STAFF REPORT
To: City Council
From: Bryan H. Montgomery, City Manager
Prepared by: Miguel Pena, Director of Water Utility & Maintenance Subject: increase to Inc. Infosend, with Agreement the to 1 No. Amendment compensation by an additional $100,000 per FY for a revised total not-to- exceed optional including agreement, the term the for $375,000 of extensions.
RECOMMENDATION:
That the City Council/Indio Water Authority (IWA) Board approve Amendment No. 1 to the Professional Service Agreement with Infosend Inc. to increase compensation by an additional $100,000 per FY for a revised total not-to-exceed $375,000 for the term of the agreement, including optional extensions.
SUMMARY:
IWA processes approximately 25,000 bills monthly, along with 5,000 delinquency notices and additional mailing projects. On July 1, 2025, IWA entered into a Professional Service Agreement with Infosend Inc. for utility bill processing, printing, and mailing services. Additional postage expenses and special print projects completed during FY 25-26 have resulted in higher-than- anticipated operational costs, including quarterly compliance letters, city sustainability collection and household hazardous waste and recycling mailings. IWA staff recommend approval of Amendment No. 1 to increase compensation by an additional $100,000 per FY for a revised total not-to-exceed $375,000 for the term of the agreement, including optional extensions.
BACKGROUND INFORMATION:
On July 1, 2025, IWA entered into a Professional Service Agreement with Infosend Inc. for utility bill processing, printing, and mailing services following a competitive RFP process. The agreement included annual an and options extension one-year term two with three-year a additional compensation not-to-exceed amount of $275,000.00. During FY 25-26, additional operational costs, including postage increases and special mailing projects for public notices and city events, are expected to exceed the original budget. Examples of these additional costs include the quarterly compliance letters related to hexavalent chromium-6 sent to all customers. This amendment is intended to cover additional expenses for the remainder of FY 25-26 and the remaining term of the agreement. IWA staff recommend approval of Amendment No. 1 to increase compensation by an additional $100,000 per FY for a revised total not-to-exceed $375,000 with no price adjustment to the Price Form, for the term of the agreement, including optional extensions.

Subject: Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastructure Adequacy and Development Standards Ordinance”) as Chapter 164 of the Indio Municipal Code; and, Adoption of Resolution No. 10560 Establishing Fees pursuant to the Ordinance.
RECOMMENDATION:
Introduce by Title Only for First Reading Ordinance No. 1832, adding Chapter 164 ("Electrical Infrastructure and Development") to the Indio Municipal Code to establish mandatory infrastructure adequacy standards and a voluntary In-Lieu Fee program; and Adopt Resolution No. 10560, establishing providing and kVA per $233.97 Capacity Fee for In-Lieu the at administrative implementation.
SUMMARY:
The City of Indio is experiencing significant residential and commercial growth that creates a cumulative demand on the electrical distribution system. This development activity consumes available thermal and voltage capacity at the substation level. Insufficient capacity poses a threat to public safety by increasing the risk of brownouts and equipment failure. Ordinance 1832 creates a framework requiring development projects that generate net new load to demonstrate adequate substation capacity exists. Resolution 10560 provides a voluntary in lieu fee path for developers to satisfy substation citywide share proportionate toward paying by requirements these a improvements.
BACKGROUND INFORMATION:
The City of Indio is experiencing significant residential and commercial development activity that creates system. project development Every distribution demand the on growing a electrical the within substation available of portion capacity consumes load new net generating a interconnected grid. Because this capacity is a shared resource the entire city constitutes a single unified area of benefit for these infrastructure concerns. Insufficient substation capacity poses a direct of establishment the necessitates which reliability safety and public to threat service mandatory adequacy standards.
These standards ensure that every project provides the physical infrastructure required to support its own electrical demand. Applicants may satisfy these requirements through an installation path by directly funding or constructing the necessary substation improvements. As a voluntary alternative the ordinance authorizes an in lieu fee program that allows developers to pay their proportionate fair AGENDA ITEM #11.1
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 230 of 289 share toward citywide improvements. The City Council finds that coordinating large scale improvements is often more efficient than project by project construction.
Resolution 10560 establishes this fee at two hundred thirty three dollars and ninety seven cents per kVA based on analysis provided by NBS Consulting. Any electrical load exceeding one thousand kVA requires a twenty five percent nonrefundable deposit prior to the issuance of a capacity service letter. This deposit is only refundable if requested within twenty four months. This fee will increase every July 1st based on the California Construction Index for the Los Angeles Area.
The program maintains a legal nexus and rough proportionality as required by the Mitigation Fee Act. To prevent double payment the city provides a dollar for dollar credit for verified payments made to the Imperial Irrigation District for the same scope of improvements. Furthermore any project already funded by the Indio Electric Financing Authority surcharge is ineligible for inclusion in this program.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF INDIO, CALIFORNIA, ADDING CHAPTER 164 (ELECTRICAL INFRASTRUCTURE AND DEVELOPMENT) TO THE INDIO MUNICIPAL CODE; ESTABLISHING THE CITY OF INDIO
ELECTRICAL INFRASTRUCTURE ADEQUACY AND DEVELOPMENT
STANDARDS ORDINANCE; AUTHORIZING A VOLUNTARY SUBSTATION CAPACITY IN-LIEU FEE PROGRAM; MAKING FINDINGS PURSUANT TO THE MITIGATION FEE ACT (GOVERNMENT CODE § 66000 ET SEQ.); AND MAKING
FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the City of Indio (“City”) is a municipal corporation organized and existing under the laws of the State of California, with full authority to adopt and enforce ordinances for the protection of the public health, safety, and general welfare pursuant to Article XI, Section 7 of the California Constitution and the general police powers conferred upon California charter and general law cities; and
WHEREAS, the City Council has identified the provision of adequate electrical infrastructure, and specifically the maintenance of sufficient substation capacity to serve cumulative growth, as a critical component of the City's long-term land use, infrastructure, and public safety strategy; and
WHEREAS, the City of Indio is experiencing significant residential, commercial, and industrial development activity that, in the aggregate, creates substantial and growing incremental demand on the electrical distribution system serving the City, including the high-voltage substations and sub-transmission facilities operated within the City's incorporated limits; and WHEREAS, the City Council finds that the electrical grid serving the City of Indio is a singular, interconnected network, and that every Development Project generating Net New Load directly and measurably consumes a discrete portion of available substation capacity that is, the thermal and voltage headroom available at the substation level regardless of the Development Project's specific geographic location within the City; and
WHEREAS, because substation capacity is a shared, interconnected resource serving the entire City, the cumulative impact of new development on that capacity is a citywide infrastructure concern affecting all properties, residents, businesses, and public facilities within the City, and therefore the entire incorporated limits of the City of Indio constitute a single, unified Area of Benefit for all purposes of this Ordinance and Chapter 164; and WHEREAS, the City Council further finds that insufficient substation capacity poses a direct threat to public safety and service reliability, including but not limited to the risk of electrical brownouts, equipment overloading and failure, increased risk of electrical fires, and the degradation of essential electrical service to existing customers, all of which have direct adverse effects on the health, safety, and welfare of the residents, businesses, and institutions of the City of Indio; and
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 232 of 289
WHEREAS, the City Council finds that a voluntary In-Lieu Fee program under which applicants may elect to pay their proportionate fair share of the cost of City-coordinated substation improvements in lieu of direct construction may be in many cases technically and economically superior to project-by-project substation construction, will provide equitable cost allocation among all projects contributing to cumulative substation demand, and is fully consistent with the interconnected, citywide nature of substation capacity constraints; and WHEREAS, the City Council finds that there is a direct and essential legal nexus between the approval of Development Projects that generate Net New Load and the requirement to provide substation capacity improvements, because the approval of such projects, absent corresponding substation improvements, will result in substation overloading that degrades safety and reliability for all customers served by the impacted substation; and WHEREAS, the City Council hereby makes the following findings:
(a) The purpose of the voluntary In-Lieu Fee is to fund the planning, engineering, land acquisition, environmental review, permitting, and construction of System Capacity Improvements, specifically substations, substation upgrades, and directly associated sub- transmission connections, that are necessary to accommodate the cumulative Net New Load generated by Development Projects within the City and to maintain substation capacity adequacy on a citywide basis.
(b) In-Lieu Fee revenues shall be deposited into a dedicated, non-commingled fund and used solely for the costs associated with Eligible Improvements, including reasonable planning, design, environmental review, land acquisition, construction, and administrative costs directly related to such improvements.
(c) There is a reasonable relationship between the use of the In-Lieu Fee and the type of development project on which it is imposed, because the fee applies only to Development Projects that generate Net New Load, and fee proceeds are used exclusively to fund System Capacity Improvements that expand substation capacity to serve that Net New Load.
Development Projects generating no Net New Load are not subject to the fee. (d) There is a reasonable relationship between the need for substation capacity improvements and the type of development projects subject to Chapter 164, because each Development Project that generates Net New Load directly consumes a measurable portion of available substation thermal capacity. Without System Capacity Improvements to replenish consumed capacity, substation overloading would result, impairing safety and reliability for all customers served by the affected substation. The need for substation improvements is thus a direct and quantifiable consequence of development activity; and
WHEREAS, the City Council finds that the specific In-Lieu Fee amount and the finding of rough proportionality between that amount and the cost of Eligible Improvements attributable to each class of Development Project shall be separately established and confirmed by the City Council at the time it adopts the Fee Schedule; and
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 233 of 289
WHEREAS, the City Council finds that Chapter 164 is expressly structured to prevent duplicative exactions and to protect applicants against double-payment: any applicant who demonstrates payment to Imperial Irrigation District (“IID”) for the same scope of System Capacity Improvements designated by the City as Eligible Improvements shall receive a dollar- for-dollar credit against any In-Lieu Fee obligation; and any infrastructure project already fully funded by the surcharge program administered by the Indio Electric Financing Authority ("IEFA") shall be ineligible for inclusion as an Eligible Improvement under Chapter 164's In- Lieu Fee program; and
WHEREAS, the City Council acknowledges that IID, as the Serving Utility, will have authority over the design, engineering, safety standards, and tariff regulations applicable to the electrical distribution system within the City of Indio, and that Chapter 164 is expressly intended to complement, and not to supersede, conflict with, or interfere with, IID's utility authority, the IID tariff, or the IEFA's resiliency and infrastructure financing programs; and WHEREAS, the City Council finds that adoption of this Ordinance is exempt from CEQA under the common-sense exemption established by CEQA Guidelines Section 15061(b)(3), because it can be seen with certainty that the adoption of a regulatory and fee framework which authorizes no specific physical construction has no possibility of causing a significant effect on the environment. Each specific System Capacity Improvement to be funded through the In-Lieu Fee program shall be separately evaluated for CEQA compliance at the time of its individual review and approval; and
WHEREAS, the City Council has reviewed and considered the staff report, all supporting technical documentation, the proposed text of Chapter 164 in the form attached as Exhibit A, and all public testimony and written comments submitted in connection with this proceeding, and finds that the adoption of this Ordinance and Chapter 164 is consistent with the City's General Plan, is in furtherance of the public health, safety, and general welfare of the City and its residents, and is supported by substantial evidence in the record.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF INDIO, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. RECITALS INCORPORATED AS FINDINGS.

EXHIBIT A
CHAPTER 164
ELECTRICAL INFRASTRUCTURE AND DEVELOPMENT
164.01 TITLE.
This Chapter 164 shall be known and may be cited as the “City of Indio Electrical Infrastructure Adequacy and Development Standards Ordinance.” All references to this Chapter shall encompass the standards set forth herein, along with any technical specifications or administrative regulations adopted by the City to implement these infrastructure requirements. 164.02 PURPOSE AND FINDINGS.
(A) Purpose. The purpose of this Chapter is to establish mandatory Electrical Infrastructure Adequacy Standards for all Development Projects within the City. These standards are intended to ensure that every project provides the physical infrastructure necessary to support its own electrical demand without detrimental impact to the surrounding community or the grid as a whole. The objectives of this Chapter include:
(1) Reliability and Safety: Maintaining the integrity of the electrical distribution system to prevent fire hazards, equipment failure, and localized brownouts caused by insufficient infrastructure.
(2) Coordinated Planning: Ensuring that substation capacity improvements are identified, planned, and funded in a timely and coordinated manner to support the cumulative growth demands of Development Projects and to avoid electrical capacity constraints that would delay development, impair public safety, or reduce grid reliability. (3) Alternative Compliance: Providing developers with a voluntary In-Lieu Fee pathway to satisfy these standards in instances where the City determines that collective system improvements are more efficient than project-specific installations. (4) General Plan Implementation: Fulfilling the City's commitment to the Infrastructure and Safety Elements of the General Plan by maintaining a grid capable of supporting planned growth.
(B) Findings. The City Council finds and declares as follows:
(1) Direct Impact on Substation Capacity: Every Development Project that increases the Net New Load on the electrical system creates a discrete and quantifiable demand on substation capacity. Because the electrical grid is an interconnected system, this demand is experienced at the substation level regardless of the Project's physical location within the service area.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 237 of 289 (2) Infrastructure as a Prerequisite: Just as the provision of water, sewer, and fire access is a prerequisite for development, the provision of adequate substation capacity is a fundamental development standard necessary to ensure a project is fit for its intended use and occupancy.
(3) Nexus and Rough Proportionality: There is a direct legal nexus between the approval of a Project and the requirement to provide or fund substation capacity to serve that Project.
Any substation capacity required to be funded or constructed, or any voluntary In-Lieu Fee paid in the alternative, shall be roughly proportional to the Project's specific impact on substation capacity within the system.
(4) Benefits of Coordinated Improvements: The City Council finds that requiring any individual developer to construct an entire electrical substation as a condition of a single Development Project is not always feasible and is less efficient than the City or Serving Utility coordinating a larger System Capacity Improvement serving multiple projects.
Therefore, the voluntary payment of an In-Lieu Fee serves as a valid and efficient alternative to project-specific substation construction. (5) Utility Primacy and Tariffs: The City recognizes that the Serving Utility possesses primary jurisdiction over system engineering and tariffs. This Chapter is intended to complement, not conflict with, utility-mandated standards. 164.03 DEFINITIONS.
For purposes of this Chapter, the following definitions apply:
(A) Adequate Point of Connection (APOC). The specific location on the Serving Utility's existing electrical distribution system, as designated by the Serving Utility, that possesses: (1) sufficient thermal capacity; (2) acceptable voltage profile; and (3) appropriate fault-current characteristics to serve the Project's Net New Load without degrading service to existing customers or violating Serving Utility reliability standards. (B) Area of Benefit. The entire incorporated limits of the City of Indio. The City of Indio constitutes a single, unified, citywide Area of Benefit for all purposes of this Chapter. This designation reflects the City Council's finding, set forth in Section 164.02(B)(1), that the electrical grid serving Indio is an interconnected system in which every Development Project's Net New Load creates a demand on substation capacity that affects the system as a whole, regardless of the Project's specific location within the City. No sub-geographic zones, districts, or separate benefit areas shall be established or designated under this Chapter. (C) Development Project or Project. Any activity requiring a discretionary permit, subdivision map, grading permit, or building permit that results in: (1) the creation of Net New Load; (2) an increase in existing electrical demand; or (3) a physical alteration to a site that necessitates the relocation, protection, or expansion of existing electrical facilities to maintain substation capacity adequacy.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 238 of 289 (D) Director. The City Manager or designee.
(E) Electrical Infrastructure (or "Improvements"). All physical facilities, equipment, and appurtenances required by the Serving Utility or the City to deliver safe, reliable, and adequate electric service to a Development Project, or to maintain the capacity and integrity of the electrical grid within the City. This term is used in this Chapter in its broadest sense; however, the City's requirements under this Chapter are expressly limited to Eligible Improvements, as defined in Section 164.03(G), and do not independently mandate the design, construction, or funding of distribution-level facilities (such as service laterals, conduit runs, or distribution transformers) that are governed by the Serving Utility's tariffs and standard service extension requirements.
(F) Electrical Infrastructure Adequacy Standards ("Standards"). The City-mandated requirements for the capacity of electrical substation facilities necessary to ensure a Project is served by a safe and reliable power source with adequate substation capacity. These Standards are a condition of Project approval and occupancy.
(G) Eligible Improvements. Those System Capacity Improvements, as defined in Section 164.03(M), which the Director determines are necessary to maintain substation capacity adequacy for a Project or the City as a whole. Eligible Improvements are limited to substations, substation upgrades, and directly associated sub-transmission connections. Such improvements are eligible for funding via the voluntary In-Lieu Fee. Distribution-level facilities, including service laterals, distribution transformers, conduit runs, and feeder extensions, are not Eligible Improvements and shall not be funded through the In-Lieu Fee program established by this Chapter.
(H) In-Lieu Fee. A voluntary monetary contribution paid by an applicant, at the applicant's sole election, to satisfy the Infrastructure Adequacy Standards for Eligible Improvements in lieu of the applicant directly funding or constructing said substation improvements. The fee shall be based on a Proportionate Cost Estimate verified by the Director. (I) Net New Load. The incremental peak electrical demand, measured in kilovolt-amperes (kVA), attributable to a Development Project. This is calculated as the total projected demand of the Project minus any credit for historically documented demand previously existing on the site, as determined by Serving Utility methods or a City-approved engineering study. (J) Oversizing. The requirement by the City or Serving Utility that an applicant fund or construct a System Capacity Improvement with total substation capacity in excess of what is strictly necessary to serve the Project's Net New Load alone, in order to accommodate the projected cumulative growth within the City. The Oversized Portion is defined as the total cost of the improvement minus the applicant's own proportionate fair-share cost based on the Project's Net New Load.
(K) Proportionate Cost Estimate. An analysis prepared or approved by the Director that determines a Project's equitable share of the cost of an Eligible Improvement based on the Project's Net New Load as a percentage of the total new substation capacity created, or other objective engineering factors.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 239 of 289 (L) Serving Utility. The Imperial Irrigation District (IID) or other utility, as applicable to the Project's location.
(M) System Capacity Improvements. Electrical substations, substation capacity upgrades, and directly associated sub-transmission connections and appurtenances necessary to accommodate the cumulative Net New Load of Development Projects and maintain substation capacity adequacy throughout the City. This term does not include distribution-level facilities such as primary feeders, service laterals, distribution transformers, conduit runs, or duct banks, which are governed exclusively by the Serving Utility's tariffs and service extension standards. 164.04 APPLICABILITY AND TRIGGERS.
(A) General Applicability. This Chapter shall apply to all Development Projects within the City that meet any of the following criteria (the "Triggers"):
(1) Load Increase: Any Project that results in Net New Load, as defined in Section 164.03. (2) New Service: Any Project requiring the establishment of a new electrical service account or new physical connection point with the Serving Utility. (3) Subdivisions: Any Project involving a tentative parcel map or tentative tract map, where the creation of new parcels necessitates the future extension of electrical service and creates Net New Load on the substation system.
(B) Administrative Thresholds (De Minimis). The Director shall have the authority to establish administrative thresholds below which the Standards of this Chapter do not apply. Until such thresholds are established by resolution or administrative regulation, this Chapter shall not apply to:
(1) Minor Residential: Residential electrical service upgrades for existing single-family homes that do not exceed a total service capacity of 400 Amps. (2) Minor Commercial: Interior tenant improvements that do not increase the Project's peak demand by more than 10 kVA and do not require any off-site infrastructure work. (3) No-Impact Projects: Any project that the Director determines, based on substantial evidence, has a negligible impact on grid adequacy and reliability. (C) Exemptions. This Chapter shall not apply to:
(1) Emergency Work: Immediate repairs required to protect public health and safety or to restore power during an outage.
(2) Maintenance: Routine repair or replacement of existing facilities with functionally equivalent equipment that does not create Net New Load.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 240 of 289 164.05 COMPLIANCE PATHWAYS.
An applicant for a Development Project shall satisfy the Electrical Infrastructure Adequacy Standards of this Chapter by selecting one of the following compliance pathways. The selected pathway shall be documented in the Project's conditions of approval or a formal improvement agreement:
(A) Installation Path (Standard Compliance). The applicant shall design, fund, and directly contribute to the construction of all required System Capacity Improvements (i.e., substation improvements) determined by the Serving Utility to be necessary to serve the Project's Net New Load. The applicant's obligation under this path is limited to the Project's proportionate share of the required substation improvement, as identified in the Serving Utility's Letter of Requirement and verified by the Director through a Proportionate Cost Estimate. This path is the default requirement for all Development Projects. All funded improvements must comply with the requirements of Section 164.07. For clarity, the obligation to design, fund, and construct distribution-level facilities (including service laterals, distribution transformers, conduit runs, and primary feeder extensions between the Project site and the APOC) is governed solely by the Serving Utility and is not a requirement of this Chapter. (B) In-Lieu Fee Path (Alternative Compliance). At the applicant's sole election and discretion, the applicant may satisfy the Standards for designated Eligible Improvements by paying a voluntary In-Lieu Fee. The City may utilize In-Lieu Fee revenues to fund Eligible Improvements, including substations and substation capacity upgrades, anywhere within the City, regardless of their geographic distance from the Project site. The City Council finds that this method is technically and economically superior to project-specific substation construction because: (i) the electrical grid is an interconnected network where the load increase caused by a specific Project site consumes a discrete "slice" of system-wide thermal and voltage capacity.
This consumption directly degrades the adequacy of the grid at the source level (i.e., the substation), necessitating substation upgrades to restore safety and reliability; (ii) coordinating a single, large-scale System Capacity Improvement is more efficient than requiring individual developers to independently fund piecemeal substation construction; and (iii) systemwide substation improvements allow the Serving Utility to balance loads across multiple circuits, providing higher reliability for all Projects throughout the City. (C) Hybrid Path (Coordinated Compliance). An applicant may elect to directly fund a portion of the required Eligible Improvements and pay a proportionate In-Lieu Fee for the remainder. The Director may approve a Hybrid Path where it is determined that such an arrangement is technically feasible and consistent with the orderly development of substation capacity throughout the City. Applicants using the Hybrid Path shall receive a credit against their total In- Lieu Fee obligation for the value of the substation improvements they directly fund, as verified under Section 164.10.
164.06 SYSTEMIC NEXUS; PROPORTIONALITY; ANTI-DUPLICATION.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 241 of 289 (A) Systemic Nexus and Substation Capacity Adequacy. The City Council finds that the electrical grid is a singular, interconnected network. Every Development Project that creates Net New Load consumes a discrete portion of the substation's total thermal and capacity headroom. (1) Consumption of Substation Capacity: This consumption reduces the available substation capacity within the grid, which, if not replenished through System Capacity Improvements, results in localized or systemwide substation overloading, posing a threat to public safety and reliability for all customers served by the affected substation. (2) Mitigation of Impact: Therefore, a direct legal and engineering nexus exists between the Project's Net New Load and the requirement to fund System Capacity Improvements, regardless of the geographic proximity of the substation to the Project site, to ensure substation capacity remains adequate to support the Project's demand. (B) Rough Proportionality and Capacity Allocation. Any requirement imposed under this Chapter, whether involving direct substation funding or a voluntary In-Lieu Fee, shall be roughly proportional to the Project's specific impact on substation capacity. Proportionality for all Eligible Improvements shall be determined by the Project's Net New Load as a percentage of the total new substation capacity (kVA) created by the System Capacity Improvement. The Director may utilize a Proportionate Cost Estimate to verify that the fee or construction requirement does not exceed the Project's fair share of the substation capacity impact. (C) Anti-Duplication and Utility Credits. To prevent duplicative exactions, the City shall provide a credit against any voluntary In-Lieu Fee as follows:
(1) Direct Utility Payments: If an applicant demonstrates they have paid the Serving Utility (IID) for the same scope of System Capacity Improvements (i.e., substation improvements) identified as Eligible Improvements by the City, the City shall provide a dollar-for-dollar credit against the In-Lieu Fee.
(2) IEFA Surcharge: The City recognizes that electric consumers within Indio are subject to a city-wide surcharge established by the Indio Electric Financing Authority (IEFA) to fund specific substation and reliability Projects. The City shall not include any substation project as an "Eligible Improvement" for the In-Lieu Fee if that specific project is already fully funded by the IEFA Surcharge.
(3) Verification Requirement: The burden of proof lies with the applicant to provide an executed contract, paid invoice, or a Serving Utility "Letter of Requirement" detailing the specific charges and the substation infrastructure they fund. 164.07 INSTALLATION PATH REQUIREMENTS.
Any applicant electing or required to proceed under the Installation Path shall comply with the following standards. The requirements of this Section apply exclusively to System Capacity Improvements (i.e., substation improvements) as defined in Section 164.03(M). Nothing in this Section shall be construed to require an applicant to independently design, construct, or fund
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 242 of 289 distribution-level facilities (such as service laterals, conduit runs, primary feeders, or distribution transformers) that are governed exclusively by the Serving Utility's tariffs and service extension requirements.
(A) Engineering Plans and Technical Standards. System Capacity Improvements shall be designed, engineered, and constructed in strict accordance with:
(1) Utility Standards: The Serving Utility's current design standards, material specifications, and tariffs applicable to substation construction and upgrades. (2) Building Codes: The California Building Standards Code (Title 24, CCR) as adopted by the City, to the extent applicable to substation facilities. (3) City Standards: The City's standard specifications for public works construction, to the extent applicable.
(4) Conflicts: In the event of a conflict between the aforementioned standards, the Director, in consultation with the Serving Utility, shall determine which standard applies based on the goal of maximizing substation safety and capacity adequacy. (B) Mandatory Will-Serve Documentation. No improvement plans shall be approved, and no building permits shall be issued, until the applicant provides a current Will-Serve Letter and a Letter of Requirement (LOR) from the Serving Utility.
(1) These documents must specify the required System Capacity Improvements, the designated APOC, and the Project's proportionate impact on substation capacity. (2) The City may require the applicant to fund an independent third-party peer review of the Serving Utility's substation capacity study to verify the proportionality of the requirements.
(C) Utility Coordination and Funding Agreement. The applicant shall execute a direct funding or construction agreement with the Serving Utility, or provide written evidence satisfactory to the Director confirming the applicant's proportionate financial contribution toward the required System Capacity Improvement identified in the Letter of Requirement. A fully executed copy of such agreement or confirmation shall be provided to the City prior to building permit issuance. (D) Performance Agreements and Financial Security. The applicant shall execute a City- approved improvement agreement addressing the applicant's substation funding obligation under this Chapter. The agreement must be supported by performance, labor, and material security in an amount equal to 100% of the applicant's proportionate share of the estimated substation improvement cost, plus a warranty bond, in forms approved by the City Attorney. (E) Inspection, Acceptance, and Risk of Loss.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 243 of 289 (1) Utility-owned substation facilities are subject to Serving Utility inspection and shall not be deemed adequate under this Chapter until they have been formally accepted by the Serving Utility in writing.
(2) The applicant remains financially responsible for all substation improvement obligations under this Chapter until the Serving Utility formally confirms in writing that the required System Capacity Improvement has been completed and accepted. 164.08 IN-LIEU FEE PROGRAM; ADOPTION AND COORDINATION.
(A) Adoption by Resolution. The Council may, at its discretion, adopt by resolution a voluntary In-Lieu Fee program. Such resolution may establish:
(1) Fee Methodology: The technical formula used to calculate a Project’s proportionate share of systemwide infrastructure impacts.
(2) Fee Schedule: A standardized schedule of costs per kVA of Net New Load or other objective engineering metrics.
(3) Eligible Improvements List: A list of System Capacity Improvements — limited to substations, substation capacity upgrades, and directly associated sub-transmission connections — that satisfy the Adequacy Standards of this Chapter. (4) Distribution-level facilities shall not be included on the Eligible Improvements List. (5) Citywide Benefit Confirmation: In accordance with Section 164.03(B), the entire incorporated limits of the City of Indio constitute the single, fixed Area of Benefit for all Eligible Improvements funded through this program. In-Lieu Fee revenues shall be pooled citywide. No resolution establishing sub-geographic benefit zones shall be adopted under this Chapter.
(B) Authorized Use of Funds. In-Lieu Fee revenues shall be used solely to fund the planning, engineering, land acquisition, environmental review, construction, and administrative costs associated with Eligible Improvements. This includes the "replenishment" of system capacity consumed by participating Development Projects.
(C) Coordination with IEFA and Other Funding. The Council may, by resolution, authorize the joint use of In-Lieu Fee revenues and IEFA Surcharge proceeds to fund "Projects" as defined under the IEFA Surcharge program.
(D) Periodic Updates. The Council may update the fee schedule or Eligible Improvements list by resolution as necessary to reflect changes in construction costs, utility tariffs, or grid adequacy requirements.
164.09 FEE CALCULATION AND TIMING OF PAYMENT.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 244 of 289 (A) Calculation Methodology. The voluntary In-Lieu Fee shall be calculated by the Director based on the Proportionate Cost Estimate for the Eligible Improvements necessary to maintain grid adequacy. The calculation shall include:
(1) Capacity Demand: The Project’s Net New Load (kVA) as a percentage of the total capacity (kVA) created by the Eligible Improvement.
(2) Engineering & Civil Costs: The estimated "all-in" cost of the Eligible Improvement, including design, land acquisition, trenching, and utility equipment. (B) Timing of Payment. Unless otherwise authorized by a Development Agreement or a Council- approved deferral, the voluntary In-Lieu Fee shall be paid at the following milestones:
(1) Subdivisions: Prior to the recordation of the Final Map or the issuance of the first grading permit, whichever occurs first.
(2) Vertical Construction: For projects not involving a subdivision, the Fee shall be paid prior to the issuance of the first building permit.
(3) Discretionary Requirements: The approving authority may require payment at an earlier stage of entitlement if the funds are necessary to secure time-critical Eligible Improvements (e.g., long-lead substation equipment) required to serve the Project’s phasing.
(C) Deferral and Security. The Director may authorize a deferral of payment until one of the following, in the Director’s discretion: (1) the issuance of a Certificate of Occupancy, (2) the issuance of a building permit, or (3) the release of the utility meter, provided the applicant executes a lien agreement or provides other financial security in a form approved by the City Attorney.
164.10 CREDITS FOR IN-KIND CONSTRUCTION OR DIRECT PAYMENTS. (A) In-Kind Construction Credits. An applicant that directly funds or constructs Eligible Improvements (i.e., System Capacity Improvements) in satisfaction of the Standards shall receive a credit against the voluntary In-Lieu Fee.
(1) Valuation: The credit shall equal the lesser of: (i) the actual, reasonable, and documented cost of funding or construction as verified by a City-approved audit; or (ii) the estimated cost of said improvements as established in the City's Proportionate Cost Estimate or fee schedule.
(2) Scope: Credits shall only be granted for Eligible Improvements as defined in Section 164.03(G) (i.e., System Capacity Improvements consisting of substations, substation upgrades, and directly associated sub-transmission connections). Credits shall not be granted for on-site service connection infrastructure, distribution transformers, service laterals, or any other distribution-level facilities required solely for the Project's own
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 245 of 289 electrical service connection, as such facilities are not Eligible Improvements under this Chapter.
(B) Credits for Direct Utility Payments. An applicant shall receive a dollar-for-dollar credit against the In-Lieu Fee for any verified payments made directly to the Serving Utility (IID) for the same scope of System Capacity Improvements (i.e., substations and substation upgrades) included in the City's Eligible Improvements. To qualify, the applicant must provide a final reconciliation statement from the Serving Utility and proof of payment confirming the specific substation improvements funded.
(C) Excess Credits and Reimbursement. If the value of the credit exceeds the In-Lieu Fee otherwise due for the Project:
(1) No Cash Refund: The excess credit shall not result in a cash payment from the City unless the applicant has executed a formal Reimbursement Agreement pursuant to Section 164.11.
(2) Banking and Phasing: Unused credits may be "banked" and applied to future phases of the same Development Project.
(3) Non-Transferability: Credits are appurtenant to the land and the specific Project; they may not be sold, traded, or transferred to a different Project or a different geographic area without the express written consent of the Director and the execution of a transfer agreement.
164.11 REIMBURSEMENT; AREAS OF BENEFIT; OVERSIZING.
(A) Citywide Benefit Framework. The City Council finds that the entire incorporated limits of the City of Indio constitute a single, unified Area of Benefit for all System Capacity Improvements funded or required under this Chapter. Because the electrical grid serving Indio is an interconnected system, substation capacity improvements benefit all properties within the City regardless of the geographic proximity of any individual property to a specific substation facility.
In-Lieu Fee revenues collected from Development Projects throughout the City shall be pooled on a citywide basis and used exclusively to fund Eligible Improvements that maintain substation capacity adequacy citywide. No sub-geographic zones or separate areas of benefit shall be designated or established under this Chapter.
(B) Requirement for Oversizing. The City or the Serving Utility may require an applicant to fund or construct a System Capacity Improvement with substation capacity in excess of what is strictly necessary to serve the Project's Net New Load alone, in order to accommodate the projected cumulative growth within the City.
(1) Construction Obligation: The applicant shall be responsible for the full upfront cost of funding or constructing the Oversized substation capacity.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 246 of 289 (2) Reimbursement Eligibility: An applicant who funds or constructs Oversized substation capacity is eligible for a Reimbursement Agreement for the "Oversized Portion," defined as the total cost of the substation improvement minus the applicant's own proportionate fair-share cost based on the Project's Net New Load relative to the total new substation capacity created.
(C) Reimbursement Agreements and Funding Sources. The Director may execute a Reimbursement Agreement with the applicant on behalf of the City. (1) Contingent Nature: Reimbursement is not a debt of the City's General Fund. It is strictly contingent upon the City's collection of voluntary In-Lieu Fees from subsequently developing properties within the City.
(2) IEFA Coordination: If the Oversized substation facility is an energy system improvement that enhances city-wide reliability, the City may coordinate with the Indio Electric Financing Authority to utilize surcharge revenues as a source for reimbursement, subject to a Project Agreement.
(3) Term: The term of any Reimbursement Agreement shall not exceed fifteen (15) years, unless a longer term is justified by the anticipated build-out period of the City and approved by the Council.
(D) Methodology for Pro-Rata Share. Reimbursement shall be based on objective engineering metrics verified by the Director, specifically the ratio of kVA demand consumed by subsequently developing properties within the City relative to the total substation capacity created by the Oversized facility.
(E) Assignment and Transfer. Reimbursement rights are appurtenant to the Development Project and may be assigned to a successor-in-interest only with the express written consent of the City. 164.12 COORDINATION WITH SERVING UTILITY; WILL-SERVE; NO CONFLICT. (A) Utility Primacy and Technical Standards. The City acknowledges that the Serving Utility retains final authority over the design, engineering, safety, and operational standards of the electrical distribution system within its service territory. Nothing in this Chapter shall be construed as an attempt by the City to regulate utility tariffs or system-level engineering. (1) APOC Designation: The Serving Utility shall remain the sole authority for designating the Adequate Point of Connection (APOC) for any Development Project. (2) Facility Acceptance: Utility-owned facilities shall not be deemed "adequate" under this Chapter until they have been inspected and formally accepted by the Serving Utility. (B) Mandatory Will-Serve Letter and Technical Study.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 247 of 289 (1) Completeness Trigger: For all Development Projects subject to this Chapter, a current Will-Serve Letter and/or a Letter of Requirement (LOR) from the Serving Utility shall be required prior to the City’s determination that a discretionary land-use application is complete.
(2) Updating Requirements: If a Project’s Net New Load increases during the entitlement process, the Director may require an updated Will-Serve Letter to ensure continued grid adequacy.
(C) Resolution of Conflicts. This Chapter is intended to complement, not replace or conflict with, Serving Utility requirements or the resiliency initiatives of the Indio Electric Financing Authority (IEFA).
(1) Interpretation: To the maximum extent possible, this Chapter shall be interpreted to be consistent with the rules, regulations, resolutions, ordinances, surcharges and tariffs of Serving Utility and IEFA.
(2) Administrative Adjustment: If an unavoidable conflict arises between a City requirement and a rule, regulation, resolution, ordinance, surcharge or tariff of Serving Utility and IEFA, the Director is authorized to grant a Technical Adjustment to eliminate the conflict, provided the adjustment is the minimum necessary and still achieves the goal of grid adequacy.
164.13 IMPROVEMENT AGREEMENTS; SECURITY; ACCEPTANCE.
(A) Agreements. Where improvements are required under the Installation or Hybrid Path, the applicant shall execute an improvement agreement in a form approved by the City Attorney, which shall address scope, schedule, inspection, acceptance, warranties, risk transfer, insurance, and indemnity.
(B) Security. The City shall require performance and labor & materials security in amounts and forms consistent with the Subdivision Map Act and City standards. (C) Prevailing Wage; Public Works. Where improvements are constructed using Fee revenues or are to be owned by the City, the work is a “public work” subject to prevailing wage laws (Lab.
Code §1720 et seq.) and applicable public contracting requirements. (D) Ownership and Maintenance. Ownership of improvements shall be as specified by the Serving Utility or the City, as applicable. City‑owned improvements shall not be accepted until completion to City standards.
164.14 ADMINISTRATION; RULES AND REGULATIONS.
Introduction of Ordinance No. 1832 (“City of Indio Electrical Infrastruc... Page 248 of 289 (A) The Director may adopt administrative rules, forms, and procedures to implement this chapter, including thresholds for de minimis exemptions, submittal requirements, credit documentation, and appeal forms.

SUMMARY:
The City is entering program year three (3) as part of its five-year Consolidated Plan for FY 2024- 2029. As part of the entitlement process, the City must prepare and submit an Annual Action Plan and Citizen U.S. the to Plan Participation a not limited but including, documents other to, Plan, Action Annual the For (HUD). and Urban Housing of Department staff Development recommends allocating the anticipated $750,000 to Public Services, Public Infrastructure, and Administration for the CDBG grant.
BACKGROUND INFORMATION:
The Community Development Block Grant (CDBG) Program is authorized under Title I of the Housing and Community Development Act of 1974, as amended. The primary objective of this Act is to provide for the development of viable urban communities through the achievement of decent housing, a suitable living environment, and expanded economic opportunities, principally for persons of low and moderate income.
In 2009, the City became an Entitlement Community eligible to receive a direct allocation of CDBG funds from the U.S. Department of Housing and Urban Development (HUD). As a result, the City assumed many administrative and grant-management responsibilities related to receiving the funds. However, as a “block grant,” the CDBG program allows the City to exercise control and flexibility in how the funds are used to directly benefit the community, especially to address the needs of low and moderate income households and individuals.
In 2025, the City received $749,597 in CDBG funds to support a variety of eligible activities, such as leveraging funds to cover costs associated with the Indio Sports Park. Funds were also used to support local AGENDA ITEM #11.2

Page 253 of 289 emergency shelter programming at Martha’s Village & Kitchen, providing prepared meals at our Senior Center, Fair Housing and Landlord/tenant mediation services, and case management associated with the SAFE Family Justice Center.
The required entitlement documents described below are provided as Attachment 1 to this staff report and must be submitted to HUD for approval by May 15, 2026.
Annual Action Plan (FY 26/27)
The principal purpose of the Annual Action Plan is to show how and where CDBG funds will be expended during a particular year, as represented in the Consolidated Plan. Thus, the Annual Action Plan identified how the needs, priorities, and objectives in the City Consolidated Plan will be addressed each year.
Public Infrastructure: The Public Works Department would utilize CDBG funds to assist in making improvements to the Miles Ave parking lot and the Berger Building.
Public Services: The proposed $112,000 will support public services within City Limits and staff has recommended the following agencies and funding amounts as shown in the table below. This option (as shown in Attachment 2) is for the City Council for determining the most appropriate funding distribution. All agencies and funding amounts are at the City Council's discretion.
Administration: The administrative costs allowance (not to exceed 20%) is $123,000. The funds will be utilized to support personnel costs, internal service fee charges, and other operating expenses.
Agency Funding Amount
Inland Fair Housing & Mediation Board $35,000
Coachella Valley Rescue Mission $53,000
Senior Center $24,000
Citizen Participation Plan
Under federal regulations, the City must provide citizens with an adequate opportunity to participate in an advisory role in the planning, implementation, and assessment of the City’s services. The City’s current Participation Plan encourages all citizens to participate and it emphasizes the involvement of low to moderate income individuals, particularly in areas where housing and community development funds are spent. It includes a 30-day public review period to gather citizen input on projects, proposed activities, and funding. It also includes notice requirements for the two required public hearings conducted by the City Council or another governing board of the City, as well as for amendments to the Entitlement Documents.
Public Consultation and Citizen Participation Process
During the preparation of the entitlement documents (Attachment 1), City staff conducted two community outreach events in order to encourage and consider community input. These events included:
March 11, 2026 (local swap meet at County fairgrounds), and
March 12, 2026 (Senior Center)
Approval of the Annual Action Plan FY 2026-2027 for the Fiscal Year 2026... Page 254 of 289 Surveys were also conducted at both of these events and are available on the City website. City staff provided all correspondence in English and Spanish. In addition to these participation outreach events, staff also conducted a public hearing at the March 4, 2026, City Council Meeting.
Financial Analysis
A budget adjustment is required to accept all revenue and expenditures associated with the Annual Action Plan allocation of CDBG funds in the amount of $750,000. The CDBG funds will be accounted for and documented in the budget under the CDBG Fund (FUND 230).
Additionally, a request is being made to delegate authority to the Director of Finance to make a budget adjustment to reprogram unspent CDBG funds to the public infrastructure project once the funds have been acquired.

Executive Summary
AP-05 Executive Summary - 24 CFR 91.200(c), 91.220(b)
1. Introduction
The Annual Action Plan must provide a concise summary of the federal resources expected to be available. These resources include Community Development Block Grant (CDBG) Funds, anticipated program income, and other resources such as private and non-federal public sources that are reasonably expected to be available to the City of Indio to carry out its Strategic Plan contained in the 2024-2029 Five Year Consolidated Plan, over the course of the HUD Program year 2026 (corresponding to the City’s Fiscal Year 2026-2027—FY26/27). The CDBG allocation for this period will be $748,597.
2. Summarize the objectives and outcomes identified in the Plan This could be a restatement of items or a table listed elsewhere in the plan or a reference to another location. It may also contain any essential items from the housing and homeless needs assessment, the housing market analysis or the strategic plan.
In June 2024, the City Council approved a 5-Year Consolidated Plan, as required by the US Department of Housing and Urban Development (HUD) that identified the priorities for the City’s use of CDBG funding during the term of the ConPlan. The City identified the following general objectives to be addressed during the 5-year planning period. • Public infrastructure improvement projects in residential neighborhoods such as sidewalk improvements and street rehabilitation projects.
• Affordable housing programs, especially targeting extremely low- and low-income households, including home-ownership programs; and,
• Increased public services through local non-profits, particularly services and programs for homeless families and individuals; and
• Economic Development activities that create jobs and support small businesses owned by women, minorities and/or low-to-moderate income individuals.
3. Evaluation of past performance
This is an evaluation of past performance that helped lead the grantee to choose its goals or projects.
Each year, the U.S. Department of Housing and Urban Development (HUD) assesses the City of Indio’ management of CDBG program funds, the City’s compliance with the ConPlan, and the

1. Introduction
Under a City Council City Manager form of government, the City Council appoints and provides policy directions to the City Manager, who is responsible for administering the City’s daily operations. As the elected legislative body of the City of Indio, the City Council has overall responsibility for the scope, direction and financing of City services. In setting policy, the City Council works closely with citizen advisory commissions and committees, considers staff information and recommendations, and receives comments from the public during open forums, such as in City Council Meetings. In the preparation of the Annual Action Plan, the City has consulted with public departments and agencies, social service and non-profit organizations to understand the community’s needs and available resources. The City met with several internal City department representatives to provide information about the AAP and its processes. Department staff provided input on how CDBG resources could be used and leveraged to provide services. The City of Indio specifically contacted agencies representing homeless persons, low-income youth, and persons with disabilities, elderly persons, and persons with alcohol and/or substance abuse problems.
Provide a concise summary of the jurisdiction’s activities to enhance coordination between public and assisted housing providers and private and governmental health, mental health and service agencies (91.215(l)) The principal provider of community development and economic development programs, housing projects, and financial support will be the City of Indio. However, The Housing Authority of the County of Riverside (HARIVCO) administers the Section 8 Voucher program and manages public housing located in the County. According to HARIVCO, funding to modernize the public housing units to ensure long-term physical and social viability of the developments is done through the HUD yearly funded Capital Fund Program.
Capital Program activities to be undertaken by HARIVCO are identified in the Public Housing Agency (PHA) 5 Year and One-Year Action Plans. The residents are invited each year to contribute to the drafting of the Housing Authority’s Plan and planned use of Capital Fund money. A resident advisory board is formed and meets at least twice each year to review the PHA’s strategy and policies for both public housing and tenant-based housing. The City works closely with qualifying Indio residents for Section 8 Housing Choice Vouchers. The City provides information on the availability of Section 8 programs to qualified residents. Other key health, mental health and service agencies that the City works closely with are the Riverside County Human Resources Division,

Describe coordination with the Continuum of Care and efforts to address the needs of homeless persons (particularly chronically homeless individuals and families, families with children, veterans, and unaccompanied youth) and persons at risk of homelessness.
The City participates in various Committees, task forces, and Meeting Groups with other Cities and non-profit agencies to coordinate different services. For example, City staff participated in monthly meetings of the Coachella Valley Association of Governments (CVAG) Homelessness Committee Meetings. This representation of the CVAG Homelessness Committee ensures that homelessness issues are addressed in Indio. Also present at those meetings are the County of Riverside's Mental Health and Continuum of Care Members, who work collectively to address a variety of underserved needs in the Coachella Valley.
City staff also participated in the SCAG Inland Empire Housing Workshop to access current trends in affordable housing. The City participated in Lift To Rise Biannual Action Plan to work with other agencies and developers (through a public/private partnership) to address the affordable and workforce housing needs on a regional basis. Staff also participated in Riverside County's Housing Program Network Meetings held at Riverside to discuss regional housing issues.
The City's Housing & Neighborhood Services Analyst is the City's designated representative on the Continuum of Care Steering Committee with the County and participates in a multitude of related committees/subcommittees.
The City spearheaded a sub-committee to conduct the Homeless Count and Survey of the sheltered and unsheltered homeless population on January 22, 2025. This was a requirement of the County of Riverside Continuum of Care. The City met multiple times with local stakeholders that would assist with the Count. The stakeholders included the County, local homeless shelters, Coachella Valley Rescue Mission, Martha's Village and Kitchen, and other City volunteers. Though the Homeless Count was subject to sheltered homeless population for 2026, the City will once again lead efforts for the unsheltered population Point in Time Count to be held in early January 2027.

Explain how federal funds will leverage those additional resources (private, state and local funds), including a description of how matching requirements will be satisfied
The City will leverage CDBG funds with City General Funds to maximize resources available to provide needed service. The City has been awarded $500,000 in State HOME funds to be used towards owner-occupied single family rehabilitation program. The City does not receive ESG, HOPWA, Section 8, ARPA, HOME Match, or ESG Match. Therefore, there will be no leveraging for these funds.
In addition, the following local funds will be leveraged:
• Low-Moderate Income Housing Asset Fund. The City’s Low-and Moderate-Income Housing Asset Fund can be used to conduct the dissolution of operations related to housing assets and activities of the former Redevelopment Agency (Housing Successor) of the City of Indio
• Measure X. Measure X, the Neighborhood Safety/Essential City Services Improvement Measure, was approved in 2016, imposing a 1% sales tax for 20 years to address essential service priorities and needs in the City of Indio identified through community outreach. Measure X provides locally controlled funding to help the City maintain essential City services including 911 emergency response times, road maintenance and police services including gang and drug enforcement programs.
Measure E was approved in 2021 to extend the 1% sales tax indefinitely, thereby generating an estimated $12 million per year.
If appropriate, describe publicly owned land or property located within the jurisdiction that may be used to address the needs identified in the plan
The City intends does not currently have an projects in queue that align with this section. However, the City has previously used publicly owned land to assist in the development of affordable housing projects, of which 3 are currently in construction (350 units total).
Discussion
The City does not currently use CDBG funds for housing-related projects. Instead, the City uses its funds to assist nonprofit agencies and public improvements and infrastructure projects.

Describe the reasons for allocation priorities and any obstacles to addressing underserved needs
The above-named projects and their allocations were selected primarily because they were identified as a high need in the ConPlan. While other high priority needs were identified in the ConPlan, the City plans to focus on public infrastructure and community services in Program Year 2026 and in turn focus on other needs in future program years.
All program activities funded with the City's CDBG funds will benefit low-to moderate-income persons.
The basis for assigning the priority to each category was based on the identified needs expressed during the consultation and citizen participation process. In addition, priorities were determined by information gathered from the Census, a market study and existing community documents, which include the City of Indio's 2021-2029 Housing Element.
The primary obstacle to addressing underserved needs is the lack of funding. The City relies primarily on CDBG Entitlement funds, program income and any state funds it can apply for to carry out the programs identified in this Action Plan.

AP-50 Geographic Distribution – 91.220(f)
Description of the geographic areas of the entitlement (including areas of low-income and minority concentration) where assistance will be directed The City geographic areas are Citywide and CDBG. The Citywide geographic priority focuses on activities for income eligible residents. The CDBG geographic priority is for specific projects requiring an area benefit qualification such as parks and street improvements.
Geographic Distribution
Target Area Percentage of Funds
Citywide 15
CDBG 85
Table 8 - Geographic Distribution
Rationale for the priorities for allocating investments geographically Indio will use a place-based strategy during the planning period. The geographic distribution of funding is predicated somewhat on the nature of the activity to be funded. It is the City's intent to fund activities in the areas most directly affected by the needs of low-income residents and those with other special needs. The Annual Action Plan directs investment geographically to an area benefit through the CDBG geographic priority area. The area benefit category is the most commonly used national objective for activities that benefit a residential neighborhood.

Affordable Housing
AP-55 Affordable Housing – 91.220(g)
Introduction
The City shall encourage the development of housing units for households earning 80 percent or less of the Median Family Income for Riverside County. Specific emphasis shall be placed on providing family housing and non-traditional housing types such as single-resident occupancies, transitional facilities, and housing units serving temporary needs. The City will encourage housing development for extremely low-income households through various activities such as outreach to nonprofits and discussions with for-profit housing developers, providing in-kind technical assistance for housing developers, financing and funding assistance, and expedited processing as appropriate. Some of the City's most recent developments include the 200 units at the Avenue 44 Apartments, 150 units at JFM villas, all of which are in construction, and are 100 percent affordable. Currently, the City does not utilize affordable housing with CDBG Funds.

AP-60 Public Housing – 91.220(h)
Introduction
This section describes what actions the City will take in the given program year to carry out the public housing portion of the Strategic Plan contained in the Consolidated Plan. The section will identify the way its plan will address the needs of public housing during the program year.
Should HUD designate the public housing agency as "troubled" or perform poorly, the City will describe how it will provide financial or other assistance to improve the operations of the public housing agency to remove such a designation.
Actions planned during the next year to address the needs to public housing The City of Indio does not own public housing. The City works in close collaboration with the Housing Authority of the County of Riverside (HARC) to provide public housing within the City.
Indio will continue to work independently and closely with the HA and local nonprofits to provide assistance to low-income families. As population demographics continue to change, the City will continue to work with the county housing authority and local (and regional) nonprofits to develop public housing projects in Indio.
The City and the County of Riverside work together to provide the following Section 8 assistance:
• Housing Choice Voucher Program. HCV is the County’s Section 8 voucher program, which includes other programs and services available to HCV participants.
Actions to encourage public housing residents to become more involved in management and participate in homeownership
HACRC encourages resident involvement through various methods, particularly focusing on self-sufficiency and enhancing the quality of one’s own life. HARC connects residents and participants to services, activities, and other organizations that promote that vision. There are Neighborhood Network Centers (including public computer centers) and community partnerships for residents to utilize. On the HACR website, resident can locate relevant services and service providers in dedicated “resident” and “resident services” sections. Additionally, HARC provides newsletters and reports about the status of its programs and residents for current and future participants.
If the PHA is designated as troubled, describe the manner in which financial assistance will be

provided or other assistance
HACR is not designated as a "troubled" public housing authority.
Discussion
With the completion of the General Plan amendment in 2020, the City anticipates higher- density residential development with more affordable units. As the number of developed sites identified as entitled projects for lower-income units increases, the City is optimistic in its pursuit of meeting its Regional Housing Needs Assessment goals, identified in its 6th Cycle Housing Element goals. 400 affordable units just opened in early 2025, with an additional 700 (5 projects) entitled or expected to start construction soon. Additionally, the City received its Prohousing Designation through HCD which incentives affordable housing developments through a variety of ways.

AP-65 Homeless and Other Special Needs Activities – 91.220(i) Introduction
This section describes the City’s one-year goals and the specific action steps it will undertake in the program year to carry out the homeless strategy outlined in SP-60 Homelessness Strategy. It will also describe the jurisdiction’s one-year goals and specify the activities it will undertake to serve the housing and supportive-service needs of non-homeless populations who require supportive housing.
Describe the jurisdictions one-year goals and actions for reducing and ending homelessness including
The City will continue to support its local agency partners in pathways to reducing homelessness in the Coachella Valley.
Reaching out to homeless persons (especially unsheltered persons) and assessing their individual needs
The County of Riverside develops a Point-in-Time Count (HPITC) on an annual basis. The HPITC is critical to identifying homeless needs. The HPITC is part of the County of Riverside's Continuum of Care (CoC) program which provides homeless assistance by leveraging funding needed through the HUD Consolidated Application, this provides collaboration between providers of housing and homeless assistance programs and other federal programs.
The City's Police Department includes a Community Outreach Unit (COU) which includes a Quality-of-Life Team which was formed in 2021 in response to increased issues created by our homeless population. The goal of the team is to deal with root causes of the existing issues and provide long term solutions, as opposed to the long-standing practice of trying to eliminate the problem through enforcement efforts alone. Officers utilize partnerships with government agencies, businesses, faith-based groups and non-profit service provides a multi-disciplinary approach to provide life-changing assistance to those in need.
In 2019, the team welcomed a full-time behavioral health specialist from the Riverside County Department of Mental Health Services. This specialist has been a tremendous support and is able to properly identify the needs of the people they serve and coordinate the most appropriate services.
The City also partners will Coachella Valley Association of Governments (CVAG), who conduct

street outreach and engagement efforts.
Addressing the emergency shelter and transitional housing needs of homeless persons The City of Indio plans to provide financial support to local emergency and transition housing programs to assist homeless women, children and victims of domestic violence and sexual abuse. Through case management, multiple
services are provided to each homeless individual or family upon entry into the program to assess further needs, such as childcare, transportation, counseling and support groups, legal aide, medical services and education
services to promote self-sufficiency. Examples of these programs is Martha's Village & Kitchen, Coachella Valley Rescue Mission and Emergency Overnight Services and FIND Food Bank.
With the adoption of Ordinance No. 1633 and 1634, the Zoning Map was amended to designate an Emergency Shelter Overlay Zone District for emergency shelters at specific sites. In addition, Municipal Code definitions related to housing, including emergency shelters, transitional housing and supportive housing were amended such that transitional and supportive housing are residential uses subject to the same regulations and procedures that apply to other residential uses of the same type in the same zone. These amendments were requirements of State law (SB 2).
Helping homeless persons (especially chronically homeless individuals and families, families with children, veterans and their families, and unaccompanied youth) make the transition to permanent housing and independent living, including shortening the period of time that individuals and families experience homelessness, facilitating access for homeless individuals and families to affordable housing units, and preventing individuals and families who were recently homeless from becoming homeless again
The City continues working with a multitude of service agencies to assist homeless person make the transition to permanent housing and independent living. The CoC Program, along with CVAG's Housing First Program, offers a rapid re-housing approach that supports in the development of permanent supportive housing throughout the county.
Martha’s Village and Kitchen runs a complete-service program that helps homeless persons transition to independent living. While this program is not directly run by the City, Martha’s Village, and Kitchen provides the model of their program to the City. The program was funded through the City of Indio’s CDBG program for FY 25/26.
The City supported the Senior Meals Program during the 2025/2026 fiscal period. The Senior Meals program is part of the solution to homelessness and helps with homeless prevention. Through the Indio

Senior Center, the funding provided through the City’s CDBG Program funds provides expanded meal services to many low-income seniors 62 years old and over.
Helping low-income individuals and families avoid becoming homeless, especially extremely low-income individuals and families and those who are: being discharged from publicly funded institutions and systems of care (such as health care facilities, mental health facilities, foster care and other youth facilities, and corrections programs and institutions); or, receiving assistance from public or private agencies that address housing, health, social services, employment, education, or youth needs.
Rental assistance is a component of the City’s strategy to prevent homelessness by individuals and families at risk of homelessness. Among this group are highly low-income renters who spend more than 50% of their income on housing costs. This includes those homeless persons and families on the Section 8 waiting list. The City will continue to support the County of Riverside Housing Authority’s Section 8 rental assistance program. In addition, the City will encourage and facilitate the Housing Authority’s landlord outreach efforts in Indio. In addition, the City’s fair housing provider will assist renters and homeowners in jeopardy of losing their housing. They will mediate landlord/tenant complaints, work with the tenant in formulating a plan, such as a rent repayment plan, and mediate with the landlord to identify realistic solutions for all parties involved. Through its default and foreclosure counseling, the Housing Resource Center’s first charge is to assist the homeowner in obtaining a loan modification or workout plan to keep them in their home. Both actions contribute to preventing homelessness.
Discussion
The City's strategy for assisting the homeless, those at risk of becoming homeless, and other special needs groups is focused on funding supportive services and programs in Indio. These include the following:
Fair Housing Services and Tenant/Landlord Mediation (Activity): Free and confidential fair housing counseling regarding housing rights and responsibilities, discrimination investigation services, and mediation services.
Senior Meal Program (Activity): Funds will be used to provide meals to low- to- moderate- income seniors in the City of Indio.

AP-75 Barriers to affordable housing – 91.220(j)
Introduction:
The City’s 2021-2029 Housing Element includes an analysis of potential and actual governmental constraints on the maintenance, improvement, or development of housing for all income levels, including land-use controls, building codes and their enforcement, site improvements, fees and other exactions required of developers, and local processing and permit procedures. Notable barriers to developing affordable housing in Indio include:
• Market Constraints
• Constructions Costs
• Labor and Land Costs
• Governmental Constraints
• Land-Use Controls
• Land-Use Designations
• Geological and Other Environmental Constraints
Actions it planned to remove or ameliorate the negative effects of public policies that serve as barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment
The State of California Department of Housing and Community Development (HCD) approved the City’s Housing Element Update in April 2022. The update included an analysis of governmental constraints, which is summarized below. The City’s general plan and zoning code were also amended to encourage affordable and transitional housing. Because of the analysis, the City concluded that its policies and current practices do not create significant barriers to affordable housing. Additionally, the City implemented a fee deferral program to assist affordable housing developers. However, due to new State laws, such as SB 2, the City will need to adopt new land use and other standards to facilitate and encourage affordable housing production. The City received its Prohousing Designation from HCD in May 2025, which amongst other things largely assists affordable housing developers including density bonus incentives and ADU incentives.
Discussion:
The City is committing to removing or ameliorating the barriers to affordable housing. The full listing of actions can be found in the current Housing Element, which provides a description of

AP-85 Other Actions – 91.220(k)
Introduction:
The section will describe the City’s planned actions to carry out the following strategies outlined in the Consolidated Plan:
• Foster and maintain affordable housing;
• Evaluate and reduce lead-based paint hazards;
• Reduce the number of poverty-level families;
• Develop institutional structure; and
• Enhance coordination.
In addition, the City will identify obstacles to meeting underserved needs and propose actions to overcome those obstacles.
Actions planned to address obstacles to meeting underserved needs The City of Indio will take the following actions to address obstacles to meeting underserved needs:
• Promote and encourage housing opportunities for all economic segments of the community, regardless of age, sex, ethnic background, physical condition, or family size. • Maintain and enhance the quality of existing residential neighborhoods. • Provide support services to meet the housing needs of the City’s residents, specifically homeless households and at-risk youth other special needs groups. • Improve the quality and increase the quantity of public improvements that benefit low and moderate-income residents.
• Provide services to non-homeless special needs populations.
Actions planned to foster and maintain affordable housing The City supports cooperation in the development of affordable housing through financial and/or technical assistance. The City will cooperate with developers to provide housing opportunities for extremely low, very-low, low and moderate-income households. The City shall also evaluate the effectiveness of its partnerships with non-profit housing developers on an annual basis. Based on its findings, the City will seek ways to expand and foster its partnerships as appropriate. The City will assist and encourage housing development for extremely low, very-low, low and moderate-income households through a variety of activities such as

providing in-kind technical assistance, funding support, land write-downs, expedited processing, fee deferrals, and incentives and concessions that meet or exceed State density bonus law as appropriate. The City shall also encourage the development of housing units for households earning 30 percent or less of the Median Family Income for Riverside County.
Specific emphasis shall be placed on the provision of family housing and non-traditional housing types such as single-resident occupancy, transitional facilities and housing units serving temporary needs. The City will encourage the development of housing for extremely low- income households through a variety of activities such as outreach to nonprofit and for-profit housing developers, providing in-kind technical assistance for housing developers, financing and funding assistance and expedited processing as appropriate.
Actions planned to reduce lead-based paint hazards
The City works in partnership with the County’s Childhood Lead Poisoning Prevention Programs (CLPPP's). The program provides health education about lead poisoning and assistance in lead removal within homes. To increase awareness of the County’s programs, the City will provide a landing page on the City’s website to link Indio residents to the County’s program website for more information and resources.
Actions planned to reduce the number of poverty-level families Indio’ antipoverty strategy is closely aligned with the goals and objectives of the overall affordable housing plan. These goals include reducing poverty, creating new and affordable housing, developing and promoting services for at-risk populations, expanding job training, and providing public and social services. The City will also continue partnering with organizations to provide a continuum of services addressing the full range of needs of low- and moderate- income families.
All communities share a goal to eradicate poverty. The City recognizes that a goal to reduce poverty will contribute to the economic wellbeing of individuals and families. The families whose income increases above the poverty level will be able to live independent of public and private assistance.
Goal: To reduce poverty level incomes below current levels by 2028. This goal will be monitored – in part - by the results of ACS data.
Policy: To continue to support and coordinate with public and private efforts aimed at

preventing and reducing poverty level incomes.
Policy: To conduct outreach with public and private agencies whose mission is to reduce poverty level incomes.
Program: To support and coordinate with the organizations who directly or indirectly contribute to a reduction in poverty such as the Community Action Partnership (CAP) of Riverside County, County of Riverside Housing Authority and Desert Alliance for Community Empowerment.
Actions planned to develop institutional structure
The City maintains primary management as well as the coordination of the various organizations involved in these processes. The staff within the Community Development Department work closely with other City departments and the community to develop programs and activities that improve low- and moderate-income neighborhoods throughout Indio. The administration of program activities includes housing, public facility and infrastructure improvements, public and social service activities and economic development activities. The City collaborates with public agencies, for-profit agencies, and non-profit organizations to provide programming and services.
Actions planned to enhance coordination between public and private housing and social service agencies
The City will continue to work closely and partner with the County of Riverside, local organizations, nonprofits, and the HACR to address regional issues that affect the needs of low- income persons, special needs populations and other at-risk groups.
Discussion:
Through the development of the Policy Program, the City has identified six broad housing priorities:
• To assist in the development of housing opportunities and accessibility for all economic levels in the City.
• To remove constraints that hinder the production and conservation of affordable housing units.
• To provide and maintain an adequate supply of sites for the development of new affordable housing. To preserve, rehabilitate and
enhance existing housing and neighborhoods.
