Staff Report -City Attorney July 7, 2022
Findings to Hold Remote Teleconference/Virtual Meetings and Hybrid (i.e., In-Person and Teleconference/Virtual) Meetings for All City Legislative Bodies, in Accordance with Assembly Bill 361
RECOMMENDED ACTION:
Council APPROVES remote teleconference/virtual and hybrid meetings for all City legislative bodies by finding that a statewide state of emergency is currently in place and that state and local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and
AUTHORIZES City Manager to implement teleconference/virtual or hybrid public meetings as needed in accordance with Assembly Bill 361.
Background:
All meetings legislative bodies of the City are subject to the Ralph M. Brown Act (Gov. Code §§ 54950 et seq.), and must be open and public so that any member of the public may attend and participate in the meetings. Commencing in March of 2020, Governor Newsom issued a series of executive orders aimed at preventing the spread of a respiratory disease that came to be known as the novel coronavirus, “COVID-19.” Among these were Executive Orders (“EO”) N-25-20, N-29-20, and N-35-20 (collectively, the “Brown Act Orders”) that waived the teleconferencing requirements of the Brown Act to allow legislative bodies to meet virtually.
On June 11, 2021, the Governor issued EO N-08-21 to begin winding down some of the prior measures that were adopted to respond to COVID-19. Notably, EO N-08-21 rescinded the Brown Act Orders, effective September 30, 2021. On September 16, 2021, Governor Newsom signed AB 361, which became effective October 1, 2021, and amended the Brown Act to allow legislative bodies to meet virtually, without following the Brown Act’s standard teleconferencing rules, provided that the legislative body makes specific findings, which include the following: (1) a statewide state of emergency is currently in place; and (2) state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19.
Continued compliance with AB 361 will require the City Council to approve the action making the City of Indian Wells Printed on 6/30/2022Page 1 of 2

File #:124-22 Item #:A.
Continued compliance with AB 361 will require the City Council to approve the action making the required findings every 30 days (or at the next Council meeting, if greater than 30 days).
Analysis:
The Governor has proclaimed a state of emergency in response to the ongoing COVID-19 pandemic.
The state of emergency currently remains in effect. Further, State officials - including the California Department of Public Health - and local officials have recommended measures to promote social distancing in connection with COVID-19, which are currently in place. Accordingly, both of the above -referenced findings required by AB 361 exist.
The City Council recognizes that a person’s ability to attend and participate in person might change suddenly, depending on the person’s exposure to the virus, or changes in the person’s own health and vulnerability to infection. The Council recognizes that members of the public, and from time-to- time, members of the Council and of other City legislative bodies, as well as City staff might need to or might feel more comfortable attending meetings virtually in light of the ongoing COVID-19 pandemic and the manner in which circumstances surrounding the pandemic, including the impact on individual and public health, may rapidly change. Accordingly, the City Council thus desires to allow for virtual or hybrid (in-person and virtual) meetings of all the City’s legislative bodies in order to both ensure the health and safety of the public, City officials, and City staff, as well as continuity of government in allowing regularly scheduled meetings to continue to occur without unanticipated interruption.

Staff Report - Public Works July 7, 2022
Authorize the City’s Non-Participation in the Three-Year Urban County Program of the County of Riverside Economic Development Agency for Federal Fiscal Years 2023-24, 2024-25 and 2025-26
RECOMMENDATION:
Council AUTHORIZES the non-participation in the Urban County Program of the County of Riverside Economic Development Agency for Federal Fiscal Years 2023-24, 2024-25 and 2025-26.
DISCUSSION:
The County of Riverside under the “Urban County Program” administers three grant programs sponsored by the U.S. Department of Housing and Urban Development (HUD); the Community Development Block Grant (CDBG), the HOME Investment Partnership Program (HOME), and the Emergency Solutions Grant (ESG). The collective purpose of these grant programs is to improve blighted areas of cities, provide funding for projects improving handicap access, homeowners’ assistance for first time home buyers, creating affordable housing for low-income households and homelessness assistance/prevention.
The City has the option to participate with the Urban County Program and gain access to County administrative support for each successful grant application. However, under the HUD rules, participating with the County restricts the City from participating in the HUD Small Cities grant program which has additional funding available. In addition, the City is still eligible to apply for any grant available under the County’s program.
Staff is recommending opting out of the Urban County program to allow for more flexibility in the types of HUD grants the City can pursue.
A city that participates as a “Cooperating City” within the Urban County program is automatically included in the County’s HOME and ESG programs. As a Cooperating City, Indian Wells could potentially receive funding from programs such as Homelessness Assistance/Prevention Programs, Home Enhancement Program and the First-Time Home Buyer Program.

Historically, the City has received funding for CDBG in the amount of approximately $15,000 per year. If the City applies for grants under HUD’s Small Cities CDBG programs, there is potential to receive additional funding.

Indian Wells City Council
Staff Report - Finance July 7, 2022 City Treasurer’s Report for May 2022
RECOMMENDED ACTION:
Council RECEIVES and FILES the City Treasurer’s Report for May 2022.
DISCUSSION:
Attached are the monthly cash balance and investment reports for the month of May 2022.
Investments reflected in this report are “Marked-to-Market”, meaning the market value of City’s investments is updated monthly. This method provides a clear depiction of the value of the City’s portfolio subject to the performance of the investment market. The City of Indian Wells continues to maintain prudent fiscal reserves and minimize un-invested cash.
Cash and Investments
As of May 31, 2022:
·The City’s cash and investments totaled $89,859,369.96 ·The City’s portfolio earned a 1.069% rate of return.
Treasurer’s Certification
Compliance - The City Treasurer certifies the City’s cash and investments presented in this Report are in compliance with the City’s investment policy and with legal requirements of State of California Government Code section 53600.
Liquidity - The City Treasurer certifies the City’s portfolio is sufficient to meet its financial obligations for the next six months. The investment portfolio will remain sufficiently liquid to meet all operating requirements, which might be reasonably anticipated. This is accomplished by striving to have securities mature at the same time cash is needed to meet anticipated demands (static liquidity). Additionally, since all possible cash demands cannot be anticipated, the portfolio consists largely of securities with active secondary or resale markets (dynamic liquidity).
Fiscal Prudence
When investing, reinvesting, purchasing, acquiring, exchanging, selling, or managing public funds, a trustee shall act with care, skill, prudence, and diligence under the circumstances then prevailing, including, but not limited to, the general City of Indian Wells Printed on 7/1/2022Page 1 of 2

economic conditions and the anticipated needs of the City, that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity needs of the City.
Background
Staff provides Council with a monthly update to the Treasurer’s Report. The Report presents the City’s cash activity and investment portfolio and provides reconciliation between investment balances and the General Ledger. Specifically, the report provides information on the types of investments, dates of maturities, costs, updated market value of securities, and rates of interest earned in the portfolio.
The City maintains a written investment policy in compliance with legal requirements of Government Code section 53600 and governs the investments made by the City. It is the policy of the City of Indian Wells to invest public funds in a manner that will provide the maximum security with the highest investment return while meeting the daily cash flow demands of the City. The investments purchased by the City are consistent with the City’s investment policy and are allowable under current legislation of the State of California.
The City invests in U.S. treasuries, federal agency securities, medium term corporate notes, municipal bonds, federally insured certificates of deposit, and overnight cash investments. Criteria for selecting investments in order of priority are:
(1) safety, (2) liquidity and (3) yield.

Indian Wells City Council
Staff Report - City Manager’s Office July 7, 2022 Memorandum of Understanding Approving a Two-Year $200,000 Financial Support for CVAG’s Coachella Valley Housing First Program RECOMMENDED ACTIONS:
Council APPROVES a two-year Memorandum of Understanding (MOU) with the Coachella Valley Association of Governments to provide funding toward their Coachella Valley (CV) Housing First Program; and
AUTHORIZES the City Manager to execute all necessary documents for same; and APPROVES a Supplemental Appropriation of $100,000 for the Fiscal Year 2022-2023; and DIRECTS Staff to include $100,000 for the Fiscal Year 2023-2024 in the upcoming two-year budget for future adoption.
DISCUSSION:
Prior to the May Budget Revise, the Finance Committee met on May 10, 2021, to discuss funding options and agreed to fund CVAG’s valley-wide CV Housing First program out of the City’s General Fund, keeping vital Housing Authority funding to other homelessness similar to the prior fiscal year.
Based on the input and action by the CVAG Homelessness and Executive Committees, CVAG has transitioned the CV Housing First program from an outsourced program to one operated by CVAG staff for 2021. This transition has also allowed CVAG to refine the program and bring increased responsiveness and capacity to the Coachella Valley, particularly as it pertains to assisting local law enforcement and public health workers with homeless services. The transition to an in-house program has also allowed CVAG to focus its efforts on clients who might not be able to get help elsewhere.
Given this information, during the City Council Meeting of May 20, 2021, Council agreed with the Finance Committee’s recommendation to allocate $100,000 to the Fiscal Year 2021-2022 Community Assistance Program Fund for this purpose.

In September 2021, CVAG’s Homelessness Committee recommended and CVAG’s Executive Committee authorized the execution of multi-year MOUs with each participating city.
In March 2022, representatives from CVAG contacted City Staff with a draft of this multi-year MOU for consideration and execution for Fiscal Years 2022-2023 and 2023-2024.
This MOU (Attachment 1) is being presented to Council today for discussion and direction.
FISCAL IMPACT:
Funding for CVAG’s CV Housing First was not included in the two-year budget adopted by Council.
Entering the MOU would require a supplemental appropriation of $100,000 to the existing Fiscal Year 2022-2023 budget and would require Staff to include another $100,000 for the Fiscal Year 2023- 2024 in the upcoming two-year budget for Council’s future adoption. Funding the Fiscal Year 2022- 23 contribution reduces the General Fund’s anticipated surplus from $306,000 to $206,000.

Prior to CVAG performing the Scope of Services, and upon renewal of such policies, CVAG shall submit to the City certificates of insurance and any applicable endorsements evidencing that the foregoing policy or policies are in effect. The coverage contemplated in this paragraph will be primary and the City’s coverage will not contribute. CVAG shall provide workers’ compensation insurance in accordance with California law, along with a waiver of subrogation endorsement in favor of the City.
80 5.0 ADDITIONAL PROVISIONS.
5.1 In all cases, the language in all parts of this Memorandum shall be construed according to its fair meaning and not strictly for or against either Party, if being agreed that the Parties or their agents have all participated in the preparation of this Memorandum.

ITEM 7F
Coachella Valley Association of Governments
Homelessness Committee
June 15, 2022
STAFF REPORT
Subject: Funding Agreements for the CV Housing First Program Contact: Erica Felci, Assistant Executive Director ([email protected]) Recommendation: Information
Background: Since 2008, CVAG has funded its regional homelessness programs – first Roy’s Desert Resource Center, and then later programs that evolved into CV Housing First – by contributions from member jurisdictions. This process has involved CVAG staff sending a request to each city and tribe as well as the County of Riverside. Sometimes the jurisdictions approve the request as part of the annual budget; other times, it is done through a separate action. Some have done this based on calendar year, and others on fiscal year – adding to additional record keeping at CVAG.
In 2021, at the recommendation of the CVAG Homelessness Committee, the CVAG Executive Committee authorized the Executive Director to negotiate and execute Memorandums of Understanding (MOU) with member jurisdictions to secure multi-year funding commitments for the CV Housing First program. CVAG staff has since circulated a draft MOU to member jurisdictions for their consideration, and invoiced each jurisdiction that had committed to funding the program for the current fiscal year. The MOUs would secure $100,000 a year through fiscal year 2023/24.
The Palm Desert City Council approved the agreement on May 12, 2022, making it the first city to approve a multi-year agreement. Two cities – Cathedral City and La Quinta – have authorized one-year MOUs. The County of Riverside, which has been instrumental in helping CVAG secure additional funds through grants, has an agreement for general fund contributions through fiscal year 2025/2026.
Support for the CV Housing First program, and the transition to in-house operations, has been resounding. Long-term funding agreements will ensure financial stability for the program, and avoid the uncertainty – and significant staff time – that comes with the traditional process of asking cities for funds each year. CVAG staff has consulted with Legal Counsel, who notes that there is no legal impediment to cities entering into a multi-year commitments. Additionally, the California Constitution debt limit only prohibits a multi-year contract where the funds to pay the full contract are not on hand, and that the amount of this proposed MOU does not appear large enough to create that concern.
Fiscal Analysis: The CV Housing First program, including the staffing and program operations, is funded by contributions from member jurisdictions and grants. CVAG’s city and tribal member jurisdictions are each asked to contribute $100,000 a year for the operations. Riverside County’s ATTACHMENT #2
87 contribution through June 2026 is for $359,711 annually. The program also has a strong financial backer in the Desert Healthcare District/ Foundation. The current agreement is for $500,000, and the District/ Foundation’s agreement has a clause that CVAG needs to demonstrate a continued commitment of current funding levels from the CVAG member agencies.

Mid-Term Update to Indian Wells Golf Resort Operating and Capital Budgets RECOMMENDED ACTION:
Finance Committee recommends Council AMENDS the Golf Resort Operating and Capital Budget for the Fiscal Year 2021-22 through 2022-23 as presented.
DISCUSSION:
After a comprehensive review resulting in multiple discussions, revisions, and additional information requests, the Finance Committee recommends Council amend the Golf Resort budget for the Fiscal Year 2021-22 through 2022-23 as presented.
Operating Forecast
The revised net profit for operations at the Golf Resort for Fiscal Year 2021-22 is $2.8 million and $2.6 million for the Fiscal Year 2022-23. The net profit pictured below is consistent with Council’s fiscal goal, includes the amenity fee, and is before City administrative costs, capital improvements, and deprecation of golf-related assets.

Key Issues and Concepts
·The Indian Wells Golf Resort has experienced a significant increase in Golf ADR (the average rate a person is willing to pay for a round of golf) and in the Average Check (the average rate a person is willing to pay for a meal).
·The Golf Resort is budgeted to remain profitable before including Resident Green Fee Amenity revenue.
o The Fiscal Year 2021-22 was the first time in over a decade that the Golf Resort was profitable before including Resident Green Fee Amenity revenue. ·The Fiscal Year 2022-23 IWGR Payroll is budgeted at 100% (meaning fully staffed) compared to 60% to 80% actual staffing levels during the Fiscal Year 2021-22. o This means that the FY 2022-23 budgeted estimates present a significant increase compared to actual FY 2021-22 staffing levels. This lack of available staffing issue happens so rarely that it becomes an important concept to understand. ·IWGR will unveil campaigns to attract residents to the Golf Resort. These expectations are reflected in resident rounds and covers.
·The VUE financials are shown before and after the payroll allocation. o Without allocating executive F & B management, the VUE operates with a loss. §This is because the VUE bar and grill program charge 100% of all executive F&B management.
o However, allocating executive F & B management to other F&B programs creates an
11.86% VUE operating profit.

Capital Costs
The Fiscal Year 2022-23 Golf Resort capital plan was revised to $676,000. A detailed capital schedule is attached to this staff report. The Council’s adopted budget is $389,375. Approval of the revised capital budget requires a supplemental appropriation of $286,625. The Golf Resort does not have a capital reserve fund. Therefore, the Golf Resort capital plan funding will come from capital loans between the City’s General Fund and the Golf resort.
Golf Resort Interfund Loans
Profitability at the Golf Resort benefits the City’s General Fund. The current loans between the Golf Resort and the City top $7.5 million. The Golf Resort’s operating surplus will pay back General Fund loans and reduce the Golf Resort’s deficit operating fund balance. As a result, the Golf Resort is expected to reduce the outstanding debt by $3.1 million at the close of the Fiscal Year 2022-23.
