, but they cannot substitute for an immediate response to a population that is currently breathing acutely toxic air. Our schools — where children are now being kept indoors during exceedance events — cannot wait. The escalating record will not wait.

The City stands ready to provide further data, to meet with your staff at any hour, and to support the State in any operational capacity required.

INSERT 8 — The Cost Argument (Final Closing) Suggested location: As the final paragraph before the sign-off, immediately following Insert 7. Frames the spending decision as inevitable, with the only variable being timing.

We recognize that an immediate State response will require resources. We ask you to weigh that figure against the alternative. The State will pay for this crisis either way — the only question is whether it pays now, on terms it controls, or pays later, on terms it does not. Continued delay does not save money; it defers it, and compounds it. The medical costs of chronic exposure to hydrogen sulfide and the co-emitted toxic contaminants in the untreated wastewater entering California accrue across decades — in pediatric asthma, neurodevelopmental impacts, cardiovascular disease, occupational illness among first responders, and lost productivity across an entire region of the State. California will absorb those costs through Medi-Cal, through the public hospital system, through workers' compensation, through special education services, and through diminished economic activity in a community whose coastline and businesses are c.6 05/06/2026 Item No 11.a
Last Minute Agenda Information
already closed. Acting today is not the most expensive option. It is the only affordable one. Every month of delay enlarges the bill the State will eventually be required to pay, and that bill will be paid in human health of California residents long before it is paid in dollars.

Attachment A — Figure caption
Attachment A. H₂S Threshold Exceedance at South Bay Community Monitoring Sites, 2024–2026. Monthly fraction of time during which measured hydrogen sulfide concentrations exceeded two health-protective thresholds: the U.S. EPA chronic reference concentration (RfC) of 1.44 ppb (green) and the California Air Resources Board / OEHHA 1-hour reference exposure level of 30 ppb (orange). Top panel: 1-hour averaging. Bottom panel: 8-hour averaging.

Continuous monitoring conducted at the Nestor/Saturn Boulevard trailer and Imperial Beach coastal station. Data through April 2026. The 8-hour averaging window better reflects the duration of exposure relevant to public health outcomes; on this metric, residents have been above the federal chronic threshold for 95–99% of the time in late 2025 and early 2026, and time above the acute 30-ppb threshold has escalated approximately sevenfold from March 2025 to March 2026.

Imperial Beach City Council and Staff,
Thank you for the draft letter requesting the Governor to declare a State of Emergency regarding the sewage crisis here in Imperial Beach. I am an Imperial Beach resident and am expressing my support for the City Council to send this letter to the Governor.

I know personal stories can sometimes help, so am willing to share mine. My spouse purchased our property near Oneonta Elementary over 10 years ago, and I moved here shortly after. We built a small ADU in our backyard where we live with our three year old and my parents now live part-time in our front (original) house. We fell in love with IB when we first moved here - biking to the beach every morning with our surfboards on our bike to get some waves before work, countless hikes and jogs through the estuary down to the pier, and we even had our wedding on the beach here. It has been a great community to grow roots, but this past year, we have been trying to figure out if we give up our perfect ADU and all the work we've put into our home and building our community in order to find a safer place to live and raise our daughter.

We have had many impacts from the sewage. Here are some, not in prioritized order:

1. We run our air purifiers 24/7 and our air conditioning at night because we can't keep the windows open. This impacts our sense of peace, our sleep, and our power bills. Even with everything closed and all of this equipment running, we are still woken up some nights by the stench and multiple times have been immediately nauseous.

2. We have had sinus and gastrointestinal issues in our house, and I have had consistent migraines for a year now.

My reprieve from sinus and migraine issues comes when I leave IB for more than 5 days, and it always returns shortly after I return. I am terrified as to what the air pollution (toxic VOCs in addition to H2S) is doing to my daughter's body as she develops. I found childcare for her north of IB and we commute daily to make sure she spends her days outdoors in a healthier environment. I work from home so have to keep everything shut and stay inside some days.

3. We have to drive at least 25 minutes to have a beach day or surf. I know this might sound frivolous but this is part of our mental and physical health, and it is also where I have made community. We rarely get out anymore because the barrier has become too high. We rarely let our daughter play on the beach here anymore, which is something we dreamed we would do daily when we talked about having her.

4. I struggled with postpartum depression, and the best thing I could do was exercise outside - walking, swimming, surfing. The sewage was so bad during those months, I was shut inside and I am confident it exasperated the length of time I suffered. It wasn't just the exercise and being outside that I missed, it was the walks with friends and conversations with neighbors that I needed too.

I am sure you will also get data and stories from people about home values, not going to the restaurants down by the beach like they used to, etc., and I agree with all of those concerns as well. Thank you for your continued efforts to help the community solve this crisis.

Respectfully,
Chelsea Grace, P.E.

1) Expect a predictable “No” to a State Of Emergency.
2) It just plays into Fascist Manuela Paloma Aguirre’s useless, toxic, filthy hands and mouth. She’s currently scheming at SANDAG for yet another pointless letter, manipulating desperate Career Politicians worried about promoting themselves to stay in Government forever.

However, if the timing of this letter is intentional for that and other reasons, then I am satisfied.
3) Just for technical consideration, I noticed there’s no mention of how many millions of gallons of Mexico’s Sewage hits IB every day on average, nor the data on Hydrogen Sulfide spikes, nor the days/years worth of beach closures, and nor the specific economic damage that the County studied over 2 years ago.

It won’t create a “yes” vote, but it would be nice to have letters that specifically reveal an increasingly worse pattern...while Mexico continues to be propped up over American Citizens in SO many sickening different ways.

California REALLY, REALLY needs a new Governor who isn’t about himself being a 🤡King – As well as an entire replacement of the Sacramento Swamp.

Good luck to us all this year.

Hope you enjoyed my colorful comments,

Please do consider writing to Governor Newsom requesting that he declare a State of Emergency for the Tijuana River Valley. It is my understanding that if this is done, it will help to fastrack a fix at the federal level.

Thank you,
Margaret Williamson
