_____________________________________________________________________ A. CONVENE THE INDIAN WELLS CITY COUNCIL, PLEDGE OF ALLEGIANCE AND ROLL CALL Mayor Griffith convened the Special Council Meeting at 10:00 a.m. on August 22, 2023, in the City Hall Executive Conference Room.
A motion was made by Mayor Pro Tem Sanders, seconded by Mayor Griffith to excuse Council Member Reed from today's Emergency Special meeting. The motion carried by the following vote:
AYES: 4 - Griffith, Peabody, Sanders, Whitman
NOES: 0 -
EXECUSED: 1 - Reed
B. APPROVAL OF THE FINAL AGENDA
A motion was made by Mayor Pro Tem Sanders, seconded by Council Member Whitman to Approve the Agenda as Submitted.

C.GENERAL BUSINESS
City Attorney Todd Leishman stated an emergency meeting has been called due to potential threat of the health and safety of the community.
A motion was made by Mayor Pro Tem Sanders, seconded by Council Member Whitman to Approve Recommendation. The motion carried by the following vote:

C.1 Ratification of Declaration of Emergency, and Discussion/Possible Direction to Staff Regarding Emergency Measures
Mr. Amir Afsar, resident, expressed concerns relating to fallen trees along Eldorado Drive that are placing pressure on property walls.
City Manager Christopher Freeland provided an assessment of the damage in Indian Wells from Hurricane Hilary. Mr. Freeland reported local emergency in Indian Wells was declared on August 21, 2023, and stated the declaration provides opportunities for state and federal grant funding.
Finance Director Kevin McCarthy provided an overview of the City's insurance policy in partnership with California Joint Powers Insurance Authority (CJPIA) and reported insurance claims have been submitted for reimbursement of property damage.
There was discussion relating to the replacement of damaged trees, the repairs at the wash area along Fred Waring Drive west of Eldorado Drive, and the funding process for Federal Emergency Management Agency and CJPIA.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INDIAN WELLS, CALIFORNIA, RATIFYING THE AUGUST 21, 2023, DECLARATION OF THE EXISTENCE OF A LOCAL EMERGENCY RELATED TO HURRICANE HILARY.
A motion was made by Mayor Pro Tem Sanders, seconded Council Member Whitman to Adopt Resolution. The motion carried by the following vote:

D.ADJOURNMENT
At 10:21 a.m., Mayor Griffith ADJOURNED the Emergency Special Council meeting to a regularly scheduled meeting on September 7, 2023, at 1:30 p.m. in the City Hall Council Chamber.
