Subject: Resolution Declaring Existence of a Local Emergency RECOMMENDED ACTIONS:
Council ADOPTS Resolution ratifying Director of Emergency Services proclamation of the existence of a local emergency.
DISCUSSION:
The National Weather Service issued a series of Flood Watches on August 18, 2023, warning of potential significant flooding between August 19, 2023, and August 22, 2023, in multiple counties, including Riverside County.
On August 21, 2023, after the City began to suffer high winds, excessive rain, flooding, and related road closures caused by Hurricane Hilary, conditions of peril to the safety of persons and property arose within the City of Indian Wells. The City Manager, as Director of Emergency Services of the City of Indian Wells, declared the existence of a local emergency.
Section 2.32.060(a)(1) of the City of Indian Wells Municipal Code empowers the Director of Emergency Services to proclaim a local emergency if the City Council is not in session and requires the City Council to take action to ratify the proclamation within seven days thereafter. The Director of Emergency Services declared the existence of a local emergency on August 21, 2023, included in the Resolution as Exhibit “A”.
FISCAL IMPACT:
The ratification of the declaration of a local emergency must be in place for the City to be eligible for Federal and state recovery funding.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INDIAN WELLS, CALIFORNIA, RATIFYING THE AUGUST 21, 2023, DECLARATION OF THE
EXISTENCE OF A LOCAL EMERGENCY RELATED TO HURRICANE HILARY
WHEREAS, Indian Wells Municipal Code section 2.32.060(a)(1) empowers the City Manager, acting as the Director of Emergency Services, to proclaim the existence or threatened existence of a local emergency when the City is exposed to an actual or threatened existence of conditions of disaster or of extreme peril to the safety of persons and property within the City and the City Council is not in session; and
WHEREAS, on August 21, 2023, after the City began to suffer high winds, excessive rain, flooding, and related road closures caused by Hurricane Hilary, the City Manager, as Director of Emergency Services of the City of Indian Wells, declared the existence of a local emergency. A copy of the declaration is attached hereto; and
WHEREAS, the City Council desires now to ratify the City Manager’s declaration.
NOW, THEREFORE, be it resolved by the City Council of the City of Indian Wells as follows:
For all the reasons set forth in the City Manager’s August 21, 2023, declaration of the existence of a local emergency, the City Council ratifies the declaration.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Indian Wells, California, at an emergency special meeting held on this 22nd day of August 2023.
