INDIAN WELLS CITY COUNCIL
July 2, 2026
To: City Council
From: City Manager Department
Prepared by:Christopher Freeland, City Manager
Subject: Recommendation to Submit Resolution to the Voters a Ballot Measure Amending the City’s Admissions Tax Exemptions
RECOMMENDED ACTIONS:

Council ADOPTS Resolution submitting to the qualified voters of the City of Indian Wells a ballot measure amending Section 3.14.040 of the Indian Wells Municipal Code to update and clarify exemptions from the City’s admissions tax; consolidating the election with the statewide general election to be held on November 3, 2026; setting rules and deadlines for ballot arguments and rebuttals; and
FINDS the action exempt from CEQA.

BACKGROUND:

In 2005, Indian Wells voters approved Measure H, which established the City’s admissions tax, codified in Chapter 3.14 of the Indian Wells Municipal Code. The admissions tax applies to admission charges for events, subject to specified exemptions.

Section 3.14.040 currently provides exemptions for certain nonprofit organizations and event sponsors. Because the existing ordinance limits the City Council’s ability to amend section 3.14.040 without voter approval, any amendment to the admissions tax exemption provisions must be submitted to and approved by a majority of City voters.

The proposed resolution would place a measure on November 3, 2026, ballot asking voters whether to approve amendments to section 3.14.040 to update and clarify which admission charges qualify for exemption from the City’s admissions tax.

DISCUSSION:

The proposed ballot ordinance would amend the City’s admissions tax exemption provisions to provide clearer standards for determining when an exemption applies. The Special Meeting Agenda- July 2, 2026

Page 7 of 16 ends

26529.00062\45166525.2
ordinance would authorize exemptions, subject to Director review and approval, for admission charges associated with events conducted by specified categories of organizations, including governmental agencies, certain governmental membership organizations, organizations exempt from federal taxation under Internal Revenue Code section 501(c)(3), and political organizations exempt under Internal Revenue Code section 527.

The ordinance would also retain the exemptions for admission charges paid by approved event sponsors without change. And it would add an exemption for events at legally established and operating hotels in the City (which generally results in increased hotel occupancy and TOT). The proposed amendments are intended to provide greater certainty for event operators, residents, visitors, and City staff regarding eligibility for admissions tax exemptions.

The resolution also establishes the ballot question, requests consolidation with the statewide general election on November 3, 2026, authorizes the Riverside County Registrar of Voters to provide election services, sets deadlines for arguments and rebuttal arguments, and directs preparation of the City Attorney’s impartial analysis.

Staff recommend that the City Council adopt the Resolution submitting the proposed admissions tax exemption ordinance to the voters at the November 3, 2026, general municipal election.

FISCAL IMPACT:

The City will be responsible for its share of the costs associated with placing the measure on November 3, 2026, consolidated ballot and for related election services provided by Riverside County. The fiscal impact of the proposed ordinance on admissions tax revenues will depend on future events and exemption applications approved under the amended provisions.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):

The proposed action is exempt from review under the California Environmental Quality Act because it concerns organizational or administrative governmental activity that will not result in direct or indirect physical changes in the environment. Accordingly, the action is not a “project” under CEQA Guidelines section 15378(b)(5).
